Pima Road Drainage Channel

WHEREAS, The Flood Control District of Maricopa County (DISTRICT) was established 
in accordance with provisions of Arizona Revised Statutes Title 48, Chapter 21, which authorizes 
the Board of Directors of the Flood Control District of Maricopa County (BOARD) to acquire by 
eminent domain, purchase, donation, dedication, exchange or other lawful means rights-of-way 
for and construct, operate and maintain flood control works and storm drainage facilities within or 
without the DISTRICT for the benefit of the DISTRICT, to contract and join with the State of 
Arizona, the United States or any other flood control district or floodplain board, municipality, 
political subdivision, governmental agency, irrigation or agricultural improvement district, 
association, corporation or individual in acquiring, constructing, maintaining and operating flood 
control works, and regulating floodplains; and,
WHEREAS, the City of Scottsdale (CITY) was the lead for the Pinnacle Peak South Area 
Drainage Master Study in 2010; and,
WHEREAS, the CITY completed the Pima Road Project Assessment (PA) Pinnacle Peak 
Road to Happy Valley Road Drainage Report in 2017; and, 
WHEREAS, the PA identified a solution to mitigate the flood hazards in the area; and,
WHEREAS, recommended the proposed channel known as the Pima Road Drainage 
Channel (the PROJECT); and,
WHEREAS, the location of the PROJECT is within the CITY beginning at Pinnacle Peak 
Road extending north to approximately 1400 feet north of Happy Valley Road; and,

WHEREAS, from the PA, the estimated cost of the PROJECT is $8,500,000; and,
WHEREAS, in October 2020, the CITY submitted the PROJECT for consideration in the 
DISTRICT’s Fiscal Year 2021/2022 Capital Improvements Program; and,
WHEREAS, in December, 2020, the District’s Flood Control Advisory Board reviewed the 
submitted PROJECT, and with District Director concurrence, recommended the PROJECT for 
future implementation.
NOW, THEREFORE, BE IT RESOLVED that the Director  of the DISTRICT is 
authorized and directed to include funds for the PROJECT implementation in the DISTRICT’s 
current and future Five-Year Capital Improvement Programs, subject to the ratification and 
approval of this BOARD; and,
BE IT FURTHER RESOLVED that the Director of the DISTRICT is authorized and 
directed to negotiate and prepare intergovernmental agreements and/or agreements with 
identified cost-share partners, other municipalities, agencies and others, as appropriate, for cost 
sharing, rights-of-way acquisition, construction, construction management and future operation 
and maintenance of the PROJECT, subject to the ratification and approval of this BOARD; and,
