April 20, 2020 Maricopa County 2801 West Durango Street Phoenix, AZ 85009 CC: Deborah Fisher, Darryl King, Tina Wesoloskie, Katrece Swenson To Maricopa County, This letter is to notify you of the mutually agreed upon early termination of agreement P-50305 which was fully executed on October 18, 2019 and originally dated to expire on September 30, 2021. Per the agreement, Arizona Center for Nature Conservation (ACNC) has been hosting a Clean Air Make More educational kiosk and monitoring station (kiosk) at South Mountain Environmental Education Center (SMEEC) which we operate under an agreement with the City of Phoenix. ACNC is terminating our agreement with the City of Phoenix early and will no longer be operator of SMEEC as of May 31, 2020. Since our license agreement for the kiosk was specifically executed for SMEEC, we have agreed to terminate agreement P- 50305 with the County and return the equipment. Termination will be effective upon execution by Maricopa County. Each party agrees to hereby release and hold harmless the other party from any obligations and liability related to and under the agreement, and each party agrees to bear its own costs associated with the agreement. It has been a pleasure working with the County Air Quality staff and we hope to continue working together in some capacity in the future. Sincerely, Norberto J.
