P a g e 1 | 3 RESOLUTION Maricopa County Board of Supervisors RESOLUTION DEFERRING THE PAYMENT OF MONTHLY, QUARTERLY AND ANNUAL MINIMUM PAYMENTS DUE UNDER MANAGEMENT AND LEASE AGREEMENTS FOR LANDS LOCATED IN MARICOPA COUNTY PARKS AND WAIVER OF LATE PAYMENT FEES ON DEFERRED FEES BETWEEN MARCH 17, 2020 AND FEBRUARY 28, 2021 BE IT RESOLVED by the Maricopa County Board of Supervisors as follows: WHEREAS, to combat COVID-19, on March 17, 2020, following updated guidance from the Centers for Disease Control and Prevention, the Arizona Department of Health Services issued updated guidance that included preventing gatherings of 10 or more people, thereby limiting certain types of recreation activities, leagues, and programs; and WHEREAS, with Executive Order 2020-09 the Governor of the State of Arizona required restaurants to provide dine-out options only and required bars, gyms and movie theaters to close; and WHEREAS, with Executive Order 2020-18 the Governor of the State of Arizona stated that at the recommendation of the state’s health officials, the State of Arizona must continue its efforts by further limiting potential exposure through a policy of social distancing while maintaining social connectedness, and further identified certain outdoor exercise activities, such as such as walking, hiking, running, biking or golfing as essential activities necessary to promote the public health, safety and welfare of the state and as part of an enhanced mitigation strategy; and WHEREAS, with Executive Order 2020-12 the Governor of the State of Arizona identified park personnel that provide maintenance and operation of park facilities that provide outdoor recreation as essential government functions necessary to promote the public health, safety and welfare of the state or assist others in fulfilling such functions; and P a g e 2 | 3 WHEREAS, pursuant to Arizona Revised Statutes Section 26-307 counties may make, amend and rescind orders rules and regulations necessary for emergency functions, among other things; and WHEREAS, Maricopa County is committed to full compliance with all applicable federal and state laws and regulations and enforcement of such as may be required; and WHEREAS, Maricopa County is further committed to providing regulatory relief to residents and businesses during this unprecedented time in order to support economic stability, recovery and growth. NOW, THEREFORE BE IT RESOLVED, the Maricopa County Board of Supervisors directs the following: With respect to any management and lease agreements for lands located in Maricopa County parks between the County and a Concessionaire (“Agreement”), during the time period as of March 17, 2020 to February 28, 2021: Upon request of a Concessionaire, monthly, quarterly and/or annual minimum payments that are due for the months of March, April, May, June, July and August 2020 may be deferred (“Deferred Payments”). The Deferred Payments shall be payable in six (6) equal installments with the respective monthly, quarterly and/or annual minimum payments due under the Agreement in September, October, November and December 2020 and January, February 2021. . Late payment fees related to the Deferred Payments under the Agreements are waived. All others fees due under the Agreement shall be paid in accordance with the terms and conditions of the Agreement.
