signatures of support received, 9 in opposition. At the 
Planning and Zoning Commission hearing 3 people spoke 
against the request and 2 in support. Subsequently, staff 
received 3 Appeal of the P&Z Commission Recommendation 
in opposition.

On 12/12/19, the Commission voted 8-0 to recommend 
approval of Z2019019 subject to conditions ‘a’ – ‘h’:  
 
a. 
Development of the site shall comply with the Site Plan entitled “Thiele Workshop“, 
consisting of 2 full-size sheets, dated 4/24/2019, and stamped received October 4, 
2019, except as modified by the following conditions. 
 
b. 
Development of the site shall be in conformance with the Narrative Report entitled 
“Anchorpoint Welding”, consisting of 9 pages, dated May 9, 2019, and stamped 
received October 4, 2019, except as modified by the following conditions. 
 
c. 
The following Planning Engineering conditions shall apply: 
  
1. 
Drainage review of planning and/or zoning cases is for conceptual design 
only and does not represent final design approval nor shall it entitle applicants 
to future designs that are not in conformance with Section 1205 of the 
Maricopa County Zoning Ordinance and the Maricopa County Drainage 
Policies and Standards.

2. 
All development and engineering design shall be in conformance with 
Section 1205 of the Maricopa County Zoning Ordinance and current 
engineering policies, standards and best practices at the time of application 
for construction. 
 
3. 
The grading and drainage plan shall be modified per the attached 
Engineering Plan Review Comments memo before submitting for the Building 
permit.  
 
4. 
Storage of materials, walls/fence, parking and storm water retention are 
prohibited in the MCDOT right-of-way. 
 
d. 
This Special Use Permit shall expire 10 years from the date of approval by the Board 
of Supervisors for a period of 90 or more consecutive days, or upon termination of 
the use, whichever occurs first. All of the site improvements shall be removed within 
60 days of such termination or expiration.  
 
e. 
Noncompliance with any Maricopa County Regulation shall be grounds for 
initiating a revocation of this Special Use Permit as set forth in the Maricopa County 
Zoning Ordinance.  
 
f. 
The granting of this change in use of the property has been at the request of the 
applicant, with the consent of the landowner.  The granting of this approval allows 
the property to enjoy uses in excess of those permitted by the zoning existing on 
the date of application, subject to conditions.  In the event of the failure to comply 
with any condition, and at the time of expiration of the Special Use Permit, the 
property shall revert to the zoning that existed on the date of application.  It is, 
therefore, stipulated and agreed that either revocation due to the failure to 
comply with any conditions, or the expiration of the Special Use Permit, does not 
reduce any rights that existed on the date of application to use, divide, sell or 
possess the property and that there would be no diminution in value of the 
property from the value it held on the date of application due to such revocation 
or expiration of the Special Use Permit.  The Special Use Permit enhances the value 
of the property above its value as of the date the Special Use Permit is granted 
and reverting to the prior zoning results in the same value of the property as if the 
Special Use Permit had never been granted. 
 
g.  
Outdoor storage shall remain below the height of the perimeter wall. 
 
h.  
All commercial business work using power tools shall be conducted within an 
enclosed building sound attenuated to achieve maximum of 55 db as measured 
outside property lines.

Project Summary: 
 
1. 
The purpose of this request is to obtain a Special Use Permit, to continue operations of a   
custom welding business on the subject property. The business includes the installation of 
flat beds attached to pickup trucks, welding services and custom steel fabrication. 
According to the narrative, in order to control noise, dust, or light pollution mitigating 
disruption to the neighboring community all business operations are conducted indoors. 
Truck beds are delivered by a tractor-trailer on a monthly, sometimes bi-monthly, basis. 
The proposed workshop will be a 60’ x 55’ fully enclosed steel building, positioned along 
the eastern border, forty-feet from the southern boundary and twelve-feet from the 
eastern boundary of the site. The narrative states the business is a low volume business, 
where a customer visit to the property is minimal and does not increase neighborhood 
traffic.

According to the narrative, the business is specifically tailored, to ensure that the welding 
complies with all minimum county requirements, and to preserve the current rural 
character of the neighborhood. The business hours of operation are Monday – Friday, 
9:00 a.m. to 5:00 p.m. No work is conducted outside of these days and times. There is a 
single employee. No one else is permitted on the site for business purposes after hours.

