Support/Opposition: The Department has received 20 comments in favor of this EROP case. No attendees, other than the presenters, were at the February 13, 2020 stakeholder meeting. Department Recommendation: Staff recommends the Board of Supervisors (BOS) approve the proposed MCEHC. BOH Recommendation: Approve per Department recommended language removal and proceed on the EROP expedited process. Executive Summary: By removing outdated piggery language, the MCEHC will be in agreement with State regulations, while retaining public health nuisance enforcement capability for fly breeding and manure disposal in Chapter XI, Section 1. Historically, piggery regulations appeared in the 1943 State Sanitary Code of Rules and Regulations when Arizona was more agrarian than today. The State repealed their piggery code and no delegation for Maricopa County to enforce the former State code exists. Page 2 of 2 In accordance with the Maricopa County Resolution, “Moratorium on Increased Regulatory Burdens,” the County Manager authorized the Department to proceed with this case in early November 2019. Also, the County Manager briefed the Board of Supervisors in late December 2019. The Department conducted a stakeholder workshop on February 13, 2020. Then on July 27, 2020, the Department presented a Staff Report for this case to the Board of Health (BOH) at which time the BOH approved this case to proceed on the EROP expedited process for the BOS to adopt the proposal. Support/Opposition: The Department held a stakeholder public meeting on February 13, 2020. Although no stakeholders attended the meeting, the Department has received 20 stakeholder comments all in support of this EROP case. Department Recommendation: Staff recommends the Board of Health approves this MCEHC revision proposal for the EROP Expedited Process. Discussion: The proposed revision removes outdated piggery regulations from the MCEHC, while retaining regulations for public health nuisances through other sections of the code. Nuisances such as fly breeding and manure disposal requirements set forth in Chapter XI, Section 1 of the MCEHC will continue to be addressed on a complaint basis. This MCEHC proposal is following the EROP policy and workflow process. In accordance with the Maricopa County Resolution, “Moratorium on Increased Regulatory Burdens,” the County Manager authorized the Department to proceed with this case in early November 2019. ADHS repealed their 1943 Piggery language from State regulations in 1997 per the State Law Librarian. Current MCEHC piggery regulations conflict with the Maricopa County Zoning Ordinance. This removal would allow for 4H and FFA students to have a swine project for fair at their home, provided they are properly zoned for it. The issues of manure management and flies would fall under other current regulations. Removal of this rule, gives opportunities for youth to have a hands-on learning opportunity within our communities. Land use for agriculture is shrinking in this county, however we are still in the top one percent in the nation for agricultural production and leading Arizona in the $23.3 Billion industry. Our youth should not be prohibited in having a learning opportunity, if they choose to participate, because of an outdated county regulation. No Comments I believe that pigs should be allowed to be housed, also known as a piggery, anywhere on a property owner’s land, as long as it does not create an environmental health concern for neighboring properties. If an environmental health issue is reported, then actions can be taken to investigate and inform that continued violations/complaints will call for the removal of the swine from the property. If this is not passed and revised, very few individuals would have the ability to raise swine (legally) due to the property lines. Very few have the space to be able to keep the swine 300 feet away from their house, as well as their neighboring homes. Many youth in the county show swine at the Maricopa County Fair as an educational project. This is not a business, but rather a learning opportunity for the next generation of your county. This encourages youth to be involved in agriculture and so the future will be sustained. Removing the restrictions on swine will provide the opportunity for more individuals to (legally) raise and maintain swine for items such as, but not limited to the county fair.
