Chairman Sellers opened the meeting and asked the Clerk to call the roll.

The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Formal Session at 
9:30 AM on Wednesday, March 13, 2024, in the Supervisors' Auditorium, 205 W. Jefferson 
Phoenix, AZ 85003, with the following members present:  Jack Sellers, Chairman, District 1;

Supervisor Gates introduced his guest, Sheriff Skinner, to offer the invocation.

Sheriff Skinner led the Pledge of Allegiance to the flag.
Supervisor Gates thanked Sheriff Skinner for his service to Maricopa County Sheriff’s 
Department for the past 30 years. 
Supervisor Galvin echoed Supervisor Gates’ comments and thanked Sheriff Skinner 
for serving all the citizens of Maricopa County.
Chairman Sellers commented on the changes in the auditorium that have been 
implemented for the security of all present and to improve the efficiency of the meetings.

May Phan, with Maricopa County Animal Care and Control, introduced Don Johnson 
who was recently found in Chandler as a stray. She said he is a calm, friendly dog, that 
has been neutered and is ready to go to his new home today. 
Chairman Sellers asked the Clerk if there were any announcements or corrections to the 
agenda. The Clerk said there were none.

PROCLAMATION PUBLIC DEFENSE RECOGNITION WEEK
Proclaim the week of March 18, 2024, as Public Defense Recognition Week.
WHEREAS, March 18, 2024, marks the 61st anniversary of the United States Supreme 
Court’s decision in Gideon v. Wainwright; and
WHEREAS, on March 18, 1963, the United States Supreme Court ruled in Gideon that the 
United States Constitution’s Sixth Amendment right to the assistance of counsel is essential

to a fair trial, and requires the appointment of counsel for indigent defendants accused of 
felonies in state court; and
WHEREAS, the Supreme Court recognized in Gideon that “. . . lawyers in criminal courts are 
necessities, not luxuries;” and
WHEREAS, Maricopa County upholds and affirms the guarantee of the Sixth Amendment’s 
right to counsel, recognizing counsel as essential to the fairness of criminal proceedings; 
and
WHEREAS, Maricopa County Public Defense Services’ attorneys and support staff continue
to work tirelessly to provide essential, constitutionally-guaranteed legal services to those who
would not otherwise have access to representation; and
WHEREAS, Maricopa County Public Defense Services not only represents its clients but
also upholds the rights set forth in the United States Constitution.
NOW, THEREFORE, BE IT RESOLVED that the Maricopa County Board of Supervisors
does hereby proclaim that the week of March 18, 2024, shall be recognized as “Public
Defense Recognition Week” in appreciation of the essential role played by the attorneys and
staff of Public Defense Services in upholding the Sixth Amendment guarantee of counsel 
and protecting the fundamental right to a fair trial.

Commission Recommendation:  On 2/8/24, the Commission voted 7-1 to adopt a motion 
recommending the Board of Supervisors approve Z2023119 subject to conditions ‘a’ – ‘h’:
a. Development of the site shall be in substantial conformance with the zoning exhibit entitled
“AES Westwing IIB BESS Zoning Exhibit”, consisting of two full-size sheets, dated January 
16, 2024, and stamped received January 16, 2024, except as modified by the following 
conditions. Staff may determine slight refinements to remain in substantial conformance with
the approved site plan.  Minor and major amendments to the site plan will be determined in 
accordance with Chapter 3 of the Maricopa County Zoning Ordinance.
b. Development of the site shall be in substantial conformance with the narrative report 
entitled “AES Clean Energy, LLC Project Narrative”, consisting of 12 pages, dated January 
16, 2024, and stamped received January 16, 2024, except as modified by the following 
conditions.
c. The following Planning Engineering conditions shall apply:
1. Without the submittal of a precise plan of development, no development approval is
inferred by this review, including, but not limited to number of proposed building lots/units, 
drainage design, access and roadway alignments. These items will be addressed as 
development plans progress and are submitted to the County for further review and/or 
entitlement.
2. A traffic impact study must be submitted with future entitlement (POD or Preliminary Plat)
application(s) or a TIS waiver obtained from MCDOT.
3. Engineering review of re-zone cases is conceptual in nature. All development and 
engineering design shall be in conformance with Section 1205 of the Maricopa County 
Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa 
County; MCDOT Roadway Design Manual; and current engineering policies, standards and
best practices at the time of application for construction.

