Chairman Sellers opened the meeting and asked the Clerk to call the roll.

ROLL CALL - LISTA
The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Formal Session at 
9:30 AM on Wednesday, February 28, 2024, in the Supervisors' Auditorium 205 W. Jefferson 
Phoenix, AZ 85003, with the following members present:  Jack Sellers, Chairman, District 1;  
Thomas Galvin, Vice Chairman, District 2 (remote);  Bill Gates, Supervisor, District 3;  Clint 
Hickman, Supervisor, District 4;  Steve Gallardo, Supervisor, District 5 (entered meeting late). 
Also present: Juanita Garza, Clerk; Mia Vargas, Minutes Coordinator; Jen Pokorski, County 
Manager; Andrea Cummings, Legal Counsel.

INVOCATION - INVOCACIÓN
Vice Chairman Galvin introduced his guest, Jay Swart, a retired police commander and 
he represents District 2 on the Planning and Zoning Commission. Vice Chairman Galvin 
thanked Mr. Swart for his time in law enforcement.
Mr. Swart offered the invocation.

PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA
Mr. Swart led the Pledge of Allegiance to the flag. 
Vice Chairman Galvin thanked Mr. Swart for coming to the meeting. He said Mr. Swart 
loves his country, his community and has served his neighbors in a variety of ways 
these past few decades. He thanked him for his work on the Maricopa County Planning 
and Zoning Commission.

Chairman Sellers asked the Clerk if there were any announcements or corrections to

Site Location:  Southeast Corner of Country Club Rd. and Lehi Rd. in the Mesa area
Commission Recommendation:  On 1/25/24, the Commission voted 6-0 (Chairman 
Hernandez recused) to adopt a motion recommending the Board of Supervisors approve 
Z2023053 subject to conditions ‘a’ – ‘j’: 
a. Development of the site shall be in substantial conformance with the site plan entitled “A 
New Leaf #Z2023053“, consisting of one full-size sheet, dated December 18, 2023, and 
stamped received December 19, 2023, except as modified by the following conditions. Staff
may determine slight refinements to remain in substantial conformance with the approved 
site plan. Minor and major amendments to the site plan will be determined in accordance 
with Chapter 3 of the Maricopa County Zoning Ordinance.
b. Development of the site shall be in substantial conformance with the narrative report 
entitled “A New Leaf East Valley Men’s Center”, consisting of six pages, dated December 
18, 2023, and stamped received December 19, 2023, except as modified by the following 
conditions.
c. The following IND-2 IUPD standards shall apply:
1. Minimum of 1 parking spaces required for every 4 sleeping rooms. 
2. Minimum 1 parking space required for 525 sq. ft. of office space
3. Screening: Min. 6’ decorative perforated steel panel fence on the north portion abutting 
rural residential zoning boundary
4. Sight Visibility Triangles: 15 x 15 
d. The following Planning Engineering conditions shall apply:
1. If/when the existing septic system fails, if there is no reserve location on the site, the 
existing septic system must be exacted and replaced, including select fill for the entire leach
bed system.
2. Engineering review of planning and/or zoning cases is for conceptual design only. All 
development and engineering design shall be in conformance with Section 1205 of the
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for construction.
3. Based on the conceptual design nature of the information submitted, changes to the site 
layout may be necessitated by the final engineering design of the site’s drainage 
infrastructure.
4. Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with the 
application for Building Permits.

e. The applicant/property owner shall finalize a lot combination of parcel 136-17-043D and 
136-17-043C prior to obtaining building permits.
f. All outdoor lighting shall be in conformance with the provisions listed in Section 1112 of 
the Maricopa County Zoning Ordinance. Any outdoor lighting shall be placed so as to reflect
away from any adjoining rural or residential zoning district.
g. Any amendments to the zone change shall be processed as revised application in 
accordance with Maricopa County Zoning Ordinance requirements.
h. Noncompliance with any Maricopa County regulation shall be grounds for initiating 
revocation of this zone change as set forth in the Maricopa County Zoning Ordinance. 
i. The property owner/s and their successors waive claim for diminution in value if the County
takes action to rescind approval due to noncompliance with conditions.
j. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, the property shall revert 
to the zoning that existed on the date of application.  It is, therefore, stipulated and agreed 
that either revocation due to the failure to comply with any conditions, does not reduce any 
rights that existed on the date of application to use, divide, sell, or possess the property and
that there would be no diminution in value of the property from the value it held on the date 
of application due to such revocation of the zone change. The zone change enhances the

WHITE TANK ENERGY STORAGE

Zone change from Rural-43 to IND-2 IUPD 
Site Location:  Generally located at the NEC of El Mirage Rd. and Indian School Rd. in the 
West Phoenix/Avondale area
Commission Recommendation:  On 1/25/24, the Commission voted 7-0 to adopt a motion 
recommending the Board of Supervisors approve Z2023142 subject to conditions ‘a’ – ‘j’: 
a. Development of the site shall be in substantial conformance with the narrative report 
entitled “Zone Change with Overlay – White Tank Energy Storage”, consisting of 12 pages,
dated 12/21/2023, and stamped received 12/26/2023, except as modified by the following 
conditions.
b. Development of the site shall be in substantial conformance with the zoning exhibit entitled
“White Tank Energy Storage Zone Change with Overlay Site Plan“, consisting of 6 full-size 
sheets, dated 12/26/202, except as modified by the following conditions.
c. Prior to issuance of initial building permits, the applicant must provide a report to Maricopa
County Planning & Development and Arizona Game & Fish Department regarding the 
existence of any animals covered under the Migratory Bird Treaty Act. If such animals are
detected on-site, the applicant must contact the Arizona Game & Fish Department and the 
U.S. Fish and Wildlife Service and provide a further report to the County regarding the results 
of such consultation.
d. The following IND-2 IUPD standards shall apply: 
Additional Regulations (MCZO Section 902.9.1)- The activities and operations associated 
with the BESS staging area use and activities are not required to be conducted within a 
completely enclosed building.
Parking (MCZO Section 1102) - Office: 1 space per 750 sf., Industrial: 1 space per 1,200 sf.
Perimeter Screening (Side & Rear abutting a rural or residential zoning district) – Min. 6’ 
chain link fencing.
e. Prior to issuance of initial building permits, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been designed in 
accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, local 
fire protection jurisdiction review and approval will be required.
f. Prior to issuance of initial building permits, a lot split shall be processed to create a single,
separate parcel matching the zone change area.

