The applicant is also proposing a POD to add these storage 
units to the subject site. There is no known opposition and 4 
documents of support from property owners within the 
surrounding neighborhood.

Recommendation: 
On 9/24/20, the Commission voted 6-0 to recommend 
approval of MCP2020005 subject to conditions ‘a’ – ‘i’:  
 
a. 
Development of the site shall comply with the Site Plan entitled “Plan of 
Development – 1142 N. 186th Dr.”, consisting of 2 full-size sheets, stamped received 
September 16, 2019, except as modified by the following conditions. 
 
b. 
Within 30 days of Board of Supervisors approval, a revised site plan shall be 
provided to correct the following: billboard setbacks (add rear yard and fix side

yard), property setbacks (fix side yard), and fix lot coverage/existing buildings 
percentages. 
 
c. 
Development of the site shall be in general conformance with the Narrative Report 
entitled “I-10 & Perryville Rd – Application for Military Compatibility Permit”, 
consisting of 22 pages, stamped received June 10, 2019, except as modified by 
the following conditions.  
 
d. 
This Plan of Development (POD) shall only apply to the billboard land use. Any 
future land uses (including wholesale trade) shall require a new POD to be 
approved by the Board of Supervisors.  
 
e. 
No access other than for single-family residential uses, indoor storage service, or 
for the construction and maintenance of outdoor advertising shall be off of 186th 
Drive. 
 
f. 
The following standards shall apply for the offsite (billboard) sign: 
 
1. 
Maximum height: 66’ 
2. 
Maximum sign area: 672 sq. ft. 
3. 
Side yard setback: 0’ (north) 
4. 
Rear yard setback: 0’ (west) 
5. 
Setback to Rural-43 zoning: 0’

The following standards shall apply to the freestanding sign for indoor storage

The following Engineering condition shall apply: 
 
 
1.  
A separate Plan of Development must be submitted to include the 
wholesale trade use on the subject premises. The Plan of Development 
application must include an engineered grading and drainage plan and a 
signed and sealed Traffic Statement.  
 
h. 
All buildings subject to noise attenuation as per ARS § 28-8482(B). 
 
i. 
The granting of this change in use of the property has been at the request of the 
applicant, with the consent of the landowner.  The granting of this approval allows 
the property to enjoy uses in excess of those permitted by the zoning existing on 
the date of application, subject to conditions.  In the event of the failure to comply 
with any condition, the property shall revert to the zoning that existed on the date 
of application.  It is, therefore, stipulated and agreed that either revocation due 
to the failure to comply with any conditions, does not reduce any rights that 
existed on the date of application to use, divide, sell or possess the property and 
that there would be no diminution in value of the property from the value it held

Development – 1142 N. 186TH Dr.”, consisting of 2 full-size sheets, stamped 
received August 14, 2020, except as modified by the following conditions. 
 
b. 
Development of the site shall be in general conformance with the Narrative Report 
entitled “Perryville Storage POD”, consisting of 5 pages, stamped received 
September 1, 2020, except as modified by the following conditions. 
 
c. 
The following Engineering conditions shall apply: 
 
1.  
A grading and drainage plan must be submitted for any required building 
permit(s).  
 
2.  
Runoff from the POD area must be directed to the proposed retention 
basin.  
 
3.  
Engineering review of planning and/or zoning cases is for conceptual 
design only. All development and engineering design shall be in 
conformance with Section 1205 of the Maricopa County Zoning 
Ordinance; Drainage Policies and Standards; Floodplain Regulations for 
Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of 
application for construction.  
 
d. 
All buildings subject to noise attenuation as per ARS § 28-8482(B).  
 
e. 
The property owner/s and their successors waive claim for diminution in value if 
the County takes action to rescind approval due to noncompliance with 
conditions.  
 
f. 
The granting of this change in use of the property has been at the request of the 
applicant, with the consent of the landowner.  The granting of this approval allows 
the property to enjoy uses in excess of those permitted by the zoning existing on 
the date of application, subject to conditions.  In the event of the failure to comply 
with any condition, the property shall revert to the zoning that existed on the date 
of application.  It is, therefore, stipulated and agreed that either revocation due 
to the failure to comply with any conditions, does not reduce any rights that 
existed on the date of application to use, divide, sell or possess the property and 
that there would be no diminution in value of the property from the value it held