There are some items stored outdoors; the aforementioned truck beds stacked three 
high, not to exceed 6’ (h) and not appearing above the fence line. The storage of the 
stacked beds comprises approximately one-third of the rear portion of the outside area. 
A forklift is employed to lift the truck beds onto the trucks being fitted for these beds. 
Welding equipment is used as well as small hand-held power tools. All machinery will be 
housed and used exclusively within the proposed workshop. Compressed oxygen and 
acetylene, in cylinders, in its welding operations with both located in the shop. No lighting 
is proposed for the project. An 8’ masonry block wall is proposed along the western side 
of the site to further ensure that truck beds stored on the subject site are not visible, as 
well as the delivering semi-trucks being able to enter and exit through a gated area. The 
wall will separate the front from the rear blocking the view of any operations conducted 
at the rear of the site. There is a violation case on the property (V201801196) with a 
compliance agreement to bring the property into compliance by 12/31/19 with 
completed permits/entitlements. Staff has administratively extended the compliance 
deadline for 90 days to 3/31/20.

Public Participation Summary:

The applicant complied with the Maricopa County Citizen Review Process with the 
required posting of the site and notification by first class mail to adjacent property owners 
within 300’ of the subject parcel and interested parties. The applicant received 
opposition and support to the proposal during the public participation process. The 
applicant also provided a log of phone conversations. Staff received no calls, there 
being 29 signatures of support and 8 of opposition as of writing of this staff report. 
Opposition includes the New River Desert Hills Community Association (NRDHCA) who are 
concerned with potential commercialization of the area.

The proposed use meets the conditions outlined in the MCZO article 1301.1.18 under the 
home-based cottage industry special use requirements. The proprietors resides on the 
property. There were no discrepancies with the lot width, setbacks, or lot coverage, 
according to the site plan. The use is commercial, where the business is conducted by a 
single employee, and is not customer extensive. The property has a violation for 
construction without permits and business in the residential zoning district. Staff is in 
support of the proposed Special Use Permit for ten years. 
 
Recommendation:

For the reasons outline in this report, staff recommends the Commission motion for 
Approval, subject to conditions ‘a’ – ‘f’.

Purpose of Request 
The purpose of this request by Hans, Gail, and Jonathan Thiele 
("Applicant") is to obtain a Special Use Permit, so that Jonathan Thiele may continue to 
operate his small, custom welding business Anchorpoint Welding LLC ("Anchorpoint") 
at 35011 N. 10th  Street, Phoenix, AZ 85086 (the "Subject Property"). The amount of time 
requested for the SUP entitlement is ten (10) years. 
All business operations will be conducted entirely indoors, and will not cause any 
noise, dust, or light pollution disruptive to the community. As a low volume business, 
customer visits to the property are minimal and do not meaningfully increase 
neighborhood traffic. Jonathan Thiele is an Arizona native, and cherishes the dark skies 
and rural character of the Desert Hills community. As you will see, Anchorpoint's 
business operations as proposed in this application are specifically tailored, not only to 
ensure that Anchorpoint Welding complies with all minimum county requirements, but 
also to preserve the current rural character of the neighborhood. 
As is discussed in greater detail in the Citizen Participation Results Report, 
Applicant has received overwhelming support from the community. This is evidenced by 
29 written letters of support signed by Applicant's neighbors, including 6 by neighbors 
residing directly adjacent to the subject Property. Applicant received only three written 
objections to the application, which are based primarily on concerns that Anchorpoint's 
operations may increase levels of dust and noise. Applicant has taken note of these 
concerns and, as described more fully herein, Applicant will build a new workshop so 
that all operations can be conducted indoors, and an 8' foot block wall along the western 
boundary of the Property, which will eliminate any potential dust or noise issues and 
screen the operations from neighbors.

