KNOW ALL MEN BY THESE PRESENTS:
THAT WHEREAS Terrell L. Glass, an unmarried man hereinafter called the GRANTOR, the
owner of the real property situated in Maricopa County, Arizona, which property is set forth in
instrument number 20120646121 in the official records of Maricopa County (the “Burdened
Property”), for and in consideration of the sum of One Thousand Three Hundred Seventy and
No/100 DOLLARS ($1,370.00) and other valuable consideration, receipt of which is hereby
acknowledged, does hereby grant and convey to MARICOPA COUNTY, a political subdivision
of the State of Arizona, hereinafter called the GRANTEE, and to its agents, successors and
assigns, a drainage easement for the purpose of constructing and maintaining the basin and
appurtenances on, over, under and across that portion of the Burdened Property legally described
on Exhibit "A-1" and depicted in Exhibit “A-2” attached hereto (the “Easement Area”):
The GRANTEE or its agents, successors and assigns shall at all times have the right of full and
free ingress and egress to said easement for the purpose heretofore specified.
The covenants and agreements herein set forth shall extend and inure in favor and to the benefit of
and shall be binding on the heirs, successors in ownership and estate, assigns and lessees of the
respective parties hereto.
In the event the GRANTOR or GRANTOR‘S successor in interest shall at any time in the future,
develop the Burdened Property with development that includes drainage facilities approved by the
GRANTEE and the municipality or governing bodies having jurisdiction over the Burdened
Property, upon final approval of such facility or facilities, the rights granted to GRANTEE
hereunder shall terminate and expire.

That portion of the Northwest quarter of Section 15, Township 6 North, Range 5 East of the Gila and
Salt River Meridian, Maricopa County, Arizona, described as follows:
COMMENCING at the Northeast corner of Lot 187 of Tonto Hills, Book 93, page 5 M.C.R., said
point being a non-tangent curve, concave Southeast, from which the radius point bears South 65
degrees 29 minutes 09 seconds East a distance of 580.53 feet;
thence Southwesterly 2.12 feet along the East Line of Lot 187, along the arc of said curve to the left
through a central angle of 0 degrees 12 minutes 35 seconds to the POINT OF BEGINNING, said
point being a point of compound curvature of a curve having a radius of 580.53 feet;
thence Southwesterly 49.70 feet along said East Line, along the arc of said curve to the left through a
central angle of 4 degrees 54 minutes 18 seconds;
thence on a non-tangent line North 70 degrees 36 minutes 02 seconds West, 20.00 feet to the beginning
of a non-tangent curve, concave Southeast, from which the radius point bears South 70 degrees 36
minutes 02 seconds East a distance of 600.53 feet;
thence Northeasterly 17.15 feet along the arc of said curve to the right through a central angle of |
degrees 38 minutes 11 seconds;
thence on a non-tangent line South 68 degrees 57 minutes 51 seconds East, 7.00 feet to the beginning
of a non-tangent curve, concave Southeast, from which the radius point bears South 68 degrees 57
minutes 51 seconds East a distance of 593.53 feet;
thence Northeasterly 33.86 feet along the arc of said curve to the right through a central angle of 3
