PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL
PRESENTACIÓN DE ANIMALS DOMESTICOS POR EL DEPARTAMENTO DE
CONTROL Y CUIDADO DE ANIMALES
John Reynolds, Shelter Division Manager for Maricopa County Animal Care and Control
(MCACC) was present and introduced a two-month-old, neutered, terrier mix puppy.
This puppy was one of 10 puppies surrendered to MCACC. The Pet Help Program
assisted the dog owner in getting all 10 puppies to the shelter to be adopted. The puppy
was the last of the litter and was available for adoption at 11 a.m. at the West Valley
Shelter located at 2500 S. 27th Avenue, Phoenix, AZ 85009.
Chairman Hickman asked the Clerk if there were any announcements or corrections to
the agenda. The Clerk said there was a request to continue item #9 until the March 9,
2020 meeting and a vote could be taken on the continuance at that time.

ANNIVERSARY
Approve and proclaim February 14 as League of Women Voters Day. (C-06-20-380-M-00)
Fran McCarroll, Clerk of the Board, read the proclamation. A copy of the proclamation is
on file with the Clerk of the Board’s Office and retained in accordance with LAPR
retention guidelines.
PROCLAMATION
Celebrating League of Women Voters 100th Anniversary
WHEREAS, The League of Women Voters was founded in 1920 as a “mighty political
experiment” by the foremothers of the suffragist movement at the National American
Woman Suffrage Association, and;
WHEREAS, the League’s goal was to help the 20 million women who were granted the

right to vote by the 19th Amendment to the Constitution understand and carry out their
new responsibilities as voters, and;
WHEREAS, due to the League’s successful efforts over the last 100 years to uphold its

nonpartisan, grassroots organization, and;
WHEREAS, the League has sponsored legislation and fought to protect and strengthen
voting rights and access, as well as free and fair elections, and;
WHEREAS, the League has consistently been noted for nonpartisan election
information, sponsorship of candidate forums and their commitment to register, educate
and mobilize voters, and;
WHEREAS, the League believes that active and engaged citizens, irrespective of
gender, ethnicity, or political affiliation are the hallmark of democracy;
NOW THEREFORE, BE IT RESOLVED that the Maricopa County Board of Supervisors
does hereby proclaim February 14 as League of Women Voters Day, and congratulates
the League on its 100th Anniversary.

Susan Penner, League of Women Voters representative for the Northwest Maricopa
County and Metro Phoenix League, thanked all who have supported the Proclamation
celebrating 100 years. She explained the many ways the League educates and
supports the public on government issues. Ms. Penner named the many
accomplishments of the League and the women who worked on those endeavors. She
thanked Fran McCarroll and Valerie Beckett for their assistance on the proclamation.
Supervisor Gallardo thanked the League for all they do to educate the public. He said
he had firsthand experience of the great work they do while he worked in the Elections
Department. As a nonpartisan organization, they strive to protect the public’s right to
vote.
Bill Gates thanked the League for their leadership and he looks forward to their
assistance in educating the public with all the changes regarding the upcoming
elections.
Chairman Hickman asked the League of Women Voters representatives present to
come forward for a picture with the Board of Supervisors.

approval of Z2019033 subject to conditions ‘a’ – ‘h’:
a. Development of the site shall be in substantial conformance with the Site Plan entitled
“Vulture City-Site Plan“, consisting of 1 full-size sheets, dated December 16, 2019, and
stamped received December 16, 2019, except as modified by the following conditions.
b. Development of the site shall be in substantial conformance with the Narrative Report
entitled “Vulture Peak Tours, LLC”, consisting of 6 pages, dated November 2019, and
stamped received November 8, 2019, except as modified by the following conditions.
c. The following Planning Engineering conditions shall apply:
1. At the Time of the Building Permit Application:
a. The Engineered Grading and Drainage Plans must be updated to show the
swales/ditches along the roads to direct the flow to the respective retention basins per the
Drainage Report.
b. The grading for Retention Basins #4 and #5 must entirely be in cut. Maximum cut slope
is 4:1. The maximum height of the lowest top of slope elevation cannot be more that 12-
inches above the bottom of the basins.
c. The proposed contours downstream of Retention Basin #4 must show how the off-site
and any flows above & beyond the 100-year, 2-hour storm event will flow downstream.
d. The retention basin emergency spillway will be sized according to the post condition flow
rate. There will be no pre vs. post flow rates used to size drainage features.
e. The retention basins’ top of berms must have a minimum width of 8-feet.
f. The first flush volumes in Retention Basins #1 and #2 must have drain down calculations.
Use either percolation tests or drywells.
g. The size of the riprap on the plans must be at the same size or greater than the riprap
calculations in the Drainage Report.
h. Update the contributing area for Retention Basin #4 to include the area of the retention
basin.