g. The following Planning Engineering conditions shall apply:
1. Without the submittal of a precise plan of development, no development approval is
inferred by this review, including, but not limited to number of proposed building lots/units, 
drainage design, access and roadway alignments. These items will be addressed as 
development plans progress and are submitted to the County for further review and/or 
entitlement.
2. A Preliminary Grading and Drainage Plan and Drainage Report are required with the Plan
of Development. The Maricopa County Zoning Ordinance (MCZO) required that all 
commercial submittals be prepared by a Civil Engineer registered in the State of Arizona. 
(MCZO 1205.7.2)
3. For retention volumes required, please see section 6.10.5 of the Maricopa County 
Drainage Policies and Standards Manual for the equation, V=C*(P/12)*A. The 100-year, 2-
hour rainfall depth (P) in inches can be taken from NOAA Atlas 14. The volumes, using this 
equation, vary slightly compared to the drainage report and does not affect the overall 
volume provided. This can be addressed during the Plan of Development.
4. See https://apps.pnd.maricopa.gov/plansubmittalchecklist for the most up to date 
interactive Engineering Plan Review checklist. (Please be sure to check commercial and all 
related grading matters so the checklist expands properly).
5. This site contains Special Flood Hazard Areas (FEMA Zone AH) along the proposed 
access route and within the site.
6. Any development in the floodplain will require a floodplain use permit issued concurrent 
with building permit(s) required for site development. Structures in the floodplain must be
elevated to the regulatory flood elevation determined by the engineer.
7. The site is adjacent to lands owned or encumbered by the Flood Control District. In 
addition to floodplain use permitting, ROW permitting may be required by the District.
8. Please see MCDOT TIS approval attached. A traffic impact study must also be submitted
with future entitlement (POD) application(s).
9. Gated access(es) must provide an adequate turnaround area so that vehicles will not back
onto public roads.
10. The City of Phoenix maintains a +/- 45’ strip annexation north of Indian School Road. 
The applicant will be responsible for coordinating with the City to review any permitting 
requirements for work in their jurisdiction.
11. The subject site is located within the County’s Urbanized Area and thus will require a 
Storm Water Pollution Prevention Permit (SWPPP) from the County for any disturbance one
(1) acre or more. The SWPPP is issued by the County (PND) and will be required prior to
issuance of any building permits required for site development.
12. Engineering review of re-zone cases is conceptual in nature. All development and
engineering design shall be in conformance with Section 1205 of the Maricopa County 
Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa 
County; MCDOT Roadway Design Manual; and current engineering policies, standards and
best practices at the time of application for construction.

h. Noncompliance with any Maricopa County regulation shall be grounds for initiating a
revocation of this zone change per the process set forth in the Maricopa County Zoning

& Zoning Commission and Board of Supervisors, as set forth in the Maricopa County Zoning

specific noncompliance issue) and cure periods and shall be subject to required public 
hearings before the Planning & Zoning Commission and Board of Supervisors, as set forth 
in the Maricopa County Zoning Ordinance. It is, therefore, stipulated and agreed that either

Request: Zone change with overlay from Rural-43 to R1-6 RUPD for a single-family 
residential subdivision
Site Location: Northeast corner of 73rd Ave. and Thunderbird Rd. in the Peoria area
Commission Recommendation:  On 1/11/24, the Commission voted 8-0 to adopt a motion 
recommending the Board of Supervisors approve Z2022068 subject to conditions ‘a’ – ‘g’: 
a. Development of the site shall be in substantial conformance with the Zoning Exhibit 
entitled “The Ville (73rd Ave. & Thunderbird Rd.)”, consisting of one full-size sheet, dated 
September 28, 2023, and stamped received November 1, 2023, except as modified by the 
following conditions.  
b. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “The Ville – Single-Family Residential Neighborhood”, consisting of eight pages, 
dated November 1, 2023, and stamped received November 1, 2023, except as modified by 
the following conditions.
c. Before the approval of the initial final plat or precise plan of development, the applicant 
shall provide the Maricopa County Planning and Development Department with an executed
pre-annexation service agreement with the City of Peoria that identifies in detail when the 
proposed project will be annexed and the provision of water and sewer service.  In place of 
a pre-annexation service agreement the developer must provide a ‘will serve’ letter from the
certificated water and sewer provider.
d. The following Planning Engineering conditions shall apply:
1. APNs 200-68-020L, 200-68-020P, and 200-68-020S are located within the jurisdiction of 
the City of Peoria (strip annexed area) and the City must approve any zone change proposal 
within their confines.
2. Thunderbird Rd. and 73rd Ave. are within the jurisdiction of the City of Peoria. The 
applicant is responsible for coordinating with the City to review any traffic impact, right-of-
way dedication, permitting, or roadway improvement requirements.
3. Without the submittal of a Plan of Development, no development approval is inferred by 
this review, including, but not limited to number of proposed building lots/units, drainage 
design, access, and roadway alignments. These items will be addressed as development 
plans progress and are submitted to the County for further review and/or entitlement.
4. Engineering review of re-zone cases is conceptual in nature. All development and 
engineering design shall be in conformance with Section 1205 of the Maricopa County 
Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa 
County; MCDOT Roadway Design Manual; and current engineering policies, standards, and
best practices at the time of application for construction.
e. The following R1-6 RUPD development standards shall apply: 
1. Minimum front yards of ten feet for any side entry garage or forward living product. 
2. Minimum rear yards of fifteen feet. 
3. Minimum lot width of 50 feet.
4. Maximum lot coverage of 55 percent. 
5. At least 15% of the area of any plat shall be set aside as common open space.

