ROAD DECLARED (ROAD FILE NO. 4276-R)

WHEREAS, pursuant to A.R.S. §28-6701(A) and (B), the County Engineer has filed with the Board
of Supervisors of Maricopa County, Arizona, a recommendation praying the Board to establish, open and
declare as a county highway the following described lines, to-wit:
Legal description identified as Exhibit "A", is attached.
WHEREAS, on the 3rd day of August 1987, the Board adopted a resolution, designated Road File
Number 4276 (F20886), declaring all streets in Sun Lakes 21 as recorded in Book 240, Page 32 as
public roads into the County Highway system; and
WHEREAS, Sun Lakes Unit 23, as recorded in Book 278, Page 28 dedicated in all streets as
private streets, which included a portion of San Tan Boulevard lying in Sun Lakes 21; and
WHEREAS, The county Engineer has recommended that the portion of San Tan Boulevard lying in
both subdivisions no longer be identified as a public street and that Road File 4276 be altered to exclude the
portion of San Tan Boulevard lying in Sun Lakes Unit 23; and
WHEREAS, the Board believes that the granting of said petition and the altering of Road File No.
4276 is in the best interests of Maricopa County.
NOW, THEREFORE, BE IT RESOLVED that the alteration of the portion of San Tan Boulevard as
more fully set forth hereinabove, is hereby altered and that the County Engineer is hereby directed to make
a plat of the public streets in Sun Lakes 21 and cause the same to be recorded in the Office of the County
Recorder of Maricopa County as provided by law.
BE IT FURTHER RESOLVED that the Board accept any right-of-way or property donated to the
State or County for said highway. The Board hereby accepts all U. S. Patent easement reservations, right-
of-way or properties along this alignment into the Department of Transportation’s Highway system.
BE IT FURTHER RESOLVED that the County Engineer be directed and authorized, and she is
hereby so directed and authorized, to negotiate with owners of parcels of private property required for the
right-of-way of said public streets with the view of obtaining for Maricopa County said private property,
subject to the ratification and approval of this Board.
BE IT FURTHER RESOLVED that the County Attorney be directed and authorized, and he is
hereby directed and authorized, to initiate and prosecute actions and proceedings in the manner required by
law to condemn all property required for right-of-way which cannot be obtained by donation or purchase.
