ARTICLE I.
NAME AND ESTABLISHMENT
Section 1.
Name
The name of this organization shall be the Maricopa County Public Safety Funding Committee
(MCPSFC).
Section 2.
Establishment
The MCPSFC was established and receives its authority pursuant to BOARD AGENDA ITEM No. C-
06-24-542-X-00.
Section 3.
Legal Authority
The MCPSFC has no independent legal authority. The Maricopa County Board of Supervisors (BOS)
maintains governance responsibilities and is responsible for all MCPSFC funds. As such, the MCPSFC
must follow all County policies and procedures with regard to making payments, entering into
contracts, hiring staff, and any other action that obligates funding.
ARTICLE II. PURPOSE
The MCPSFC shall work collaboratively to advise the BOS concerning public safety needs in Maricopa
County.
ARTICLE III. VALUES
The MCPSFC’s values are as follows:

C. Responsive to a changing environment
ARTICLE IV.
ROLE
Section 1.
Compliance and Role
In cooperation with County staff identified by the BOS, MCPSFC shall be responsible to ensure
the completion of the following:
A.
Review statutory framework to fund public safety facilities, including alternatives to
current funding (i.e. property tax increase, jail district) and identify most viable option.
B.
Review the goals related to Proposition 400 and 411 and the outcomes.
C.
Assess the existing adult and juvenile jail facilities, the current Jail Masterplan, and current
Jail CIP to identify maintenance, capital, and expansion needs in the next twenty years.
D.
Analyze staffing needs, both short and long term.
E.
Review probation and other recidivism programming and their impacts on public safety
funding.

F. Advise the Board concerning other issues, public concerns and matters of interest that may pertain
to the planning and financing of public safety services in Maricopa County.
Section 2.
Methods
The MCPSFC shall perform all duties in accordance with these methods:
A.
Public meetings;
B.
Meeting with community stakeholders;
C.
Consultation with qualified consultants.
ARTICLE V.
STAFFING AND SUPPORT
Necessary staffing and support of the MCPSFC shall be funded by the County and is subject to approval by
the BOS or its designee. MCPSFC staff shall include staff necessary to support the activities of the MCPSFC.
ARTICLE VI.
MEMBERSHIP
Section 1.
Composition, Size and Nominations
The MCPSFC is made up of nine (9) members.
Section 2.
Nominations
Nominations are as follows:
A.
One (1) member nominated by each County Supervisor (five (5) total)
B.
One (1) additional member nominated by the Chairman of the Board
C.
One (1) member nominated by the Presiding Judge of the Superior Court
D.
One (1) member nominated by the Maricopa County Attorney
E.
One (1) member nominated by the Maricopa County Sheriff
Section 3.
Appointments
A.
The BOS shall appoint each member of the MCPSFC.
B.
Notification of appointments will be evidenced within the minutes of the BOS meetings.
Section 4.
Term of Office
Members appointed to the MCPSFC shall serve until the MCPSFC is dissolved by the BOS.
Section 5.
Resignations
A. Resignation by MCPSFC members shall be submitted in writing to the MCPSFC Chair, and
the Clerk of the Board. A member’s resignation is effective when accepted by the BOS.
B. An agenda item will be placed on the next MCPSFC meeting for the MCPSFC to acknowledge

that member’s resignation.
Section 6.
Terminations
The BOS may remove a member for any of the following reasons:
A.
Failure to attend MCPSFC meetings as required in these bylaws.
B.
Failure to comply with the Conflict of Interest and Ethics as required by A.R.S. §38-502 et
seq., and Maricopa County Internal Policy HR2416.
C.
Documented malfeasance, fraud, or abuse.
D.
Removal of a MCPSFC member shall require a formal vote of the BOS.
Section 7.
Vacancies
A.
All efforts shall be made to fill MCPSFC vacancies within 60 days of the vacancy by the BOS.
Section 8.
Compensation
A.
Members of the MCPSFC shall serve without compensation except for any pre-authorized
travel expenses incurred in connection with their duties, including transportation, meals,
and lodging; in accordance with all applicable Maricopa County policies and regulations.
B.
The BOS through the Fiscal Agent is authorized to reimburse those expenses identified
in (A) post-travel to the extent such expenses are allowable and reimbursable under
all applicable Maricopa County policies and regulations.
ARTICLE VII.
OFFICERS AND THEIR ELECTION
Section 1.
Officers
A.
The officers of the MCPSFC shall be Chair, Vice Chair, Second Vice Chair and Third Vice Chair.
B.
The Chair is appointed by the BOS.
C.
There shall be elected one (1) individual to serve in the Vice Chair, Second Vice Chair and
Third Vice Chair office.
D.
Officers, excluding the Chair who is appointed by the BOS, shall be elected by vote of the
Committee.
Section 2.
Duties of Officers
A.
Chair. The MCPSFC Chair shall:
1. Preside over all regular, special, and Executive Committee meetings of the MCPSFC;
2. Serve as Chair of the Executive Committee of the MCPSFC;
3. Encourage best and broadest participation possible from all Board members;
4. Provide information for the preparation of the agenda for MCPSFC meetings;
5. Appoint all committee Chairs and committee members;
6. Work cooperatively with BOS assigned staff to provide information as needed;

