Arizona Coalition to End Sexual and Domestic Violence.

Ms. Bowers led the assemblage in the Pledge of Allegiance to the Flag.
Supervisor Gallardo acknowledged October as Domestic Violence Awareness month 
and thanked Ms. Mendoza and Ms. Bowers for the work they do with the Coalition, 
serving the community throughout the year. He thanked his Chief of Staff, Cristina 
Arzaga-Williams, who has served on the Board of Directors for six years. Arizona 
Coalition organizes a variety of fund raisers, bringing the community together to raise 
money and awareness for this important cause.
Chairman Gates thanked Supervisor Gallardo for all the work he has done to support 
the  Arizona Coalition.

PRESENTACIÓN DE ANIMALS DOMESTICOS POR EL DEPARTAMENTO DE 
CONTROL Y CUIDADO DE ANIMALES
Jose Santiago, with Maricopa County Animal Care and Control, presented Laverne and 
Shirley, two four-month-old Terrier mix puppies who came to the shelter as strays. They 
are available for adoption at the West Valley Animal Care and Control Facility, 2500 S. 
27th Avenue Phoenix, AZ 85009. Mr. Santiago announced a successful adoption event 
sponsored by Bissell Pet Foundation on Saturday September 14, 2019 where 237 
animals were adopted.
Chairman Gates asked the Clerk if there were any additions or corrections to the 
agenda. The Clerk said there were none.

Approve the "Domestic Violence Awareness Month" Proclamation. This proclamation 
recognizes October 2019 as Domestic Violence Awareness Month. (C-06-20-127-M-00)
Chairman Gates announced October 2019 as Domestic Violence Awareness Month, 
and asked the Clerk to read the Proclamation.

PROCLAMATION
Domestic Violence Awareness Month
October 2019
WHEREAS, domestic violence is an epidemic affecting Americans in all communities, 
regardless of age, gender, economic status, race, religion, or educational background; 
and
WHEREAS, domestic violence is a pattern where one partner uses their power to 
control the other partner through physical, sexual, emotional, or financial abuse; and
WHEREAS, the Centers for Disease Control and Prevention reports that nearly 1 in 4 
women & 1 in 10 men have experienced domestic violence in their lifetime; and
WHEREAS, last year, 85 people were killed in domestic violence related homicides in 
Arizona, 60% of which occurred in Maricopa County, according to the Arizona Coalition 
to End Sexual and Domestic Violence; and
WHEREAS, the Arizona Department of Health Services reports that in Arizona, children 
witness a domestic violence incident every 44 minutes; and
WHEREAS,  enhanced  education,  prevention,  and  intervention  efforts  will  increase  
public awareness and confront the abuse of power and control in interpersonal 
relationships;
NOW THEREFORE, BE IT RESOLVED that the Maricopa County Board of Supervisors 
does hereby proclaim October 2019 as DOMESTIC VIOLENCE AWARENESS 
MONTH and encourages all citizens of Arizona to support the efforts of organizations 
providing education, outreach, and support to victims of domestic violence, and calls 
upon citizens to dedicate themselves to ending all forms of violence and the abuse of 
power in relationships.

Supervisor Gallardo said that during the month of October, many downtown Phoenix 
office buildings will be illuminated in purple as a reminder of Domestic Violence 
Awareness Month. He invited the public to come downtown and enjoy the glow of 
purple. Supervisor Gallardo also reminded the community that October 24, 2019 is 
National Wear Purple day. On October 4 and October 18, 2019, District 5 will sponsor 
coffee and a snack on the 2nd floor of the Administration Building for employees to 
obtain information about resources available in the community.