6. Lots with narrow throats containing a driveway extending from either street knuckles or 
cul-de-sacs shall have actual building envelope delineated on subdivision plats so that 
excluding the area of the narrowed throat the lot proper will meet a minimum 50-foot width 
and minimum 6,000 square foot area. Such lots shall have a throat of at least 20 feet wide 
and shall be no longer than 100 feet along its greatest dimension. 
f. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. 
g. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, it may be considered 
for revocation by the Board of Supervisors, upon recommendation by the Commission, to 
the previous Rural-43 zoning category. It is, therefore, stipulated and agreed that either 
revocation due to the failure to comply with any conditions, does not reduce any rights that 
existed on the date of application to use, divide, sell or possess the property and that there 
would be no diminution in value of the property from the value it held on the date of 
application due to such revocation of the Zone Change.  The Zone Change enhances the 
value of the property above its value as of the date the Zone Change is granted and reverting 
to the prior zoning results in the same value of the property as if the Zone Change had never
been granted.

Chairman Sellers asked Tom Ellsworth, Director of Planning and Development, and 
Darren Gerard, Planning Division Manager, to come forward.
Mr. Ellsworth reviewed the item for the Board. The request was for a zone change from 
Rural-43 to R1-6 RUPD. He said the item was continued indefinitely in March of 2023, 
and since then, the applicant has revisited the site, received neighborhood feedback, 
and revised the application. The application was reduced from 80 townhomes to 19 
single-family homes. Mr. Ellsworth said it was heard by the Planning and Zoning 
Commission at the January 11, 2024, hearing and there was one individual who 
expressed concerns. He noted the Planning and Zoning Commission did recommend 
approval with stipulations listed on the staff report with a vote 8 to 0.

Applicant, Ashley Marsh, with Gammage & Burnham, P.L.C., referenced the March 
2023 hearing. 
Ms. Marsh reviewed the slide above and she highlighted the developer’s revised 
proposal for the site based on the neighborhood feedback and working with County

Development, who work in luxury home developments.

Site Location:  Generally located 500’ west of the SWC of Pete Road and Eagle Eye Road

Commission Recommendation:  On 1/25/24, the Commission voted 6-0 to adopt a motion 
recommending the Board of Supervisors approve Z2022171 subject to conditions ‘a’ – ‘n’: 
a. Development of the site shall be in substantial conformance with the site plan entitled 
“Gambler’s Row“, consisting of nine full-size sheet, dated March 7, 2023, and stamped 
received April 13, 2023, except as modified by the following conditions. Staff may determine
slight refinements to remain in substantial conformance with the approved site plan. Minor 
and major amendments to the site plan will be determined in accordance with Chapter 3 of 
the Maricopa County Zoning Ordinance.
b. *Development of the site shall be in substantial conformance with the narrative report 
entitled “Narrative Report for Gambler’s Row”, consisting of sixteen pages, dated December
21, 2023, and stamped received December 28, 2023, except as modified by the following 
conditions.
c. A 6 foot solid CMU wall shall be provided along the east property line to serve as screening 
from the development. 
d. The following Planning Engineering conditions shall apply:
1. Engineering review of planning and/or zoning cases is for conceptual design only. All 
development and engineering design shall be in conformance with Section 1205 of the
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for construction.
2. Based on the conceptual design nature of the information submitted, changes to the site 
layout may be necessitated by the final engineering design of the site’s drainage 
infrastructure.
3. Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with the 
application for Building Permits.

e. *This special use permit is valid for a period of ten (10) years and shall expire on February 
28, 2034 or upon the termination of the use for a period of 90 or more days, whichever occurs 
first. All site improvements associated with the special use permit shall be removed within 
90 days of such expiration or termination of use. 
f. *Event operation hours shall be from 8:00 a.m. to 10:00 p.m. daily.
g. *All outdoor lighting shall be in conformance with the provisions of Section 1112 of the 
Zoning Ordinance and shall be shielded directed downward 20-degrees below the horizontal 
plane at bottom of light fixture and shall not shine onto adjacent properties. Parking lot 
lighting and related facility lighting shall be shut off by 11:00 p.m.
h. *All outdoor speakers shall be directed south away from residential areas located north of
the site. 
i. Noncompliance with any Maricopa County regulation or ordinance shall be grounds for 
initiating revocation of this SUP as set forth in the Maricopa County Zoning Ordinance. 
j. The property owner/s and their successors waive claim for diminution in value if the County
takes action to rescind approval due to noncompliance with conditions.
k. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, and at the time of 
expiration of the Special Use Permit, the property shall revert to the zoning that existed on
the date of application.  It is, therefore, stipulated and agreed that either revocation due to 
the failure to comply with any conditions, or the expiration of the Special Use Permit, does 
not reduce any rights that existed on the date of application to use, divide, sell or possess 
the property and that there would be no diminution in value of the property from the value it 
held on the date of application due to such revocation or expiration of the Special Use Permit.
The Special Use Permit enhances the value of the property above its value as of the date 
the Special Use Permit is granted and reverting to the prior zoning results in the same value
of the property as if the Special Use Permit had never been granted.
l. A water truck shall be employed to control dust within arenas and on site.
m. The operator show notify all persons entering the site that there are private aviation 
operations in the immediate vicinity via signage at site entrances.
n. Events held on site shall adhere to the Board of Supervisors Resolution, December 1980 
as applicable which establishes guidelines and conditions for temporary uses. The following 
conditions shall apply: 
Security 
1. At least one patrolman or security guard for every 500 persons in attendance. 
Access to Event
2. The applicant shall provide adequate ingress and egress to the premises and parking 
areas. Traffic guards shall be employed to ensure orderly traffic movement and relieve traffic
congestion onto public rights-of-way.

