District 1 Councilperson.  He noted her ties to the Deer Valley area which is also part 
of Supervisorial District 3 and thanked her for her presence.

Approve the appointment of Juanita Garza as Clerk of the Board at salary of $130,000 
($62.50/hr) effective June 14, 2021.

Motion to approve was made by Supervisor Bill Gates, seconded by Supervisor Steve 
Chucri
Supervisor Steve Chucri spoke of Fran McCarroll's steady hand while she was Clerk of 
the Board and thanked her for her many years of dedication.  He said through the 
appointment of Juanita Garza the County will continue to be represented well.
Supervisor Steve Gallardo concurred with Supervisor Steve Chucri's comments noting 
Ms. McCarroll was the Clerk when he was a County employee.  He welcomed Ms. 
Garza as Clerk of the Board noting she has a vast amount of experience as she has 
worked in all areas of the Clerk of the Board Office.  He said he looked forward to 
continuing working with Ms. Garza.
Supervisor Bill Gates noted Ms. McCarroll's presence.  He spoke of her service and 
significant institutional knowledge.  He thanked Ms. McCarroll for her part in the smooth 
transition of Ms. Garza to Clerk of the Board.  Ms. Garza has continued to show great 
work while with the County.
Supervisor Clint Hickman concurred with the Supervisors' comments thus far.  He 
spoke of Ms. McCarroll's retirement occurring while he was Chairman and appreciates 
the manner in which the transition occurred.  He noted the significance of the Clerk 
position having five bosses with their own personalities.  He thanked Ms. Garza for 
continuing to do a great job for the County.
Chairman Jack Sellers spoke of the critical role that the Clerk of the Board has with the 
Board and spoke of the significance of having five bosses that do not always think alike.  
He thanked Ms. McCarroll for her service and said he looked forward to continuing to 
work with Ms. Garza.

alignment in the Glendale area
Commission Recommendation:  On 5/13/21, the Commission voted 10-0 to recommend 
approval of CPA2021004 subject to conditions ‘a’ – ‘f’: 
a. Development and use of the site shall comply with the narrative report entitled, “A 
Comprehensive General Plan Amendment for Luke Land 58”, including all exhibits dated 
revised February 19, 2015, and stamped received February 20, 2015, except as modified by 
the following conditions.
b. If the Board takes action to amend or revert/rescind subsequent zoning, this land use plan 
shall be considered for amendment to change the land use designation back to the prior 
Mixed Use Employment.
c. The total number of residential units shall not exceed 274 dwelling units.
d. Prior to initial Final Plat approval or initial precise plan of development, the applicant shall 
submit to the Maricopa County Planning and Development Department a “will serve” letter 
and verification of approval of a Maricopa Association of Governments (MAG 208) 
amendment from Liberty Utilities.
e. The following Luke Air Force Base condition shall apply:
Luke Land 58 shall notify future occupants/tenants that they are located near a military airport 
with the following language:
“You are locating in a residential dwelling inside the State Statute defined “territory in the 
vicinity of a military airport,” which means that aircraft flying in this area are authorized to fly 
as low as 1,500 feet above the ground. You will be subject to direct overflights and noise by 
Luke Air Force Base jet aircraft in the vicinity. 
Luke Air Force Base executes an average of approximately 165 overflights per day. Although 
Luke’s primary flight paths are located within 20 miles from the base, jet noise will be 
apparent throughout the area as aircraft transient to and from the Barry M. Goldwater 
Gunnery Range and other flight areas. 
Luke Air Force Base may launch and recover aircraft in either direction off its runways 
oriented to the southwest and northeast. Noise will be more noticeable during overcast sky 
conditions due to noise reflections off the clouds.

Luke Air Force Base’s normal flying hours extend from 7:00 a.m. until approximately 
midnight, Monday through Friday, but some limited flying will occur outside these hours and 
during most weekends.

www.luke.af.mil/urbandevelopment or contact the Maricopa County Planning and 
Development Department.” 
Such notification shall be permanently posted on not less than a 3 foot by 5 foot sign in front 
of all leasing offices and be permanently posted on the front door of all leasing offices on not 
less than 8½ inch by 11 inch sign.
f. The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner. The granting of this approval allows the property owner 
to enjoy uses in excess of those permitted by the land use existing on the date of application, 
subject to conditions. In the event of the failure to comply with any condition of approval, the 
property shall change to the land use designation that existed on the date of application. It 
is, therefore, stipulated and agreed that revocation due to the failure to comply with any