The Clerk indicated there were several speakers’ slips regarding the proposed district. 
Norris Phelps, resident, spoke in favor and stated he has ancestors who used this land 
previously for dairy farming. He said he appreciates the process that allows the cost to 
be distributed more evenly.
Gary Schuller, resident, spoke in favor and stated their neighborhood is one of six 
historical districts in Mesa and the first post-World War II development. The volunteers 
have been maintaining the 70-year-old system and Mr. Schuller is in favor of a more 
formal system. All of the neighbors benefit from the mature trees and landscape and he 
would like everyone to contribute financially.
Alice Skinner, resident, spoke in favor and acknowledged Doug Davis, who has done 
most of the maintenance on the system. The neighborhood is a tight-knit community

and she would like to have all of the neighbors contribute to the maintenance of the 
system.
Peter Eller, resident, registered in favor and chose not to speak.
Keith Christian, resident, spoke in opposition and stated he is in favor of fairness and 
equity in all areas of his life. He contacted Salt River Project (SRP) and learned there 
are 115 properties that receive water through irrigation and when he looked at a map, 
he saw there were 141 properties in the proposed IWDD system. Mr. Christian said he 
lives one block over, outside the historic district and receives flood irrigation. He does 
not think it is fair that people are forced to pay a tax for something that is not being 
used. He explained that flood irrigation is a luxury and would not want a citizen to have 
to pay for the luxury of another.
Supervisor Chucri thanked the speakers for their comments. He stated there have been 
a large number of Irrigation Districts being formed this past year. Some citizens are 
included in the formation process that do not have access to water on their property. He 
said there is a way to manage this circumstance and encouraged the citizens affected to 
work with the Clerk’s Office. Supervisor Chucri said it is important for all neighbors to 
work together to ensure there is a clear understanding of the process.
Chairman Gates announced there were four letters received in support of the Fraser 
Field IWDD. Those letters were from property owners at 315 N. Fraser Drive, 253 N. 
Fraser Drive, 60 N. Fraser Drive and 224 N. Fraser Drive.

APPROPRIATION ADJUSTMENTS FOR QUEEN CREEK LAW ENFORCEMENT 
SERVICE
In accordance with A.R.S. 42-17106(B), authorize the following amendments in revenue 
and expenditure to the FY 2020 budget: 
a) Increase the revenue and expenditure appropriation for the Sheriff’s Office (500) 
General Fund (100) Operating (OPER) by $931,464.
b) Direct the Budget Office to increase the FY 2021 revenue and expenditure Sheriff's 
Office (500) General Fund (100) Operating (OPER) budget baseline by $241,705 for a total 
of $1,173,169 annualized.
c) Increase the revenue and expenditure appropriation for the Sheriff's Office (500) General 
Fund (100) Non-Recurring (NREC) appropriation by $553,640.
Intergovernmental Agreement Revenues are not local revenues for the purposes of the 
constitutional expenditure limitation, and therefore expenditure of the funds is not 
prohibited by budget law. These actions will have a County-wide net impact of zero and 
they do not alter the budget constraining the expenditure of local revenues duly adopted by 
the Board pursuant to A.R.S. 42-17105.
On May 22, 2019, the Board of Supervisors approved a new contract with the Town of 
Queen Creek increasing its service level to 6 full beats; adding a total five sworn deputy 
positions; one sworn lieutenant position and two sworn sergeant positions (C-50-19-080-
03-M). Approval of this action aligns the MCSO’s FY 2020 revenue and expenditure

Approve the Maricopa County Authorized Volunteer Time Policy A2612. This policy directly 
supports the Volunteer 13K initiative by allowing employees to voluntarily serve on County 
approved projects outside of their departments. Volunteerism has shown to be a positive 
contributor to employee engagement. This policy and initiative offers employees an 
opportunity to learn about other departments and those they serve. The volunteer events or 
projects may serve as team building opportunities and may promote employee retention. 
The policy outlines that with the approval of the appointing authority, classified and 
unclassified employees may be granted up to 8 hours annually to participate in County 
sponsored projects of interest. The use of this paid time is limited to those projects or 
events scheduled through the County’s online learning management system. Time and 
attendance will be tracked and feedback is encouraged in order to develop and expand this

MARICOPA COUNTY EMPLOYEE LEAVE POLICY (HR2415) REVISION
Approve a revision to the Maricopa County Employee Leave Policy (HR2415) effective

used consecutively, separates Emergency Leave with Pay from Administrative Leave, caps

Approve a financial Intergovernmental Agreement “Agreement” between Scottsdale Unified 
School District and Maricopa County, administered by its Human Services Department. 
The purpose of this Agreement is to establish the terms and conditions governing the 
purchase of full-service food catering services for the Maricopa County Head Start 
Program.
The District shall provide meals and snacks that meet the minimum 1/3 of the daily 
recommended dietary allowances for Head Start Program participants. The Agreement is a 
fixed-price per meal and snack and shall not exceed $536,138.75.
Upon approval by the Parties, the Agreement shall be effective from October 1, 2019 to 
September 30, 2020. The Agreement may be extended for two (2) additional one (1) year 
terms upon acceptance and approval by the Parties.
This contract is funded by grants from U.S. Department of Health and Human Services (C-
22-16-011-G/09CH010385 & C-22-17-060-G/09HP000105), and the Arizona Department 
of Education/Child and Adult Care Food Program (CACFP).

