RESOLUTION
Maricopa County Board of Supervisors
RESOLUTION ALLOWING INSTALLMENT PAYMENT PLANS FOR DELINQUENT
CY2020 ANNUAL ENVIRONMENTAL SERVICES’ PERMIT FEES; EXTENSION OF
CY2020 FEES DUE TO SUSPENSION OF OPERATION; AND, EXTENDING THE
PAYMENT OF CY2021 FEES TO TWO PAYMENTS OF ONE HALF EACH OVER SIX
MONTHS, WAIVER OF PERMIT REINSTATEMENT FEES FOR NONPAYMENT AND
ALLOW PERMIT FEES TO BE REFUNDED, BEGINNING AS OF OCTOBER 1, 2020
BE IT RESOLVED by the Maricopa County Board of Supervisors as follows:
WHEREAS, to combat COVID-19, on March 17, 2020, following updated
guidance from the Centers for Disease Control and Prevention, the
Arizona Department of Health Services issued updated guidance that
included preventing gatherings of 10 or more people; and with
Executive Order 2020-18 the Governor of the State of Arizona stated
that at the recommendation of the state’s health officials, the State of
Arizona must continue its efforts by further limiting potential exposure
through a policy of social distancing while maintaining social
connectedness; and
WHEREAS, with Executive Order 2020-12 the Governor of the State of
Arizona identified food production, distributions and sale, stores that
sell groceries and medicine, and restaurants for consumption off-
premises as essential services necessary to promote the public health,
safety and welfare; and
WHEREAS, with Executive Order 2020-43 the Governor of the State of
Arizona ordered that, effective June 29, 2020, organized public events
of more than 50 people are prohibited unless the city, town or county
in unincorporated areas has approved the event, and only if adequate
safety precautions are implemented, including physical distancing
measures, and pools as part of a public accommodation and privately
owned pools located in public areas may continue to operate under

certain conditions, including prohibiting groups larger than 10 people
from congregating; and
WHEREAS, with Executive Order 2020-47 the Governor of the State of
Arizona, additional measures were imposed to protect public health and
safety and decrease the strain on health care providers by containing
the spread of COVID-19; and
WHEREAS, pursuant to Arizona Revised Statutes Section 26-307
counties may make, amend and rescind orders rules and regulations
necessary for emergency functions, among other things; and
WHEREAS, Maricopa County is committed to full compliance with all
applicable federal and state laws and regulations and enforcement of
such as may be required; and
WHEREAS, Maricopa County is further committed to providing
regulatory relief to residents and businesses during this unprecedented
time in order to support economic stability, recovery and growth.
NOW, THEREFORE BE IT RESOLVED, the Maricopa County Board of Supervisors directs
the following:
For the time period beginning as of October 1, 2020 through December 31, 2021:
Upon request, allow CY2020 annual permit fees to be refunded within forty-five (45) days
of the previous year’s expiration date.
Upon request, allow operators to enter into installment payment plans for delinquent
CY2020 annual permit fees. Operators may request an installment plan that the Maricopa
County Environmental Services Department (Department) will review for approval.
Installment plan payments shall be no less than eight percent (8%) of the annual permit
fee paid monthly. All CY2020 permits fees paid under agreed upon installment plans must
be paid in full no later than December 31, 2021.
When the first payment under the agreed upon installment plan is received by the
Department, the permit shall be considered issued and valid, instead of requiring the
entire fee as indicated in Chapter I, Regulation 5(a) of the Maricopa County Environmental
Health Code. However, if a permit fee is not paid in accordance with the agreed upon
installment plan, the operator’s permit shall be expired and void thirty (30) days after a
missed payment and the establishment may be posted for nonpayment.

For establishments that suspended all permitted operations during CY2020 due to COVID-
19, CY2020 annual permit expiration and fee due dates can be extended, upon request,
by the same number of months that the establishment was closed, with no additional
fees. This option does not apply to establishments that remained open with full or partial
operations because the Department continued to provide usual services, such as
inspections, for those establishments. All CY2020 permits fees for establishments under
this extension must be paid in full no later than December 31, 2021.
Any business that holds a CY2021 permit from the Department with an annual permit
renewal and requests financial relief shall be allowed to pay the CY2021 annual permit
fee in two (2) installments. The first payment of one half of the permit fee shall be due
on the permit renewal date and the second payment of the balance of the permit fee
shall be due six (6) months after the permit renewal date. If the second half of the permit
fee is not paid six months after the permit renewal date, the permit shall be expired and
void and the establishment may be posted for nonpayment. When the first one half of
the permit fee is received by the Department, the permit shall be considered issued and
valid, instead of requiring the entire fee as indicated in Chapter I, Regulation 5(a) of the
Maricopa County Environmental Health Code.
There shall not be any permit reinstatement fees for failure to pay permit fees when due.
Unless an agreement has been requested and approved by the Department, beginning
January 1, 2021, CY2021 annual permit fees will be due on the regular, pre-COVID
schedule.
IT IS HEREBY ordered that the following provisions of the Maricopa County Environmental
Health Code shall be suspended for renewable annual permits for the time period
beginning as of October 1, 2020 through December 31, 2021.
Second sentence of Chapter I, Regulation 4(g)(1) (refundable permit fee)
Chapter I, Regulation 4(g)(2) (suspension of this provision applies only to permits
on Department approved installment payment plans)
Chapter I, Regulation 4(g)(3) (permit reinstatement fee)
The following phrase of the first sentence of Chapter I, Regulation 5(a): “No permit
shall be issued, and no permit is valid, until the permit fee is received by the
Department...”

IT IS HEREBY FURTHER ordered that the following provision of the Maricopa County
Environmental Health Code shall be modified for renewable annual permits for the time
period beginning as of October 1, 2020 through December 31, 2021.

First sentence of Chapter I, Regulation 4(g)(1) shall be modified as follows:
Permits are valid for one calendar year from the initial issue date unless EXTENDED OR
revoked by the Department.
ADOPTED by the Maricopa County Board of Supervisors, Maricopa County,