3. The applicant shall provide an ample supply of water for drinking and sanitation purposes.
The quality and quantity of water and location of facilities shall be approved by the Maricopa 
County Environmental Services Department. 
4. Supplemental toilet facilities must be provided for every special event.  At least one closed
toilet facility shall be provided.  A toilet for each 40 males and for each 40 persons. The 
number and location of toilets shall be approved by the Maricopa County Environmental 
Services Department.
Concessions 
5. Concessionaries must be licensed. The quality and quantity of food and location of 
concessions shall be approved by the Maricopa County Environmental Services 
Department. 
Refuse 
6. At least one trash can with 32 gallons capacity shall be provided for every 25 persons. 
Trash and refuse disposal shall be pursuant to procedures established by the Maricopa 
County Environmental Services Department.
Outdoor Lighting 
7. Temporary lighting shall be shielded so that it is directed downward below the horizontal 
plane of the fixture and does not trespass onto adjacent properties.

Chairman Sellers asked Tom Ellsworth, Director of Planning and Development, and 
Darren Gerard, Planning Division Manager, to come forward.
Mr. Ellsworth reviewed the item, a request for a Special Use Permit (SUP) for an 
equestrian event facility with an RV Park in the Rural-43 zoning district. He said the 
case was remanded back to the Planning and Zoning Commission on December 6, 
2023, by the Board of Supervisors. He said the applicant needed to work with the 
neighbors and make modifications to the operations of the facility. Mr. Ellsworth said 
significant support and opposition has been expressed and is listed on the staff report.  
He mentioned the concerns of the people who were in opposition and said a petition 
letter was received by the Clerk expressing those concerns and was then distributed to 
the Board.

Mr. Ellsworth talked about another complaint and referred to the Aviation Clearance 
Exhibit slide above. He said concerns are flight safety and protection and referenced 
the other airfields that have similar proximity to development and are examples of Land-
Use Compatibility.

Mr. Ellsworth read additional condition “o” regarding avigation easements that would 
inform visitors to the site of air traffic noise. Additionally, Mr. Ellsworth explained a fourth 
concern regarding traffic. He said ADOT is interested in receiving a traffic study in the 
winter months of the year. He read an additional condition, “d.4”, regarding “a revised 
traffic study is needed to be submitted to ADOT prior to construction permitting”.  He 
said the applicant has agreed to abide by the noise ordinance and stipulations stated 
above. 
Mr. Ellsworth said the Planning and Zoning Commission heard this case on the January 
25, 2024, hearing and recommended approval with stipulations with a vote 6-0. 
Chairman Sellers called on the applicant, Shannon Whiteaker, Garrison 48, 
representing Gambler’s Row. 
Ms. Whiteaker highlighted the journey with the Gamblers Row project and 
acknowledged the people in support and opposition. She gave an overview of the 
outreach that was made throughout the community. Ms. Whiteaker said if approved, 
she knows trust and support needs to be earned by the community.

Ms. Whiteaker highlighted the flyers and reviewed the outreach efforts that were

2024.

Ms. Whiteaker spoke briefly about some of the issues as listed on the slides above. 
Supervisor Hickman clarified with Ms. Whiteaker that the Fire District supports the 
project because the business would provide tax dollars. 
The Clerk announced two speakers registered to speak in favor, and a list of 34 people 
who are present and in support but do not wish to speak. The Clerk announced eight 
people in opposition who do not wish to speak. She said there are nine people in 
opposition that would like to speak. Five speakers were chosen to speak in effort to 
stay within the time limit allotted.
 
Susan Lay, resident, spoke in opposition citing concerns about dust, smell, flies, and 
traffic, especially in the winter months. Ms. Lay mentioned other concerns regarding

safety, drainage, animal waste hazards, noise, and light pollution and asked why the 
developer did not chose a more appropriate location.
Bob Symns, resident, was called on to speak in opposition and he opted not to speak.
Dale Zogleman, resident, spoke in opposition. He talked about an appeal filed and the 
proposed site running through the air park. He was concerned about future complaints 
with regards to air traffic and air noise disturbing livestock, resulting in accidents or 
lawsuits. 
Mark Rebholz, resident, spoke in opposition. Mr. Rebholz said he lives near the airport 
and is a pilot. He talked about having freedom of movement and the disruption of 
current lifestyle in Aguila with this project. Mr. Rebholz noted some of the people in 
favor of the project are from out of state and are only there just a few months out of the 
year. 
Carolyn Jones, resident, spoke in opposition. She clarified that no one from Gamblers 
Row had reached out to her with any information regarding the project. She talked 
about misleading population numbers, negative effects on the community, the water 
shortage, manure causing illnesses, traffic, and mentioned the Board of Supervisors’ 
mission statement which states it is their job to promote health, safety, and well-being 
for its residents.
Richard Milhous, resident, spoke in opposition. Mr. Milhous said other areas are more 
appropriate for the Gamblers Row development. He spoke at length about the 
disturbances that the project would bring and how it would ruin the quality of life that 
the permanent residents living in Aguila currently have. Mr. Milhous stated this sort of 
project needs to be in an area zoned for it rather than a Special Use Permit.
Supervisor Hickman noted the proposed project and acknowledged the concerns of the 
residents in the rural area of Aguila. He said growth is happening everywhere and 
asked Cody Soffel, the applicant, to describe why he is wanting a Special Use Permit 
in Aguila.  
Mr. Soffel responded to one of Supervisor Hickman’s questions regarding the Fire 
Department.  Mr. Soffel said he had reached out to the Fire Chief numerous times with 
great success. He noted his staff will have access to all equipment and water trucks 
ready for any emergency. He offered his staff and emergency equipment to help 
anyone in Aguila including all neighbors. Mr. Soffel gave a brief family background and 
talked about wanting a business facility in the Town of Aguila.  He explained to the 
Board his reasoning for choosing Aguila for his business. 
Supervisor Hickman stated his concerns about any future legal actions against any 
plane incidents and wanted reassurance that the applicant and Gamblers Row 
participants acknowledge they are entering an airstrip area. He asked Mr. Soffel how 
the issue of dealing with manure odor and flies would be handled. Mr. Soffel said that 
the handling of the manure is in the narrative report, and that the property will be 
cleaned daily. He noted there have been cows on the property in the wintertime and 
had no issues before. 
Supervisor Hickman spoke about residents’ concerns regarding law enforcement. He 
said he has been working with the Sheriff’s Office on getting resources and get patrols 
in the far areas. He noted that the people in Gamblers Row need to follow the 
stipulations addressed by staff. Supervisor Hickman said the SUP had gone through a 
long path in addressing deficiencies with staff and the community. He addressed FAA