Description of Proposal  
Proposed Uses: 
Applicant proposes to operate Anchorpoint at the Subject Property. 
Business Operations: 
Anchorpoint is in the business of installing flat beds onto pickup trucks, as well as 
providing custom steel fabrication and welding services. In general, these services 
require the use of a fork lift, welding equipment and small power tools (all indoors), and 
delivery and storage of the truck beds to operate its business. Anchorpoint's business 
activities do not interfere with the delivery of utilities or other services to the area. 
I. 	
Workshop 
Anchorpoint operations are currently conducted, to the extent possible, inside of a 
small workshop on the southern end of the Subject Property. As a part of this Application 
(as described further below in the "Description/Location of Buildings" section), 
Applicant will obtain the proper permits to construct a slightly larger 60' x 55' enclosed 
steel building (the "Workshop") near the southeastern corner of the Subject Property. See 
Site Plan attached hereto. Thereafter, all operations will be conducted inside the 
Workshop. 
The Workshop will not change the appearance of the actual residence (house), and 
generally will not be viewable from the street. Anchorpoint already does not generate 
much noise or dust; however, by constructing the Workshop, erecting the 8 foot block 
wall, and conducting all operations inside, Applicant has ensured that its operations will 
be virtually undetectable to neighbors.

Customers and Services 
Very few customers visit the Subject Property on a monthly basis. Anchorpoint 
averages just four to five (4-5) installations of flat beds per month. Customers of 
Anchorpoint may make an appointment during regular 9:00 am to 5:00 pm business 
hours to visit Anchorpoint only to drop off or pick up their trucks, and spend minimal 
time on the Subject Property. There are never more than 2 or 3 customers at the Subject 
Property at any one time. Anchorpoint provides sufficient (no more than 6) off-street 
parking spaces for its customers. Anchorpoint also has the ability to arrange for pick-up 
and drop-off of the trucks to customers, to further minimize customer presence on the 
property. 
Anchorpoint also makes custom handrails, gates, fences and other decorative items 
for installation at homes or offices. However, purchasers of these custom items typically 
do not ever visit the Subject Property. Anchorpoint only makes pre-ordered and custom 
items—there are no retail sales being conducted at the Subject Property. When an 
item is completed, Anchorpoint contacts the customer and arranges for an offsite 
installation date, or ships the items directly to the customer. 
Due to the low volume nature of Anchorpoint's business, it is clear that approval 
of this SUP application will not result in a meaningful increase of traffic. Accordingly, 
without an increase in traffic, there will not be an increase in dust from the roads or other 
traffic related concerns.

Delivery 
Truck beds are delivered by a tractor-trailer (semi-truck) on a monthly, or 
sometimes bi-monthly, basis. The deliveries do not restrict traffic in the area. Delivery 
trucks will enter the Subject Property through the southern gravel driveway, and will exit 
through the northern gravel driveway.

Storage 
The only items stored outdoors are the Applicant's truck beds. The beds are 
stacked three (3) beds high in the back outside area of the Subject Property, not 
encroaching onto the front or side yards. The beds, when stacked, do not exceed 6' high, 
do not rise above the fence line, and generally are not visible to anyone standing outside 
the property. The storage of the stacked beds comprises approximately one-third of the 
back outside area of the Subject Property, which is significantly less than 25% of the 
entire lot size.

Machinery  
Anchorpoint uses a fork lift to lift the truck beds onto the trucks. Anchorpoint also 
uses welding equipment and small hand-held power tools to install the truck beds. The 
fork lift, welding equipment, and power tools do not generate excessive noise, vibration, 
smoke, dust, odors, heat, glare, or electrical interference with radio or television 
transmission in the area that would exceed that normally produced by a dwelling unit in a 
zoning district used solely for residential purposes. Other than transportation of truck 
beds into the Workshop, all machinery, including the forklift and power tools, will be 
housed and used exclusively inside the Workshop. A list of all power tools used in

Anchorpoint uses compressed oxygen and acetylene in its welding operations. 
The compressed oxygen is in a 225-cubic-foot cylinder, and the acetylene is in a 60- 
cubic-foot cylinder. Both cylinders will be chained to a cart located in the shop, and will 
be used exclusively inside the shop. Anchorpoint also heats the welding shop in the 
winter with 3 small propane tanks stored on the bottom shelf of a storage rack in the 
shop.

