These billboards will only worsen an already egregious level of
light pollution in Maricopa County. They are unsightly, gaudy,
and distracting to drivers. They will be a detriment to tourism - no
one comes to Arizona to see billboards. Don't mar our beautiful
state further. Arizona needs fewer billboards not more.

As an astronomer living in Maricopa county for the past 35 years,
I have seen the light pollution worsen over and over. Digital
billboards are abnormally and unnecessarily bright. Allowing
them along county roads would have the added effect of
spreading the light pollution out from population centers into what
was previously darker outlying areas. Arizona is known for it's
dark skies but if we do not manage our growth properly, we will
lose that. The two astronomy clubs I belong to (Saguaro
Astronomy Club and East Valley Astronomy Club) hold outreach
programs for the public (star parties). It amazes me how often I
hear from the public at these events that they've never seen the
stars or the night sky. If this proposal is allowed, it will only
spread the light pollution to our more rural communities. I ask the
county to reject this proposal.

I am opposed to digital billboards for two reasons. The first is my
concern that drivers will be distracted, increasing the likelihood of
accidents. The second is that digital billboards will increase light
pollution, which is something we have been trying to decrease.
The billboards are of no value to me or other residents of the
county, they are only valuable to the companies promoting them.

Arizona resident. I object to putting all these visually obstructive
billboards. This is a beautiful state and this is a state known as
the place to go to for astronomy. How can we observe our

To Planning and Zoning Commissioners:
Please register my opposition to the Text Amendment (TA) -
TA2018001 – Off-site Advertising (Billboards).
This TA seeks to permit billboards across county lands, allowing
these signs to be as high as 80 feet tall, as close as 500 feet
apart and as near as 150 feet from residential property.
Most significantly, this proposed TA would allow digital billboards
within the county. Currently the county does not allow this use.
This would be a major increase in intensity and use with
messaging changing as often as 8 seconds on digital faces
double the size of current billboards.
If approved, the process for challenging a billboard would be just
one public hearing. Residents and other stakeholders deserve a
fair and open process to voice our concerns to the county.
I do not want intrusive light to trespass into residential areas. I do
not want to see more billboards on our highways distracting
drivers and compromising driver safety. I do not want advertising
technology to rob our public views and beautiful scenery during
the day and our dark skies at night. I don't live directly in the
affected area, but this spreads. First it's your neighborhood, then
it's mine. I hope you will take my concerns into consideration.

I’m writing in opposition to TA2018001. Some specific areas of concern in the proposed text 
include:  
1403.3.1 A. 1. a. & b. include this sentence in regard to separation distance: “Measurement 
shall not cross any freeway, except within scenic corridors.” Is this sentence stating that if 
across the freeway from another sign, the distance requirement is void? 
1403.3.1 A. 2. seems to allow any currently static billboard that is converted to digital to 
maintain only 500 feet of distance from other freeway digital billboards. Why not the 1,000 feet 
or 3,000 feet required in section 1? 
1403.3.1 B. 1. & 2. have changed the language from “rural zoning district” to “residential use in 
a rural zoning district”. This seems to allow any billboard to be erected a rural zoning district if 
there are no homes present, but we should protect rural areas, homes or not, from light 
pollution. 
1403.3.1 K. 1. Appears to allow conversion of “existing static billboards…that become non-
conforming due to any changes” from this text amendment can be converted to digital, and it 
seems that would be allowed without a public hearing. Is that interpretation correct? If so, this 
allowance should be struck, as people have the right to know of a change like this to a sign 
near them before it is done. 
1403.3.1 K. 3. a. i. is struck-through and that is also a concern. Property values are extremely 
important to the owners of those properties and this should absolutely be a consideration of 
allowing digital billboards. My home is just over 500 feet from a static billboard, but I would 
definitely not want to be that close to an excessively bright, ever-changing sign, and fell it 
would detract from my home’s value. 
1403.3.1 K. 3. a. viii. is struck-through and needs to be reinstated as well as modified. Notice 
of this hearing should be sent to all property owners within 500 feet or more. 
Personally I find digital billboards obnoxiously bright and potentially distracting to drivers, and 
feel they have no place off-freeway. I would prefer to have the current prohibition in Maricopa 
County continue.

To Planning and Zoning Commissioners:
Although I do not live in Maricopa county I feel very strongly
about this issue. I am a member of an astronomy club in Tucson.
Please register my opposition to the Text Amendment (TA) -
TA2018001 – Off-site Advertising (Billboards).
This TA seeks to permit billboards across county lands, allowing
these signs to be as high as 80 feet tall, as close as 500 feet
apart and as near as 150 feet from residential property.
Most significantly, this proposed TA would allow digital billboards
within the county. Currently the county does not allow this use.
This would be a major increase in intensity and use with
messaging changing as often as 8 seconds on digital faces
double the size of current billboards.
If approved, the process for challenging a billboard would be just
one public hearing. Residents and other stakeholders deserve a
fair and open process to voice our concerns to the county.