The property is within FEMA Zone AE Floodway and FEMA Zone AE Floodplain. 
Any work on the site will require a Flood Use Permit.
    3.
Any construction (driveway, utilities, etc.) within Carefree Highway Right-of-Way will 
require a Maricopa County Department of Transportation (MCDOT) Right-of-Way Permit.
    4.
No modification to the existing building exterior without an Engineered Grading & 
Drainage Plan and an updated POD.  
    5.
Without the submittal of a precise plan of development, no new or existing 
development approval is inferred by this review, including, but not limited to drainage design, 
access and roadway alignments. These items will be addressed as development plans 
progress and are submitted to the County for further review and/or entitlement.
    6.
All development and engineering design shall be in conformance with Section 1205 
of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain

e. Prior to occupying the existing structure or any portion thereof for any use associated with 
the Special Use Permit, the applicant shall obtain a Certificate of Occupancy for the 
retrofitted building prior to occupancy.
f. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance. 
g. The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, and at the time of

Chairman Jack Sellers asked if there were any comments or speakers for item 8.  The 
Clerk stated no comments were received.  She said Ben Graff of Quarles & Brady LLP, 
AES applicant representative, has requested to speak in favor of the item and has a 
presentation for the Board.
Planning and Zoning staff approached the dais.  Jennifer Pokorski, Assistant County 
Manager, reviewed the item as noted on the agenda.
Supervisor Clint Hickman said he would like to hear from the applicant representative.
Ben Graff of Quarles & Brady LLP, AES applicant representative, presented the 
following via webinar:
Mr. Graff briefly highlighted the bullet points on the Strategic Rationale slide. He noted 
that because of an incident in Surprise, Arizona that took place in April 2019, it was 
important for the applicant to collaborate with the fire authority in the County and

engage them in future processes.  He spoke of the importance of the newly revised 
facility with new technology to be safer for the community and first responders.
Mr. Graff proceeded to slide #8. He said the applicant has been coordinating with 
several entities noting it is a rigorous outreach for a safe facility for all first responders.

Mr. Graff stated that as a result of several discussions with Supervisor District 4 and 
the fire authorities the applicant is in full agreement of stipulation h.
In closing Mr. Graff moved forward to slide #11 explaining that they felt confident that 
with the rezoning and general plan the facility is appropriate for the area. He highlighted 
some of the safety features put into place since the incident in 2019 where firefighters 
were injured.  He noted the importance of not only focusing on the benefit from a 
renewable energy but also on first responder safety.  He concluded his presentation 
noting he is happy to answer any questions the Board or staff may have.
Supervisor Clint Hickman thanked Mr. Graff for his presentation.  He said the item is 
significant as it deals with new technology and spoke of the tragedy that happened in 
2019 where firefighters were injured.  He stated new technology is coming to all 
supervisorial districts.  It is important to look at the safety logistics of these type of 
projects for the safety of the community and first responders.  He thanked staff and the 
applicant for their significant work on the item.  He asked Ms. Pokorski to read the 
additional stipulation into the record.
Ms. Pokorski read the following stipulation into the record:
h.
Administrative approval of a Plan of Development will be required prior to approval 
and issuance of construction permits to develop and establish use of the site. Prior 
to issuance of a building permit, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been 
designed in accordance with their regulations and requirements, and that 
emergency fire protection service is being provided to the facility. Prior to issuance 
of the certificate of occupancy, local fire protection jurisdiction review and approval 
will be required.

Interoperable Special Event Radio Headsets (50INOPHDST) Agreement Number 19-
AZDOHS-HSGP-190206-04 in the amount of $5,672 for the award period beginning May 13, 
2021 and terminating on April 30, 2022. This Agreement may be terminated by any of the 
parties by written notice to the other parties thirty (30) business days prior to termination.
The funding award is not recurring and there is no match requirement.  The Sheriff’s Office 
indirect cost rate for FY21 is 14.6%. Unrecoverable indirect costs associated with this 
Agreement are estimated to be $828.11 and will be absorbed by the General Fund. There 
are no future or ongoing contributions required after the grant period ends; however, property 
(items) purchased with these funds must remain available to the unit for the duration of its 
existence and/or the useful life of the item. 
This is not a mandated function although it supports the MCSO public safety mandate and 
provides a benefit to the citizens by enhancing response to serious incidents involving 
hostages and/or individuals which have been identified as having involvement in serious 
criminal offenses and/or terrorist activities.  This is a competitive award.  The Maricopa 
County Sheriff’s Office is one of several local law enforcement agencies in the Phoenix metro 
area that participate in this effort.  This is reimbursement funding that will be used to purchase

