We did though, make copies of the deposit slip that shows we were supposed to send the check to the bank and our 'End of day report showing we cashed the check that day. Here is the response from County attorney for the Treasurer, who spoke to the Treasurer. In sum, Finance may reissue/duplicate the check/warrant to Speedy Cash so long as the County (Treasurer, Finance, and BOS) complies with A.R.S. §11-632 (see text, below). Ariz. Rev. Stat. Ann. § 11-632 A. When it appears to the satisfaction of the board or county school superintendent by affidavit or otherwise that a warrant on the county treasurer has been lost or destroyed prior to payment and there is no reasonable probability of its being found or presented, the board may direct the issuance to the owner of a duplicate of the lost or destroyed warrant. Before issuing the duplicate, however, the board or county school superintendent shall send a written stop payment notice to the county treasurer, giving the number, amount and date of the warrant, the payee and the fund on which drawn. Such duplicate warrant issued under authority of this section shall constitute full and sufficient authority to the county treasurer for disbursement of public monies in the 4 amount set forth on the duplicate warrant. The county treasurer shall not pay any warrant on which a stop payment notice has been made unless the board has released the stop payment in writing. B. The board of supervisors shall establish procedures for issuing duplicate warrants that protect the county and provide the owner with a duplicate warrant within a reasonable time. A.R.S. §11-632 prescribes several requirements. Here are the requirements and my notes on the same: 1. Obtain evidence that a warrant has been lost/destroyed prior to payment: a. Get documentation from Speedy Cash showing they cashed the check b. Check with treasurer that warrant has not been submitted (done already) 2. BOS (Finance?) send stop payment notice to Treasurer (self explanatory) 3. Affidavit: a. If Speedy shows proof of check cashing, the affidavit may be completed by Speedy b. If Speedy cannot show proof of check cashing, perhaps get affidavits from both Speedy and vendor 4. Issuance of duplicate warrant to "owner': a. In this case, Speedy is the owner. The relevant statutes do not provide any guidance or definition for "owner." Accordingly, any interpretation must be reasonable. It is reasonable to conclude that Speedy became the owner when the vendor signed over the check at time of check cashing (assuming Speedy can produce proof). b. There are two ways to do this: reissue in Speedy's name or reissue in vendor's name and provide to Speedy. As the statutes are silent on this, it is a policy decision and the client may make the call. 5.