Anchor Point will use no outdoor lighting. 
All operations occur inside the 
enclosed Workshop. 
Hours/days of Operation: 
Anchorpoint's hours of operation are Monday — Friday, 9:00 a.m. to 5:00 p.m. No 
work is conducted in the evening hours, weekends, or holidays. No non-resident 
employees, customers, clients, or students are permitted on the Subject Property for 
business purposes after hours. 
Number of Employees: 
Anchorpoint has only one full-time employee, Jonathan Thiele, who resides at the 
Subject Property. Mr. Thiele's partner, Jonathan McMahon, spends part-time to full-time 
hours at Anchorpoint, depending on work flow, but does not live at the Subject Property. 
No other employees or students come to the Subject Property. 
The only vehicles parked regularly at the Subject Property are Jonathan Thiele's 
passenger vehicle, Anchorpoint's truck, and the vehicle driven by Mr. Thiele's partner, 
Jonathan McMahon. There are no other vehicles parked at the Subject Property that are 
used for commerce. 
Description/location of Buildings: 
As shown on the site plan, the Workshop will be a 60' x 55' fully enclosed steel 
building located along the eastern border and forty feet from the southern side of the

Subject Property. The Workshop will be built on a concrete pad and powered with 
electricity. The Workshop will be a "dry" building, meaning there will be no plumbing or 
drainage. The Workshop is 46.3' from the house, and approximately 100' from the septic 
tank. 
Screening Wall Details and Location: 
As indicated as Items 4 and 5 on the attached Site/Grading & Drainage Plan, an 
existing 6' block wall runs along the northern, eastern, and southern sides of the Property. 
Applicant is building an 8' masonry block wall along the western side of the Property to 
further ensure that truck beds stored on the Subject Property are not visible, and so that 
the semi-trucks delivering the beds can enter and exit through a gated area, causing 
minimal disruption to the neighboring area. The new masonry 8' block wall will separate 
the front of the Subject Property from the back and block the view of any operations 
being conducted in the back of the Subject Property. The wall is 8' in height and the 
stored beds will not be stacked higher than 6' in height. 
D. 	
Relationship to Surrounding Properties  
The surrounding rural area is zoned as Rural-43, which is the same zoning as the 
Subject Property, and is comprised of mostly 1-acre+ lots. Most of the houses are 
occupied, and a number of the neighboring properties are permitted and/or used for 
commercial activities. Anchorpoint's business activities do not affect neighboring 
properties. All welding is done on a concrete pad, which is at least 40 feet away from the 
nearest neighbor's house. 
Per the County's "PlanNet" overlay mapping website, Applicant's search for 
special use permits in the surrounding area revealed that special use permits had been 
granted on properties at the corner of 12' Street and Carefree Highway (APN 211-52- 
002A) and at the corner of 14th Street and Carefree Highway (APN 211-52-077).The 
Subject Property is surrounded by CUPD and C-2 zoned sites, and it appears that special 
use permits have been granted for APN Nos. 211-52-014C and 211-52-014E, with "other 
status" relating to permits on APN Nos. 211-52-011A, 211-74-012B and 211-74-102. 
A drive through the neighborhood revealed that at least one adjacent neighbor 
appears to be operating an auto repair shop in the back yard of his premises, and another

In light of the Rural-43 zoning designation for the area, along with the above SUP 
applications and business activities taking place in the general vicinity, Anchorpoint's 
business will not be a disruption to the neighborhood and will blend in to the present 
scenery, flow and purpose of the area. It appears from Applicant's research of the area 
that most occupants purchased their properties with an eye toward the potential for home-
based businesses.

First and foremost, I would like to declare that I am NOT in support of the (above) commercial business

Various reasons consist of: 
1- Consistent Daily Noise Pollution 
2- Poorer Air Quality within my Proximity due to Large Machinery and Equipment 
3- higher Traffic Amounts on N. 10th St., of which (above) business is located on the "non-paved 
private portion" of N. 10th St. of which there will be an increase in costs Incurred to the property 
owners in the neighborhood, for example, with,pothole repairs, drainage repairs etc. 
4- JHome values in the neighliorhoix1 may decrease iminensely due to activity and operations of a 
Corrimereial Business Allowance 
5- Theft and Crime may increase in our neighborhood with the hiring of various employees needed 
to operate a commercial business, as these "so called employees" are-considered "non-
residents" of our residential zoned area 
6- There is always an uncertainty of how much any business can impact a residential 
neighborhood. Most importantly regarding Growth of a business; the "now" and "projection 
forward in years", therefore, the (above) concerns/ risks may in fact escalate, leaving that 
"unknown burden to the property owners" of N. 10th  St 
7- Once a commercial business is allowed and permitted in a residential zone, others may want to 
potentially follow, leaving many "unknowns" on all (above) concerns within our neighborhood