i. The area for Retention Basin 1 must match between the 100-year, 2-hour storm event
and the first flush calculations.
j. Provide calculations to show how the bleed-off pipes will drain between 24-hr and 36-hr.
2. Drainage review of planning and/or zoning cases is for conceptual design only and does
not represent final design approval nor shall it entitle applicants to future designs that are
not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and the
Maricopa County Drainage Policies and Standards.
3. All development and engineering design shall be in conformance with Section 1205 of
the Maricopa County Zoning Ordinance and current engineering policies, standards and
best practices at the time of application for construction.
4. The existing Vulture Mine Road Right-of-Way (R/W) is 130-ft (65-ft on either side). The
driveway within the existing R/W will need to be construct as a Minor Collector Roadway
Connection.
5. Any construction (driveway, utilities, etc.) within Vulture Mine Road Right-of-Ways will
require a Maricopa County Department of Transportation (MCDOT) Right-of-Way Permit.
d. This Special Use Permit shall expire 20 years from the date of approval by the Board of
Supervisors. All of the site improvements shall be removed within 60 days of such
termination or expiration.
e. Prior to occupying the existing residence or any portion thereof for any use associated
with the Special Use Permit, the applicant shall obtain a Building Permits to retrofit the
existing buildings to meet current commercial building code requirements as applicable and
shall obtain a Certificate of Occupancy for the retrofitted building prior to occupancy.
f. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Special Use Permit as set forth in the Maricopa County Zoning
Ordinance.
g. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property to enjoy uses in excess of those permitted by the zoning existing on the date of
application, subject to conditions. In the event of the failure to comply with any condition,
and at the time of expiration of the Special Use Permit, the property shall revert to the
zoning that existed on the date of application. It is, therefore, stipulated and agreed that
either revocation due to the failure to comply with any conditions, or the expiration of the
Special Use Permit, does not reduce any rights that existed on the date of application to
use, divide, sell or possess the property and that there would be no diminution in value of
the property from the value it held on the date of application due to such revocation or
expiration of the Special Use Permit. The Special Use Permit enhances the value of the
property above its value as of the date the Special Use Permit is granted and reverting to
the prior zoning results in the same value of the property as if the Special Use Permit had
never been granted.
h. All activity shall be contained on site unless separate permit/s is/are obtained from the

1. Without the submittal of a precise plan of development, no development approval is
inferred by this review, including, but not limited to drainage design, access and roadway
alignments. These items will be addressed as development plans progress and are
submitted to the County for further review and/or entitlement.
2. The applicant is advised of MCDOT Transportation Improvement Project (TIP) TT0248
for improvements along Williams Drive. If construction has not commenced on MCDOT TIP
TT0248 before final plat approval by the Board of Supervisors, construction or a financial
contribution in lieu of constructing ultimate half-width improvements along Williams Drive
will be required/conditioned as part of future entitlements (i.e. preliminary and final plats). If
construction of MCDOT TIP Project TT0248 has commenced prior to the Board of
Supervisor’s final plat approval, the applicant will be under no obligation to construct or pay
for the improvements along Williams Drive. For purposes of this condition, “commenced”
shall be the Contractor’s Notice to Proceed date for MCDOT TIP Project TT0248. The
applicant is responsible for their driveway onto Williams Drive.
3. Engineering review of planning and/or zoning cases is for conceptual design only. All
development and engineering design shall be in conformance with Section 1205 of the
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards and best practices at the time of application for
construction.
d. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance.
e. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article 304.6,
and ARS § 11-814 for five (5) years for the initial phase and an additional five (5) years for

and/or construction permits. The status report to be administratively reviewed by Planning
and Development with the ability to administratively accept or to carry the status report to
the Board of Supervisors (Board), upon recommendation by the Planning and Zoning
Commission (Commission) for consideration of amendments or revocation of zoning for
undeveloped parcels. Status reports will be required until completion of the initial
subdivision infrastructure and/or construction permits for each zoning parcel CS-CUPD.
f. The following R1-6 RUPD standards shall apply:
1. Average Lot Area per Dwelling Unit: 6,700 sq.-ft.
2. Minimum Lot Area: 5,000 sq.-ft.
3. Minimum Lot Width: 45’
4. Maximum Lot Coverage: 60 %
5. Maximum Height (ft./stories): 30/2 ft./stories

Ms. Pokorski gave a brief overview noting it was continued from the January 29, 2020
meeting to allow the applicant and neighbors an opportunity to discuss their concerns.

