First Amendment to Agreement for Law Enforcement Service
between the Town of Queen Creek
and Maricopa County on behalf of the Sheriff's Office

This First Amendment to the Agreement between the Town of Queen Creek (“Town”) and Maricopa County (“County”)
on behalf of the Sheriffs Office shall be effective on July 1, 2019 upon approval of the Maricopa County Board of
Supervisors and the Town.

Recitals

The County, acting on behalf of the Sheriffs Office, and the Town entered into an Agreement for Law Enforcement
Services (the “Initial Agreement’), retroactive to January 1, 2019 and executed June 5, 2019 (C-50-19-080-3-00).

This First Amendment authorizes credit to Town for continuing unfilled positions per Section |I.B.3.a. and replaces
wording in this section for future management of the contract.

The parties agree to change the Initial Agreement as follows, all other terms and conditions of the Initial Agreement
remain in place.

Amendment

This First Amendment authorizes the MCSO to issue a credit in the amount of $347,338.76 to the Town
per Section |I.B.3.a. of the Initial Agreement for applicable continuing vacant positions for the period
January 1, 2019 through June 30, 2019.

This First Amendment replaces Section |I.B.3.a. of the Initial Agreement in its entirety with the following,
effective July 1, 2019.

MCSO will credit the Town for sustained decrease in deployment of FTE for a period of greater
than three consecutive months for reasons including, but not limited to extended sick leave,
administrative leave or retirement.

The calculation for the credit will be based on current Worksheet Exhibit A. for the fiscal year
in which the credit is applied.

The credit will be applied per position in monthly increments beginning the fourth month in
which the vacancy falls and ending the month the vacancy is filled.

The credit will be 1/12 of the annualized amount of Worksheet salary and benefits for the
vacant position type plus applicable Worksheet workers compensation and unemployment.

Credit will be applied quarterly to the monthly invoices of October, January, April, and June.

Total annual credit amounts that exceed (10%) of the annual contract value will require
authorization by amendment to this agreement, and the Town and the County shall meet in
good faith to review the County's ability to provide contracted level of service.

This section does not apply to vacant positions resulting from contracted increases to level
of service for which costs are pro- rated until positions are filled.