SOLUTIONS BORDERPLEX, INC.
Approve the receipt of grant funds from Workforce Solutions Borderplex, Inc. (WSB) for 
training sessions to be provided by Maricopa County Human Services Department program 
staff. WSB will provide the County with $2100 for County staff to provide training sessions 
to WSB managers, leaders and champions who will be implementing Family Centered 
Coaching (FCC) mindset throughout Workforce Solutions Borderplex system.
Also request authorization and approval for the Board of Supervisor’s Chairman to sign the 
Letter of Agreement “Agreement” which outlines the activities and responsibilities of each 
Party. The Agreement and funding availability shall commence on September 18, 2019 
through July 31, 2020. 
The County has been recognized by WSB for its best practice implementation of FCC, 
which has been incorporated in the Human Services Department and WSB would like to 
incorporate FCC into their system. The Human Services Department did not submit a grant 
application and was awarded the funds through a noncompetitive process and is a one-
time grant award.
The Human Services Department will be utilizing the provisional indirect rate of 22.2% by 
the U.S. Department of Health and Human Services for FY2020 for salaries and employee 
related expenses. The total Grant award amount is $2100 of which $692 is for salaries and 
ERE. The total estimated indirect costs are $154 and fully recoverable.
Receipt of the funds does not require match or cash funds and no future or ongoing 
contributions are required at the end of the Agreement term.
The services that will be provided under this Agreement are not mandated services but will 
assist a system partner with implementing FCC and WSB will be utilized as a resource as 
the Human Services Department continues to strengthen the FCC project with the

A. Extend the expenditure deadline for the HOME Program Year 2016 funds from

provide the City with additional time to complete the Work Statement identified in the 
original Agreement. The Parties agree that all work performed or costs incurred or 
expended shall remain reimbursable under the original terms and conditions.

Approve and authorize the Chairman to execute Amendment No. 7 to Lease Agreement L-

Enterprise (CARE) Partnership to extend the term of the lease at 466 Bellview Street,

Grant awards are to be expended within four (4) year period of time, starting retroactively 
on October 1, 2018 and ending September 30, 2022. The City of Phoenix has been 
designated as the fiscal agent for this consortium and municipalities.
3. Authorize Chairman of the Board to sign all documents related to the acceptance of the 
grant funds.
4. Approve an appropriation adjustment resulting in a net increase to revenue and 
expenditure of $10,000 in FY 2020 Medical Examiner (D290) Grant Fund (224) Operating

grant award is competitively bid and other eligible agencies may or may not bid on this 
grant award. Any unallowable indirect costs will be absorbed by the departments.
The grant allows a 0% rate for indirect costs, or $0 which may be incurred by the Office of 
Medical Examiner or Maricopa County for the administration of this grant. The Maricopa 
County Department of Finance has calculated the Office of Medical Examiner's composite

No ADHS17-155910, Nurse Family Partnership (NFP) for Maternal, Infant, and Early 
Childhood Home Visiting (MIECHV), between the Arizona Department of Health Services 
(ADHS) and Maricopa County through its Department of Public Health (MCDPH) to provide 
additional funding for the NFP MIECHV program. The PO amount is increased to a not-to-
exceed total of $1,631,523.00, an increase of $61,027 for the budget period October 1,

based home visiting models to communities identified to be at risk. The award is

and standardization to NICP Community Nursing Contractors in the implementation of

Sheet is in the amount of $9,490,249 for the budget period October 1, 2019 through 
September 30, 2020. 
Maricopa County Department of Public Health’s Indirect Rate for FY 2019-20 is 19.2% The 
indirect costs are estimated at $1,528,629 all of which are recoverable.
The WIC Services award is anticipated to remain reoccurring and has been awarded to the 
department for many years. This grant does not require match, indirect cost is fully 
recoverable and ongoing cash contributions are not required. The grant award is not a 
mandated function but provides a benefit to the citizens by providing vouchers for approved 
foods (milk, cheese, cereals, peanut butter, eggs, infant formula, and juice etc.) for low-
income pregnant, post-partum, breast-feeding women, infants, and children up to five (5) 
years of age. Clients also receive nutrition and breast-feeding education and referrals to 
applicable social services. The grant award is competitive. There are no costs that will 
need to be absorbed by the department’s operating budget.