LED lighted billboards were tried in LA and were taken down due
to so many accidents near them. Don't try it in Arizona! You are

ATTENTION OF EVERYONE WITHIN VIEW." (Emphasis mine)
The above quote is in a promotional video by Trans-Lux, a
company that designs, sells and maintains outdoor digital
billboards, such as proposed in TA 2018001, according to
IllinoisLighting.org, a coalition for responsible outdoor lighting.
That's a frightening picture--drivers visually bombarded with
HUGE, EVER-CHANGING SCREENS on busy roadways; AND
to date--advertisers, at least--bear no responsibility for creating
these hazardous distractions. Just think: Trans-Lux ADMITS
digital billboards exploit the latest in media design to DISTRACT
and COMPEL us to watch. 
While we're driving. While trying to sleep. 
The TIME IS NOW to quash corporations set to conquer those
counties currently with no digital billboard restrictions--"fresh
meat," if you will--with irresponsible, free-for-all proposals that
disrespect essential boundaries as driver safety and
neighborhood quality of life.
Each of these proposed policy changes will only benefit sign
companies' profits. Not one of them is pro-citizen. They are a
BLATANT TAKEOVER OF OUR SAFETY, OUR QUALITY OF
LIFE, AND OUR PUBLIC VIEWS.
Imagine TA 2018001's effects:
Digital billboards at least THREE TIMES THE HEIGHT of an
AVERAGE RESIDENTIAL HOME.
80 foot tall billboards TOWERING OVER TREES.
UGLY FLASHING BILLBOARDS LOWERING PROPERTY

VALUES. (Will YOU buy a home nearby?)
Digital billboards BLASTING FLASHING IMAGES/LIGHT INTO
RESIDENTIAL HOMES INTO THE NIGHT, DISRUPTING
SLEEP.
Light emitted from digital billboards WILL AFFECT DRIVERS
AND RESIDENCES EVEN FURTHER THAN THE PROPOSED
150 FEET OF SEPARATION (Please see Trans-Lux quote
above).
Our beautiful night canopy of stars--erased. Even now, in
Payson, Arizona, where I live, the direction of Maricopa County
can be discerned simply by its light pollution.
Instead... consider safety on our roadways to rank as much more
important than advertising.
Consider the right to essential cycles of sun and dark of night for
health of humans, animals and plants.
And consider helping to preserve the desert beauty of Maricopa
County, Arizona with sane, responsible outdoor lighting policies.

There are several reasons why I oppose this Text Amendment
that is being proposed by an individual organization for their self
interests:
1- this is only about their interests and needs. Yhey are
struggling to find sites to erect billboards; therefore they are only
looking out for themselves. Putting more billboards closer
together is only about finding ways to their income. The TA does
nothing for the citizens of Maricopa County
2. Billboards close to neighborhoods negatively impact the value
of homes
3. Billboards (especially digital ones) are distracting and unsafe.
The State has outlawed use of cellphones while driving, yet this
TA would expand another unsafe driver distraction. That does
not make sense. Drivers should keep their eyes on the road, not
on roadside flashing billboards
Please oppose this change in the Maricopa County zoning code

Dear Chair Arnett & Members of the Commission: 
 
Please accept these comments on behalf of the Sierra Club’s Grand Canyon (Arizona) Chapter and our 
thousands of members and supporters who reside in Maricopa County. We ask that you reject the 
text amendment TA 2018001 Off-site advertising signs (billboards) before you due to the harm it will 
cause in our communities. 
 
The Sierra Club’s mission is “to explore, enjoy, and protect the wild places of the earth; to practice 
and promote the responsible use of the earth’s ecosystems and resources; and to educate and enlist 
humanity to protect and restore the quality of the natural and human environments.”  Our members 
have a significant interest in keeping dark skies, reducing energy use, and making our communities 
more livable.  We have consistently opposed efforts to promote electronic/digital billboards. 
 
Digital billboards contribute significantly to roadway blight, are a huge distraction for already 
distracted drivers, and emit a considerable amount of light upward, threatening dark skies in natural 
areas as well as for Arizona’s observatories. Many communities have taken actions to protect the 
dark skies, recognizing their value for the average citizen, but also recognizing their economic 
importance for the observatories. There appears to be no consideration of that potential impact 
relative to this text amendment. 
 
Digital billboards can also consume significant amounts of electricity, taking us in the wrong direction 
when it comes to energy efficiency and conservation, and in so doing increasing our energy footprint, 
including associated pollution and water use. 
 
We oppose this text amendment, including the provisions allowing signs as high as 80 feet, only 500 
feet apart, and near residential property at 150 feet. We also oppose this significant change for the 
county to move from no digital billboards to allowing digital billboards. Please reject this text

amendment and put the welfare of our communities ahead of the demands of these billboard 
companies.

themselves. Maricopa county doesn't need digital billboards.
They're a dangerous distraction to travelers and an annoyance to
homeowners. This seems like an end run around the people of

Please register my opposition to the Text Amendment (TA) -
TA2018001 – Off-site Advertising (Billboards).
This TA seeks to permit billboards across county lands, allowing
these signs to be as high as 80 feet tall, as close as 500 feet
apart and as near as 150 feet from residential property.
Most significantly, this proposed TA would allow digital billboards
within the county. Currently the county does not allow this use.
This would be a major increase in intensity and use with
messaging changing as often as 8 seconds on digital faces
double the size of current billboards.
If approved, the process for challenging a billboard would be just
one public hearing. Residents and other stakeholders deserve a
fair and open process to voice our concerns to the county.
I do not want intrusive light to trespass into residential areas. I do
not want to see more billboards on our highways distracting
drivers and compromising driver safety. I do not want advertising
technology to rob our public views and beautiful scenery during
the day and our dark skies at night.