concerns, property rights, growth, health, and safety. Supervisor Hickman said this case 
has divided the community of Aguila. He believes the conditions of approval address all 
concerns raised by project opposition. The SUP is limited to a 10-year period so that 
Gamblers Row can prove itself to be a good neighbor and will have to be reconsidered 
in 10 years. 
Motion to approve in accordance with the Planning and Zoning Commission 
recommendation as printed on the agenda but with the addition of conditions ‘d.4’ and 
‘o’ as listed in today’s handout and read by staff by Supervisor Clint Hickman, seconded

Irrigation Water Delivery District, as they have been determined to be signed by a majority

Pursuant to A.R.S. § 48-3424, any landowner within the boundaries of the proposed district 
may appear and object to the organization thereof, or to the inclusion of the landowners’

district within the boundaries proposed in the petition or with modified boundaries.
If the Board decides to proceed with the organization of the district, the Clerk is directed to

and postings are completed. Written protests against the organization may be filed by owners
of a majority of the acreage with the proposed district boundaries. If no protest is filed, or if

APPROPRIATION ADJUSTMENT FOR GRANT FUNDING FROM ARIZONA 
DEPARTMENT OF HOMELAND SECURITY (230825-01)
Approve and authorize the Recorder’s Office for the application of the Homeland Security 
Grant Program Award administered by the Arizona Department of Homeland Security 
(AZDOHS) and authorize the Chairman to approve the receipt of any and all such funds 
awarded.
In accordance with A.R.S.42-17106(B), approve a revenue and expenditure appropriation 
adjustment increasing the FY 2024 Recorder’s Office (360) Recorder Grant Fund (298) Non-
Recurring/Non-Project (NRNP) budget in the amount of $235,000. Grant revenues are not 
local revenues for the purpose of the constitutional expenditure limitation, and therefore, 
expenditure of the funds is not prohibited by the budget law. This budget adjustment does 
not alter the budget constraining the expenditure of local revenues duly adopted by the Board 
pursuant to A.R.S. §42-17105.  Funding for this Agreement is provided by AZDOHS and will
not affect the County’s general fund.
The program will support the continued hardening of Maricopa County’s critical election 
equipment and data infrastructure. The acquisition of hardware, software, and critical 
services will harden security for both hard and cyber targets. The request represents the 
Office's efforts to continue to strengthen elections infrastructure and the mitigation and/or 
elimination of any security gaps identified during the 2020 election cycle and subsequent 
audits. Elections remain the cornerstone of American democracy and funding from the 
AZDOHS Homeland Security Grant Program will aid in the department’s mandate to provide
fair, safe, and secure elections.
The total amount of funds requested is $235,000. The grant period will cover the periods 
October 1st, 2023 through September 30th, 2024. The grant does not allow for indirect costs 
for which the County is eligible. The Maricopa County Recorder’s Office composite indirect 
cost rate for FY 24 is 22.07% or $51,864.50. The recoverable indirect cost of administering 
this grant is $0; the non-recoverable indirect cost is $51,864.50. Nonrecoverable indirect 
costs will be covered by the departmental general fund budget. This grant is competitive and
does not require a match or on-going cash contributions after the grant period end date. The 
grant award is nonrecurring and has not been awarded to the department in past years.
Maricopa County and the Recorder’s Department are eligible to apply for and receive grant 
funding through various state agencies. Maricopa County must apply for these funds and the 
Board of Supervisors must duly authorize the application.

Approve the acceptance of grant funds from The Flinn Foundation, in the amount totaling
$754,159 for the purpose of bridging the gap between the education sector and the 
Bioscience and Healthcare industries, promoting Bioscience and Healthcare as potential 
careers for students, and helping teachers teach and students learn about essential skills 
required for these careers. The grant award begins on January 1, 2024, and ends on 
December 31, 2026.
 
Authorize the Chairman to sign all documents related to these grant funds, as applicable. 
The County School Superintendent Office’s (Office) approved indirect rate for fiscal year (FY) 
2024 is 1.43%, and total grant indirect costs are estimated to be $10,784. However, indirect 
costs were not included in the grant application and will be absorbed in current budget 
appropriations.
The grant award is reoccurring, and The Flinn Foundation has awarded grants to the Office 
in the past. This new grant will enable the Office to continue and expand educational support
programs that benefit citizens by helping students pursue and be prepared for post-
secondary education in in-demand career fields. In so doing, the grant will help the Office
meet its statutory requirement (A.R.S. §15-302(A)(11)) to collaborate with the department of
education to assist school districts, charter schools, and others on curriculum alignment and 
teacher staff development to improve student performance leading to college and career
readiness. The grant award was competitively bid and has an in-kind match requirement for
the Office to maintain an Industry-Education Program Partnership Director, educational tools 
development, teacher professional development training and training delivery, data 
analytics, marketing, and communications support. The Office will provide this support 
through current Office staff. Additionally, the grant agreement requires the Office to develop
a strategy for program growth and increased impact beyond the grant period. Any ongoing 
or future costs will be absorbed by the Office’s operating budget appropriation, new fee 
revenues, grants/donations, and/or special revenue funds.
As a result of this funding and pursuant to A.R.S. §42-17106(B), approve an adjustment to 
the FY2024 County School Superintendent (D370) Schools Grants Fund (715) Operating 
(OPER) revenues and expenditures budget in the amount of $251,386.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditures of these revenues are not prohibited by the budget 
law. This action does not alter the budget constraining the expenditures of local revenues 
duly adopted by the Board pursuant to A.R.S. §42-17105.