INCREASE IN FLEET FOR MARICOPA COUNTY DEPARTMENT OF PUBLIC HEALTH 
OFFICE OF VITAL REGISTRATION
Approve the permanent addition to Maricopa County’s Department of Public Health’s fleet 
for one mid-size sedan, estimated at $25,000 (including taxes and fees). The vehicle will 
be used by the Office of Vital Registration (OVR) for official business activities. Funding for 
the vehicle is Department of Public Health (860), Public Health Fee Fund (265).
The Office of Vital Registration (OVR) is requesting to add one vehicle to its fleet currently 
due to OVR’s increased demand and activity amongst all five of its locations. The program 
currently has a fleet consisting of five vehicles which has proved insufficient to sustain its 
operational demand, ensure exceptional and timely customer service, partner and 
employee required training and maintain compliance throughout Maricopa County and the 
State. The OVR’s field program alone has been challenged to meet increased requests for 
training and support amongst its hundreds of funeral establishments, licensed healthcare 
facilities, physicians, educational institutions as well as various private & public agencies 
that must participate in the registration of vital records and the reporting of vital events. The 
OVR’s training team of four hosts trainings from all five of its locations throughout the 
County; however, most of its concurrent meetings, trainings and workshops are held offsite 
at these various partner locations - hospitals, establishments, board meetings, offices, 
educational institutions and agencies to ensure increased participation which directly 
impacts our mutual ability to ensure quality assurance, timely reporting and compliance

benefiting the community we serve. Additionally, staff must travel daily across the 
program’s five locations, other Public Health sites and various state agencies to ensure 
that the OVR is meeting all of its various mandated service requirements. Therefore, the

regeneration equipment, including repeaters, amplifiers, base station equipment, antennas 
and associated network devices (In-Building Equipment) on County and District properties 
located at 2901 and 2801 West Durango Street, respectively. 
There is no cost to the County or District under this Agreement.
This license Agreement will allow Verizon Wireless, at its sole cost and expense, to install, 
operate, and maintain In-Building Equipment on County and District property to improve 
and enhance cell phone reception within the County and District properties. The term of the 
agreement is defined as that period of time when County and District occupies the space 
which is the subject of this Agreement and continues to utilize the Verizon Wireless 
services in accordance with the terms of the Agreement and any amendments thereto, and 
will terminate upon discontinuance of those conditions. The license may be terminated

Approve the waiver of the civil penalty assessment applied pursuant to A.R.S. 42-12052 on

property owners of the required notice of classification change and right to appeal.