Noise and dust were the primary concerns. There was one stipulation amendment Ms.
Pokorski read into the record: Stipulation d. to read: “This Special Use Permit shall
expire 10 years from the date of approval by the Board of Supervisors or upon
termination of the use, whichever occurs first. All of the site improvements shall be
removed within 60 days of such termination or expiration.”
Chairman Hickman asked the Clerk if there were any registered speaker slips for PZ-6.
She said she had several speaker slips.
Janet Salazar, resident, spoke in favor of the item. Ms. Salazar stated Mr. Thiele has
been a good neighbor and has done much to clean up the property.
Hans Thiele, resident, spoke in favor of the item. Mr. Thiele said he is the Trustee of the
property. He stated that those in opposition have told lies about his son, Jonathan
Thiele, and when lies are told, how can good decisions be made.
Thomas Baird, resident, spoke in favor of the item. Mr. Baird lives nearby and he
commented on the dust complaint saying there will always be dust as long as the wind
blows. There are no paved roads in the neighborhood and the fences that surround the
property help to mitigate dust. He stated that the business does not diminish the
property values or quality of life for he and his wife.
Joni Gates, resident, spoke in favor of the item. Ms. Gates has lived in the
neighborhood for 20 years because she liked bigger properties. She lives two properties
away and stated Mr. Thiele is very clean and neat. It is hard to tell there is a business
there.
Michael Rolland, attorney for Jonathan Thiele, was present and would speak if needed.
Gail Thiele, resident, was present and in favor of the item and chose not to speak.
Ron Reynolds, resident, spoke in opposition of the item. Mr. Reynolds lives south of the
proposed property and said it would look better if the building is painted. He asked
about fire prevention in the welding building. He also said he was concerned when he
heard from neighbors that the applicant made threats on his family.
Supervisor Gates asked about fire prevention. Ms. Pokorski said the building must meet
all the standard building requirements including fire codes.
Jeannette Reynolds, resident, spoke in opposition of the item. Ms. Reynolds purchased
her property in the 1970’s. She stated Mr. Thiele is new to the neighborhood and he has
been very noisy with pneumatic tools and grinding. She said she had not heard the
threats that the neighbors stated were made. Ms. Reynolds commented she believes
this process has divided the neighborhood which bothers her.
Denice Griffin, resident, is in opposition of the item but chose not to speak.
Supervisor Gates asked the applicant, Mr. Jonathan Thiele and his attorney, Mr.
Michael Rolland to come forward. He asked Mr. Thiele about the allegations of threats
to the Reynolds. Mr. Thiele said he did not threaten Ms. Reynolds or anyone else.
Supervisor Gates said threats are taken seriously and if Ms. Reynolds felt threatened
enough, to call the Maricopa County Sheriff’s Office. Supervisor Gates also wanted to
clarify some of the business operations:

declaring the return of the right-of-way contingent on the fulfillment of the additional

NATIONAL CRIMINAL HISTORY IMPROVEMENT PROGRAM (NCHIP) GRANT FROM
THE ARIZONA CRIMINAL JUSTICE COMMISSION
Approve receipt of grant funds from the Arizona Criminal Justice Commission (ACJC) for
the National Criminal History Improvement Program in the amount of $406,581.00. These
grant funds are provided to enhance efforts to improve criminal history records and
information. This grant agreement, ACJC number NCP 19-21-001, will commence on
January 1, 2020 and will terminate on December 31, 2021.
In accordance with the agreement, page 6, paragraph 35, these funds will not be used for
any indirect or administrative costs that may be incurred by the Maricopa County Attorney’s
Office or Maricopa County for the administration of this grant. Thus, the grant allows a 0%
rate for indirect costs, or $0 that may be
incurred for the administration of this grant. The Maricopa County Attorney’s Office FY
2020 composite indirect cost rate is 15.8%, or $71,377. The recoverable indirect cost of
administering this grant is $0 and the non-recoverable indirect cost is $71,377. Non-
recoverable indirect costs will be covered by the departmental general fund budget. This
grant is competitive and does not require on-going cash contributions after the grant period
end date.
Authorize the Chairman of the Board of Supervisors, or designee, to sign all documents
related to this award. Grant revenues are not "local revenues" for the purpose of the
constitutional expenditure limitation, and therefore expenditure of the funds is not
prohibited by the budget law.
This award agreement is in the amount of $406,581.00 in Federal dollars under CFDA
16.554 awarded to the Arizona Criminal Justice Commission by the U. S. Department of
Justice. This grant requires a 10 percent match, which the County Attorney can provide
through the salary and benefits of various personnel, totaling $45,175.00. The total project
cost is $451,756.00. These funds are used to support mandated services to reduce the
agency’s backlog of arrest disposition records. This grant is a one-time award with no
expectation of continued funding. However, the County Attorney’s Office has received
funding under this grant program since 2009. This grant will expire at the end of the award
period unless prior written approval for an extension has been obtained from the Arizona
Criminal Justice Commission. Payment of these grant funds are conditioned upon the