The addition of digital signs on county land, which could occur in
most rural areas will be a blight across Maricopa County and also
impinge on Dark Skies regulations, which we in our rural area are
seeing the declination of clear and dark skies. The proposal will
allow larger and higher signs to be placed that will affect the
peace and privacy of any citizen living near them. There is NO
NEED to increase advertising beyond the Phoenix or other
city/town limits. We in county islands see this as a significant
threat, especially after larger signage was approved for a gas
station on Mile Post 232. We do NOT want to be LA or any other
overgrown area and we must preserve our deserts, our stars, our
wild animals and not allow any of this greedy push to ruin our
skies. Thank you.

How many trees and shrubs will be cleared for electronic
billboards? We do NOT need more light pollution in Maricopa
County! Research done online: Some cities and states are
debating whether to limit or regulate these types of signs
because of the distraction they provide for drivers. Do we need
more distracted drivers on the road? Digital billboards use LED
lighting for their displays. Digital billboards, which are made of
LED lights, consume lots of energy and are made of components
that will turn into e-waste once the billboard’s life has ended...not
environmentally friendly. digital billboards have hundreds if not
thousands of LEDs, which are illuminated day and night. And
LEDs function poorly at high temperatures, so the signs need a
cooling system. In a year, a digital billboard can consume up to
30 times the energy that an average American home uses.

It is disturbing that the language of the request has not
substantially changed from the last meeting. Specific objections
are:
1. The density of digital billboards will increase due to the ability
of converting an existing static billboard that is currently 500 feet
from a digital board.
2. There is no limitation placed upon conversions of existing
static billboards to digital. The economics are obvious. Why
retain a static billboard where you can bill a single customer once
a month, when a digital customer can be billed every 8 seconds?
3. The notification to property owners near billboards and
consideration of degraded property values remain crossed out.
As a property owner it is unfair for a government entity to
deliberately ignore the impact of their decisions upon the
citizenry. No specification or consideration is given to light
trespass, Rights of existing property owners are not considered
other than proximity in this ordinance.
4. The night time brightness of digital billboards is still set
uniformly at 300 nits. This is much too bright in urban areas and
especially for rural areas where there is no other bright light
source nearby.
I am hopeful that staff will consider the comments and
recommendations and adjust the text to protect property rights,
the potential for unlimited conversion of static boards to digital,
and the addition to general light pollution from excessively bright
digital billboards.

I would like to be contacted by staff to understand how
compliance with sign codes concerning lighting are enforced. I
would also like to recommend that Planning and Development
adopt a standard that all illuminated billboards be turned off at
11pm, not just digital ones. I do not know if the current rules
require this. In driving around the valley at 2am I notice that
many static billboards are not illuminated after 11pm. The major
exceptions are from two vendors (discounting those on tribal
lands).

appeasing the business community over that of its residents
concerns about their home environments. This blatant visual
pollution proposal and change to signing regulations is an assault
to our existing beautiful neighborhoods and our attempts to

new signs would be bigger, bright enough to interfere with sleep
and more closely packed. No project or rule change should ever
be undertaken without an environmental impact study, audited by

Association we have opposed all digital billboard conversions in
and around our association's boundaries since I first the board.
The light emitted from digital billboards has been shown to
increase accidents and response times in traffic. AZ has some of
the most amazing views of mountainous silhouettes cast against
our clear starry skies. The light produced from these billboards
takes away these views and provides no benefits to the
community. I urge you to not pass TA2018001 as it endangers
our drivers and our peaceful night skies.

Please register my opposition to the Text Amendment (TA) -
TA2018001 – Off-site Advertising (Billboards).
 
This TA seeks to permit billboards across county lands, allowing
these signs to be as high as 80 feet tall, as close as 500 feet
apart and as near as 150 feet from residential property.
 
Most significantly, this proposed TA would allow digital billboards
within the county. Currently the county does not allow this use.
This would be a major increase in intensity and use with
messaging changing as often as 8 seconds on digital faces
double the size of current billboards.
 
If approved, the process for challenging a billboard would be just
one public hearing. Residents and other stakeholders deserve a
fair and open process to voice our concerns to the county.
 
I do not want intrusive light to trespass into residential areas. I do
not want to see more billboards on our highways distracting
drivers and compromising driver safety. I do not want advertising
technology to rob our public views and beautiful scenery during
the day and our dark skies at night.