Approve Amendment #1 to the Subrecipient Agreement 20-AZDOHS-HSGP-200812-05 
between the Department of Homeland Security and Maricopa County Sheriff’s Office and 
the acceptance of the changed amount of $120,000 in grant funding for a Vehicle Mounted 
Radiation Detection System.   The MCSO’s original request, approved by the Board of 
Supervisors on December 9, 2020 (C-21-079-X-00) was for $40,000. This is the first time 
the Sheriff’s Office has received this funding award. The term of this funding is from October 
1, 2020 through September 30, 2021.   This is reimbursement funding that will be used to 
purchase capital equipment.
The Sheriff’s Office indirect cost rate for FY21 is 14.6%, applicable to the award amount of 
$120,000 less capital expenses of $120,000 for an indirect cost base of zero ($0) and indirect 
costs of zero ($0).   There are no future or ongoing contributions required after the grant 
period ends; however, property (items) purchased with these funds must be used for 
authorized purposes as described in the grant application and may be used in the program 
or project for which it was acquired for as long as needed whether or not the program or 
project continues to be supported by federal grant funds.  This is not a mandated function 
although it supports the MCSO public safety mandate and provides a benefit to citizens by 
coordinating with state and local governments with relevant and executable planning, training 
and exercises necessary to ensure adequate capabilities exist to prevent, protect against,

APPLICATION AND ACCEPTANCE OF FUNDING FROM THE OFFICE OF NATIONAL 
DRUG CONTROL POLICY (ONDCP) FOR THE HIGH INTENSITY DRUG TRAFFICKING 
AREA (HIDTA) PROGRAM – INITIATIVE XXXII
Approve Application and Acceptance of up to $672,747 with the Office of National Drug 
Control Policy (ONDCP) Award Number G22SA0005A, for the High Intensity Drug Trafficking 
Area (HIDTA) Program. The term of this funding is January 1, 2022 to December 31, 2023. 
This amount represents the total FY 22/23 budget and spending ceiling for this initiative. 
The Maricopa County Sheriff’s Office is the Fiduciary of these funds for the County. The 
Maricopa County Sheriff’s Office will receive up to $557,004. The Maricopa County 
Attorney’s Office will receive up to $115,743. 
The Sheriff’s Office funding award is designated for two separate initiatives:  Intelligence 
Initiative (HIDTAISC):  $60,663 and Interdiction Initiative (MCDST): $496,341.  The total 
indirect cost amount for these two initiatives is $81,322.59 ($8,856.80 and $72,465.79).  The 
Sheriff Office indirect rate is 14.6% and MCSO will not recover $81,322.59.  The County 
Attorney’s funding award is designated for the Investigation Initiative (MISTIC) and its indirect 
rate is 20.1%.   The total indirect cost amount for this initiative is $23,264.34 and MCAO will 
not recover $23,264.34.
This funding supports of the Sheriff’s public safety mandate through efforts to reduce illegal 
drug use with the interruption of drug trafficking. The funding is recurring and has been 
awarded to the Sheriff’s Office for over twelve years. There is no matching requirement and 
there are no future or ongoing contributions required after the grant period ends. This is a 
competitive award.

provide matching funds to MCAQD for the EPA FY21 Arizona State Clean Diesel Grant 
Program.
This IGA Amendment will provide matching funds to support MCAQD’s FY21 DERA Work 
Plan to retrofit or replace diesel powered vehicles through annual sub-award agreements 
until December 30, 2022.  An annual Amendment will be required to update the Work Plan 
and any future match funding dollar amounts.  The Work Plan for Amendment 5 will expire 
on December 30, 2022 and will provide for $350,261 in “matching” funds to allow additional 
DERA funding in the amount of $175,131 from the EPA.
Title VII, Subtitle G, Section 793 of the Diesel Emissions Reduction Program (DERA) in the 
Energy Policy Act of 2005 authorizes the U.S. Environmental Protection Agency (EPA) to 
support grant, rebate, and loan programs, administered by eligible states or territories, which 
are designed to achieve significant reductions in diesel emissions.  This program is referred 
to as the State Clean Diesel Grant Program.  The grant program is reoccurring and has been 
awarded to the department in previous years.  Cash, indirect costs or in-kind match are not 
applicable as this amendment is for the “matching” funds required for the state program.  The 
matching funds will be passed thru to sub-recipient(s) and is not subject to indirect cost 
recovery.  The annual grant program is non-competitively bid and is based on population.

