Jefferson, 10th Floor Phoenix, AZ 85003 BOARD OF SUPERVISORS The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Special Emergency Session at 9:30 AM on Monday, March 16, 2020, in the Board of Supervisors Conference Room, 301 W. Jefferson, 10th Floor, Phoenix, AZ 85003, with the following members present: Clint Hickman, Chairman, District 4 (attended telephonically); Jack Sellers, Vice Chairman, District 1 (attended telephonically); Steve Chucri, District 2 (attended telephonically); Bill Gates, District 3; Steve Gallardo, District 5 (entered late). Also present: Fran McCarroll, Clerk of the Board; Kelly Gardiner, Minutes Coordinator; Joy Rich, County Manager; and Andrea Cummings, Legal Counsel. 1. EXECUTIVE SESSION Vote to convene in Executive Session to consider the items on the Special Executive Agenda dated March 16, 2020, for Board of Supervisors and relevant Special Districts pursuant to the statutory authority listed for each item. ~ There was no Executive Session held at this meeting ~ 2. EXCEPTIONS TO THE MARICOPA COUNTY EMPLOYEE LEAVE (HR2415) AND TELEWORKING (HR2409) POLICIES TO ADDRESS THE COVID-19 VIRUS To address the impact of COVID-19 during this worldwide pandemic, and under the advice of the Maricopa County Public Health Department, approve the following exceptions to the Maricopa County Employee Leave (HR2415) and Teleworking (HR2409) Policies: • Authorize up to 10 days of Emergency Leave with Pay for employees who test positive for COVID-19 or who have COVID-19 symptoms (fever, cough, upper respiratory distress, shortness of breath). • Allow employees to use their Sick Leave to care for their dependent children while schools are closed due to COVID-19. • Employees who are authorized to telework by their Appointing Authority may do so and watch their dependent children at the same time. • Allow employees who have exhausted their Vacation Time and Sick Leave to borrow up to 80 hours of paid leave from their future accruals to care for their dependent children. Special Emergency Meeting Minutes Monday, March 16, 2020 Page 2 of 3 • Custodial parents, custodial stepparents, and custodial grandparents raising minor children or anyone having primary caregiver responsibilities for children or dependent disabled adults are eligible for the teleworking and paid leave options above. • Employees exhibiting symptoms that mirror those of COVID-19, (fever, cough, upper respiratory distress, shortness of breath) are required to stay home until 72 hours after symptoms clear. Employees who wish to use any of these options must work with their supervisor to follow proper call-out procedures and to ensure coverage is maintained. These exceptions will be in effect for 60 days. (C-31-20-044-6-00) ~ Supervisor Gallardo entered the meeting during item #2 ~ Supervisor Gates opened the Special Emergency Meeting for the Board of Supervisors. He confirmed attendance of the Supervisors attending telephonically. Supervisor Gates announced this meeting was called in response to the State of Emergency declared by Governor Ducey and the National Emergency declared by President Trump regarding the COVID-19 pandemic. He said the posting of this meeting came this morning and due to the nature of the emergency, the 24 hour posting requirement was not mandated. The meeting was called to request approval by the Board of Supervisors for exceptions to the Maricopa County Human Resources Policies. Jan Plank, Director of Human Resources was present to review the proposed exceptions to the Maricopa County Human Resources Policy. The specific policies are Employee Leave (HR2415) and Teleworking (HR 2409). There are six items listed and are outlined in item #2 above. Ms. Plank said these requests to the Board are exceptions to the two policies. She said these changes will extend over the next 60 days to ensure employees are safe and have the flexibility to care for immediate family while performing their jobs with Maricopa County. Supervisor Sellers confirmed the 10 days of Emergency Leave with Pay is 10 business days. Ms. Plank clarified that the request is for exceptions to the policies over the next 60 days not to change the policies permanently. Supervisor Gates thanked everyone who worked through the weekend on this unprecedented situation. He stated the exceptions being brought before the Board are forward-thinking and what needs to be done under the circumstances.