Dear Friends on the Planning and Zoning Commission,
I'm writing in opposition to text amendment TA2018001 amending Maricopa County road
signage ordinances.
In 1984 when Calvin Goode appointed me to sit on the Phoenix Bond Committee that put
before the voters of Phoenix the rare opportunity to create what is now the Phoenix Mountain
Preserves, we did so with the mindset that as we grew as a community, we would leave in
perpetuity both the beauty and access to our natural environment.  One of the enduring
memories as a then 24 year old was hearing Ben Avery, the famed local naturalist, speak to us
about the legacy of what we were trying to accomplish in the hopes that it would abound
beyond Phoenix and be a catalyst County and State wide.
Today, had we capitulated to development interests, had Bill Lane, the then State Land
Director not signed on to selling Phoenix then, "Squaw Peak," as part of our proposal, access
to our natural environment for everyone, and worse, development causing visual blight up and
down South Mountain, North Mountain, and Piestewa Peak would have been a reality. 
Millions of people world wide would have had a different, degraded view of the Phoenix area.
What you have in your hands here is no different.  Is the County Board of Supervisors Legacy
to be one of short term profits in the hands of a few, or the long term profits that come from
tourists from all over the world to see, visit, walk, enjoy, and perhaps move and live in what
we have created to the benefit of the entire local economy.
Think strategically.  This is a small minded anti business text amendment, not a greater good
pro business text amendment.  What short term profits gained are minuscule in comparison to
the desire of visitors to relocate to our unique environment.
I shutter to think what the impact on our local economy would have been had we not
preserved our mountains and you should think the same in considering this text amendment
for the very same reasons.
It is simply VERY bad public policy.

Please register my opposition to the Text Amendment (TA) - TA2018001 – Off-site
Advertising (Billboards).
 
 
 
This TA seeks to permit billboards across county lands, allowing these signs to be as
high as 80 feet tall, as close as 500 feet apart and as near as 150 feet from
residential property.
 
 
 
Most significantly, this proposed TA would allow digital billboards within the county.
Currently the county does not allow this use. This would be a major increase in
intensity and use with messaging changing as often as 8 seconds on digital faces
double the size of current billboards.
 
 
 
If approved, the process for challenging a billboard would be just one public hearing.
Residents and other stakeholders deserve a fair and open process to voice our
concerns to the county. 
 
 
 
I do not want intrusive light to trespass into residential areas. I do not want to see
more billboards on our highways distracting drivers and compromising driver safety. I
do not want advertising technology to rob our public views and beautiful scenery
during the day and our dark skies at night.

I am deeply opposed to the TA2018001 - Off-Site Advertising (billboards). This amendment is a terrible idea on so
many levels, would harm the County and its residents, and would only benefit outdoor advertisers.
Some of the areas of concern for me:
(1) This text amendment would transform the scenic views from our county roads to nonstop advertising— huge
signs as high as 80 feet tall, 500 feet apart, and as close as 150 feet from residential property, none of which are
allowed or exist at present.
(2) Allowing digital billboards all over the county would be dangerous. I know because I am very distracted by
digital billboards when I am driving.  It is hardwired into our human brains to notice abrupt visual changes — in a
natural setting, noticing these changes could mean surviving a bear attack.  However, on the road, these visual
changes distract from the serious business of driving.  Being surrounded by digital faces that are double the size of
current billboards and change every 8 minutes will increase the stress of driving and increase the likelihood of
accidents.  I wonder whether our car insurance rates will increase as a result.
(3) Tourism dollars will be lost.  Where will our tourists drive to enjoy scenes of the desert?  Will they come to
Maricopa County to enjoy drives looking at the ever-changing digital billboards? If they want to enjoy natural
scenery, they will have to avoid Maricopa County.  I understand Pima County and Yavapai County are lovely—
perhaps our tourism dollars will migrate elsewhere?
(4) The light from the billboards will affect wildlife and residential neighbors. How many neighbors want to see
digital billboards from their living rooms, their kitchens, their bedrooms, their back yards? Wildlife, who are already
stressed and finding their lives changed by food and water shortages and climate change will be subject to more
distress from these huge beacons of light.   Light from billboards also pollutes our views from space— making it
more difficult to be able to use telescopes and for us as humans to enjoy views of our night skies.
I urge you to reject proposed Text Amendment TA2018001 because it is a bad idea for Maricopa County.

I am opposed to the TA2018001 - Off-Site Advertising (billboards). This amendment is a bad idea and would harm
the County and its residents. The amendment would benefit outdoor advertisers, but I fail to see how the proposed
changes would provide a public benefit. Drivers already face many distractions, both inside and outside of their
vehicles, that diminish public safety. The whole purpose of a billboard is to attract a driver’s attention and divert
their thinking, if only for a few moments, from their primary responsibility of operating their vehicle safely. At the
current 1,000-foot spacing requirement, a driver traveling at 60 mph could pass a billboard about every 11 seconds.
How would cutting the minimum spacing in half so twice as many billboards that are only about 5.6 seconds apart
could be installed to compete for a driver’s attention not further compromise safety? How would allowing those
billboards to be more than twice as large and possibly more than twice as tall as the current limits not further distract
drivers? And how would permitting those billboards to be digital not dangerously urge drivers to divert their
attention from the road, especially at night? Advertisers already have many avenues through which they can reach
consumers. In order to approve the proposed changes, you must be ready to justify why it would be beneficial to
reduce public safety to accommodate the desires of the advertising industry. This would not be a tradeoff that would
be in the public’s best interest.
I urge you to reject proposed Text Amendment TA2018001 because it is a bad idea for Maricopa County.

Dear Wendell - great letter, you hit all the high notes very clearly.
 