#S1038. Lex is approximately 8 years old.  Lex has been assigned and working along the 
side of Sgt. Davison for about 6.5 years as a dual-purpose Explosive Detection and Patrol 
Canine. Lex was recently diagnosed with an infection due to location and severity deemed
inoperable and will be treated with lifelong antibiotic that will not cure and Lex will not regain

his biting grip. Also, Lex also has a terminal disease affecting his teeth. Since the veterinarian
visit and bill of health, Lex was placed on inactive status immediately for the health and safety

and will accept full care and financial responsibility for Lex upon adoption and will be asked 
to sign the Canine Release and Indemnification.

Approve “Modification of Grant or Agreement” #3 to accept funding in the amount of 
$100,400 for the CY 2024 Operating and Financial Plan (Exhibit A) between Maricopa 
County on behalf of the Maricopa County Sheriff’s Office (MCSO) and the U.S. Department 
of Agriculture, Forest Service, Tonto National Forest. The reimbursement period will be 
retroactive to January 1, 2024, through December 31, 2024.  
Also approve a rollover amount of $16,067.97 from the CY 2023 Agreement. Also approve 
an estimated amount of $30,000 that is allowed for in the agreement for special enforcement 
situations that include but are not limited to fire emergencies, drug enforcement, and certain 
group gatherings for a total of $146,467.97.
The MCSO Indirect Rate is 16.72%. Total grant indirect costs are estimated to be 
$24,489.44, and none of this amount is recoverable. The unrecoverable amount of 
$24,489.44 will be absorbed within the Sheriff’s General Fund operations.
This grant award is multi-year and recurring. The Sheriff’s Office has been providing these 
services for more than 30 years. The award does not require a cash contribution, nor an in-
kind contribution, and there are no future or ongoing contributions required following the 
grant period. This service is not mandated; however, it furthers the Sheriff’s public safety 
mandate. Funding is used to pay deputy overtime, the leases on two vehicles, monthly 
charges for cell phones, and other supplies related to this grant agreement for MCSO to 
assist in patrolling portions of the Tonto National Forest, located in Maricopa County.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditure of the funds is not prohibited by the budget law.

$350,000 and indirect costs of $58,520. Indirect costs are unallowable by the terms of this 
Agreement and $58,520 in indirect costs will be absorbed by the General Fund. There are

services for staff training and IDEA implementation along with a variety of contracted 
professional services for juvenile inmates. The term of this funding is from July 1, 2024 
through June 30, 2025. 
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditures of these revenues are not prohibited by the budget 
law.
This funding award is re-occurring and has been awarded for last twenty (20) years. A cash 
or in-kind match is not applicable. There is no future or ongoing contribution required 
following termination of the grant period. The grant award is not competitively bid. The 
Sheriff’s Office indirect cost rate for FY2024 is 16.72%. Unrecoverable indirect costs 
associated with this funding are estimated to be $8,360.00. The maximum recoverable 
indirect cost is estimated to be $6,000; there is a cap of 12% on operating costs. 
The priority use for these funds is to ensure Maricopa County Jail Education Programs are 
in compliance with state and federal special education requirements. These funds will be 
used to contract with special education consultants to work with staff in implementing the 
IDEA Laws and Regulations, to assist staff in providing transitional services and to assist in 
special education program improvement efforts. The Sheriff's Office has participated in the 
County Jails Education Program for many years.

MOU WITH GRAND CANYON UNIVERSITY, FEDERAL DIESEL EMISSIONS 
REDUCTION ACT STATE CLEAN DIESEL GRANT PROGRAM
Approve and authorize the Chairman to execute a Memorandum of Understanding (MOU) 
between the Maricopa County Air Quality Department (MCAQD) and Grand Canyon 
University (GCU) for MCAQD to provide up to $169,400 in federal DERA sub-award funding
to GCU for the replacement of one diesel shuttle bus.
This MOU will provide up to $169,400 in funds to support the State Clean Diesel Grant 
Program and benefit air quality by replacing one 2007 Class 6 diesel shuttle bus with one 
new 2021 or newer Class 6 CNG low NOx shuttle bus.  Matching funds of 65% will be 
provided by GCU. This agreement shall become effective upon execution by all parties and 
will be valid until March 31, 2025.
The program is consistent with Maricopa County Air Quality Department’s (MCAQD) mission
“to provide clean air to Maricopa County residents and visitors so they can live, work, and 
play in a healthy environment.”  This project is in District 3.

item. He talked about a couple of agenda items from the Regional Public Transportation

INTERGOVERNMENTAL SERVICES AGREEMENT WITH YUMA ELEMENTARY 
SCHOOL DISTRICT, FEDERAL DIESEL EMISSIONS REDUCTION ACT (DERA) STATE 
CLEAN DIESEL GRANT PROGRAM
Approve and authorize the Chairman to execute an Intergovernmental Services Agreement 
(IGA) between the Maricopa County Air Quality Department (MCAQD) and Yuma 
Elementary School District for MCAQD to provide up to $283,321.50 in federal DERA sub-
award funding to Yuma Elementary School District for the replacement of three diesel 
powered school buses.
This agreement will provide up to $283,321.50 in funds to support the State Clean Diesel 
Grant Program and benefit air quality by replacing three diesel school buses.  One 2004 
model year diesel school bus, one 2006 model year diesel school bus, and one 2008 model
year diesel school bus with three 2023 Ultra-Low NOx propane school buses.  Matching 
funds of 65% will be provided by Yuma Elementary School District. This agreement shall

NEW HOPE AGREEMENT WITH STAY WITH ME ANIMAL RESCUE
Approve an agreement between Stay With Me Animal Rescue and Maricopa County, 
administered by Maricopa County Animal Care and Control, to allow said rescue to transfer 
animals that have been deemed eligible for the New Hope program. Maricopa County will 
provide a rabies vaccination, dog license tag, and new owner transfer fee within the first year 
of transfer for each dog three months of age or older at no cost to the Contractor. The cost 
for these services is $52 for each animal transferred in FY 2024 and thereafter. Animal Care
and Control estimates six (6) New Hope transfers annually, for a total of $312.00 per year, 
over the term of the agreement. The term of this agreement shall commence upon approval
and execution by the Board and will expire on March 1, 2027.

