PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL PRESENTACIÓN DE ANIMALS DOMESTICOS POR EL DEPARTAMENTO DE CONTROL Y CUIDADO DE ANIMALES John Reynolds, Shelter Division Manager for Maricopa County Animal Care and Control (MCACC) was present and introduced a two-month-old, Shepard/Huskie mix. The male puppy came to the shelter as a stray and is ready for adoption. The $300 adoption fee will help support five other animals at the shelter. Mr. Reynolds announced that MCACC had been selected as a Wildcard Finalist for the PetCo Innovation Showdown that will take place in May. If MCACC wins the showdown, they will compete for a chance to win up to $500,000 in grant funds. Development of the site shall be in substantial conformance with the Site Plan entitled “Design Submittal for IND-2 (Light Industrial Zoning) with and Industrial Unit Plan of Development“, consisting of 12 full-size sheets, dated December 2018 and stamped received November 25, 2019, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Sun Streams IV Solar Project”, consisting of 43 pages, dated August 2019, and stamped received August 5, 2019 except as modified by the following conditions. c. The following Planning Engineering conditions shall apply: 1. At the time of application for building permits, existing drainage patterns east of 355th Avenue (possible overtopping) and structures (pipes) under 355th Avenue south of Retention Basin RB-2 must be depicted and analyzed to address possible conflicts with the retention basin location. 2. Retention basin bleed-offs must be directed to existing well defined (natural) or proposed (engineered) drainage channels. 3. Fencing shall not be constructed within existing right-of-way and/or areas preserved for future right-of-way. 4. Driveway access to paved MCDOT right-of-ways must be paved for the full width of the right-of-way. 5. Any disturbance to SFHAs will require that a Floodplain Use Permit be issued concurrent with the associated building permit. 6. Any electrical connections within SFHAs must be elevated to the regulatory flood elevation. 7. Fencing is prohibited in floodways. Fencing in the floodplain shall be designed to allow historic flow to be maintained. 8. Foundations for pole lines (i.e. gen ties) in SFHA must be analyzed to determine scour depth for footings. d. The following IND-2 IUPD standards shall apply: 1. Front yard setback: 0’ 2. Rear yard setback: 0’ 3. Rear yard setback: 0’ 4. No parking required. 5. No loading/unloading required. 6. No site triangles required at all driveways, section line intersecting alignments. 7. All uses may be conducted outdoors. 8. Chain link fencing, including concertina or barbed wire topping, and gates shall be allowed on the perimeter. e. The IUPD overlay is applied to restrict the use of the site. Until such time as the site is served by sewer, uses on the site shall only be those acceptable to the Maricopa County Environmental Services Department (MCESD) that can be accommodated by septic systems. A public water system and public sewer system shall be required prior to establishment of any non-residential use that requires potable water. f. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article 304.6, and Formal Meeting Minutes Wednesday, March 11, 2020 Page 4 of 42 ARS § 11-814 for five (5) years for the initial phase and an additional five (5) years for each subsequent phase, within which time the initial building permit or construction permit must be obtained. The applicant shall submit a written report every five years from the date of Board of Supervisors approval of Z2019008 which details the status of this project, including progress on obtaining building and/or construction permits. The status report to be administratively reviewed by Planning and Development with the ability to administratively accept or to carry the status report to the Board of Supervisors (Board), upon recommendation by the Planning and Zoning Commission (Commission) for consideration of amendments or revocation of zoning for undeveloped parcels. Status reports will be required until completion of the project. g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. h. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. i. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. The purpose of this agreement is to establish a partnership between the Maricopa County Sheriff’s Office Cadet Program and Franklin Police and Fire High School and Phoenix Union High School District to introduce students to possible career and employment opportunities through hands on experiences in and out of the classroom setting. Cadets are not employees. This is a non- financial agreement. The term of this agreement is Fall 2019 and may be renewed thereafter on a year-to-year basis upon mutual consent of the parties. MOU WITH CITY OF PHOENIX CONCERNING USE OF NATIONAL INTEGRATED BALLISTIC INFORMATION NETWORK Approve a Memorandum of Understanding (MOU) between the City of Phoenix for and on behalf of the Phoenix Police Department (PPD) and Maricopa County on behalf of the Formal Meeting Minutes Wednesday, March 11, 2020 Page 16 of 42 Sheriff’s Office (MCSO) regarding scheduling and use of PPD’s National Integrated Ballistic Information Network (NIBIN). The purpose of this MOU is to set forth agreed upon procedures for management, accountability, direction, authority and liabilities of the parties. This is a non-financial MOU, effective upon signature of both parties and will remain in effect for five (5) years. It may be extended by mutual written consent of authorized parties and canceled at any time upon mutual written consent of the parties with a 30-day notice. The NIBIN is property of the US Bureau of Alcohol, Tobacco and Firearms (ATF). NIBIN is the only national network that allows for the capture and comparison of ballistic evidence to aid in solving and preventing violent crimes involving firearms. NIBIN provides investigators the ability to compare their ballistics evidence against evidence from other violent crimes. PPD has permission to provide NIBIN network and systems access to another law enforcement agency provided the other law enforcement agency agrees to the same restrictions on the use of the NIBIN network and systems as placed on the PPD. The term of this funding is unchanged January 1, 2019 to December 31, 2020. The reduction will impact the Maricopa County Sheriff’s Office portion of the HIDTA award reducing the total from $468,187.60 to $458,187.60. Maricopa County will provide a rabies vaccination, dog license tag, and new owner