IGA WITH ARIZONA DEPARTMENT OF AGRICULTURE (LIVESTOCK) FOR SWORN
TRAINING ACADEMY
Approve an Intergovernmental Agreement (IGA) between Maricopa County on behalf of the
Sheriff’s Office and Arizona Department of Agriculture (Livestock) regarding the Maricopa
County Sheriff’s Office Sworn Basic Training Academy. This Agreement allows Arizona
Department of Agriculture (Livestock) law Enforcement recruits to participate in scheduled
MCSO Sworn Basic Training Academies at a cost of $500 per registrant January 1, 2020
through June 30, 2020 and $750 per registrant beginning July 1, 2020. The term of this
Agreement is January 1, 2020 to June 30, 2021 and it is effective when signed by the
parties. This agreement can be terminated at any time with two months written notice.
Arizona Department of Agriculture (Livestock) does not have its own training academy and
this Agreement will allow MCSO to provide training space, when available, to the
Department’s Law Enforcement recruits in MCSO scheduled sworn training academies.
Arizona Department of Agriculture (Livestock) is responsible for providing worker’s
compensation insurance, salary, benefits, weapons, ammunition and uniforms for its recruit

IGA WITH CITY OF PHOENIX FOR MAINTENANCE ON CONSOLE UNITS (POSITIONS)
USED BY ADULT PROBATION
Approve an IGA between the City of Phoenix and Maricopa County through the Sheriff’s
Office in the not-to-exceed amount of $54,000 per year. This is a renewal of an IGA
approved in May 2016 (C-50-16-105-3-00) and March 2017 (C-50-16-105-3-01) that
expires June 30, 2020. The purpose of this IGA is to provide hardware maintenance,
preventative maintenance, and help desk support for nine (9) consoles units (“positions”)
located in the Sheriff’s 911 Center that are used by the County Adult Probation
Department. This IGA is effective from July 1, 2020 and will continue until June 30, 2025 or
until terminated by formal act of the Parties. MCSO’s current use of positions includes an
understanding that positions will be commandeered for use as emergency 9-1-1- positions
in a declared emergency.
In 2016 the County Adult Probation Department dispatch function was located to the
Maricopa County Sheriff’s Office Communications Division/911 Center. The “positions” that
are assigned to Adult Probation do not meet the emergency criteria for those that are

rabies vaccination, dog license tag, and new owner transfer fee within the first year of

FOR RENEWAL OF EMERGENCY PLANS SOFTWARE
Authorize Emergency Management to apply for grant funds from Arizona State Department
of Homeland Security, (FFY20 SHSGP), in the not-to-exceed amount of $85,000 for the
MaricopaRegionPrepares.com subscription renewal. This is a Continuity of Operations
Planning (COOP) software package for all jurisdictions within Maricopa County. The grant
period for this grant is October 1, 2020 through September 30, 2021. The Maricopa County
Department of Finance has calculated the Department of Emergency Management's
composite indirect cost rate at 10% or $8500. The Department will not be recovering
indirect costs off of this grant. The amount of unrecoverable indirect cost is $8500.
Emergency Management will absorb these indirect costs within their general budget.
The grant award is non-recurring, the department has to apply every year however, we
have received the grant for the past four years. The department does not have an in-kind
match requirement for this grant. The grant award is not a mandated function but it is a
department strategic goal to have all county departments with a viable Continuity of
Operations Plan (COOP). The grant is awarded through the Arizona State Homeland
Security Department-State Homeland Security Grant Program (SHSGP), which is a
competitive grant program. Maricopa County jurisdictions compete for projects based off
the
State grant initiatives. Maricopa County has spear headed the grant for the Emergency
Operations Plans (EOP)/COOP software project for all county departments and
jurisdictions within Maricopa County. Each year Maricopa County applies for the recurring
cost of the software maintenance and training funds. Maricopa County does not have to
fund any additional costs for the program.
The grant is intended to renew the MaricopaRegionPrepares.com subscription. This
software tool benefits Maricopa County in developing Emergency Operations Planning
(EOP), Continuity of Operations Planning (COOP), Continuity of Government (COG)
Planning for local government. The Department was awarded a grant for the software in
2015, we are applying for a grant to cover the cost associated with the maintenance of the
system.