AMENDMENT TO IGA WITH ARIZONA HEALTH CARE COST CONTAINMENT 
SYSTEM (AHCCCS)
Approve Amendment No. 6 to the Intergovernmental Agreement (IGA) between Arizona 
Health Care Cost Containment System (AHCCCS)-MEDICAID YH16-0018-07 and Maricopa
County by and through the Department of Correctional Health Services (CHS). The purpose 
of this Amendment is to change rates and quarterly estimate of State Match Advance 
Payments. All other terms and conditions of the Intergovernmental Agreement remain in full 
force and effect.
This is a cost avoidance for Maricopa County, as CHS would be responsible for 100% of the 
cost if patients are not approved to be AHCCCS eligible, thereby making AHCCCS the payer
rather than the County as payor of last resort. This Agreement is entered into pursuant to 
A.R.S. § 36-2903 to provide AHCCCS with the appropriate State Match in order to pay for 
Medical Services that qualify for Federal Financial Participation (FFP) provided to Inmates 
who qualify for Title XIX while they are an inpatient in a non-secure ward of a Medical 
Institution. It also provides AHCCCS with the funds to pay for administrative costs associated
with this Amendment.

In accordance with state law (A.R.S. §16-531), approve the appointment of election boards 
and central boards necessary to conduct the March 19, 2024, Presidential Preference 
Election.  The board worker appointments are made by the Elections Director overseeing in-
person voting, election services, warehouse operations, and tabulation.  Appointments are 
on file with the Clerk of the Board of Supervisors and retained in accordance with LAPR
approved retention schedule.  This action also authorizes the Elections Director to pay 
election boards compensation wages and communications expenses.  This board action also 
authorizes the Director of Election Day to hire additional election boards and central board 
positions that are not yet filled and/or replace election boards and central boards appointees 
if the originally appointed board member is unable to work.

ADOPT RESOLUTION FOR THE MARCH 2024 PRESIDENTIAL PREFERENCE 
ELECTION
The list of vote centers and emergency voting centers and their hours of operation are on file
with the Clerk of the Board of Supervisors and retained in accordance with LAPR approved
retention schedule and are posted on Maricopa County Elections’ website.  If a vote center 
established pursuant to this resolution becomes unavailable and there is not sufficient time 
for the Board of Supervisors to convene to approve an alternate location for that vote center,
the Director of In-Person Voting and Tabulation is authorized to make changes to the 
approved vote center location and shall notify the public and the Board of Supervisors 
regarding the change as soon as practicable.  The alternate vote center shall be as close in 
proximity to the approved vote center location as possible.  The list of vote centers and 
emergency vote centers as of February 19, 2024, are listed in exhibits (A) and (B).  
The Board of Supervisors also authorized the use of drop boxes for the March 19, 2024, 
Presidential Preference Election.  The list of Drop Boxes is included in exhibit (C).  The drop
boxes will adhere to the security requirements established in the December 2023 Arizona 
Secretary of State’s Elections Procedures Manual and will be used to accept early ballots. 
The list of drop boxes and their hours of operation will be on file with the Clerk of the Board 
of Supervisors and posted on Maricopa County Election’s website. If a location authorized 
pursuant to this resolution becomes unavailable and there is not sufficient time for the Board
of Supervisors to convene to approve an alternate location, the Director of In-Person Voting

Suite 217, in Mesa.  The term of the lease is 9 months from March 1, 2024 through November 
30, 2024 at $4,400 per month plus rental tax ($3,600 Rent; $800 in common area 
maintenance.) The suite will be used as a vote center for the upcoming Primary and General

Approve the revisions to the Maricopa County Code of Conduct (HR2416) effective February 
7, 2024. This revision updates the political activity section of the Code of Conduct to be 
consistent with the rules for Classified Employees found in the Employee Merit Rules and 
clarifies that only service animals are allowed in the workplace.
This Policy applies to all employees of Maricopa County-appointed departments as well as 
the Flood Control District of Maricopa County and the Maricopa County Library District 
(Special Districts). The Board of Supervisors is authorized to jointly adopt policies applying 
to the Special Districts under the Intergovernmental Agreement, C-06-18-393-6-00, 
approved on April 11, 2018. An elected office may follow this Policy for its employees when

Approve financial Amendment No. 11 to the Intergovernmental Agreement (Agreement) 
between Arizona Department of Economic Security (DES) and Maricopa County 
administered by its Human Services Department (County). DES provides funding to the
County for administration of community services. The Human Services Department 
administers the Community Action Agency Program SERVICES to provide eligible residents
with low-incomes with eviction prevention services and crisis navigation. 
The purpose of the Amendment is to amend the Agreement as follows: 
A. To revise the Itemized Service Budget for the period of July 1, 2023, through June 30,2024

The total value of the budget is revised from $3,341,569.00 to $4,027,092.36 as detailed in 
the attached Itemized Service Budget. This amount includes the estimated carryover funding 
from State Fiscal Year 2023 in the amount of $685,523.36.
DES contracts with the County on an annual reoccurring, non-competitive basis for service 
delivery of the Community Action Agency program activities. Receipt of the funds from DES
does not require in-kind or match funds and no future or ongoing contributions by the County
at the end of the Agreement term.
The services provided under this Agreement are not a mandated function but provide a 
benefit to the citizens by providing eligible low-income residents with financial assistance
and services for economic self-sufficiency.

therefore indirect costs are $0 and are not subject to indirect cost recovery.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditure of the revenues is not prohibited by the budget law. 
This Agreement does not alter the budget constraining expenditures of local revenues duly 
adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted 
as necessary to accommodate this Amendment through future budget reconciliation.

