Contract No. C-22-19-020-3-05 Amendment No. 5 1 AMENDMENT NO. 5 TO THE CONTRACT BETWEEN MARICOPA COUNTY ADMINISTERED BY ITS HUMAN SERVICES DEPARTMENT AND HUMAN SERVICES CAMPUS, INC. I. Maricopa County (“County”), administered by its Human Services Department, and Human Services Campus, Inc. (“Subrecipient”) entered into a financial contract (“Agreement”), containing a Start Date of January 1, 2019, for the provision of emergency weather relief accommodations for individuals experiencing homelessness at the Human Services Campus. The County provided the Subrecipient with $3,042.12 in FY19 Maricopa County General Funds for these services. The County and the Subrecipient are referred to collectively as the “Parties.” The Parties fully executed Amendment No. 1 on or about June 19, 2019, to extend the Agreement expiration date from June 30, 2019 to June 30, 2020. The Parties fully executed Amendment No. 2 on or about November 22, 2019, to increase funding by $100,000 and identify nightly reimbursement to the Subrecipient at a cost not to exceed $1,000. The Parties fully executed Amendment No. 3 on or about May 6, 2020, to extend the Agreement expiration date from June 30, 2020 to October 31, 2020 and increase funding to an amount not to exceed $219,762, with a maximum monthly billing amount not to exceed $73,254, for the purpose of providing services on County designated lots. The Parties fully executed Amendment No. 4 on June 10, 2020. Among other things, it revised oversight of Security Guard activities, provided for weather relief services, added required Agreement language, and increased funding by $49,335. II. The Parties agree to enter into this Amendment No. 5 to amend the Agreement as follows: A. Revise Paragraph 9.0 (CONTRACTOR RESPONSIBILITIES) to add Subparagraph 9.6: 9.6 The Subrecipient shall operate a COVID Overnight weather-relief shelter located at 1 West Madison Street, Phoenix, Arizona 85003 (“Shelter”). 9.6.1. At the Shelter, the Subrecipient shall: 9.6.1.1 Ensure adequate social distancing for vulnerable homeless individuals (“Clients”); 9.6.1.2 Provide staffing and security to manage shelter operations (no fewer than 4 staff and 2.5 security guards); 9.6.1.3 Ensure that all staff have appropriate training and access to first aid equipment; 9.6.1.4 Operate the Shelter from 6 p.m. to 7 a.m. daily; 9.6.1.5 Provide Clients with: 9.6.1.5.1 A code of conduct rules; 9.6.1.5.2 A fire evacuation plan; 9.6.1.5.3 No smoking in the Shelter; and 9.6.1.5.4 Social distancing; 9.6.1.6 Provide shelter services for up to 130 Clients per night; 9.6.1.7 Provide Clients with masks, drinking water, floormats, and laundry service as needed; Contract No. C-22-19-020-3-05 Amendment No. 5 2 9.6.1.8 Ensure Clients are social distancing while in the Shelter; 9.6.1.9 Provide the County with a daily count of the Clients who are provided services; 9.6.1.10 Maintain and record a daily census of Clients in HMIS; and 9.6.1.11 Report any incidents that may involve a liability issue or may leave the County open for public scrutiny by telephone to the County Community Development staff as soon as possible following occurrence/notification. B. Add that the County shall provide the Subrecipient with funding in an amount not- to-exceed $277,068 for the services identified in Subparagraph 9.6. Funding availability is from July 1, 2020, through September 30, 2020. III. The foregoing paragraphs contain all the changes made by this Amendment No.5. All other terms and conditions of the Agreement and Amendment Nos. 1, 2, 3, and 4 shall remain the same and in full force and effect as approved and amended. IV. The Parties have authorized the undersigned to execute this Amendment No. 5 on their behalf. V. This Amendment No. 5 shall be effective upon approval and signature by both Parties.