d. The following IND-2 IUPD standards shall apply for use of the site as a BESS facility:
1. Minimum setback of 100’ required for battery storage containers.
2. 14’ minimum height for perimeter screening (8’ solid masonry wall with 6’ intrusion 
detection system).
3. Parking spaces not required.
4. Reverse motion of a vehicle into right-of-way allowed.
5. Stabilized DG surfacing for internal circulation and driveways.
e. Administrative approval of a plan of development will be required prior to approval and 
issuance of construction permits to develop and establish use of the site. Prior to issuance 
of a building permit, written confirmation will be required from the emergency fire protection 
jurisdiction having authority that the facility has been designed in accordance with their 
regulations and requirements, and that emergency fire protection service will be provided to
the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction 
review and approval will be required.
f. Noncompliance with any Maricopa County regulation shall be grounds for consideration of 
initiating a revocation of this zone change as set forth in the Maricopa County Zoning 
Ordinance.
g. The property owner/s and their successors waive claim for diminution in value if the County
takes action to rescind approval due to noncompliance with conditions.
h. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, the property shall revert 
to the zoning that existed on the date of application.  It is, therefore, stipulated and agreed 
that either revocation due to the failure to comply with any conditions, does not reduce any 
rights that existed on the date of application to use, divide, sell or possess the property and 
that there would be no diminution in value of the property from the value it held on the date 
of application due to such revocation of the zone change.  The zone change enhances the 
value of the property above its value as of the date the zone change is granted and reverting 
to the prior zoning results in the same value of the property as if the zone change had never
been granted.

“Zoning Exhibit“, consisting of one full-size sheet, dated November 16, 2023, and stamped 
received November 17, 2023, except as modified by the following conditions. 
b. Development of the site shall be in substantial conformance with the narrative report 
entitled “Village @ Waddell”, consisting of eight pages, dated November 16, 2023, and 
stamped received December 13, 2023, except as modified by the following conditions.
c. The development shall contain a minimum of 13 acres that will be a mix of active and 
passive open space. 
d. The development shall not have access to the adjacent Clearwater Farms community to 
the north and west of the site unless one is required as a gated emergency access by a fire 
protection provider.

e. The existing drainage ditches around the site’s perimeter shall be maintained and not tiled
over to preserve the rural character of the area. 
f. The master developer shall notify future homeowners that they are located within the state-
defined “territory in the vicinity of a military airport” with the following language:
“You are buying a home or property in the ‘vicinity of a military airport’ as described by State 
of Arizona statute ARS §28-8481. Your house should include sound attenuation measures 
as directed by State law. You will be subject to direct overflights and noise by Luke Air Force
Base jet aircraft in the vicinity.
Luke Air Force Base executes over 200,000 flight operations per year, at an average of
approximately 170 overflights per day. Although Luke's primary flight paths are located within 
20 miles from the base, jet noise will be apparent throughout the area as aircraft transient to
and from the Barry M. Goldwater Gunnery Range and other flight training areas.
Luke Air Force Base may launch and recover aircraft in either direction off its runways 
oriented to the southwest and northeast. Noise will be more noticeable during overcast sky 
conditions due to noise reflections off the clouds.
Luke Air Force Base's normal flying hours extend from 7:00 a.m. until approximately 
midnight, Monday through Friday, but some limited flying will occur outside these hours and 
during most weekends.
Such notification shall be recorded on all Final Plats, be permanently posted on not less than
a three-foot by five-foot sign in front of all home sales offices, be permanently posted on the
front door of all home sales offices on not less than an 8½-inch by eleven-inch sign, and be 
included in all covenants, conditions, and restrictions (CC&Rs) as well as the Public Report 
and conveyance documents.
For further information, please check the Luke Air Force Base website or contact the 
Maricopa County Planning and Development Department.”
g. All habitual buildings shall be constructed within this site shall be constructed to attain a
noise reduction level as per ARS § 28-8482(B).
h. The following Planning Engineering conditions shall apply: 
1. Without the submittal of a precise plan of development, no development approval is
inferred by this review, including, but not limited to drainage design, access, and roadway
alignment(s). These items will be addressed as development plans progress and are 
submitted to the County for further review and/or entitlement. 
2. A traffic impact study must be submitted with the preliminary plat application. 
3. Dedication of right-of-way along the following roadway alignments shall be required as 
part of the subdivision plat. Additional right-of-way may be required to accommodate turn 
lanes and signalization based on the MCDOT-approved traffic study:
Citrus Road:   55 feet half-width
Bethany Home Road:        55 feet half-width