The County will provide the Developer with $6,140,196 in U.S. Department of Housing and 
Urban Development (HUD) HOME Investment Partnerships Program funds (HOME ARP) 
under Assistance Listing Number 14.239 and $10,583,125 in American Rescue Plan Act
Funds (“ARPA”) under Assistance Listing Number (“ALN”) 21.027 provided to the County by
the U. S. Treasury. The total amount to be funded under this Agreement is $16,723,321.
The Agreement term shall begin February 28, 2024, and will expire December 31, 2026.

DES maintains database systems that must be accessed by Workforce Development 
Division staff members to enroll individuals in Workforce Innovation Opportunity Act (WIOA) 
programs, complete case management reports, and report performance measures as

The purpose of this IGA is to provide medically necessary health care and support services 
for individuals with HIV infection.
The award was competitive and there is no cash or in-kind match required. This is not a 
mandated service but provides a benefit to the community through enhancing access to a 
comprehensive continuum of high quality, community-based care for families with HIV/AIDS. 
If discontinued, ongoing cash contributions should not be required. 
The Department of Public Health indirect rate for FY24 is 15.65%.  Full indirect costs are 
estimated at $405,966.28 all of which are recoverable.  Departmental indirect rates are 
reestablished at the beginning of each fiscal year and the future indirect rates will be collected 
at the corresponding rates. All program costs are allocated to the grant so there will not be 
an additional burden on the department’s operating budget.

Approve Intergovernmental Agreement (IGA) CTR065199 between Arizona Department of 
Health Services (ADHS) and Maricopa County by and through its Department of Public 
Health to provide funding for Ryan White Early Prevention Services.  The funding for this 
program is in the not-to-exceed amount of $932,880.00 for the budget period January 01, 
2023, through December 31, 2024.  The term of the agreement is from January 01, 2023, 
through December 31, 2028.  
This is a new IGA with no requirement for in-kind match or ongoing contributions.  This award 
was not competitive.  Ryan White Early Prevention Services are not a mandated function but
provide benefits to citizens by providing HIV Testing Services, Partner Support Services, and 
Data to Care Activities.  Although this is a new IGA, this grant award is recurring and has 
been awarded to the department for several years.  
This grant deviates from County Policy A2505 and does not allow for full indirect cost 
reimbursement, but a maximum of 15% of salaries and employee related expenses.  The 
Department of Health’s indirect rate for FY24 is 15.65%.  Total indirect expenses are 
estimated to be $126,952.80 of which $5,272.80 is not recoverable and will be absorbed by 
the department’s operating budget.  
Departmental indirect rates are reestablished at the beginning of each fiscal year and the 
future indirect rates will be collected at the corresponding rates.

Office of Oral Health, Dental Sealant Program for free dental sealant services for students. 
This IGA is effective July 1, 2023, through June 30, 2028.  
The funding for this IGA represents a long-term commitment that is recurring between ADHS
and MCDPH.  The current work activities require the administration of a Dental Sealant 
Program in Maricopa County.  This school based dental sealant program is an evidenced-
based, comprehensive strategy that is effective in reducing tooth decay.  It is available to 
Maricopa County schools with 50% or greater participation in the National School Lunch

Approve Amendment 1 of the non-financial Memorandum of Understanding (MOU) between 
Arizona Department of Health Services (ADHS) and Maricopa County by and through its 
Department of Public Health (MCDPH).  This MOU sets forth and defines the terms under 
which ADHS and MCDPH agree to provide one another specific data as defined in Section
2.2. The data to be provided include all those listed in the table in Exhibit A and as further 
defined and limited within any other exhibit attached to this agreement. The original term of 
the Agreement began February 15, 2022 and will continue through February 14, 2027. 
The above-named contract is hereby amended as specified below:

kind matching requirement.  Should the grant cease, ongoing contributions are not required.
 The Department of Public Health’s indirect rate for FY24 is 15.65%.  Grant indirect costs are
fully recoverable in the amount of $208,358.81.

The Department of Public Health indirect rate for FY24 is 15.65%. The full indirect costs are
estimated at $7,151.50 all of which is recoverable. Departmental indirect rates are 
reestablished at the beginning of each fiscal year and the future indirect rates will be collected 
at the corresponding rates. Program costs not covered by the grant will be subsidized by the
MCDPH indirect cost pool.

$11,500,000, however, inspection of the property resulted in a request by staff to reduce the
Purchase Price to $11,300, 000. Because of the need to transfer title by an established date
certain, the Director agreed to the reduction. The property was transferred to the County on 
January 31, 2024, and was purchased for use as an office building by Public Health 
Department.

parking, staging, and other County uses.

PROPERTIES
Request the Board to approve and execute a Listing Agreement between the Flood Control 
District (District) and ROI Properties, LLC (ROI) authorizing ROI to list and market real 
property to the public that has been declared as excess to the needs of the District. The 
District is authorized to offer up to a 3% brokerage fee pursuant to Resolution 2007R012. 
Interested buyers procured by ROI will be required to bid at public auction pursuant to A.R.S.
§ 48-3603.
The District utilizes its disposition program on all excess properties to evaluate them for the 
best potential of sales or leasing, depending on current market information. The properties 
would be sold at public auction with the minimum bid being market value as determined by 
appraisal, unless to another agency for public purposes, at market value without auction.