I joined the TA 2018001 webinar this morning and my impression is that the commissioners are so
bound up with the rules and regulations and the changes the billboard lawyers are putting forth,
they can’t see the saguaros.  Nor the best interests of Maricopa County citizens.
 
I spoke on the webinar along with half a dozen very knowledgeable guests, all Opposed to this plan
to allow county billboards to be higher, larger, closer together and digital – and please, deleting the
digital section will not mollify those of us opposed.
 
Except for these speakers, the staff and commissioners never mentioned the impact on the public as
our beautiful desert county is invaded by yet more onerous billboards nor the impact on our dark
skies, what we have left.  What will our tourists think of these terrible billboards when other states
are tearing them down?
 
My own closing comment was that the public is obviously not aware of what the commission is
planning to endorse, and when that happens there will be a major outcry of opposition.  It behooves
all of us who DO know what they’re planning to get the word out via social media, PBJ and the
Republic.  There is a second meeting coming up in July and then a decision in August.
 
When I have more information on meetings and how we can effectively be heard, I will share with
you and others who should be able to assist in opposing this most important decision.

not provide a control option infringing on space we all
share. I do not want advertising technology to rob us of
our views and natural scenery during the day and our
dark skies at night any more than currently allowed. I do
not want to see more billboards on our highways distracting
drivers and compromising driver safety. I do not want intrusive
light to trespass into residential areas.

Advertising (Billboards)
TA2018001 Proposes significant changes to the MCZO Sign Ordinance which are less
restrictive than those authorized by ARS 28-7912. If approved, the ordinance would impair
Maricopa County’s ability to effectively regulate and control outdoor advertising along interstate,
primary and secondary highways.
TA2018001 Proposes significant changes in billboard quantity and intensity. If the TA is
approved, it would fundamentally alter highways in a negative way throughout Maricopa County;
the only ones that are served by this significant change to the MCZO would be billboard
companies and landowners where the billboards are leased. There is no public benefit.
The TA is intended to be Maricopa County wide in many zoning districts. If passed, the following
are a few major points on what the draft TA will do to the current zoning ordinance:
1.
Allow for billboards to go to a maximum height of 80 feet at grade. Currently,
certain zoning districts are allowed a maximum of 48 feet and others only 30 feet at road
level. The new definition of grade would include both natural grade and the grade of an
elevated freeway.
2.
Allow for a reduction in spacing between billboards. Currently, they need to be
1,000 feet apart. The TA would allow for only 500 feet of separation.
3.
Allow for billboards to go from static to digital. This would greatly increase the
intensity of a billboard’s impact on any given location. Currently, Maricopa County does
not allow for digital billboards.
4. Allow for an increase of the square footage of a sign face from 300 square feet
to 672 square feet. This would increase the size of a board to the larger 14’ x 48’
industry standard.
5. Allow for an administrative approval process for new billboards with only one
public meeting for residents and other stakeholders to voice their concerns.
6. Remove the “Take Down” requirement of Legal Non-Conforming Off-Premise
Signs (Billboards) to allow conversion of Static to digital. This would violate the FSA
and contradict effective control of outdoor advertising.
Section R17-3-701-C-3 Nonconforming signs shall be in violation if:
a. A sign is enlarged (increased in any dimensions of the sign face or structural support),
b. A sign is replaced (an existing sign is removed and replaced with a completely
different sign),
c. A sign is rebuilt to a different configuration or material composition beyond normal
maintenance,
d. A sign is relocated (moved to a new position or location without being lawfully
permitted), or
e. A sign which was previously non-illuminated has lighting added.

While the proposed TA does not change the ordinance as it pertains to Scenic Corridors and
overlays, it does permit billboards within 660 feet of a scenic corridor. This made sense when
billboards were only static (conventional). Digital billboards are designed to be viewed from
1,000 feet or more.  Also, the definition of Scenic Corridors needs to be expanded, as do other
definitions, but scenic corridors should include any scenic route/road and historic sites adopted
or recognized by the municipalities.
Many changes proposed, all bad.
Most significantly, this proposed TA would allow digital billboards within the county to be as high
as 80 feet tall, as close as 500 feet apart and as near as 150 feet from residential property.
Currently the county does not allow this use. This would be a major increase in intensity and
could and likely will double or triple the number of billboards with messaging changing as often
as 8 seconds on digital faces double the size of current billboards.
The proposed TA also fails to address lighting and illumination standards that would mitigate the
harmful impacts on Arizona’s Dark Sky communities and Astronomy and Space Industry
If approved, the process for challenging a billboard would be just one public hearing. Residents
and other stakeholders deserve a fair and open process to voice our concerns to the county.
I do want intrusive light to trespass into residential areas.
I do not want to see more billboards on our highways, distracting drivers and compromising
driver safety.
I do not want advertising technology to rob our public views and beautiful scenery during the
day and our dark skies at night.
Please reject the proposed Text Amendment – TA2018001.