The purpose of this amendment is to extend the term of the agreement for one (1) year, at 
the current rate, commencing on August 1, 2021 through July 31, 2022 and to allow for 
Lessee Right Of First Option to purchase the Property.  The Agreement is subject to 
termination pursuant to the provisions of A.R.S. 38-511. This Agreement may be terminated 
by Lessee at the end of any fiscal year due to non-appropriation of funds without any penalty

In accordance with A.R.S. 42-17106(B), authorize the following appropriation adjustments to 
the FY 2021
Telecommunications budget:
1. Increase the FY 2021 expenditure and revenue budgets for the Enterprise Technology 
(D410) Telecommunications (681) Operating (OPER) by $2,758,064.
2. Offsetting expenditure and revenue adjustments in the Eliminations (D980) Eliminations 
Fund (900) Operating (OPER) in the amount of $2,736,689.
3. Offsetting expenditure and revenue adjustments in the Eliminations County/Districts 
(D990) Eliminations Fund (900) Operating (OPER) in the amount of $21,375.
This appropriation adjustment is needed to increase the OET telecommunication budget to 
account for increased device counts and usage for mobile devices and increased usage of 
long-distance and phone services. Budgeted amounts for FY21 did not account for the 
substantial increase in usage related to Elections, pandemic response, and telework.  A 
detailed department breakdown that shows the increases is attached in this submission.

parties. The original agreement expired on October 1, 2018. The term of the 1st renewal was 
from October 2, 2018 until September 31, 2021. This second renewal will be from to October 
21, 2021 through October 20, 2024.  All other terms of the original agreement remain in

Pursuant to the Electronic Fund Transfer Policy A2512, the Office of Budget and Finance is 
requesting authorization to have the Treasurer’s Office process Electronic Funds Transfers 
(wire transfers) due to the Trustee(s) for annual debt service payments for certificates of 
participation in the amount of $71,982,783, and other County business as necessary in Fiscal 
Year 2022. The payments have been budgeted. The Office of Budget and Finance requests 
for authorization to the Treasurer’s Office will come from the Chief Financial Officer, Cynthia 
Goelz, and Deputy Finance Director, Bridget Harper.  Debt Service payments require 
guaranteed funds.  The Office of Budget and Finance will prepare corresponding journal

to the Special Districts under the Intergovernmental Agreement, C-06-18-393-6-00, 
approved on April 11, 2018. This Policy also applies to employees of County elected offices

CENTER, INC.
Approve and execute Amendment No. 4 to Lease Agreement L-7457 with Son Rise Faith 
Community Center, Inc., for the use of 1,527 square feet of space for the premises located 
at 800 West Galveston St, Chandler AZ 85225 to provide Head Start Services.
The purpose of the Amendment is to address the following: (A) ratify approval of certain 
Lessee Improvements to make improvements to the existing playground, at a one-time cost 
of up to $50,000; (B) approve certain Lessee improvements; (C) amend alterations 
provisions; (D) amend Notice provisions; and (E) provide for administration authority of the

AMENDMENT TO LICENSE AGREEMENT WITH ARIZONA DEPARTMENT OF 
ECONOMIC SECURITY FOR USE OF REAL PROPERTY
Approve Amendment No. 5 to the financial License Agreement P-50327, (“Agreement”) for 
Use of Real Property, with Arizona Department of Economic Security (“Licensee”) for use of 
County controlled properties, East Valley One Stop Career Center located at 735 North 
Gilbert Road, Suite 134, Gilbert, Arizona 85234 (“Facility 2”) and West Valley One Stop 
Career Center located at 4425 West Olive Avenue, Suites 190 and 200, Glendale, Arizona 
85302 (“Facility 3”). “Facility 2” and “Facility 3” shall be collectively referred to as the 
“Facilities”. Licensee and Licensor shall collectively be referred to as the “Parties” and 
individually as “Party”.
The purpose of the Agreement is for Licensee to share costs associated with the operation 
of the Facilities.
The Parties hereby agree to amend the Agreement as follows:
1. Reassign and delete space utilized by Licensee as listed in Section 12 of the Agreement 
and depicted in the attached Exhibits.
2. The Licensee’s share of costs associated with the operation of the Facilities shall be 
revised and effective retroactively to February 1, 2021 through June 30, 2021.
3.
The Licensee shall pay a proportionate amount for the operation of the space and 
shared costs identified in section 13.0 (Shared Facilities Operation Costs) of the Agreement: 
         a. Facility 2 - $2,252.19/Monthly plus 8.72% of shared costs estimated at