Katie Gerlach, resident, spoke regarding the three volunteers terminated from the Maricopa 
County Animal Care and Control (MCACC). Ms. Gerlach commented on the qualities of the 
three volunteers. Lorena Bader had an innate ability to interact with the difficult animals. 
Jordan Bader utilized social media to help place animals particularly the senior dogs from 
MCACC. Erika Edmark was the newest of the terminated volunteers and quickly 
demonstrated her dedication to the animals. 
Marianne Zeun, resident, spoke regarding the three volunteers terminated from MCACC. 
Ms. Zeun said that she has worked with the MCACC volunteers and found them to be 
compassionate, knowledgeable and have a passion for the dogs. 
Hayley Hannigan, resident, spoke regarding the three volunteers terminated from MCACC. 
Ms. Hannigan read a series of social media posts from angry constituents regarding the 
release of the volunteers. She stated that the posts were removed immediately by the 
management of MCACC and she considered that censoring. 
Erika Edmark, resident and former volunteer for MCACC. Ms. Edmark spoke regarding the 
termination of volunteers. She announced she wanted to speak about the “toxic and 
tyrannical leadership at MCACC”. Ms. Edmark said to terminate volunteers for benign 
comments made in a private social media chatroom was extreme. 
Callie Wolff, resident, spoke regarding the termination of the volunteers. Ms. Wolff said she 
was disappointed to still be talking about this subject. She would rather be caring for the 
animals who are subject to the overcrowding and underfunding of the shelter. 
Elizabeth Olisky, resident and former MCACC volunteer. Ms. Olisky spoke about the 
importance of communication. She stated there has been miscommunication and lack of 
communication on this issue. Specifically, the reason or justification for the release of the 
volunteers. Ms. Olisky would like to have a more effective means of communication 
regarding the termination of the volunteers.
Carrie Rowser, resident and current volunteer for MCACC. Ms. Rowser spoke regarding 
termination of the volunteers. Ms. Rowser announced she has a degree in architecture, is a 
general contractor and said MCACC is behind the times compared to other shelters across 
the country.
Jordan Bader, resident and former volunteer. Ms. Bader spoke regarding the termination of 
the volunteers. She stated hundreds of emails have been sent to the Board about this issue.

The volunteers have given so much time to the animals at the shelter, and yet, the Board 
will not give volunteers “the time of day”.
Gwendolyn Hjelmstad, resident. Ms. Hjelmstad spoke regarding the termination of 
the volunteers. She was very frustrated that we are still talking about this subject. 
The need is great for volunteers to help care for animals at the shelter.
Leslie Fletcher Ayrs, resident of Payson, AZ and disabled former service member. 
Ms. Ayers spoke regarding the terminated volunteers. She has volunteered at 
shelters in five different states and the MCACC Shelter is an archaic system. The 
volunteers work tirelessly caring for the animals particularly the “E” listed and 
senior dogs. Ms. Ayers said MCACC needs to gain additional funding to open a no-
kill shelter.
Analise Ortiz, resident was announced as the next speaker and she asked that the 
other speakers go before her.
Juliane Gonzalez, resident and representing Puente Arizona. Ms. Gonzalez spoke 
regarding the appointment of a new County Attorney. Her 17 year old daughter has 
been housed at Lower Buckeye Jail for the past five months. The incarceration has 
been a traumatic experience for her daughter who has mental health issues and 
has had no family contact for four months.  
Vangelina Gloria, resident and representing Puente Arizona. Ms. Gloria spoke 
regarding the appointment of a new County Attorney and was present on behalf of 
her daughter who has been incarcerated for the last eight months. She stated she 
would like a County Attorney that utilizes the Criminal Justice programs available 
and decriminalize mental illness.
Maria Castro, resident and Community Organizer with Puente Human Rights 
Movement. Ms. Castro has been working with the Gonzales and Gloria families 
whose teenage daughters are incarcerated and affected by mental illness. She 
stated the problem of incarcerating the mentally ill has been going on over four 
decades (Graves v. Maricopa County). Ms. Castro urged the Board to appoint a 
County Attorney who will fairly handle the accused, manage prosecutorial 
misconduct, protect the due process of people charged with crimes, be radically 
transparent and end lobbying against criminal reform. She presented a Demand 
Letter document to the Board or Supervisors. 
Analise Ortiz, resident and representing ACLU of Arizona. Ms. Ortiz spoke about 
the Demand Letter which had been presented to the Board, urging them to appoint 
a County Attorney who will not run for office in 2020, allowing the citizens to elect 
a candidate who is not an “incumbent”. She stated her appreciation for the 
appointed Citizen Committee but was disappointed that the Committee did not fully 
represent the community most impacted by the legal system. Ms. Ortiz announced 
she would be willing to be a resource for the Committee and for Living United for 
Change in Arizona (LUCHA), and Puente Arizona who have experienced firsthand 
the shortcomings of the justice system.

