I have reviewed the Maricopa County HOME Consortium Agreement (the “Agreement”) that was drafted according to the National Affordable Housing Act. Pursuant to the Agreement, the geographically contiguous units of general local government consisting of the municipalities of Avondale, Chandler, Gilbert, Glendale, Peoria, Scottsdale, Surprise, Tempe, and the County of Maricopa, have formed a consortium for the purpose of receiving an allocation to participate in the HOME Investment Partnerships Program. The Agreement designates Maricopa County to act in a representative capacity for all member units of general local government, and to assume responsibility for ensuring that the Consortium’s HOME Program is carried out in compliance with HUD rules, regulations, and requirements of the HOME Program, including requirements concerning a comprehensive housing affordability strategy. I have determined that the terms and provisions of the Agreement are fully authorized under state and local laws, and that the Agreement provides full legal authority for the consortium to undertake or assist in undertaking housing assistance activities for the HOME Investment Partnerships Program.