Approve financial Amendment No. 6 to the Agreement between Community Bridges, Inc. 
(Subrecipient), a community-based organization and Maricopa County (County) 
administered by its Human Services Department. The purpose of the Agreement is for the 
operation of temporary emergency shelter services for homeless individuals experiencing 
homelessness in Maricopa County in an effort to protect them from exposure to COVID-19. 
The Subrecipient and the County shall be referred to as the “Parties.”

SERVICES FOR THE EARLY HEAD START PROGRAM GRANT FUNDING FOR 
FY2021
Approve an Amendment to the grant from U.S. Department of Health and Human Services 
(DHHS)/Administration for Children and Families (ACF), Office of Head Start (OHS), Grant 
No. 09HP000200. The Office of Head Start approved a Non-Federal Share (NFS) Waiver. 
The Amendment reduces Maricopa County’s required Non-Federal Share (NFS) for the 
period of July 1, 2020 through June 30, 2021. 
The previous NFS amount was $673,423 and is now reduced to $631,012, a reduction to 
the Grant’s NSF by $42,411. The reduction in NFS does not impact the grant funding amount 
of $2,804,899.
On March 24, 2021, the Board of Supervisors approved (C-22-20-003-G-07) the submittal of 
an application for the reduction in the required NFS. The Office of Head Start has provided 
a Notice of Award with the reduction to the Maricopa County required NFS. Human Services 
Department submitted a waiver to DHHS/AFC/OHS for a reduction to the required NFS. The 
waiver was approved and the required NFS is now reduced.
The County received the Early Head Start Program grant (09HP000200) for a sixty (60) 
month period that began on July 1, 2019 through June 30, 2024.

RECEIPT OF U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT CDBG 
FUNDS
Request approval of the following actions:
1. Approve the receipt of additional funds from the U.S. Department of Housing and Urban 
Development (HUD) for Community Development Block Grant (CDBG) Programs: HUD 
notified the County of an unanticipated increase of CDBG allocation for fiscal year 2021-
2022, in the amount of $41,978. The original CDBG allocation was $2,848,640 and shall now 
be increased to $2,890,618.
2. Approve the expenditure of $36,085 of previously approved CDBG un-programed funds 
for FY21-22 program year projects. 
3. Approve the updated Attachment A, which addresses the CDBG activities and funding 
allocation of $2,890,618, and $36,085 for a total of $2,926,703. Funds shall be expended 
over multiple years as allowed by HUD regulations and may be reallocated if necessary and 
with public input through the Citizen Participation Plan. 
4. Authorize the Human Services Department Director or designee to submit any referenced 
plans and sign all documents related to the HUD grant funds.
On April 21, 2021, the Board of Supervisors approved the submission of the FY2021-2022 
Annual Action Plan (AAP) for the HOME Consortium and Urban County; and acceptance of 
CDBG, HOME, and ESG funding for FY2021-2022 (C-22-20-038-G-01). The increase in 
CDBG funds does not require an amendment to the FY2021-2022 AAP.

RECEIPT OF AMERICAN RECOVERY PLAN ACT FUNDS FROM U.S. DEPARTMENT 
OF HOUSING AND URBAN DEVELOPMENT
Request approval of receipt of The American Rescue Plan Act of 2021 funds from the U.S. 
Department of Housing and Urban Development (HUD). HUD provided notification to the 
County of funding allocation in the amount of $16,756,617 HOME Investment Partnerships 
Program-American Rescue Plan (HOME-ARP) funding.
The funds will be utilized for eligible HOME activities including the creation or preservation 
of affordable housing; Tenant-Based Rental Assistance; Supportive Services, including 
homeless prevention services and housing counseling; and purchase or development of non-
congregate shelter for individuals and families experiencing homelessness; and other 
eligible activities as may be determined by HUD.
The HUD notification lists that HOME-ARP funds are available for expenditure until 
September 2030. HOME-ARP funds can be used for individuals or families from the following 
qualifying populations:

Homeless; 
•
At-risk of homelessness; 
•
Fleeing or attempting to flee domestic violence, dating violence, sexual assault, 
stalking, or human trafficking; 
•
Other populations where providing assistance would prevent the family’s 
homelessness or would serve those with the greatest risk of housing instability;

•
Veterans and families that include a veteran family member that meet one of the 
preceding criteria; and 
•
Other eligible populations as may be determined by HUD.  
Further clarification and direction provided in the HUD notifications and will be subject to any 
additional applicable regulatory waivers, notices, funding flexibilities, or conditions as 
granted or allowed by HUD. The Human Services Department will request approval of 
activities from the Board of Supervisors at a formal meeting, when HUD provides additional 
information and direction on the expenditure of the allocated funds. 
The funding allocation is one-time funding and was awarded to the County through a non-
competitive process.
Also request authorization and approval for the Department Director or designee to sign any 
documents required by HUD for this funding allocation.

Approve and execute letter acknowledgement of tenant improvements to the County leased 
space. Maricopa County, (“Lessee”), and City of Chandler, (“Lessor”) are parties to Lease 
Agreement No. L-7178 for the use of 2,220 square feet for the premises located at 660 South 
Palm Lane, Chandler, Arizona to provide Head Start Services. The City of Chandler provided 
written consent for tenant improvements.
Tenant improvements include the removal and replacement of flooring material. The project 
has a funding limit up to ten thousand dollars ($10,000). Lessee shall be responsible for 
performing the work required to complete the Tenant Improvements. Improvements are 
being completed to meet the safety and quality expectations of the Office of Head Start and 
the program.

AMENDMENT TO ADOBE MOUNTAIN GOLF COURSE LEASE AGREEMENT
Approve and execute the Sixth Amendment to the Adobe Mountain Golf Course Lease 
Agreement between Maricopa County and Sun States Sports, Inc. dba the 500 Club Golf 
Course (“The 500 Club”) (CS 896024), as amended, to extend the term of the agreement.
The 500 Club desires to make a substantial improvement to the Complex by development of 
an event center (the “Event Center”). Upon the date that The 500 Club obtains a certificate 
of occupancy issued by jurisdictional authorities for the Event Center, the term of the Golf 
Course Agreement shall be extended for ten (10) years or until December 31, 2053, 
whichever is sooner. The 500 Club will pay a reduced fee of 5% of only the Event Center’s 
adjusted gross revenue during the first five (5) years of occupancy.  Upon year six (6) and 
for the duration of the agreement, the Event Center fee will be calculated and paid in 
accordance with the current fee schedule.
If The 500 Club does not commence construction of the Event Center within three (3) years 
of the effective date of the Sixth Amendment, the Sixth Amendment will be null and void.)

DEPARTMENT OF HEALTH AND HUMAN SERVICES THRU THE ARIZONA 
DEPARTMENT OF CHILD SAFETY
Approve the application and acceptance of Tile IV-E federal entitlement funds from the 
Department of Health and Human Services thru the Arizona Department of Child Safety in 
the amount not to exceed $2,983,627 for the purpose of supplementing the costs of 
dependency in Public Defense Services. This grant is an open-ended entitlement. Per the 
MOU, 75% of the funding must be invested in dependency to supplement Public Defense 
Services. The other 25% may be used to offset costs to the County. The 25% (approximately 
$745,907) will be used to offset General Fund expenditures.
Also, approve the waiver of indirect costs. Public Defense Services will receive a total of up 
to $2,983,627; at the indirect rate of 12.79%, the indirect costs are estimated at $381,606, 
all of which will be waived. These indirect costs are not being sought so that the grant funds 
can be used for contract attorney costs previously funded by the General Fund. 
The grant award is re-occurring. There are no in-kind match requirements and requires no 
ongoing cash contributions. This entitlement award supplements a mandated function.