Supervisor Gallardo thanked the people who came to speak today. He thanked 
Erika Flores, Senior Communications Officer for all the work she has done for 
Domestic Violence Awareness month. Supervisor Gallardo announced the Annual

D-Back Jam scheduled for September 25, 2019. Kids from local school districts 
were invited to the stadium for a game. He explained in order for the kids to be 
eligible, each was required to perform community service and then write an essay 
about it. A drawing was held and five winners were recognized on the field. One 
was selected to throw out the opening pitch. Supervisor Gallardo noted he had a 
meeting with Phoenix Union High School to plan an event in April 2020 to bring 
together the LGBTQ community from all over the valley. This event is intended to 
give the students an opportunity to meet, share stories, support one another, and 
learn about available services.
Supervisor Sellers noted he attended the following:

East Valley Partnership Board meeting with a presentation on the Palo 
Verde Nuclear Plant as a source of clean energy for our region. 

International Leadership Council - Greater Phoenix Economic Council 
where they discussed the international outreach efforts. 

The Chandler Unified School District had an informational session on the 
Bond Elections scheduled for this year. Many of East Valley schools have 
bond and override elections this year making this information timely. 

East Valley Partnership Economic Development Committee met September 
12, 2019 for an update on economic activity in the City of Mesa. 

East Valley Partnership Government Relations Committee met September 
17, 2019 to start discussions for the 2020 agenda. 
Supervisor Sellers asked his Chief of Staff, Richard (Rick) Bohan to come forward 
to present him with a 20 year service award. Supervisor Sellers gave a brief 
history of Mr. Bohan’s service to Maricopa County.
Supervisor Hickman thanked the Citizens Committee for their willingness to assist 
with the vetting and selection of County Attorney. He stated this is a very important 
public service and wanted to thank them.
Chairman Gates thanked all the people who have attended community meetings in 
District 3: The County coffees for elections discussion, the final New River Area 
Plan meeting, and the Desert Hills lunchtime meeting which is an open forum. As a 
point of personal privilege, Chairman Gates announced the two “Sweet 16” 
Birthdays coming up in the Gates’ Household.

CHANNEL WEST ACCESS ROAD IMPROVEMENT PROJECT
Adopt Resolution FCD 2019R004 for the White Tanks Flood Retarding Structure (FRS) No.3 
Outfall Channel West Access Road Improvement Project (Project), authorizing the Director 
of the Flood Control District of Maricopa County (District) to include Project funding in the 
District’s Five-Year Capital Improvement Program; obtain the necessary Rights-of-Entry; 
advertise, select, negotiate, and award contracts for Project engineering and construction 
services; and expend funds necessary to continue safe operations of the White Tanks FRS 
No.3 Outfall Channel, subject to the ratification and approval of the Board.
The existing outfall structure combines a soft structural channel and a box culvert along a 
five-mile stretch of Jackrabbit Trail to convey storm water from behind White Tanks FRS 
No.3 to White Tanks FRS No.4. The current maintenance access to the outfall channel is a 
multi-purpose road located on the east bank of the channel. As Jackrabbit Trail is being 
widened, an access road and equipment ramps on the west side of the channel are 
required. This Agenda Item impacts Supervisorial District 4 (C-69-20-005-6-00)

(“Agreement”) between Cellco Partnership, DBA Verizon Wireless (“Verizon”) and i) 
Maricopa County (“County”) and ii) Flood Control District of Maricopa County (“District”) to 
allow Verizon to install, operate, and maintain radio distribution or regeneration equipment, 
including repeaters, amplifiers, base station equipment, antennas and associated network 
devices (“In-Building Equipment”) on County and District property located at 2901 and 2801 
West Durango Street, respectively.
This license will allow Verizon, at its sole cost and expense, to install, operate, and maintain 
In-Building Equipment on County and District property to improve and enhance cell phone 
reception within the County and District properties. The term of the agreement is defined as 
that period of time when County and District occupies the space which is the subject of this 
Agreement and continues to utilize the Verizon services in accordance with the terms of the 
Agreement and any amendments thereto, and will terminate upon discontinuance of those 
conditions. The license may be terminated pursuant to A.R.S. §38-511. There is no fee to

Pursuant to paragraph 13 of the Binding MOU between the Maricopa County Stadium 
District and AZPB Limited Partnership, receive the quarterly reports from AZPB Limited 
Partnership regarding disbursements from the Chase Field Reserve Account covering the 
periods of January 1, 2019 to March 31, 2019, and April 1, 2019 to June 30, 2019. (C-06-20-

Director Chucri confirmed this was simply accepting the report and disbursement.