Raymond R Reynolds who resides at and owns the property located at 34845 N. 10th Street, 
Phoenix, AZ. Mr Reynolds is currently in the hospital and has requested that I write this letter 
on his behalf. Mr. Reynolds would like to object to the issuance of a special use permit to a Mr. 
J Thiele that would allow a commercial business to be conducted on a property currently zoned 
residential, located at 35011 N. 10th St, Phoenix, AZ. Mr Reynolds recently had a bone marrow 
transplant which has totally eliminated his immune system and will have a severely 
compromised immune system for a minimum of a year while the new cells grow. 
This proposed commercial business is approximately 100' from the door that Mr Reynolds uses 
to access his house. Because of his compromised immune system Mr. Reynolds cannot be 
exposed to fumes, dust and other airborne toxins that this business may genera te. The outdoor 
use of commercial equipment to move heavy materials, as well as welding and grinding would 
cause an undue hardship on Mr Reynolds making him a virtual prisoner in his own home. All 
doors and windows would have to be kept closed at all times and Mr. Reynolds would be 
denied the right to simply sit or walk on his own property. The simple act of getting into a 
vehicle for his doctor appointments would put him at risk. 
This property was bought in the mid 70s as a residential property and has been used as such 
continually since then. Mr Reynolds respectfully requests that this special use permit be denied 
allowing him the right to continue to use his property in the manner that it was designed for,

regard for his neighbors. He has kept an inventory of up to 40+ flat beds to be installed on pickup trucks, 
utilizing a forklift to unload deliveries of the beds, and to move them around the property as more are 
delivered or he installs them. This creates a noise issue as well as a dust concern in an area that a high 
incident of valley fever. In addition he operates at all hours and days of the week. He may be working at 
6am or 11pm. As a neighbor I have had to exsist with excessive noise, loud music, loud talking, grinding, 
beating on metal and the backup alarm on the forklift. This may occur any day of the week, includig 
Saturday, Sunday and holidays. Again he has shown no concern for the effect this has on his neighbors. 
This has created a hardship for me as I can no longer enjoy simple outdoor activities on my property. I 
do not have air conditioning so even having my windows open in the summer to cool the house has 
become difficult. 
Please help keep our neighborhood with the rural/residential enviorment that it is currently zoned as

peaceful residential area, In June of 2019, my father, Raymond R eynolds passed away after being 
confined to his house for several months prior to his hospitalization, because recent increase In dust and 
odors in the area 
There are multiple reasons that I oppose the approval of the special use permit AnChOrpoint Welding is 
requesting. The main point of entry to our house is on the northside, which faces parcel #211-52-105B, 
The wall, hoists and the oversized building is not something that I would like to see when I look out my 
door every morning, and with my wife's health issues (Chronic Migraines, Multiple Chemical 
Sensitivities, and Chronic Coccidiornycosis, aka valley Fever, which left her with her severe asthma), 
approval of this request would limit our ability to utilize our property, affecting my family's quality of 
life, and violating our civil rights to enjoy a peaceful existence. My Family moved out of the city to enjoy 
a peaceful life with beautiful views of the desert. With the changes that Anchorpoint Welding is 
proposing, It will dramatically affect the peaceful residential area by converting it into commercial, 
permanently changing the ambience that everyone that moved out there to enjoy. 
I am not just speaking as a rl generation property owner in the area, I am speaking on behalf all the 
people's fife the Anchorpoint Welding would affect. 
Please don't allow our neighborhood to turn into an industrial complex. 
Upon his passing my father left the property to myself and my siblings. I'm including a copy of the 
beneficiary deed to show ownership. The property has been placed in a family trust, and I am still a 
shared owner.

