The subject property is located within the Rural Development Area (0-1 d.u./a.c.) land use and in the City of Chandler General Plan as a neighborhood land use. The requested zone change with overlay will have no adverse impact on the Comprehensive Plan. One letter of opposition was received from the City of Chandler. There is no other known opposition. Commission Recommendation: On 9/24/20, the Commission voted 6-0 to recommend approval of Z2020039 subject to conditions ‘a’ – ‘h’: a. Development of the site shall be in substantial conformance with the Zoning Exhibit consisting of 1 full-size sheet, stamped received August 6, 2020, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Vault Storage & RV Development Redesign”, consisting of 6 pages, and stamped received August 6, 2020, except as modified by the following conditions. c. Engineering review of planning and/or zoning cases is for conceptual design only and does not represent final design approval nor shall it entitle applicants to future designs that are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and the Maricopa County Drainage Policies and Standards. 2. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance and current engineering policies, standards and best practices at the time of application for construction. 3. At the time of application for building permit(s), detailed Grading and Drainage Plans must be provided. 4. Access to Victoria Street shall be for emergency purposes only and appropriate notes, signs and details shall be included on the Grading and Drainage submitted for a Building permit. d. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. g. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. h. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone had never been granted. Michelle Bach of EAPC Architects Engineers, on behalf of Lawhead Family LLC, requests a zone change from Rural-43 and C-3 to C-3 CUPD, of approximately 8.4 acres located on the northeast corner of Riggs Rd. and Saint Andrews Blvd. in the Chandler area. Existing development on the site consists of single-story self-storage buildings, RV parking area, an office/retail building with customer parking, and a 8’ high block wall along portions of the north, east, and west property line in the RU-43 and C-3 zoning district. 2. The existing self-storage facility was originally allowed in the Rural-43 zoning district by Special Use Permit (SUP) case# Z1996026 approved by the Board of Supervisors on October 16, 1996. The SUP permitted the self-storage facility to operate for a period of 20 years and allowed the existing buildings to be in the 0’ street-side and side-yard setbacks. There is a variance case# BA1996081 which varied the rear yard setback to 0’. The SUP has expired. *Historical Aerial 1998 Dec – 1999 Oct Z2020039 Page 3 of 7 3. The applicant has applied for C-3 CUPD zoning to permanently the existing use as part of this zone change to implement certain variations to the C-3 base zone development standards. The following table lists the development standards to be varied under the C- 3 CUPD overlay in (bold). Chandler General Plan 2016 Adopted on April 14, 2016, this plan designates this site for ‘neighborhoods’ which allows for a variety of densities and non-residential uses, commercial, institutional, public facilities, and commercial offices based on location and other criteria described in the text of the general plan. Public Participation Summary: 10. * The applicant complied with the Maricopa County Public Participation Process with the required posting of the property and notification to the adjacent property owners within 300’ of the subject site and interested parties. Staff has not received any calls or correspondence to the request. Staff has received one letter of opposition with comments to the proposed rezone from the City of Chandler which are not enforceable by Maricopa County. The City of Chandler opposes the rezone as the proposed rezone does not align with the city’s general plan. Per the Chandler general plan, commercial development is most appropriate at the intersections of arterial streets not between these intersections. Comments from the City of Chandler were discussed between the property owner, applicant, and Chandler Planning Director. Outstanding Concerns from Reviewing Agencies: 11. * There are no outstanding concerns from the primary County review agencies. The City of Chandler has expressed concerns in the attached letter dated September 15, 2020. The concerns include: Right-of Way dedication and half-street improvements for St. Andrews and Victoria. Raised median on Riggs Rd. Wastewater sampling port. Water and sewer by-ins. Fire line connection with a double check connection assembly. Staff does not believe it appropriate to condition zoning approval on these items. The physical development is in place for over 20 years and no change is proposed. The entitlement is not a redevelopment. The property owner should address these items with the City of Chandler separate from this zoning entitlement matter. However, the applicant has agreed to address some of the concern (see attached email dated September 16, 2020) including half-street dedications and assistance with the ultimate half-street improvements. Staff Analysis: 12. The proposed zone change with CUPD overlay would allow for the continued operation of American Self –Storage Facility that has continuously operated on the site for 20 years. The requested zone change does not require an amendment to the Area Plan. The proposed development on the site is in character with the IND-2 zoning to the west, and structures with a 0’ side-yard setback existed prior to the development of the single-family residential subdivision