RESOLUTION
Maricopa County Board of Supervisors
RESOLUTION PERMITTING THE TEMPORARY EXTENSION OF PREMISES FOR 
OUTDOOR DINING AND SERVICE AREAS, AND WAIVING PLAN OF 
DEVELOPMENT FEES AND CONSTRUCTION PERMITS, IN UNINCORPORATED 
MARICOPA COUNTY
 
BE IT RESOLVED by the Maricopa County Board of Supervisors as follows:
WHEREAS, Governor Douglas Ducey declared a state of emergency due to the 
COVID-19 pandemic for the State of Arizona on March 11, 2020; and,
WHEREAS, to combat COVID-19, the Arizona Department of Health Services issued 
guidance that Arizonans must limit potential exposure to the virus by practicing 
social distancing; and
WHEREAS, Maricopa County is committed to full compliance with all applicable 
federal and state laws and regulations and enforcement of such as may be 
required; and
WHEREAS, Maricopa County is further committed to protecting development rights 
and providing regulatory relief to residents and businesses during this 
unprecedented time in order to support economic stability, recovery and growth.
NOW, THEREFORE BE IT RESOLVED, the Maricopa County Board of Supervisors 
directs the following:
This Resolution shall permit any establishment desiring a land use only temporary 
extension of premises for outdoor dining and drinking areas and/or outdoor service 
areas to submit a Land Use (Plan of Development) application to the Planning and 
Development Department without application fee. The application will be reviewed and 
granted in accordance with departmental policy to be developed and adopted by the 
Planning and Development Director. 
This Resolution shall permit temporary structures for outdoor dining and drinking areas 
and/or outdoor service areas to be erected without an issued construction permit 
application in accordance with Planning and Development Department policy to be 
developed and adopted by the Planning and Development Director.

The Temporary Land Use (Plan of Development) shall be valid only for the duration of 
the COVID public health state of emergency as declared by the Governor of Arizona, 
and shall expire when the state of emergency ends.
This Resolution only applies to the Plan of Development process for the Planning and 
Development Department. There may be other approvals required from other county 
departments for additional processes. 
ADOPTED by the Maricopa County Board of Supervisors, Maricopa County,
Arizona, this 18th day of November, 2020.
