P a g e 1 | 3 RESOLUTION Maricopa County Board of Supervisors RESOLUTION EXTENDING THE PAYMENT OF ANNUAL ENVIRONMENTAL SERVICES’ PERMIT FEES TO TWO PAYMENTS OF ONE HALF EACH OVER SIX MONTHS, WAIVER OF PERMIT REINSTATEMENT FEES FOR NONPAYMENT AND ALLOW PERMIT FEES TO BE REFUNDED BETWEEN APRIL 1, 2020 AND SEPTEMBER 30, 2020 BE IT RESOLVED by the Maricopa County Board of Supervisors as follows: WHEREAS, to combat COVID-19, on March 17, 2020, following updated guidance from the Centers for Disease Control and Prevention, the Arizona Department of Health Services issued updated guidance that included preventing gatherings of 10 or more people; and with Executive Order 2020-18 the Governor of the State of Arizona stated that at the recommendation of the state’s health officials, the State of Arizona must continue its efforts by further limiting potential exposure through a policy of social distancing while maintaining social connectedness; and WHEREAS, with Executive Order 2020-12 the Governor of the State of Arizona identified food production, distributions and sale, stores that sell groceries and medicine, and restaurants for consumption off- premises as essential services necessary to promote the public health, safety and welfare; and WHEREAS, on April 3, 2020, the Governor of the State of Arizona issued additional guidance and ordered communal pools to cease operations but still be maintained under environmental and public health rules and guidelines; and WHEREAS, pursuant to Arizona Revised Statutes Section 26-307 counties may make, amend and rescind orders rules and regulations necessary for emergency functions, among other things; and P a g e 2 | 3 WHEREAS, Maricopa County is committed to full compliance with all applicable federal and state laws and regulations and enforcement of such as may be required; and WHEREAS, Maricopa County is further committed to providing regulatory relief to residents and businesses during this unprecedented time in order to support economic stability, recovery and growth. NOW, THEREFORE BE IT RESOLVED, the Maricopa County Board of Supervisors directs the following: For the time period as of April 1, 2020 to September 30, 2020: Upon request, allow annual permit fees to be refunded within forty-five (45) days of the previous year’s expiration date. Any business that holds a permit from the Environmental Services Department (Department) with an annual permit renewal and requests financial relief shall be allowed to pay the annual permit fee in two (2) installments. The first payment of one half of the permit fee shall be due on the permit renewal date and the second payment of the balance of the permit fee shall be due six (6) months after the permit renewal date. If the second half of the permit fee is not paid six months after the permit renewal date, the permit shall be expired and void. When the first one half of the permit fee is received by the Department, the permit shall be considered issued and valid, instead of the entire fee as indicated in Chapter I, Regulation 5(a) of the Maricopa County Environmental Health Code. There shall not be any permit reinstatement fees due for failure to pay permit fees when due. IT IS HEREBY ordered that the following provisions of the Maricopa County Environmental Health Code shall be suspended for renewable annual permits for the time period as of April 1, 2020 through September 30, 2020.
