Ms. Young, I have reviewed the application and associated docurnents for the above referenced patent easernelt abandonment application and object to the request as it is proposed. Abandonment of an easement may not land lock and adjacent property, conflict with an existing utility easernent, or force deviation from a legal and existing access road onto an adjacent lot. The proposed requests woulcl accornplish all three. o Access to APN's 202'12-056G and -056F and APN 202-12-066A from Sunset Drive is provided via an existing gravel roadway (41st Ave) which straddles the shared property line of ApN 202- 12-056D and an existing 30' MCDOT ROW. A significant portion of the gravel roadway on APN 202- l 2-056D is located within the 50' Patent Easement being considered for abanclonment. o MCDOT has acquired a 30' ROW adjacent to the west property line of APN 202-12-042A, as well as adjacent to the east property line of APN 202-12-056F. These 30'ROW's DO NOT line up, but are in fact kitty-cornerto one another. Full abandonment of the east patent easement on APN 202-l 2-056D would perrnanently keep these existing ROW's disjointed and unusable. o The existing APS easement must be maintained. A full abandonment of both the south and east patent easement would not coincide with the existing r-rtility easement. I support a PARTIAL abandonment of both easements with the following language: "Abandon the N24' of the S50' except the E30' and abandon the W20r of the E50' except the 526' of Pat No. 1218730 on APN 202-12-05GD,, This allows MCDOT to acquire the E30' for ROW and align it with the existing 30' ROW to the north.