4. Prior to any final plats the applicant must formally abandon the north/south right-of-way 
along the 181st Avenue alignment (road rights as per the Romola recorded subdivision plat 
(MCR # 19-07)) in accordance with the County road abandonment requirements. 
5. The applicant is responsible for coordinating improvements and dedications with the 
Maricopa Water District (or the appropriate purveyor as the case may be) who appear to own
or maintain irrigation facilities within the site and along the site’s perimeter. There may be 
public or private rights associated with the historic use and conveyance of irrigation water 
within said irrigation facilities which the County does not regulate. Any disputes that may 
arise concerning any irrigation purveyor’s land rights may be superior to the County’s. 
6. Engineering review of planning and/or zoning cases is for conceptual design only and 
does not represent final design approval nor shall it entitle applicants to future designs that 
are not in conformance with Section 105 of the Maricopa County Zoning Ordinance and 
Drainage Policies and Standards; Floodplain Regulations for Maricopa County and the 
MCDOT Roadway Design Manual.
i. The following R1-10 RUPD development standards shall apply:
1. There shall be a maximum building height of 24 feet (single-story) for any lot or tract within
100 feet of the perimeter of this zoning district, which shall be noted on any plat. 
2. There shall be a minimum landscape setback of 24 feet along the south and west 
perimeter of this zoning district.
3. There shall be a minimum landscape setback of 100 feet along the east perimeter of this 
zoning district.
4. There shall be a minimum landscape setback of 85 feet along the north perimeter of this 
zoning district. 
5. There shall be a minimum front yard setback of 15 feet. 
6. There shall be a minimum side yard setback of five feet. 
7. There shall be a minimum rear yard setback of 20 feet. 
8. There shall be minimum lot widths of 40 feet. 
9. There shall be minimum lot areas of 7,000 sq. ft. 
10. Any lot within 100 feet of the north, south, and west perimeter of this zoning district shall 
have a minimum lot area of 18,000 sq. ft. which shall be noted on any plat. 
j. Noncompliance with any Maricopa County Regulation shall be grounds for consideration

COMMUNITY SOLUTIONS FUNDING
Authorize the Community Solutions Funding Proposal request for the Gila Bend Fire 
Department to purchase medical and safety equipment in the amount of $132,434.00 with 
an expected start date of March 13, 2024, and an expected end date of December 31, 2024.
The Board of Supervisors’ Community Solutions Funding (CSF) is primarily intended to cover 
the cost of initiatives that carry the potential of advancing Maricopa County’s Strategic Goals
and provide a clear public benefit for Maricopa County residents.  The Associated Maricopa
County Strategic Goal is: Safe Communities.
Pursuant to A.R.S. 42-17106(B), authorize the following appropriation adjustments to the FY 
2024 budget:

1. Decrease the expenditure authority in the Non Departmental (D470) General Fund (100) 
Non Recurring (NRNP) budget in the line “Community Solutions Funding” (4711) by 
$132,434.00

Non Recurring (NRNP) budget in the line “D5 – Community Solutions Funding” (4765) by 
$132,434.00
These actions will have a net zero impact on the County-wide budget and do not alter the 
budget constraining the expenditure of local revenues duly adopted by the Board pursuant 
to A.R.S. 42-17105.