Project Summary: 
 
1. 
The applicant is requesting a MCP Modification of Conditions (MCP2020005) to change 
condition ‘e’ of MCP2019001. The applicant is also proposing a POD for storage units 
under Z2020003. MCP2019001 was approved by the Board of Supervisors (BOS) on 
October 23, 2019 for a wholesale trade business and a billboard with a precise POD (for 
the billboard only). The site is an approximately 1-acre parcel (502-37-068B addressed at 
1142 N. 186th Dr.) and is located south of the SEC of Perryville Rd. and I-10 in the Goodyear 
area. The parcel is part of the Quintana Estates residential subdivision (lot #49). The 
subject site has an existing single-family residence and accessory structures. There is a 
pending permit for the billboard under B202000205. The site is zoned Rural-43, with the 
Military Airport and Ancillary Military Facility (MAAMF) Overlay Zoning District. The property 
is also within the statutorily defined high noise or accident potential zone (LDN 65-69 noise 
contours and APZ2 Accident Potential Zone) of Luke Air Force Base (AFB). 
 
2. 
Condition ‘e’ of MCP2019001 was approved with the following language:

No access other than for single-family residential uses or for the construction and 
maintenance of outdoor advertising shall be off of 186th Drive. 
 
The applicant proposes to modify the condition to read as the following language (in

The Z2020003 case for the POD includes four separate storage units (8’ X 20’) and an 
office with a restroom as part of the wholesale trade use. There would also be 3 parking 
spaces (1 handicap accessible space). Access for the storage operation would be from 
186th Dr., which is why the condition modification to MCP2019001 condition ‘e’ is being 
proposed. Access is restricted to Perryville Rd. since the recorded plat has a 1’ Vehicular 
Non Access Easement (VNAE) tied to the plat along the western parcel boundary.

As part of the storage unit business, the applicant is proposing a freestanding sign located 
near the southwest corner of the subject lot. This sign would be 5’ (h) and 30” x 60”. The 
applicant is also requesting to waive the 25’ x 25’ SVT requirements. They state in the 
narrative that the justification is since the property is located on a cul-de-sac and only 
one other property along 186th has ingress/egress onto 186th Dr. The submitted Traffic 
Impact Study states minimal traffic along the 186th Dr.

regarding the case specifics and the related hearing information. As part of the narrative 
submittal for MCP2020005, the applicant included 4 documents of support from 
neighbors along 186th Dr. as seen on the map exhibit within the narrative.

Staff Analysis:

Staff recommends approval of the subject requests. The subject site was already 
approved for the wholesale trade land use with MCP2019001 and has support from most 
neighbors along 186th Dr. in the immediate neighborhood. MCDOT has approved a TIS 
for the subject premises with case Z2020003, which included access to the site from 186th 
Drive. Traffic would include occasional maintenance for the billboard as well as 
employee parking for the proposed storage business. In addition to the proposed

modifications to condition ‘e’ of MCP2019001, staff has amended condition ‘f’ to address 
amended design standards for the proposed freestanding sign.  
 
Staff is recommending modification to condition ‘f’ to include the development

Purpose of Request 
The applicant requests a Plan of Development to allow for the construction of indoor storage 
units (the “Storage”) along the I-10 freeway, parcel # 503-37-068B (the “Property”).  This 
43,004 square foot parcel is located in unincorporated Maricopa County and is currently zoned 
RU-43 with Military Overlay.  The Military Overlay was approved via MCP2019001.  Please see 
Exhibit 1 and 2 for aerials of Property. 
 
Description of Proposal 
 
The property is located approximately 160’ feet south of the southwest corner of Perryville  Rd 
and the I-10.  The storage units will be along the western perimeter furthest away from 186th Dr 
and any residents. The Property is currently used as a single-family residence and is being 
currently processed to be purchased by the applicant.  The property can be accessed off of 
186th Dr.  A concurrent stipulation modification is being submitted to allow this access off of 
186th Dr. 
 
