BOARD OF SUPERVISORS
The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Special Session at
1:30 PM on Friday, June 19, 2020, in the Supervisors' Conference Room, 301 W. Jefferson, 10th
Floor, Phoenix, AZ 85003, with the following members present: Clint Hickman, Chairman, District
4; Jack Sellers, Vice Chairman, District 1; Steve Chucri, District 2 (telephonically); Bill Gates,
District 3 (telephonically); and Steve Gallardo, District 5 (telephonically). Also present: Fran
McCarroll, Clerk of the Board; Joy Rich, County Manager; Emily Craiger, Legal Counsel
(telephonically). Minutes compiled by Kelly Gardiner, Minutes Coordinator.

EXECUTIVE SESSION
Vote to convene in Executive Session to consider the items on the Special Executive
Agenda dated June 19, 2020, for Board of Supervisors and relevant Special Districts
pursuant to the statutory authority listed for each item.
Motion to approve by Supervisor Sellers, seconded by Supervisor Chucri
Ayes: Sellers, Chucri, Gates, Hickman, Gallardo
After discussion in Executive Session, the Board reconvened in Open Session.
OPEN SESSION RECONVENED
The Chairman reconvened the Board in the Board of Supervisors Conference Room.

ACTION RELATED TO EXECUTIVE SESSION DIRECTIVE
Take action as directed in Executive Session on June 19, 2020, regarding Countywide
mitigation efforts concerning COVID-19 (C-06-20-569-M-00)
Chairman Hickman asked Dr. Rebecca Sunenshine, Medical Director for Disease
Control, Maricopa County Department of Public Health to come forward to give an
update on the COVID-19 status.
Dr. Sunenshine spoke on behalf of Public Health and commented on the rapid rise in
the cases of COVID-19 in Maricopa County in the last 24 hours. The current scientific

information is that individuals wearing cloth masks is the best chance of slowing the
spread of the Coronavirus. Dr. Sunenshine stated that slowing the spread in the
community will also keep the local health care facilities from becoming overwhelmed.
She introduced Marcy Flanagan, Executive Director, Maricopa County Public Health to
talk about recommendations.
Ms. Flanagan thanked the Board of Supervisors for all their support since the first
reported case of COVID-19 in January of this year. She also thanked all the citizens of
Maricopa County for their cooperation in slowing the spread by doing their part. Ms.
Flanagan said the Public Health Department is coming to the Board to ask for
consideration to implement a regulation requiring all citizens in Maricopa County to wear
a face covering. This regulation includes unincorporated Maricopa County as well as
the incorporated regions.
The Clerk read the highlights from the proposed Proclamation entitled Regulations
Requiring Face Coverings in Maricopa County. She said the complete document will be
available on-line.
WHEREAS, Maricopa County has authority to promulgate county-wide regulations to
mitigate the spread of infectious disease for the protection and preservation of public
health pursuant to A.R.S. § 26-307 and consistent with Maricopa County Health
Department v. Harmon, 156 Ariz. 161 (1987);
NOW, THEREFORE, IT IS HEREBY ORDERED that, as a result of the aforementioned
conditions, it is the policy of Maricopa County that all persons within Maricopa County
shall wear face coverings in compliance with the following regulations: I) Definitions, II)
Use of Face Coverings, III) Categorical Exemptions, IV) Territorial Applicability, V)
Enforcement, and VI) Severability.
IT IS FURTHER PROCLAIMED that Maricopa County encourages cities and towns in
Maricopa County to adopt regulations at least as restrictive as these regulations; and
IT IS FURTHER PROCLAIMED AND ORDERED that these regulations shall remain in
place until further notice of repeal or revision by the Maricopa County Board of
Supervisors.
ADOPTED by the Maricopa County Board of Supervisors, Maricopa County, Arizona,
this 19th day of June, 2020.
Supervisor Gallardo thanked the many individuals at Public Health for the effort that has
been put forth to create this policy. The expert advice of Dr. Sunenshine and Ms.
Flanagan has been imperative as we navigate this difficult situation. He also thanked
the legal team for their guidance. Supervisor Gallardo stated these are trying times and
it is necessary for the Board to step up and implement policies that will protect the
citizens of Maricopa County.
Supervisor Chucri concurred with Supervisor Gallardo’s comments. He stated protecting
the public health is one of the jobs the Board of Supervisors have been elected to do.
The Coronavirus does not discriminate and has affected all walks of life in the County. It
is necessary for the Board to make these difficult decisions in order to protect the health
of the citizens of Maricopa County.
Supervisor Gates agreed with his colleagues and added that the Board has to act in the
best interest of the County. He noted that we have not experienced a crisis like this in a

century and is asking all residents to partner with the County and wear masks in public.
He stressed the importance of not overwhelming the hospitals and healthcare workers.
Supervisor Sellers reiterated the previous comments and thanked the medical, health
and legal support for the many months of work related to the Coronavirus.
Chairman Hickman asked Ms. Flanagan to explain what is at risk when people refuse to
wear face coverings. Ms. Flanagan said that people’s lives and wellbeing are at risk.
She said it is necessary for everyone to be in this together. When some people choose
not to wear a face covering, it puts others at risk. In order to get the pandemic under
control, it is important that we all work together to protect one another.
Supervisor Sellers made the following motion: “I move that we adopt and publish a
Proclamation requiring face coverings in Maricopa County pursuant to our authority
under Arizona Revised Statute § 26-307, and that it become operational when filed of
record at the Office of Clerk of the Board.” Motion was seconded by Supervisor Gates.

There being no further business to come before the Board, the meeting was adjourned.