grant will be MOU'd to the Arizona Department of Emergency and Military Affairs (DEMA)
upon receipts of award letter. Indirect costs are not applicable since Maricopa County
Department of Emergency Management (MCDEM) will not accept the grant funding. DEMA
will retain and manage the grant during the performance period.
It is the intent of MCDEM to MOU the grant funds to DEMA to retain and manage the

PROGRAMS
Approve revisions to the Child and Adult Care Food Program (CACFP) Permanent
Agreement (“Agreement”) with Arizona Department of Education (ADE), Child Nutrition
Programs, (A.G. Contract No. KR02-1170-ALS) administered by Maricopa County Human
Services Department, Early Education Divisions, Head Start Program. The revised
Agreement identifies the individuals authorized to sign any documents that relate to the
CACFP activities.
Also request authorization for the Chairman to sign the Permanent Agreement and request
authorization for the Human Services Department Director to sign all documents related to
CACFP activities to include ADEConnect Entity Administration Account documents, which
designates the individuals authorized to submit reports to ADE.
The Maricopa County Board of Supervisors entered into the Permanent Agreement with
ADE on September 25, 2013. Due to staff changes in the Head Start program, a revision to
the Permanent Agreement must be submitted to ADE.
The revised Permanent Agreement will allow for the County to continue to receive CACFP
funds for meals and snacks that meet 1/3 to 2/3 of program participants’ daily nutritional
needs. ADE on an annual basis provides the County with CACFP funds for meal service

Approve revenue Amendment No. 14 to the Intergovernmental Agreement (Agreement)
between Arizona Department of Economic Security (DES) and Maricopa County,
administered by its Human Services Department.
The purpose of Amendment No. 14 will address a reduction in funds from DES as follows:
• Revise Section 32.0 (Levels of Service), the Case Management service reimbursement
ceiling for the period of July 1, 2019 through June 30, 2020 is revised from $5,388,470 to
$5,371,931.63, a decrease of $16,538.37.
• Revised Case Management Service Budgets are added to the Agreement.
The Agreement ceiling amount shall be changed from $6,289,777.75 to $6,273,239.38 a
difference of $16,538.37. The reason for the decrease in funding is due to reconciliation of
FY19 budget and FY20 carryforward funding.
Except as provided in Amendment No. 14, all terms and conditions of the original
Agreement and previous Amendments, remain unchanged and in full force and effect. The
Amendment shall become effective on the date of last signature unless otherwise
specified.
DES contracts with the County on an annual reoccurring, non-competitive basis for service
delivery of the Community Action program activities. Funds are utilized to provide

limitation, and therefore, expenditure of the revenues is not prohibited by the budget law.

The purpose of the Amendment is to address the following items:
1. Revise item #2 of the Agreement and remove Arizona Call-A-Teen Resources (ACYR)
as an agent of Maricopa County for Workforce activities and terminate access to the DES
database system identified in the DSA.
2. Add the following Agents to the DSA and grant access to the database system identified
in the DSA, specifically the Arizona Job Connection (AJC) database system as identified in
the revised Attachment A:

DES database systems in order to record Youth Program service delivery under Workforce

The term of this Agreement began on September 29, 2017 and shall expire on September
28, 2027.
DES maintains database systems that must be accessed by the Agents as Maricopa
County Contractors (Serial 16026 RFP) for service delivery of Youth Program activities to

