The statute allows for a 20- day period during which a written protest against the organization of the district may be filed by “owners of a majority of the acreage within the district.” (ARS 48-3424(B)). On June 8, 2020, the Clerk’s Office received a three-page document with the following heading: “Dec 18 2018 I Ric Murphy am asking for your support of a NO VOTE For a tax district. Sign here for a NO vote.” The three pages contained 35 signatures with partial addresses and phone numbers or email addresses. The total acreage in the proposed Evergreen District is 32.20 acres. Therefore a protest would need to contain signatures of owners representing more than 16.1 acres. The names of the signers and the addresses on the documents were compared to the Assessor’s database of property owners and acreage. The total acreage represented by the three-page document is: 12.692 acres. However, seven signatures (names) of signers did not match the names on the deeds for those 7 properties which represented 1.70 acres. Discounting these signatures would bring the acreage total down to 10.992 acres. In either case, this “protest” appears to be insufficient in representing a “majority of the acreage within the district.” Attached is a copy of the three-page document received by the Clerk’s Office.