transfer fee within the first year of transfer for each dog three months of age or older at no cost to the Contractor. The cost for these services is $52 for each animal transferred in FY 2020 and thereafter. Animal Care and Control estimates twelve (12) New Hope transfers over the term of the agreement for a total of $624. The Letter of Promulgation is signed by the jurisdiction’s senior elected or appointed official(s). The Approval and Implementation Letter is a signed statement formally recognizing and adopting the plan as the jurisdiction’s all-hazards Emergency Operations Plan (EOP). The implementation letter introduces the plan, outlines its applicability, and indicates that it supersedes all previous plans. It includes a delegation of authority for specific modifications that can be made to the Formal Meeting Minutes Wednesday, March 11, 2020 Page 19 of 42 plan and by whom they can be made without the senior official’s signature. The County provided the City with U.S. Department of Housing and Urban Development (HUD) for HOME Investment Partnerships Program (HOME) activities. The Parties agree to enter into this Amendment No. 3 to the Agreement to amend the Agreement as follows: A. Add additional Work Statement, hereinafter referred to as “2019 Work Statement A” for the City to acquire, rehabilitate and resell a single-family home. The County shall provide the City with $141,585.00 in 2019 HOME funds for this Work Statement. The expenditure timeframe for the 2019 Work Statement A shall be through September 30, 2023. B. Add additional Work Statement, hereinafter referred to as “2019 Work Statement B” for the City to expand the tenant based rental assistance program. The County shall provide the City with $229,291.29 in 2019 HOME funds for this Work Statement. The City shall utilize $60,468.73 of Program Income and recaptured funds for the 2019 Work Statement B activities. This agreement with To Taste will allow dietetic interns to continue to receive approved practicum experience in clinical nutrition. The County Attorney Received one-time spending authority within FY2019 for fund 213 in the amount of $117,500 for the Other Operating-Software expenses that will enable the department to enhance public safety (C-19-19-044-M-00 approved 4/10/19). The County Attorney is requesting the authority to be extended through FY2020 and increased. The County Attorney proposes to utilize up to an additional $116,500, totaling $234,000, in existing fund balance of the County Attorney (D190) County Attorney RICO Fund (213) RICO Arizona State Shared Funds Non-Recurring (RAZ1). These actions will have a County-wide net impact of zero and they do not alter the budget constraining the expenditure of local revenue duly adopted by the Board pursuant to A.R.S. §42-17105. Due to the current COVID-19 epidemic, Ms. Thompson has rescinded her offer. She and many of the polling place volunteers are elderly and have health considerations that put them at risk for contracting the Coronavirus. Ms. Thompson is a member of the League of Women Voters and said it is important to educate the public. Planning ahead for the upcoming elections is necessary and implementing Permanent Early Voting List (PEVL) would help keep voters safe. She stated that keeping the Vote Centers open is important for those who choose to go to the polls. Lorena Bader, resident and former volunteer, spoke about bullying at Maricopa County Animal Care and Control (MCACC) and County policies on bullying. Kathleen Bau, resident, spoke about ongoing problems at MCACC, the goal to help the animals live more comfortably while at the shelter and complimented the Pima Animal Care Center (PACC) in Tucson. Andrea Aldren, resident, spoke about postings which resulted in the firing of three MCACC volunteers and spoke of her experience with harassment. Erica Edmark, resident and former volunteer at MCACC spoke about the enrichment program between Four Paws and Friends and MCACC and policy changes regarding the program. SUPERVISORS'/COUNTY MANAGER'S SUMMARY OF CURRENT EVENTS Resumen de temas de actualidad de los Supervisores/Administrador del Condado Supervisor Gallardo spoke about the upcoming PPE on Tuesday, March 17, 2020. He stated the importance of making sure the voter is casting their vote properly. He said he has been asked about “re-voting”. If the voter has submitted the ballot already, no re- vote is possible. However, if the ballot has not yet been submitted, the voter can “spoil” the ballot and get a new one at a polling location. He thanked the Elections Department for the many hours of work that have gone into preparation. Supervisor Gallardo mentioned the Coronavirus and the challenges that it has brought to the elections this year. He said he is confident that everything will go well. Supervisor Sellers spoke about the successful County sponsored Hazardous Waste Collection Day in Sun Lakes on February 29, 2020. There were many volunteers from Intel that showed up to help and assist with the disposal of the waste. The participation from Intel was very much appreciated. Supervisor Sellers recently attended the Phoenix East Valley Partnership Board meeting. They had County Attorney Allister Adel present to share updates from the County Attorney’s Office. Also present was Chandler Councilmember Mark Stewart to speak about the importance of the 2020 Census. Supervisor Sellers also spoke about the March 10, 2020 Capital Times Morning Scoop where they discussed road funding. Panelists included Senate President Karen Fann, Representative Noel Campbell and Gilbert Mayor Jenn Daniels. Reid Spaulding reminded citizens, “do not drive through flooded washes.” Supervisor Gates reminded everyone that March 11, 2020 is the last day to send ballots for the PPE by mail. He announced that Tuesday, March 17, 2020 is the monthly New River/Desert Hills meeting and he encouraged people to attend with questions or concerns. The Farm-City Breakfast is scheduled for Wednesday, April 1, 2020 at Turf Paradise, 1501 Bell Road, Phoenix 85023. Supervisor Gates said he would be attending and speaking at the Water Summit at Moon Valley Country Club next week. Chairman Hickman commented on the elections planning that has taken place and the importance of reviewing after the election to determine what worked well and where there can be improvement with the August Primary and the November General Election. Chairman Hickman spoke about the all-staff Library District meeting last week. He said it was great to see the motivated workforce and how they serve the County so well.