Approve revenue Amendment No. 5 to the Agreement between Wildfire and Maricopa
County, administered by its Human Services Department. The purpose of the Amendment
is to increase Salt River Project (SRP) funding amount by $35,000 for the Program Year
(PY) 2019-20.
The Agreement shall be increased from $271,220 to $306,220. The increased funds shall
be utilized: $5,833.34 for Program Delivery and $29,166.66 for Direct Services. The
Amendment limits program expenditure funds to 5% or $15,311 to be used to address
Health & Safety concerns. The period of availability for the increased funds shall be
January 1, 2020 through March 30, 2020.
The term of the Agreement remains unchanged May 1, 2015 to March 30, 2020.
Unexpended funds from PY 2019-2020 will not be available for any future PY projects.
All provisions of the original Agreement and previous Amendments remain in full force and
effect. This Amendment is effective when executed by all the Parties.
ACAA contracts with the County on an annual reoccurring, non-competitive basis for
service delivery of the SRP Low-Income Weatherization Assistance Program.
The Human Services Department is utilizing the provisional indirect rate of 22.2% approved
by the U.S. Department of Health and Human Services for FY2020 for salaries and
employee related expenses. The total Amendment amount is $35,000 of which $5,833.34
is for program delivery. Of the $5,833.34 a total of $4,773.60 is for salaries and benefits.
The total estimated indirect costs is $1,059.74 and fully recoverable. Budget adjustments
will be made when the Indirect rate costs has been fully negotiated and shall be effective
as of July 1, 2019.
Receipt of the funds from ACAA does not require in-kind or match funds and no future or
ongoing contributions by the County at the end of the Agreement term.
The services provided under this Agreement are not a mandated function but provides a
benefit to citizens by providing Weatherization measures in dwellings occupied by low-
income residents, which will assist in reducing energy burdens in Maricopa County.
This Amendment does not contain County General funds. Grant revenues are not local
revenues for the purpose of the constitutional expenditure limitation, and therefore
expenditure of the revenues is not prohibited by the budget law. The approval of this
funding does not alter the budget constraining expenditures of local revenues duly adopted

The purpose of Amendment No. 1 is to amend Section III (Work Statement), Paragraph 2.0
(Scope of Work), subparagraph 2.1 as follows:
Project Description: The Subrecipient shall remove and replace approximately 11,673
square yards of asphalt on six (6), 30-foot streets from curb to curb. The streets are Calle
Fortunato Serrano, Calle Juan Taeva, Calle Brigido Valenzuela, Calle Maximo Solarez,
Ciculo S. Hernandez, and Jimenez Circle. Project activities shall also include the
installation of new speed humps on the following streets: S. Calle Tomi and W. Calle
SENU. The project will be located in within the Town of Guadalupe, AZ. The engineering
design and installation of the work shall meet Maricopa Association of Governments (MAG)
Standards and locally adopted codes.
The Amendment now includes the installation of speed humps to 2 streets: S. Calle Tomi
and W. Calle SENU.
The Agreement is amended to incorporate the changes contained in this Amendment No.
1. All other terms and conditions of the Agreement shall remain unchanged and in full force
and effect as executed by the Parties.
This Agreement is funded by a grant from the U. S. Department of Housing and Urban

DEPARTMENT OF HEALTH AND HUMAN SERVICES THRU THE ARIZONA
DEPARTMENT OF CHILD SAFETY
Approve the application and acceptance of Title IV-E federal entitlement funds from the
Department of Health and Human Services thru the Arizona Department of Child Safety in
the amount not to exceed $5,000,000 per year for the purpose of supplementing the costs
of dependency in Public Defense Services. Authorize the Chairman of the Board of
Supervisors to sign all documents related to this award. This grant is an open-ended
entitlement. Per the IGA, 75% of the funding must be invested in dependency to
supplement Public Defense Services. The other 25% may be used to offset costs to the
County. The 25% (approximately $1,250,000) will be used to offset General Fund
expenditures.
Also, approve the waiver of indirect costs. Public Defense Services will receive a total of up
to $5,000,000 annually; at the indirect rate of 11.69%, the indirect costs are estimated at
$584,500, all of which will be waived. These indirect costs are not being sought so that the
grant funds can be used for contract attorney costs previously funded by the General Fund.
The entitlement is re-occurring and is a new award to the department. There are no in-kind
match requirements and requires no ongoing cash contributions. This grant award
supplements a mandated function. Public Defense Services is the only eligible entity to
receive this award.
The department will come back to the Board for appropriation adjustments once the actual
amount is known.
A change in the Child Welfare Policy Manual now allows states to claim federal matching
funds through Title IV-E of the Social Security Act to reimburse half the cost of attorneys for
children who are eligible for Title IV-E foster care benefits and half the cost of attorneys for
their parents. This reimbursement can then be used to supplement the dependency system
as outlined in the IGA with the Arizona Department of Child Services.
The policy change allows the state to claim reimbursement retroactively for actual
expenditures in the period January 1, 2019 to December 31, 2019 and every quarter
thereafter. PDS will receive up to $5,000,000 for the initial retroactive period and up to