It is important to consider the level of illumination of digital
billboards in darker areas, especially with residential property
nearby. I believe the current recommendation for 300 nits
illumination following sunset is based upon language in ARS 28-
7902. That legislation was a compromise which helped define
and protect encroachment of digital billboards near astronomical
observatories. The standard was adopted at the time because
most digital billboards were envisioned for placement in urban
areas, and because digital billboards were fairly new and
research on their impact was limited. The level of 300 nits is too
high a level, especially in dark rural areas. This is especially true
if the sign is as large as 672 sq ft in size. A better method to
determine brightness is to use a standard adopted in numerous
states of 0.3 foot candles over ambient lighting conditions. This
would enable brighter signs in urban areas, but lessen the
amount of light in a rural setting. A better calculation of
brightness, rather than a single number, is necessary to avoid
the incredible brightness of digital billboards in a rural
environment.
The text of ARS 28-7902 enables local governments to craft
better and more up to date regulations based upon the language
in section L of the legislation:
L. This section does not prevent a city, town or county from
enforcing or enacting an ordinance regulating outdoor advertising
that is authorized by subsection E of this section, including the
lighting of the outdoor advertising. The city, town or county may
enact an ordinance that is more restrictive than this section but
not less restrictive than this section.
I hope staff will consider comments made by myself, Dr. Rolf
Jansen and others to recommend a standard that considers the
location of the digital billboard in a rural site. This would help
protect the dark skies while also lessen the negative impacts of
driver distraction and light trespass in these areas.

Maricopa County should reject Text Amendment TA2018001. The proposed amendment would 
would negatively impact driver safety and human and ecological health, harm nearby properties, 
degrade the scenic qualities of the community, and grant undue concessions to billboard 
companies. 
 
 
Dear Chairman Arnett and Planning and Zoning Commission Members, 
 
As the only national nonprofit that helps citizens safeguard the scenic qualities of America’s 
roadways, countryside, and communities, Scenic America actively supports local efforts to 
preserve scenic beauty and oppose visual blight in cities throughout the United States. For almost 
forty years, our organization has identified billboards as a particularly harmful form of scenic 
blight, with significant negative impacts.  
 
We have learned of Text Amendment to amend Chapter 2, Definitions and Chapter 14, Articles 
1403 and 1404 of the Maricopa County Zoning Ordinance (MCZO) relating to Off-Site 
Advertising Signs (Billboards). The proposed amendment is being processed through the 
Enhanced Regulatory Outreach Program, in preparation for a Planning and Zoning Commission 
hearing. This amendment would, among other things, significantly increase the number of 
billboards in Maricopa County and allow the currently prohibited conversion of static billboards 
to digital billboards.  
 
During public hearings for the proposed amendment in 2019, 155 organizations and local 
citizens responded with comments, questions, and critiques, and more have commented since 
then. The large majority of comments opposed the amendment, and citizens expressed particular 
concern regarding light pollution, driver distraction, visual blight, uncontrolled proliferation of 
digital billboards, degradation of scenic areas including designated scenic byways corridors 
which support travel and tourism, and constraints on public input and lack of notice for parties 
impacted by future billboards. The proposed amendment has far-reaching consequences, and key 
stakeholders such as officials from the Town of Gilbert, the Surprise City Council, the City of

Glendale, and the Signs Supervisor for the City of Phoenix have all expressed concerns about the 
amendment. 
 
The most recent version of the proposed amendment changes very little from the earlier version, 
and does not adequately addressed any of the concerns raised by citizens in 2019 or in 2021. 
 
First, there is a preponderance of evidence demonstrating the negative impacts digital billboards 
have on public safety by altering driver behavior. Digital billboards create dangerous and 
unavoidable driver distractions by design and for the purpose of drawing driver attention away 
from the road and toward the advertisements. Human error is the leading cause of traffic 
accidents, and lawmakers have come to recognize the importance of reducing driver distraction 
by enacting laws to ban cell phone use while driving. As digital billboards have become more 
common, an emerging body of research indicates that digital billboards can create similar 
distraction conditions.  
 
For an extensive list of the dangers which digital billboards pose to drivers, please refer to this 
compendium of research studies which describe the hazards at length.1 This research was cited 
by other commenters, and we encourage you to review the most recent version of the 
compendium, which includes even more evidence about the hazards posed by these signs. Other 
public comments cited a Federal Highway Administration report which minimized the dangers of 
digital signs; the flaws in that report are explored at length in a detailed critique which is also 
available for review.2 
 
In addition to harming drivers, digital and brightly lit static billboards harm wildlife. These 
structures contribute to the growing problem of light pollution, which disrupts the circadian 
rhythms and related behavior of local wildlife populations. People are not immune to this kind of 
pollution, and excessive lighting can negatively impact human health as well as ecosystems.345 
 
Visual blight from billboards constitutes a threat to property owners and to overall quality of life 
in a city. The threats to scenic value posed by the proliferation of billboards are broadly 
recognized and have served as the impetus for the creation of sign ordinance laws throughout the 
country. Proponents of billboards describe them as sources of economic growth, but there is no 
evidence that billboards sufficiently offset the losses they impose on others, or that they function 
as net positive assets for a community. More than 700 towns in America, as well as four states, 
have banned billboards, and billboards are not necessary to support economic growth. Billboards 
impose significant negative externalities upon the communities which host them, and 
amendments to sign regulations must account for the blight which spurred the creation of those 
laws.  
 
Finally, as a matter of good governance, consider the process used in other communities for 
removing multiple static billboards in exchange for approval of a single new digital billboard.

