Official Records of Maricopa County Recorder ADRIAN FONTES 20200322362 04/15/2020 12:54 ELECTRONIC RECORDING S46499-6-1-1— ORDINANCE S-46499 AN ORDINANCE EXTENDING AND INCREASING THE CORPORATE LIMITS OF THE CITY OF PHOENIX, ARIZONA, PURSUANT TO THE PROVISIONS OF ARIZONA REVISED STATUTES, SECTION 9-471(N), BY ANNEXING THERETO A CERTAIN TRACT OF LAND CONTIGUOUS TO AND NOT EMBRACED WITHIN THE PRESENT LIMITS OF THE CITY OF PHOENIX, CONTINGENT UPON APPROVAL BY THE MARICOPA COUNTY BOARD OF SUPERVISORS; DESIGNATED AS BROADWAY ROAD (33RD AVENUE) ROWANNEXATION, NO, 488. WHEREAS, the City of Phoenix desires to annex certain property, consisting of public right of way outside the City, . NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PHOENIX AS FOLLOWS: SECTION 1. That the corporate limits of the City of Phoenix be, and they are hereby, increased so as to include within the corporate limits of the City of Phoenix the unincorporated right of way of Broadway Road (33rd Avenue), more particularly described in Section 2 hereof, and that said territory is hereby annexed and declared to be a part of the City of Phoenix contingent upon the fulfillment of the conditions of A.R.S. Section 9-471(N). SECTION. 2. That the City Council hereby determines that the territory to be annexed is described as Exhibit "A." SECTION 3. That the map or plat attached to this Ordinance as Exhibit "B" is an accurate map of the territory annexed, and the same is hereby adopted as the official map of the territory hereby annexed, which said map and plat show the legal boundaries thereof, together with the avenues, streets, alleys and lanes and the locations thereof. SECTION 4. That the Mayor of the City of Phoenix be, and she hereby is, authorized and directed to certify that said map is an accurate map of the territory annexed under the provisions of this Ordinance. SECTION 5. That a copy of this Ordinance, together with the attached official map, shall be filed with the Board of Supervisors of Maricopa County, State of Arizona, for their consideration pursuant to A.R.S. Section 9-471(N). SECTION 6. That the annexation of the above-described territory is contingent upon the approval of the annexation by the Board of Supervisors, Maricopa County, State of Arizona. SECTION 7. That, approval of the County Board of Supervisors pursuant to A.R.S. Section 9-471(N), a copy of this Ordinance, together with an accurate map of the territory hereby annexed to the City of Phoenix, certified by the Mayor of said City, shall be filed and recorded in the office of the County Recorder of Maricopa County, Arizona. 2 Ordinance S-46499 SECTION 8. if any provisions of this Ordinance shall be held inValid, its invalidity shall not affect any other provision, and for this purpose the provisions of this Ordinance are hereby declared to be severable.
