ADOPTION OF RESOLUTION RE:  PURCHASE OF DISPOSED PROPERTY

WHEREAS, Maricopa County, a political subdivision of the State of Arizona (COUNTY), acquired 
title  to  Maricopa  County  Highway  Department  (MCHD)  project  parcel  D18438  (PROPERTY)  via  that 
certain  Warranty  Deed  filed  of  record  as  Document  Number  91‐475531  in  the  Maricopa  County 
Recorder’s Office (MCRO) on October 10, 1991; and 
 
WHEREAS, MCHD constructed its Buckeye Operation and Maintenance Yard (BUCKEYE YARD) on 
a portion of the PROPERTY; and    
WHEREAS, on or about October 13, 2016, at the request of an interested party, the Maricopa 
County  Department  of  Transportation  (MCDOT),  successor  in  name  to  MCHD,  determined  that  the 
unimproved remainder of the PROPERTY was no longer needed for a public purpose; and  
WHEREAS, on November 16, 2016, the COUNTY Board of Supervisors, through agenda item C‐
64‐17‐049‐M‐00 declared an approximately 5‐acre portion of the PROPERTY as excess to the COUNTY’S 
needs; and    
WHEREAS, pursuant to Arizona Revised Statutes (A.R.S.) § 11‐251, the COUNTY offered to sell 
the excess parcel at public auction; and 
 WHEREAS,  pursuant  to  a  successful  auction,  the  COUNTY  sold  the  excess  parcel  to  Value 
Leasing LLC, an Arizona Limited Liability Company, in exchange for $260,000.00, via that certain Special 
Warranty Deed filed of record as Document Number 2017‐0649348 in the MCRO on August 31, 2017; 
and 
WHEREAS, the COUNTY has discovered an error in the mapping of the parcel declared excess to 
the COUNTY’S needs through agenda item C‐64‐17‐049‐M‐00, so that improved portions of the BUCKEYE 
YARD were inadvertently declared excess to the COUNTY’S needs; and 
WHEREAS, a 31,964 square foot (0.734 acre) portion of the PROPERTY is needed for a public 
purpose as part of the BUCKEYE YARD; and  
WHEREAS,  an  easement  over  an  additional  3,768  square  foot  (0.087  acre)  portion  of  the 
PROPERTY is also needed for a public purpose to provide the COUNTY with the ability to maintain the 
COUNTY’S wall; and  
 
WHEREAS, the COUNTY Board of Supervisors has determined that the portions of the PROPERTY 
inadvertently declared excess to the COUNTY’S needs are in fact needed for a public purpose and are 
not excess to the COUNTY’S needs.  
NOW THERFORE, IT IS RESOLVED that the fee simple estate of the lands located within a 31,964 
square foot (0.734 acre) portion of the PROPERTY, and an easement over an additional 3,768 square 
foot  (0.087  acre)  portion  of  the  PROPERTY,  which  are  described  and  depicted  on  Exhibits  A  and  B

attached to this resolution, are not excess to the COUTY’S needs and are needed for a public purpose; 
and  
BE IT FURTHER RESOLVED that the COUNTY, acting on behalf of MCDOT, is hereby authorized to 
appraise and acquire the land and land rights described herein for a public purpose; and  
 BE IT FURTHER RESOLVED that, pursuant to A.R.S. § 11‐251, the COUNTY, acting on behalf of 
MCDOT, is hereby authorized to appraise and acquire the land and land rights described herein for a 
public purpose; and 
 BE IT FURTHER RESOLVED that the Chairman of the COUNTY Board of Supervisors is granted 
the authority to execute any and all documents necessary to acquire the required land and land rights 
on behalf of the COUNTY.