The Board of Supervisors’ Community Solutions Funding (CSF) is primarily intended to cover 
the cost of initiatives that carry the potential of advancing Maricopa County’s Strategic Goals
and provide a clear public benefit for Maricopa County residents. The associated Maricopa 
County Strategic Goal is: Regional Services.
Pursuant to A.R.S. 42-17106(B), authorize the following appropriation adjustments to the FY 
2024 budget:
1. Decrease the expenditure authority in the Non Departmental (D470) General Fund (100) 
Non Recurring (NRNP) budget in the line “Community Solutions Funding” (4711) by $8,000.

Attorney Grants (219) Operating (OPER) budget by $1,438,272. 
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore expenditure of the revenues is not prohibited by the budget law.
These actions will have a county-wide net impact of zero, and they do not alter the budget 
constraining the expenditures of local revenue duly adopted by the Board pursuant to A.R.A

The grant allows a 0% rate for administrative or indirect costs. The Maricopa County

Approve the purchase and permanent additions to fleet of 21 vehicles: six (6) semi-trucks 
(tractor), three (3) refrigerated trucks, four (4) trailers and eight (8) refrigerated trailers. These
vehicles are currently being leased from Penske Truck Leasing Co, LP under County
contract #180195. Penske will no longer offer a governmental leasing program in Arizona at 
the termination of this Contract. MCSO would like to exercise the option to purchase the 
equipment, under Section 2.3.2 of the Contract, for a total cost of $1,182,250.00 plus 
applicable taxes and fees by the termination of the contract May 31, 2024.      
Also approve an exemption from markings for these vehicles. These are all 2019 vehicles 
and will be used by MCSO Distribution Services. The vehicles are used to transport inmate 
meals to MCSO jail facilities, deliver Warehouse orders to MCSO locations throughout 
Maricopa County and occasionally pickup donated food items. The vehicles have low 
mileage and will be operational for at least five more years.  
   
The Detention Fund (255) will purchase these vehicles and support its annual operations 
that are estimated to be $20,000 per truck and $7,500 per trailer for a total of $270,000 per 
year.

AMENDMENT TO AGREEMENT FOR DONATION FROM THE ARIZONA PROPANE 
GAS ASSOCIATION (APGA) FOR THE PROPANE FIRE PIT PROGRAM
Approve and authorize the Chairman to execute an Amendment No. 5 to the Agreement 
between the Maricopa County Air Quality Department (MCAQD) and the Arizona Propane
Gas Association (APGA) for APGA to continue to spend remaining and previously approved 
restricted donated matching funding to MCAQD for the Propane Fire Pit Program and accept 
the funds.
This Agreement will provide for continued use of matching funds to support MCAQD’s 
Propane Fire Pit Program which encourages the exchange of wood burning fire pits for 
cleaner burning propane gas devices, to aid in the reduction of particulate matter 2.5 (PM 
2.5) during the wood burning season. This program will be marketed to all County residents 
and will offer through e-mail a voucher which can be taken to select Home Depot stores 
within Maricopa County for a discount on a propane fire pit.  There will be a $50.00 discount
provided by the County and a $25.00 discount provided by the APGA, for a total of $75 per 
program participant.  The program is limited to a total of 1,000 vouchers redeemed.  The 
term of this Amendment shall commence on the Effective Date and end no later than April 
1, 2024.
PM 2.5 is an EPA pollutant that is known to cause damaging health issues, including acute
asthma symptoms leading to hospitalization and heart disease, as the tiny pollutant can
deposit deep into the lungs and enter the blood stream. If PM 2.5 should exceed the EPA 24
hour or annual standard, this could lead to more stringent regulations and negative economic
impact for Maricopa County.  
Previously donated revenue funds of $27,500 were deposited into Fund 504 when they were
received. This amendment is to use remaining funding available.  Donation funds are not
local revenues for the purpose of the constitutional expenditure limitation; therefore, 
expenditures of these revenues are not prohibited by the budget law. The approval of this 
action requested does not alter the budget constraining the expenditures of local revenues 
duly adopted by the Board pursuant to ARS 42-17105.  This county-wide program is in all 
districts.