to the east. Z2020039 Page 6 of 7 Recommendation: 13. For the reasons outlined in this report, staff recommends the Commission motion for Approval, subject to conditions ‘a’ – ‘h’: a. Purpose of Request & Background This request is for the rezone with an overlay of the existing American Self-Storage & Mail Center facility on an 8.46 net acre (+/-) property located at 12220 E. Riggs Rd., Chandler, AZ. The property has an associated zoning case, Z96-26, approving the existing retail, storage and RV parking under a split zone designation of C- 3 and RU-43 with a special use permit. The original special use permit has since expired, and we are proposing to rezone the entire property from C-3/RU-43 to C-3 CUPD to redevelop the site area currently being used for RV parking. II. Design & Description of Proposal The proposal is for a redevelopment of the RV parking area at the American Self-Storage facility. The rebranding of the site has included a new facility name of Vault Storage & RV. The site currently has 7,188 SF of retail and 50,071 SF of single-story exterior storage buildings with the remainder of the site being used for RV and boat storage. During the initial construction of the facility there were eight concrete structural slabs installed with drainage infrastructure in the middle of the site. We are proposing to remove the RV storage on these slabs and develop eight new single storage buildings, approximately 41,403 SF, to match the existing onsite facility. Out of the eight proposed buildings, six of them will be exterior roll up storage units and two will be interior climate-controlled buildings. The northern portion of the site will be redeveloped for covered RV and boat storage. Two canopies exist and will remain, eight new canopies are proposed. The RV and boat storage will have lighting mounted under the canopies and power access. The building architecture will be designed to match the existing facility with metal paneling in an earth tone palette. III. Relationship to Surrounding Properties The adjacent properties are zoned the following: North – Victoria St / RU-43, East – PAD, South – Riggs Road, and West – RU-43 and IND-2P. To the north and east of our site are single family homes. The east residential neighborhood is new construction increasing our demand for the extra storage space. To the south across Riggs Road is existing single family residential as well. New commercial development is being developed to the west and east of our property along the Riggs Road frontage. IV. Location and Accessibility The subject property is located at 12220 East Riggs Road in Chandler, Arizona with Maricopa County serving as its jurisdiction. The closest lighted intersection to the property is McQueen Road and Riggs Road. McQueen Road has a direct connection approximately 5 miles north of the site to the Loop 202 freeway. V. Circulation System Primary access to the site will remain off the existing drive cut from Riggs Road with a secondary access point from St. Andrews Boulevard to the front parking area. Parking will continue to be available along Riggs Road in front of the retail building and storage rental office. Interior access to the storage buildings and RV parking will remain from the existing gate off of Riggs Road and the additional exit gate onto Victoria Street. Interior drive aisles range from 27 feet to 33 feet wide throughout the property. VI. Development Schedule The redevelopment construction will be completed in one phase. VII. Community Facilities and Services The subject property is within the Chandler Unified School District. Shortly after the comments were sent, the applicant of the aforementioned zoning case contacted the City to discuss the comments. During our discussion, compromises were reached regarding Planning’s comments (June 15th letter) while still meeting the goal of protecting visual impacts on the adjacent single family neighborhood. The land use still remains inconsistent with the City’s General Plan and the Southeast Chandler Area Plan; however, we are grateful for the willingness of the applicant to work towards the goal of minimizing visual impacts to the adjacent residential neighborhood. With respect to the comments in the June 25th letter, the following items are in need of further coordination and assurances: • Right of way and public utility easements must be dedicated for Saint Andrews and Victoria Streets. For dedication utilize City forms for separate instrument or dedicate by a plat map. • Construct improvements or enter into an offsite lump sum cash deferral agreement for half street improvements along St. Andrews and Victoria Streets; if improvements are to be constructed, the plans must be approved and permitted by the City. • Construct a raised median in Riggs Road along the property’s frontage; the plans must be approved and permitted by the City. • Provide a waste water discharge questionnaire. This site may be required to install a waste water sampling port/vault depending on the results of the questionnaire. • Water and sewer buy-ins are due on this project. Prices will be calculated upon formal submittal and prices are subject to yearly adjustments. • Fire line connection must have a double check connection assembly, verify and update if necessary. These are standard comments that are applied to developments undergoing major improvements in Chandler and are essential to completing the transportation infrastructure that serves the subject property as well as the surrounding area. A resolution to these remaining issues must be reached before moving forward with the zoning case. As such, the City requests that the above mentioned tasks be completed prior to Maricopa County’s issuance of plan approval.