MCDPH will continue to coordinate, collect, and provide data regarding birth defects. The
budget period is from January 1, 2020 through December 31, 2020 and is in the amount of
$269,250.00. The cumulative amount is $1,452,750 for the 3 year budget term of January
1, 2017 through December 31, 2020. The IGA contract term is January 1, 2017 through
December 31, 2021. All other provisions of this agreement shall remain in their entirety.
This grant award is in year 3 of a 4 year term and it is uncertain whether it will reoccur.
There is no cash or in-kind match required nor should ongoing cash contributions be
necessary. This is not a mandated function but provides a benefit to the citizens through
the continued surveillance and registration of newborns with birth defects. This grant
provides for the collection of cancer data as well. The opportunity was not competitive.
The Department of Public Health’s indirect rate for FY20 is 19.2%. Full indirect costs are
estimated at $43,369, all of which is recoverable. Departmental indirect rates are
reestablished at the beginning of each fiscal year and the future indirect rates will be
collected at the corresponding rates.

FOR COMMUNITY HEALTH NURSING CONSULTING SERVICES
Approve amendment 2 to contract ADHS17-154596, High Risk Perinatal Program (HRPP)
Community Health Nursing (CHN) Consultant Services, between the Arizona Department
of Health Services (ADHS) and Maricopa County, by and through its Department of Public
Health (MCDPH). The amendment extends the contract through November 30, 2021, the
final year of the 5 year term.
The HRPP CHN Consultation Services RFP award is reoccurring and has been awarded to
the Department since 2016. This grant does not require an in-kind match, indirect cost is
fully recoverable and ongoing cash contributions are not required. The grant award is not a
mandated function but provides a benefit to the citizens by providing guidance, education,
and standardization to NICP Community Nursing Contractors in the implementation of
community nursing services for the critically ill/premature newborns enrolled in the NICP
program. The award is competitive. There are no costs that will need to be absorbed by the
department’s operating budget.
Indirect cost calculations are not applicable to this action as it extends the contract date
only.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation, and therefore expenditure of the revenues is not prohibited by the budget law.

FOR RESILIENCE FELLOWSHIP
Approve the Notice of Award of grant funds from Arizona State University (ASU),
Knowledge Exchange for Resilience, in the not-to-exceed amount of $30,000. Funding is to
support a cohort resilience fellow, under the ASU Community fellowship program, in order
to identify and address challenges for building community resilience. The budget period for
this award is January 1, 2020 through December 31, 2020. The term of the agreement is
for one year beginning January 1, 2020 through December 31, 2020.
This is a new fellowship grant and its reoccurrence is not known. It was a competitive grant
opportunity and there is no cash or in-kind match required. Should the grant cease, on-
going contributions will not be required. This is not a mandated service but provides a
benefit to our citizens by continuing work to foster knowledge-based community resilience
within Maricopa County.
This Grant deviates from County Policy A2505 and does not allow for any indirect cost
reimbursement. MCDPH indirect rate for FY19-20 is 19.2%. The full indirect costs are
estimated at $5,760, none of which are recoverable. Program costs not covered by the
grant will be subsidized by the MCDPH indirect cost pool. Departmental indirect rates are
re-established at the beginning of each fiscal year and the future indirect rates will be
collected at the corresponding rates.

Approve the receipt and expenditure of a one-time appropriation of $200,000 to Maricopa
County by the State Legislature in HB 2747 for the Sun Lakes Dust Mitigation Pilot
Program to be administered by the Maricopa County Department of Transportation
(MCDOT), Project Code: TE0064.
This is a one-time appropriation. There are no cash or in-kind matching requirements.
MCDOT’s current (or FY20) indirect rate is 13.45%. Total allowable indirect costs are

Lorena Bader, resident and former volunteer. Ms. Bader, co-founder of Four Paws and
Friends, said Four Paws and Friends has worked with Maricopa County Animal Care
and Control (MCACC). She stated that since she was fired, Four Paws and MCACC
cannot get along for the good of the animals. She cited numerous examples
demonstrating the lack of cooperation between the management team and Four Paws.
Haley Hannigan, resident, spoke about the edible enrichment program at MCACC. This
program was started by the non-profit, Four Paws and Friends in October 2019 and
provided dog treats to be distributed to the sheltered dogs by members of the public.
She stated there was management intervention in January 2020 that changed the rules,
prohibiting the dispensing of treats by all except MCACC volunteers.
Jordan Bader, resident, spoke about MCACC being financially self-sustaining. Ms.
Bader said this could only be achieved with the staffing of volunteers. She stated the
majority of those volunteers are unhappy and do not feel respected for the work they do.
She said a well-run volunteer program requires strong leadership which the west shelter
does not have.
Erika Edmark, resident, talked about Four Paws and Friends and the need for dog food.
Four Paws solicits donations for food for the shelter. Four Paws recently received phone
calls from MCACC saying they were out of wet food. Ms. Edmark said there was a post
on the MCACC Facebook page stating there was no shortage of wet food and there
were groups soliciting food unnecessarily. She provided a copy of the FB post for the
Supervisors.
Kathleen Bau, resident, spoke about a failing volunteer program at MCACC citing
statistics. Ms. Bau said many volunteer hours would be needed to take care of the
animals at MCACC. She compared MCACC to the county shelter in Tucson, Pima
Animal Care Center, which operates a successful volunteer program. Ms. Bau
concluded the volunteer program at MCACC does not have enough volunteers to
adequately care for the number of animals. She stated the County spends over a million
dollars to pay staff that could be managed with a successful volunteer program.