COMMUNITY
Pursuant to the Board’s Resolution regarding Processing of Tribal Gaming Fund 
Applications, dated May 31, 2016 (“Gaming Resolution”), Maricopa County is the 
administrative pass-through for tribal gaming applications (“Applications”) received pursuant 
to the State of Arizona Department of Gaming Compact (“Compact”). The Applications seek
funds for services that benefit the general public, including public safety, mitigation of the 
impacts of gaming, or promotion of commerce and economic development. Pursuant to the 
Board’s Gaming Resolution, Maricopa County defers substantive review of the Applications 
to the Tribal authorities and places these matters on the consent agenda. Pursuant to the 
Compact, Sections 12(b) and (d), the Tribe shall perform the substantive review of 
applications and ensure 12% of its contributions under the Compact go to services that

Chairman Sellers asked the Clerk if there was anything to report regarding Public 
Comment email responses. The Clerk said several emails were received and all have 
been shared with the Board offices. The Clerk said she received four speaker slips and 
she delivered them to the Chairman.
Florence Smith, resident, commented on the partisan divide in voting. She talked about 
elections and tabulation fraud. She said in her research for writing her book, she found 
there were ballots in question and duplication suspected.
Dennis Hudson is a resident of Mobile, AZ and his family has resided there since the 
1920s. He spoke about the annexation with Goodyear in 2006 and that was supposed 
to support the community services. He was told that there would be money coming to 
the community and he has not seen it and wants to know why.
Blue Crowley, resident, comments on RPTA Audit and Finance, and he went to their 
office and was not allowed to give input. Mr. Crowley talked about an appointment he 
went to in the west valley and noticed there were very few buses on the congested 
roadway. When he spoke at an RPTA meeting, he was asked to step away when his 
three minutes were up.
Dianne Barker, resident, shared a good news story when she recently lost her phone, 
and she was able to get it back by asking around. She said, as an advocate of women’s 
rights, today she honors Susan B. Anthony who was an advocate of the 19th 
amendment.  Ms. Barker also mentioned that today in history, Brianna Taylor was killed, 
reminding us that no-knock search warrants are wrong.

Supervisors'/County Manager's summary of current events - Resumen de temas de 
actualidad de los Supervisores/Administrador del Condado
Supervisor Hickman said a few weeks ago, he went out to see the Sun City West Prides, 
a volunteer organization in Sun City. The Maricopa County Department of 
Transportation bought everyone lunch. Supervisor Hickman said he was honored to be 
invited and is proud of the volunteerism in that community. He mentioned Luke Days 
coming to Luke Airforce Base on March 23 & 24, 2024.

Supervisor Galvin said thank you to security for being at the meeting today. There was 
a brief interruption from the audience. Supervisor Galvin commented on the new East 
Valley Animal Shelter that is under construction. He thanked Val Beckett, Deputy 
County Manager, and the Director of MCACC for all the work they have done for Animal 
Care and Control.
Supervisor Gallardo commented on the beautiful weather and the ability to get out to 
the various events and interact with Gila Bend and other communities. The Laveen 
BBQ is another great event in their 72nd year. Tolleson had their Latin Music Festival 
which is another opportunity for the community to learn about services. Nascar Shriner 
500 at Phoenix International Raceway is coming soon too.
Supervisor Gates echoed the thank you for Security today. He also took the opportunity 
to thank Supervisor Hickman for his service. He said he plans to attend Luke Days with 
his family. Supervisor Gates also said thank you to Elections for the Jurisdictional 
Elections. 
Supervisor Gallardo added a comment to say a record turnout is anticipated for 
elections this year.
Chairman Sellers took a moment to clarify the adjournment of the meeting dated 
February 26, 2024. He stated he did not, nor has he ever, adjourned a meeting of the 
Board of Supervisors to attend another meeting.
