Dear Toni,

This letter is to inform you that pursuant to the enclosed September 20, 2019 letter
Luke Air Force Base determined that your proposed land uses on APN 501-61-006B
and 501-61-006C are compatible and consistent with the high noise or accident
potential of the military airport or ancillary military facility, subject to the terms and
conditions noted in the September 20, 2019 letter from Luke Air Force Base. In
accordance with this determination by Luke Air Force Base, Maricopa County is able
to make a similar determination of compatibility and consistency for the proposed
land uses, thus you may proceed with the required entitlement process pursuant to
Maricopa County requirements. However, please note that this determination only
applies to the land uses, terms and conditions identified in the September 20, 2019
letter from Luke Air Force Base. Any other land uses on the subject parcel may
require additional use compatibility and consistency determinations.

Thank you for the opportunity to provide comments on the Use Compatibility and Consistency
Determination (UCCD) Application for Falcon Golf Course. The site is located on approximately 157
acres of golf course north of Camelback Road and 152nd Avenue in the Glendale planning Area. The
developer is proposing multiple uses for the properties to remain consistent with the Maricopa County
Zoning Ordinance. The parcel in the application is located within the 65Ldn, 70Ldn, 75Ldn, 801.dn and
approximately 1 acre inside the clear zone with an easement agreement dated 28 Feb 2007 in the 65 LDN
as identified by A.R.S. § 28-8461 and is within the “territory in the vicinity of a military airport” also
defined by A.R.S. § 28-8461.

A complete review indicates that the proposed uses in the UCCD application are those found in
A.R.S, §28-8481; as such this request will not have a negative impact on Luke AFB Flight Operations as
long as the developer follows the published guidance.

Luke AFB reserves the right to review/comment on final plans submitted to the County. Since
the site will be located within the “territory in the vicinity of a military airport,” it will be subjected to
approximately 170 over flights per day. We recommend you review the sound attenuation requirements
found in A.R.S. §28-8482. We also encourage an aggressive notification program on the part of the
county to inform potential developers about Luke AFB operations.

lighting height guidance from the FAA keeping their height at 110ft or less.

subjected to approximately 170 over flights per day. We recommend you review the sound attenuation
requirements found in A.R.S, §28-8482. We also encourage an aggressive notification program on the
part of the county to inform potential developers about Luke AFB operations.

Thank you for the opportunity to provide additional comments on the Military Compatibility

in the vicinity of a military airport” also defined by A.R.S. § 28-8461.

Previously we commented it would not have a negative impact on our operations (attached),
however upon further review and having been provided more in-depth details we now have several
significant concerns associated with this development and its negative impacts to Luke AFB and its
surrounding community. First, this project upon final development will heavily utilize Camelback Ave,
which is a major artery into the northwest valley and Luke AFB. Not only will there be increased traffic
in general with a high number of delivery trucks, but that increased traffic count will significantly impact
our Airmen’s access to and from their assigned work-stations on Luke AFB. Critical response times to
issues on Luke AFB will be negatively impacted. Secondly, we have a responsibility to inform all
property owners south of Luke AFB and north of Camelback Ave of their proximity to our high-explosive
munitions storage area, Although the plans for building are sited outside the Quantity Distance (QD) or
blast arc, this does not guarantee that there will be no structural damage, injuries, or even fatalities if a
mishap were to occur. The QD arc represents only an area outside which structural damage from
overpressure is expected to be minimal. If a mishap should occur, the risk of structural damage is still
present, as well as the risk of bodily injury and possible fatalities from flying debris, In such a case, the
arterial road of Camelback becomes of greater importance to first responders both on and off Luke AFB.
We believe this is a general health, safety and welfare issue that the County should take into consideration
when they review this project. :

These two issues are of significant concern to the continued safe and efficient operations at Luke
AFB, but just as important, they negatively impact the health, safety and welfare of the surrounding
community, which has supported Luke AFB over the years.

Maricopa County Case Reference MCP 2019005

Dear Ms. Pokorski:

The city of Goodyear City Council held a work session on Monday, April 13 to provide policy direction on the city’s
position on the proposed Cross Dock Industrial Project in Maricopa County. Our staff presented an overview of
the project, in addition to the necessary engineering and transportation items that remain unresolved at the current
time. The consensus of our City Council is to oppose the project based upon the following concerns.

Quality of Life: Goodyear City Council has expressed deep concern with the impacted quality of life for residents
in the adjacent neighborhoods. The proposed 24/7 operation, along with increased volumes of truck traffic on
Camelback Road, will have a negative impact on these communities.

Roadway and Infrastructure: The Traffic Impact Study (TIS) is a critical step in the development process, and it
helps to establish the types and amounts of physical roadway improvements necessary to support a project and
mitigate potential negative impacts. Our Engineering department received the second TIS submittal, less than one
hour before the start of our work session on April 13, and it is currently in our queue to review. It would be untimely
to consider this case until any roadway improvements required in the TIS were identified, and the project has been
thoroughly vetted. Furthermore, there are other significant issues that need to be resolved such as a CLOMR for
the floodplain, and also an intergovernmental agreement between the city, county, and the city of Glendale.