Almost every community that has permitted digital billboards in recent years has accepted an 
agreement to reduce the total number of signs permitted. For example, Kansas City, MO, 
considered a proposal for an equivalent seven to one conversion agreement.6 Gulfport, MS, had 
an agreement for a six to one conversion ratio, and Tampa, FL, had a ten to one ratio.7 The lack 
of a defined conversion ratio for static to digital billboards in Maricopa County represents a 
significant concession to billboard companies. 
 
Ultimately, this proposal is bad for the people of Maricopa County. It would make driving more 
dangerous, it would allow billboards to negatively impact human health and the local ecosystem, 
and it would harm property owners and reduce the scenic qualities of the surrounding area. The 
existing billboard laws reflect a desire to prevent the kind visual blight that this amendment 
would create. We therefore recommend that this amendment be rejected.

As a driver I find the digital billboards within city limits to be distracting. I fear at higher freeway
speeds in the county they would be dangerously distracting.
The larger digital billboards can be seen at up to 1000 feet and the current buffers in zoning
districts would not apply. Further, the current setback of 660 feet from scenic corridors and
protected overlays such as the mountain preserves and county parks would not be sufficient.
The process for challenging a billboard would be just one public hearing. Residents and other
stakeholders deserve a fair and open process to voice our concerns to the county.

My name is Dominic Martinez and I live in Laveen Arizona. I believe that we should not allow
billboards to ruin our community. Billboards are extremely well lit. Not only regular billboards but
also LED billboards put out tremendous amounts of light. These billboards will add additional light
into our night sky and furthermore drowning out the stars that we have over South mountain. By
allowing these billboards to be so close and so frequent we will never see stars in this area of the
valley again. An additional way that billboard's ruin the community is they will block our views of the
mountain. One of my favorite things to do is drive the new highway and we should be preserving this
as a scenic road not selling it out to the highest bidder. The scenic views on the loop 202 are one of
the best views of the entire Phoenix Metro area. If you were to rate these views by anyone that
drives from Chandler to the west side you would understand this too. By trying to place billboards in
this area you will not only ruin the views but also obstruct the scenery of our great desert. Billboards
are terrible foreign communities mainly because they will bring additional unneeded light to our
night skies and they will ruin our beautiful views of the Estrella mountains. These billboards will be
no benefit to our community the money will not benefit our community. There are many places in
the valley that have billboards and others that do not and you can tell what type of people live in
those neighborhoods. Please do not make South Phoenix deal with billboards because you want to
please your big business agendas. We need to make sure that we're thinking about what are tourist
will think of us as a visit our area and drive on our highways. Phoenix should not be a giant
advertisement as you cruise down to the stadium from the east side to the west side. Please
consider rejecting any recommendations or request for billboards on the loop 202 by Leveen.

Some concerns in county areas adjacent to Gateway Airport is
the height of allowed signs, location in proximity to runways and
flight paths, and the digital illumination intensity and timing of
display changes. We address this with municipalities on freeway
monument signs. State Route 202 and State Route 24 (now
being extended) border Gateway Airport. In the 'Definitions'
section for 'Freeway' it lists SR 202, but is there a plan to add SR
24 as well, if County areas are contained in the alignment?
Gateway's concern is that any new billboard signs allowed in
vicinity of the airport undergo an FAA 7460 review to determine if
the height and any wireless frequencies could be of impact to
airport operations. This was recently completed for new
billboards on County land on Ellsworth Road, adjacent to
Gateway Airport, and if we would be notified on any new
proposals.

What we do not need in our beautiful state are more distracting, unattractive and unnecessary billboards.   There
must be a better way to get revenue than creating distractions causing more lack of concentration to drivers and
passerby’s. To say nothing about the potential fire hazards these items create.

Please note my very strong objection to the above amendment to our County Zoning.  There is
absolutely no good reason for more intrusive and unsightly advertising via billboards, nor the
added distraction and danger of digital billboards.  Maricopa County is not Las Vegas.  Please
preserve the views of our lovely state for those traveling within and through.  Highway
billboards have been a nuisance and calls for their elimination go back to Lady Bird Johnson. 
We are being bombarded and overloaded with light-polluting, distracting, view blocking
billboards for far too long.  The only ones who benefit are sign owners and property
landlords.  It does not serve to benefit the tax-paying citizens of Maricopa County in any way.
The County Commission's response will reflect my voting choices.  Thank you.

Dear Ms Applegate,
I was told if I registered for tomorrow's webinar I'd have the opportunity to provide written input rather than
speaking at that webinar. Here's my input:
I strongly oppose the addition of more electronic signage on several grounds:
1. We are losing our night sky, a valuable resource for Arizona pros and amateurs.
2. We don't need additional distractions for drivers.
3. Purely on the basis of energy conservation and climate change, these are absurd vehicles for
advertising. The larger signs actually require internal AC to cool the electronics, and I know of at least one
sign operator that has overridden the factory default settings that normally dim them at night.
If these signs must be built, I would urge some type of regulatory action to ensure electronic signs are
dimmed at night when full brightness is not required for visibility. I would also urge the use of a new
technology called SITELINE™ that can reduce the light scattered in other directions while still being
visible to drivers. See:

Although that article talks about light scattered to the sides into adjacent neighborhoods, the technology

I am opposed to this TA for the following reasons:  
1) This TA would allow billboards to multiply in number, concentration, and physical size
across county lands, allowing these signs to be as high as 80 feet tall, as close
as 500 feet apart and as near as 150 feet from residential property.
 
