The Court finds that the two parties who did not participate in the settlement—the
Maricopa County Attorney on behalf of Maricopa County Animal Care and Control, and Pilots N
Paws—have received notice of the Petition, have not objected to the Petition, and in fact entered
into a stipulation agreeing to be bound by the terms of the settlement in which both parties received
a specific distribution of $37,500 from the Deborah S. O’Callaghan Sole and Separate Property
Trust. Pilots N Paws shall receive this distribution within 30 days from the entry of this order; and
the County shall receive its distribution within 10 days after the Maricopa County Board of
Supervisors approves said distribution.
The Trustee Wendell Cook shall pay the attorneys’ fees for the Arizona Humane Society,
Heeling Heelers Hearts Dog Rescue, Inc., and Rusty’s Angels Sanctuary and make the specific
distributions outlined in the settlement as memorialized in the Court’s March 12, 2020 Order
within 30 days from the entry of this Order. Additionally, the Trustee shall resign as Trustee and
provide Petitioners with access to any and all Trust property, including all documents necessary
for the administration of the Trust.
The non-appearance/objection hearing on April 14, 2020 is hereby vacated because all
interested parties and Trust beneficiaries have received notice and are not objecting to the terms
of the settlement agreement, as confirmed by either their participation in the settlement conference
on March 12, 2020 or through their stipulation to the aforementioned Petition.
All parties representing themselves must keep the Court updated with address changes.