The applicant is proposing to place six separate storage units on the western perimeter of the 
site.  Each unit will be 8’ by 20’ and will be accessed from the east side of the property through 
a private drive.  The units will be setback 40’ from the rear property line and will meet the 
standards set forth by the RU-43 zoning.  There will be vegetation between the units and the 
right of way to create an aesthetically pleasing buffer along Perryville Rd.  The developed 
portion and access will be completely dust proof allowing for vehicular access from the east 
into the site and access to the units.  The site will continue to use well and septic.  The County 
requires that a restroom be installed in one of the units.  The proposed use will not need direct 
water or sewer. 
 
The storage will be used for wholesale uses associated with farming and nurseries including all 
equipment and supplies.  Equipment and supplies will only be kept in the completely enclosed 
units. 
There is a 1’ Non Vehicular Access Easement along Perryville Rd.  All access to the site will be 
from N 186th Dr. 
Any driveway and parking areas will be treated for dust suppression with either gravel of 
decomposed granite per County standards. Employee parking will be provided inside the 
Property and will be limited to two (2) spaces.   
No outdoor lighting is proposed for the use since all activities will take place during the daylight 
hours.  Typical hours of operation for the storage use will be from 8:00am to 5:00pm.

Since the Property is on a cul-de-sac and will have minimum traffic, the applicant is requesting 
to waive the standard of 25’x25’ Sight Visibility Triangle.  Only one other property along 186th 
has ingress/egress onto 186th Dr.  The submitted Traffic Impact Study states minimal traffic 
along the 186th.  The wavier of this standard should not have any effect on the surrounding 
properties and traffic.   
 
Relationship to Surrounding Properties 
The surrounding parcels of the Property consist of RU-43 and commercial zoning uses and 
districts.  The parcel to the south is John’s Amish Country Farmers Market.  The parcel to the 
north is zoned RU-43, but is an ADOT remnant parcel that will not be developed.  The relief 
from the north setbacks will not affect the adjacent parcel since it will never develop as 
residential.  The setbacks to the southern and eastern residential properties are over 150 feet.  
Please see Exhibit 3 for surrounding zoning. 
North – Immediately north is a vacant parcel owned by the State of Arizona that is being used 
for a retention basin.  The parcel is undevelopable.  Further north is the I-10 Freeway, and the 
Waste Management facility across freeway.  No adverse effects are expected. 
South – John’s Amish Country Store Farmers Market - No adverse effects are expected. 
West – Vacant Commercial zoned land in Jurisdiction of Buckeye.  No adverse effects are 
expected.

East – Residential. No adverse effects are expected. 
 
Benefit to Surrounding Area 
The approved MCP will benefit surrounding properties and the valley in general by brining 
storage uses to a parcel adjacent to the freeway and a farmers market.  Additional commercial 
storage uses will benefit the surrounding community bringing storage services associated with 
wholesale trade and equipment closer to an area predominately residential. 
Recent Developments in the Area 
This area has been a mix of industrial (Waste Management Recycling Facility, U-Haul Storage 
Facility) and residential for a long period of time. Recently, there have been properties to the 
north and east that have been rezoned or have received Use-permits for various industrial uses 
that have been developed along the I-10 freeway. Waste Management and other industrial 
users have developed various types of industrial and commercial uses in the area. It is 
anticipated that this area will continue to be developed with other industrial and commercial 
uses over time. 
Location and Accessibility 
The Property access is located along N 186th Drive from Perryville Road which is an exit from the 
I-10 Freeway, which allows for vehicles to have accessible ingress and egress to the Property. 
There is a 1’ Non-Vehicular Access Easement along Perryville Rd that does not allow access off 
of Perryville.  A concurrent stipulation modification is being submitted to run along with this 
POD to allow access off of 186th Dr.  There has been multiple discussions with neighbors along 
186th to garner support. 
 
Community and Area Benefits of Proposed Use 
The proposed storage units will serve the immediate and surrounding area.  There is a great 
deal of transition in the area because of the proximity to the I-10 and associated development 
patterns towards commercial uses.  There are many farming and nursery uses in the area.  
Many residents and these businesses in the area need the additional storage wholesale trade 
and equipment.

Development Schedule 
Once the permit is issued by Maricopa County the structures will be ordered and delivered 
within 4 weeks of being ordered.  The construction process can be done in only a few weeks.