I'm writing in opposition to the special use permit for the welding business being run out of a 
residence. Parcel number 211-52-105B. I am a shared owner to the property next door to the south. 
Parcel number 211-52-109x. My property was previously owned by my father, who unfortunately 
passed in June of this year. He was also strongly opposed to this business. My father, who loved the 
outdoors, was limited in his final months and needed to stay close to home. This business made it tough 
for my him to enjoy the outdoors of his own property. Noise and dust among other things kept him 
indoors. He knew my fathers' condition, and never stopped. It is understood that if the welding 
operation gets their special use permit, they would probably be required to build a wall. But that won't 
block the view of his hoists. It won't block the view of an oversized workshop. It won't stop the dust. It 
won't stop the noise. It won't stop the fumes. It won't reduce customer traffic. 
My family has owned this land since the mid-70s. They/we didn't move to the Desert Hills area 
to live in an industrial neighborhood. 
The individual that is requesting the special use permit has not been playing by the rules. Why 
should we assume that he will moving forward? His yard is full of equipment and is an industrial blight 
on the neighborhood. There are plenty of areas that are zoned accordingly for his type of business. 
Please don't allow our neighborhood to turn into an industrial complex.

I would like to submit a formal request to appeal the decision to approve the special use permit for Anchorpoint 
Wielding to be located at 35011 N. 10th St. The recommended approval took place at the hearing conducted on 
December 12, 2019. My basis for this appeal is:(1) of the 20 letters in support many if not all of them or not within 300 
feet of this proposed business. The majority of us that are adjacent to this property are not in support of this. We are 
the ones that this will have the most adverse affect on, taking away our quality of life and reducing our property values; 
(2) the property that is adjacent to this proposed business has been placed in my family trust. This property is on the 
south side where there is nothing more than a chain-link fence. There were no stipulations to correct this issue. All 
activity and storage will be visible from this property severely affecting the ability to enjoy the property at 34845 N 10th 
St; (3) it is my understanding that a very large building will be placed at the south east corner of this property which 
again would adversely affect the property on the south with the noise and dust as work is conducted moving trucks, 
truck beds and other items back and forth into the building with a forklift in addition to causing a visual blight. 
The letters of support was a form letter drawn up by the lawyer representing the business owner and do not accurately 
represent the properties that will most seriously be negatively affected.

Dear Maricopa County Zoning Appeal Board, 
I'm writing to formally appeal, the Maricopa County's Planning and Zoning Commission's 
recommendation of approval of the Special Use Permit requested by Anchorpoint Welding for operating 
a welding and vehicle modification business out of a residence, at 35011 N. 10' n St. (parcel 211-52- 
10513), My family purchased 35845 N 10 u St, (Parcel l 211-52-109-X) in 1974, and built a house in 1977 
to reside, and raise their families in a nice peaceful residential area. In June of 2019, my father, 
Raymond Reynolds passed away after being confined to his house for several months prior to his 
hospitalization, because recent increase in dust and odors in the area. 
There are multiple reasons that I oppose the approval of the special use permit that Anchorpoint 
Welding is requesting. The main point of entry to our house is on the northside, which faces parcel 
4211-52-105B. The increased traffic, the hoists and the proposed oversized building and is not 
something that I would like to see when I look out my door every morning and will affect the property 
value, it does not appear that these conditions were taken into consideration with their 
recommendation. Currently my wife has multiple health issues (Chronic Migraines, Multiple Chemical 
Sensitivities, and Chronic Coccidiomycosis, aka Valley Fever, which left her with her severe asthma), 
approval of this request would limit our ability to utilize our property, affecting my family's quality of 
life, and violating our civil right to enjoy a peaceful existence. My family moved out of the city to enjoy a 
peaceful life with beautiful views of the desert. The changes that Anchorpoint Welding is proposing will 
dramatically affect this peaceful residential area by converting it into a commercially zoned parcel and 
permanently changing the ambience that everyone moved here to enjoy. 
I am not just speaking as a 3ril generation property owner in the area, I am speaking on behalf of all the 
people whose lives the Anchorpoint Welding would affect. 
Please don't allow our neighborhood to turn into an industrial complex. 
Upon his passing my father left the property to myself and my siblings. I'm including a copy of the 
beneficiary deed to show ownership. The property has been placed in a family trust, and I am still a 
shared owner.