Supervisors'/County Manager's summary of current events

Supervisor Gallardo spoke about agenda item #A-3 regarding intervention by the
County Attorney in the 2020 Elections. He said he understands and appreciates the
comments made by his colleagues and it is important to discuss and understand all the
variables. He thanked Scott Jarrett, Election Day Director, and Rey Valenzuela, Deputy
Director for Elections, for all the work that has been accomplished for the upcoming
March 17, 2020 Presidential Preference Election, the August 4, 2020 Primary and the
November 3, 2020 General Election.

He took a tour of the Anthem Test Bed on Tuesday February 11, 2020 and
pointed out how they are working to improve safety and traffic flow in Arizona.

He stated he attended his first Regional Public Transportation Authority Board
meeting as a member.
Supervisor Sellers is a new member to the Intel Community Advisory Panel.
Intel provided an update having had a presence in Arizona for 40 years and
stated that Intel has spent $40 billion in the area and employs 12,000 people
which is a welcome economic boost for the region.
On February 11, 2020 he attended Queen Creek State of the Town event.
Supervisor Gates thanked Supervisor Sellers for coming out to tour the Anthem Test
Bed project. He stated it is a great project and thanked the Department of
Transportation for their work. Supervisor Gates said he attended the Anthem
Leadership Group. This organization is composed of young professionals looking to get
involved in the community. He had the honor of attending the event for the retiring Daisy
Mountain Fire District Chief, Mark Nichols. Brian Tobin will be the new Fire Chief.
Supervisor Gates took a moment to acknowledge and thank Bill Wiley for his great
leadership as Acting Administrator in the Assessor’s Office during the recent transition.
Chairman Hickman thanked Bill Wiley for his great leadership in the Assessor’s Office.
He also thanked his colleagues for their diligence and all the candidates who applied for
the Assessor position. Chairman Hickman expressed his appreciation for the Elections
Department, for the outreach of County employees and many volunteers. There was a
lot of time invested in planning and training to make it a great election year. He
reiterated his appreciation for the many who stepped forward to help the County with the
elections.

AMENDMENT TO LEASE AGREEMENT WITH ARIZONA SPORTS COMPLEX, LLC
FOR FCD PARCEL P-6611
Approve, and authorize the Chairman to execute Amendment to Lease Agreement
AD2004-01 Phase 1 between Arizona Sports Complex, LLC (ASC) and the Flood Control
District of Maricopa County (the “District”) for use of 5.583 acres of District property within
County Assessor Parcel Number 206-40-002.
Parcel information:
1. South of Pinnacle Peak Road and east of 36th Avenue.
2. A portion of Assessor Parcel Number 206-40-002, consisting of 5.583 acres (243,195
sq. ft.).
3. City of Phoenix zoning is RE-43
FCD Parcel P-6611 was acquired as part of the District Adobe Dam project. The District
leased a portion of P-6611 to ASC via lease agreement which was executed on April 15,
2004. Said lease was for a term of fifteen (15) years and included a unilateral option for the
Lessee to renew for an additional fifteen (15) year term. The Lessee has elected to
exercise the renewal option and, in accordance with the terms of the lease, the District has
obtained a new appraisal and determined a new rental rate.
In addition, the District property encumbered by ASC’s lease was declared no longer
needed for flood control purposes by Resolution FCD 2019R002 (C-69-19-025-6-00) on
March 27, 2019. Pursuant to the Patent by which this property was acquired, the property
must be conveyed back to the Arizona State Land Department (ASLD). ASLD has agreed
to accept the property, and assignment of the ASC lease, once the District executes the
lease renewal. The lease renewal will allow ASC to continue to use the District’s property
until the conveyance to ASLD is final which is anticipated to occur before March 31, 2020.