7. Represent the MCPSFC as appropriate; and
8. Assign and delegate such responsibilities as needed.
B.
Vice Chair. The MCPSFC Vice Chair shall:
1. In the absence of the MCPSFC Chair, perform all the duties of the MCPSFC
Chair; and
2. Assign and delegate such responsibilities as directed by the MCPSFC Chair.
C.
Second Vice Chair. The MCPSFC Second Vice Chair shall:
1. In the absence of the MCPSFC Chair and MCPSFC Vice Chair, perform all
duties of the MCPSFC Chair; and
2. Assign and delegate such responsibilities as directed by the MCPSFC Chair.
D.
Third Vice Chair. The MCPSFC Third Vice Chair shall:
1. In the absence of the MCPSFC Chair, Vice Chair and Second Vice Chair,
perform all duties of the MCPSFC Chair; and
2. Assign and delegate such responsibilities as directed by the MCPSFC Chair.
Section 5.
Removal of Officers
Any Officer, excluding the Chairman, may be removed from office for cause and a vote of majority
of the current members of the MCPSFC. Only the BOS has authority to remove the Chairman.
ARTICLE VIII.
COMMITTEES
The MSCPC may create ad hoc committees as necessary.
ARTICLE IX.
MEETINGS
Section 1.
Public Meetings
A. All meetings of the MCPSFC, including its committees shall be conducted in compliance
with Open Meeting Law (Arizona Revised Statutes 38-431 et seq.).
B.
Where these bylaws and other applicable law do not afford an adequate procedure
in the conduct of a meeting, the MCPSFC Chair may refer to Robert’s Rules of Order
as a guide.
C.
The MCPSFC shall meet as necessary to meet its obligations as established by the BOS.
D.
Special meetings of the MCPSFC or its committees may be called by the MCPSFC Chair or
any other officer of the MCPSFC. Special meetings shall be announced in the same manner
as regular meetings.
E.
Phone- and web-based meetings and other use of appropriate technology may be used to
promote and enhance MCPSFC member participation in conjunction with face-to-face, in-
person meetings when applicable. The agenda may state the means of connection to the
meeting if participation via phone or other electronic means is being utilized. MCPSFC
members participating in a telephone conference call or other electronic means shall be
clearly identified in the minutes.

F.
The agenda for MCPSFC meetings shall be developed by the MCPSFC Chair or officer calling
the meeting.
G.
The MCPSFC Chair or officer calling the meeting shall be responsible for orderly
business of meetings and for calling items on the agenda.
H.
Within seven (7) business days of approval of any MCPSFC meeting, including its
committees and ad-hoc committees, the MCPSFC staff shall make available the
meeting minutes on the County website.
Section 2.
Quorum
A.
A simple majority of appointed members shall constitute a quorum for the transaction of
business at all MCPSFC and committee meetings; vacant positions shall not be counted
when determining quorum.
B.
A meeting at which a quorum is initially established may not continue to transact business
or to discuss business if the quorum is not maintained due to the withdrawal or departure
of members.
Section 3.
Voting
A.
Each member of the MCPSFC shall be entitled to one vote on an action.
B.
No member of the MCPSFC shall cast a vote on any matter which has direct bearing on
services to be provided by the member or any organization with which that member is
associated, or would otherwise be the basis for a conflict of interest, as outlined in these
bylaws.
C.
Action brought before the MCPSFC shall be resolved by a vote of a simple majority
of the members present, provided a quorum is present.
D.
Members recusing or abstaining from a vote shall be counted as “absent” from the vote,
so as not to inadvertently affect the desired outcome of the majority of voting members.
E.
At the request of any member, or at the discretion of the MCPSFC Chair, a roll-call or ballot
vote may be taken for any action of the MCPSFC. The outcome of voting shall be recorded
in the minutes of the MCPSFC.
Section 4.
Attendance
A.
All MCPSFC members are expected to attend regularly scheduled meetings.
B.
More than three consecutive absences from regularly scheduled meetings by any member
during any 12-month period may result in the removal of the member from the MCPSFC.
C.
Within seven (7) days of notification of attendance policies violation a member may
provide a written explanation to MCPSFC staff on the reason for the absences.
D.
Exceptions to attendance policies may be made by BOS appointed staff due to
special circumstances.
ARTICLE X.
CONFLICT OF INTEREST AND ETHICS

Section 1.
Conflict of Interest
A.
The MCPSFC shall follow Arizona Law on Conflict of Interest as set forth in Arizona Revised
Statutes, Section 38-501 et seq.
B.
Should a conflict of interest arise, MCPSFC members shall inform the Chair so that
appropriate action may be taken.
C.
MCPSFC member may not vote on any matter that would provide direct financial benefit
to the member or the member’s immediate family, or on matters of the provision of
services by the member or the entity the member represents.
D.
MCPSFC member must avoid even the appearance of a conflict of interest.
E.
It is the responsibility of the MCPSFC members to monitor potential conflicts of interest and
bring it to the MCPSFC’s attention in the event a member does not make a self-declaration.
Section 2.
Ethics
MCPSFC shall comply with the Maricopa County Internal Policy on Professional Conduct
(HR2416). MCPSFC Members who violate this policy may be removed from MCPSFC.
ARTICLE XI.
CONFLICT RESOLUTION
Conflicts which arise between MCPSFC members will be resolved through the MCPSFC Executive
Committee.
ARTICLE XII.
AMENDMENTS
Section 1.
Amendment Process
A. Amendments to the MCPSFC Bylaws may be necessary from time to time. Any proposed
changes to the Bylaws must:
1. Be submitted to the MCPSFC Attorney for legal review;
2. Reviewed by the MCPSFC;
3. Receive final approval by the BOS.
B. Each time the Bylaws are amended, a copy of the updated Bylaws will be distributed to
all MCPSFC members, the BOS, MCPSFC Attorney, and will be posted on the County
website.
ARTICLE XIII.
SEVERABILITY
If any part of these bylaws is held to be null and/or void, the validity of the remaining portion of
the bylaws shall not be affected.
