AMENDMENT No. 1 to LEASE AGREEMENT
BETWEEN
CITY OF TEMPE, LESSOR
AND
MARICOPA COUNTY, LESSEE
RECITALS
A.
WHEREAS, Lessor and Lessee are parties to that certain Lease Agreement No. L-7414
dated July 1, 2010 by and between the City of Tempe and Maricopa County (“Lease”);
and
B.
WHEREAS, the Lease is for a portion of the premises at 715 West 5th Street, Tempe,
Arizona 85281, consisting of classrooms and playground space and including common
areas; and
C.
WHEREAS, the Term of the Lease expires on June 30, 2020; and
D.
WHEREAS, Lessor and Lessee now mutually desire to enter into this Amendment No.
1 to amend the Lease to exercise the first of four (4) additional ten (10) year terms
(individually, “Renewal Term”) and update Lessee notice addresses.
AGREEMENT
NOW, THEREFORE, in consideration of the foregoing and other good and valuable
consideration, the sufficiency and adequacy of which the parties hereby acknowledge,
Lessee and Lessor agree to amend Lease L-7414 as follows:
1.
The Recitals, by this reference, are incorporated herein and made a part of this
amendment.
2.
The Term of the Lease is hereby extended ten (10) years, commencing July 1, 2020
and expiring June 30, 2030, unless terminated earlier as provided for in the Lease. This
Lease, as amended, is subject to termination pursuant to the provisions of A.R.S. §38-511,
the provisions of which are incorporated herein by this reference.
3.
Notice addresses for Lessee in Paragraph 15 of the Lease is changed as follows:

This amendment shall not become effective until it is executed by both parties.
5.
The foregoing paragraphs contain all the changes made by this amendment. All
other terms and conditions of the original Lease remain the same and in full force and
effect.