2) This proposed TA would allow digital billboards within areas of the county where
they would be disruptive and distracting, since they would be visible from within areas where such
intrusions are not allowed, namely scenic corridors.  Currently the county does not allow
this use.  
3) Having bright, digital lighted messages changing every 8 seconds is not only an eyesore, but
also a very dangerous distraction to drivers.
 
4) I believe it is wrong for such intrusive lighting to trespass into residential areas,
or scenic areas. 
5) Such intrusions by advertising technology will not only destroy our dark skies and ruin our
beautiful natural scenery, but will likely be a disturbance and detriment to wildlife.

This Amendment attempting to permit billboards across all county lands at a
larger number would be a destructive act upon the beauty of the land and the
senses of the people.  
Do we need more billboards?  Who benefits from more billboards?

near as 150 feet from residential property is clearly only wanted by the Billboard
Advertising Industry and its lobbyists.  As a career advertising veteran who has
created billboard advertising in Los Angeles I have first hand knowledge about
this subject.  
Please DO NOT vote in favor of this blatant disregard of the people of Maricopa
County.  
We need you to protect the people.

our dark skies at night.

I am an astronomer at Arizona State University where we
have access to some of the worlds best telescopes
through the state system (Kitt Peak, Mt. Graham, Mt.
Lemon, Mt. Hopkins, Lowell Observatory). The capability
of these telescopes is limited by having a DARK night sky
at night. From these mountain tops, you can see the
glow of Phoenix already but the proposed billboards will
make it even worse. As an astronomer, we have noticed,
in a measurable way, that urban growth has affected the
darkness of the night sky in the state. Rejecting this TA is
the only way to ensure that Arizona will remain a world
leader in the field of astronomy. 
 
Please reject the proposed Text Amendment –
TA2018001.

I am submitting a comment regarding item TA2018001/Offsite Advertising Sign/Billboards.
Please reconsider this unfortunate plan to clutter our roadways with these obnoxious signs. 
The landscape in our area is one of our treasures, and these enormous, outrageously bright and
intrusive signs along our roads will destroy the view of the natural landscape, and also be a
dangerous distraction for drivers who are already crashing their cars at record rates.
As a resident and taxpayer in Maricopa County, I would prefer that we ban these monstrous
signs completely.  This is not Las Vegas, and we should not aspire to be a tacky, low-end,
totally commercialized community.

I’m not sure why there is even any discussion to put up a big
digital billboard along the 202 past Laveen. It’s bad enough that
our small town has been allowed to explode in development,
resulting in losing it’s character of being a rural farming
community. What a shame to ruin the landscape even more with
a decision like what is proposed.

Honorable Chair Arnett & Members of the Commission: 
 
Scenic Arizona hereby registers its opposition to the draft ordinance being put forward in the above-
referenced case.  This ordinance was not promulgated in response to any groundswell of public wishes, 
but rather only to benefit those who would profit from the further degradation of the visual 
environment.   We would urge that you do not set this item for public hearing, and either take no action 
or continue the item so that there is an opportunity to rebut the one-sided documentation provided by 
the applicant, particularly such documentation that largely relies on self-interested sources. 
 
We note that the allowance of electronic displays on billboards for the first time runs contrary to past 
involvement of the major astronomical observatories with Maricopa County and there is no indication 
that they have been contacted or engaged in the current process.  We further note that there is no 
mention in the draft ordinance of potential conflict with state law (ARS Sec.28-7902), prohibiting 
electronic billboards within certain radii of observatories that extend well into Maricopa County.  
These radii were established as part of a legislative compromise in 2012, subsequent to successful 
litigation in which Scenic Arizona was a plaintiff and in which the court upheld the Arizona Highway 
Beautification Act prohibition of electronic billboards on state and federal jurisdiction highways. 
 
More particularly, we oppose the following as being harmful to the visual environment: 1) any 
allowance of electronic displays on billboards; 2) increasing the area allowance of freeway billboards 
from 300 to 672 square feet; 3) increasing the heigh allowance of freeway billboards from 30 feet to 
48 feet (or more in some cases); and 4) turning nonconforming use law on its head by allowing 
increases in intensity (adding electronic displays, decreasing separation requirements, or otherwise).  
 
Again, we would urge that this item not be set for public hearing at this time.

Dear Commissioners –
 
I am one among hundreds of concerned county residents who oppose the text
amendment that will forever change the landscape along the roads and
highways of the county. The proposal would serve no one’s best interest but the
applicant’s.
 
All of the proposed changes in the existing regulation of Off-Site Advertising
Signs would significantly increase the intensity of billboards. The increase in
height, size, spacing, and proximity to residentially zoned property would
negatively impact driving safety, wildlife, dark skies, quality of life, and the
overall aesthetic of our surroundings.
 
The proposal to allow digital billboards compounds these negative impacts.
Billboards in general, and digital signage specifically, are designed to get
attention. This attention equals distraction. In fact, “Digital signs capture
400 percent more views than static signs.”
