HOME DETENTION RESOLUTION 
 
WHEREAS, A.R.S. § 11-251.15(H) grants the Board of Supervisors authority to establish 
a home detention program for use by the Justices of the Peace; and 
 
WHEREAS, home detention programs for misdemeanor DUI offenses may use 
continuous alcohol monitoring, and have been shown to have high compliance with respect to 
treatment programs and financial sanctions; and 
 
WHEREAS, a home detention program allows the offender to continue to work and the 
ability to maintain stable employment which reduces recidivism; and 
 
WHEREAS, the Maricopa County Attorney’s Office supports the establishment of a home 
detention program to promote justice and public health, reduce recidivism, and ensure the efficient 
use of county resources. 
 
WHEREAS, the Presiding Justice of the Peace supports establishing a home detention 
program, as required by 11-251.15(I); and 
 
WHEREAS, pursuant to A.R.S. § 11-251.15(H), the Board of Supervisors held a public 
hearing and found it necessary to approve the proposed home detention program; and 
 
NOW, THEREFORE, BE IT RESOLVED that the Maricopa County Board of 
Supervisors adopts Resolution No. C-06-058-M-00, the “Home Detention Resolution.”