Respectfully, the city of Goodyear is requesting that the Maricopa County Planning Commission and the Maricopa
Board of Supervisors deny the case, in order to protect the health, safety, and welfare of the public, and especially,
those that travel on Camelback Road.

However, if the county elects to move forward, and approve this project, over the reasonable and valid objections
raised by the cities of Goodyear and Litchfield Park, we request the following stipulations be placed on the project:

1. Improvement of Camelback Road, West to Loop 303; including, but not limited to: traffic signals meeting
Goodyear standards, medians, sidewalks, landscaping, street lights, and similar normal and customary
street improvements.

2. Improvement of Camelback Road, East to 147" Drive; including, but not limited to: traffic signals meeting

Goodyear standards, medians, sidewalks, landscaping, street lights, and similar normal and customary

street improvements.

Approval of the CLOMR process through FEMA prior to the issuance of the project's first building permit.

The developer shall obtain plan approval and pull the requisite permits from the city of Goodyear prior to

any work taking place on Camelback Road.

5. No Certificates of Occupancy on any buildings within the site until such a time as the city has accepted
the Camelback Road Improvements as related to Item 1 and 2 above.

Good Morning Sean:

The City is working to understand the nature of potential impacts from
this project as it relates to both traffic and noise. The city reviewed and

commented on the 15' submission of the TIA, but we haven’t seen the
2nd submission. As you are aware a significant portion of Camelback is
within the jurisdiction of the City of Goodyear. | looked on-line this
morning again and, unless | am doing something wrong, there are 7

pages of 18 submittal info, but no 2" submittal info posted. Do you

know if there is a 2" submission of the TIA and when we may get a
copy to review?

Also, has there been any consideration related to noise impacts from
the proposed facility. What | mean is that most of these truck terminals
deploy small vehicles (tuggers) that have the back-up beeper warning.
Since there is residential close the proposed facility has the County
thought about addressing this issue?

Given the above how certain do you think it is that this application will
proceed for hearing on April 23°49

Dear Ms. Pokorski,

Litchfield Park City staff has recently become aware of a proposed development project in
Maricopa County that will adversely affect our community due to the tremendous amount of truck
traffic generated that will travel through our community. This project, KW Cross Dock Facility, is
proposed to be located at the current site of the Falcon Dunes golf course. That site is located only
one-quarter mile west of our community.

According to the Traffic Impact Study prepared by United Civil Group for the proposed Cross Dock
facility and the adjacent industrial park, nearly 4,000 additional vehicle trips per day will be added
to Camelback Road when the project is built out. Roughly 2,500 of those daily trips are projected
to travel on Camelback Road through Litchfield Park. And, most of those vehicles will be large
semi-trucks. Not only will that additional traffic overwhelm the underdeveloped portions of
Camelback Road, but such a large amount of additional truck traffic will also severely and adversely
affect our resident’s quality of life. Furthermore, we expect that many of these trucks will turn
south on Litchfield Road, which will add noise and diesel exhaust fumes to an area of the City that
is exclusively residential.

The City of Litchfield Park requests that development of this project be denied by the County.
However, should the project be approved, mitigation of the adverse effects this Cross Dock facility
will have on our residents (and those of the County and other cities) should be required by the
County Planning and Development Department by placing restrictions on the truck traffic
associated with this project, and require that all truck traffic travel only to and from the west of the
facility and utilize Loop 303 as much as possible.

Finally, we learned about this project by accident. A project this large that will result in such a
dramatic change in the area’s land uses, will generate such a large amount of traffic, and will have
severe and adverse impacts to our residents should have been brought to our attention by County
staff as soon as the project was proposed to the County.

Re: Protest and Objection - Case No. MCP20190005 SMT Investors Limited Partnership, et al -
Cross Docking Facility generally located north of the intersection of 152nd Avenue and Camelback
Road, in the Glendale area.

Dear Ms. Pokorski:

The City of Litchfield Park (City) submits its protest and objections to the above application that, if
approved, would change permitted uses on approximately 157 acres near the City from low density
residential to commercial and industrial uses through the use of a Military Compatibility Permit
(MCP) and without a rezoning process. A review of the staff report reveals that little or no
consideration has been given to compatibility with non-military facility uses in the surrounding
area.

The City of Litchfield Park is a small, quiet residential community not far from the proposed truck
cross-dock facility (Facility). The Facility will have an adverse impact on the City by substantially
increasing truck traffic on Camelback Road, much of which will travel through the City.

The City’s protest and objections are described below.

Inadequate Citizen Participation Plan: The County’s Citizen Review Process for MCPs requires that
every application for an MCP and/or Plan of Development include a citizen participation plan that
includes which residents, property owners, interested parties, political jurisdictions and public
agencies may be affected by the application. The Citizen Participation Plan submitted by the
applicant included only the following:

All property owners and homeowners associations within 300 feet of the property, other
citizens, City of Goodyear, City of Glendale, Luke Air Force Base, Maricopa County
Association of Governments, other political jurisdictions, and public agencies that may be
impacted by this application will be notified of the MCP application.
