Lease No. L-7471 Amendment No. 1 C-86-18-020-1-03 AMENDMENT No. 1 TO LEASE AGREEMENT BETWEEN EASTERN-COLUMBIA PROPERTIES, LP, LESSOR AND MARICOPA COUNTY, LESSEE RECITALS A. Lessor and Lessee (collectively the “Parties”) are Parties to that certain Lease Agreement No. L-7471 dated September 20, 2017, as amended by Amendment No. 1 dated September 19, 2018, which Amendment No. 1 was rescinded on October 24, 2018 (the “Lease”). The Lease is for property at 3230 East Broadway Road, Suite A200, Phoenix, Arizona 85040, consisting of 5,320 rentable square feet of office and clinic space within the property (the “Premises”). B. The term of the Lease expires on October 31, 2020. C. Lessor and Lessee now mutually desire to enter into this Amendment No. 1 (“Amendment”) to the Lease to extend the term of the Lease, increase the size of the Premises and adjust the rent rate. AGREEMENT NOW THEREFORE, in consideration of the foregoing and other good and valuable consideration, receipt and sufficiency of which is hereby acknowledged, Lessor and Lessee agree to amend the Lease as follows: 1. The Recitals, by this reference, are hereby incorporated into this Amendment. 2. Capitalized terms used in this Amendment without definition shall have the meanings assigned to such terms in the Lease, unless the context expressly requires otherwise. 3. The term of the Lease shall commence on November 1, 2020 and expire December 31, 2023. The Parties may further extend the term as provided for in the Lease. The Lease is subject to termination pursuant to the provisions of A.R.S. § 38-511, the provisions of which are incorporated herein by this reference. Either Lessor or Lessee may terminate the Lease as provided for in the Lease. 4. Suite A216 at 3230 E. Broadway, consisting of 2,456 square feet and as depicted in Exhibit “A” which is attached hereto and made a part hereof, shall hereby be added to Exhibit A to the Lease and shall be added to the definition of Premises included under the terms and conditions of this Lease. The Premises shall now consist of 7,776 rentable square feet. 5. During the term of the Lease as extended by this Amendment, Lessee agrees to pay as full- service rent, in equal monthly installments, the sums as follows: Lease No. L-7471 Amendment No. 1 C-86-18-020-1-03 Lease Term Rate Monthly Annual ___________ Months 1-38 $13.52 $8,760.96 $105,131.52 plus rental tax 6. Lessor notice address from Section 9.1 is clarified as follows: Eastern Columbia Properties, LP c/o Evan Kaizer Sieroty Company 6148 Wilshire Blvd. Los Angeles, CA 90048 7. The foregoing paragraphs contain all the changes made by this Amendment. All other terms and conditions of the Lease remain the same and in full force and effect.