APPLY AND ACCEPT EDWARD J. BYRNE MEMORIAL JUSTICE ASSISTANCE 
GRANT/ DRUG ENFORCEMENT ACCOUNT BYRNE FUNDING
Approve the application and acceptance of grant funds from the Edward J. Byrne Memorial 
Justice Assistance Grant/Drug Enforcement Account (DEA) in the amount not-to-exceed 
$194,215. The department budgeted $194,215 through the normal annual budget process. 
Grant funds will be used to partially fund the salaries of attorneys providing legal 
representation for defendants with drug related charges. The grant award supports 
mandated legal representation per the United States Constitution. The grant award is 
competitively pursued and other eligible agencies may or may not apply for this grant award.
The grant award begins on July 1, 2021 and ends on June 30, 2022. The Public Defender 
indirect rate for FY2022 is 12.79%. Unrecoverable indirect costs are estimated to be 
$24,840. The grant award is reoccurring and has been awarded to the department for the 
past 30 years.  The cost of the positions supported by this grant for FY2021-22 total 
$385,761. If awarded, the grant will cover up to $194,215 and the remaining amount (which 
includes the in-kind match requirement) will be absorbed by the department’s general fund 
budget. In the event that the department does not receive funding in future years, grant

Approve the Second Amendment to the Dietitian Observer Agreement with Dignity Health, a 
California nonprofit public benefit corporation d/b/a St. Joseph’s Hospital & Medical Center, 
Mercy Gilbert Medical Center and Chandler Regional Medical Center to provide clinical 
nutrition training experience for graduate students in the dietetic internship program. The 
agreement is non-financial, and the term is to be from the later of August 1, 2021, or the last 
date signed through July 31, 2023.
As a part of its established accredited dietetic internship program, the Department of Public 
Health seeks to provide its dietetic interns with a broad and diverse practicum experience. 
This agreement with Dignity Health will allow dietetic interns to continue to receive approved 
practicum experience in clinical nutrition.  Supervised by Dignity Health registered dietitians 
in Dignity Health facilities, interns would continue to be responsible to Public Health. This 
agreement is non-financial, and does not affect the County general fund. MCDPH and Dignity

The purpose of this amendment is to extend the term of the agreement for two (2) years 
commencing on July 1, 2021 through June 30, 2023; adjust the monthly rent schedule: 2022 
annual rate $4,200 and 2023 annual rate $4,668.00; and allow for administrative authority 
for County.  The Agreement is subject to termination pursuant to the provisions of A.R.S. 38-

Health (MCDPH), Office of Oral Health (OOH), to provide continued funding for the oral 
health service First Teeth First (FTF) program.  The FTF PUSD program provides

SERVICES-EARLY INTERVENTION
Approve an amendment to extend the RFP between Southwest Center for HIV/AIDS and 
Maricopa County Department of Public Health for the purpose of identifying HIV positive 
individuals at key points of entry, HIV counseling and to ensure that newly diagnosed 
individuals are linked to HIV Care and treatment. This extension will allow for the time needed 
to successful transition all newly HIV diagnosed individuals from the Southwest Center for 
HIV/AIDS Early Intervention Services program to other Ryan White Part A contracted 
services.
The contract term is extended for an additional three (3) months from May 31, 2021 through 
August 30, 2021. This is an additional extension beyond the original maximum 6-year term,

Adopt a Resolution regarding Designation of a County Applicant's Agent to Mitchell Lach, 
Disease Control Division Administrator, specifically in regard to the Public Assistance 
Program related to the Coronavirus (COVID-19) Pandemic. This Resolution will allow the 
designated Applicant's Agent to execute and file with the appropriate authorities any 
applications necessary for Maricopa County to receive financial assistance under the 
Disaster Relief Act. This designation supersedes Applicant Agent authority granted to 
individual County Department personnel with respect to the COVID-19 Pandemic. The 
original COVID-19 Delegation of Authority Designation was approved under agenda item C-
95-20-006-9-00 on April 22, 2020. All other Applicant Agent authority delegations for non-
COVID-19 pandemic efforts remain intact.
When emergency situations occur, state and federal disaster relief funds may be available 
to reimburse qualified expenses incurred by responding organizations. To be eligible to 
receive these funds, each affected organization is required to appoint an Applicant's Agent. 
The Applicant's Agent must have the legal authority to apply for the assistance on behalf of 
the Applicant organization by executing a Disaster Assistance Agreement and submitting it 
to State or Federal authorities. These agreements outline work completion deadlines and 
other responsibilities of the Applicant organization necessary to receive relief funds. The

estimated cost to relocate the electrical facilities is $1,300,126.17.  Funds are budgeted in

for the work to take place.  All of the work to relocate the electrical facilities is necessary for

AMENDMENT TO THE COMPETITION IMPRACTICABLE CONTRACT WITH CIRCLE 
THE CITY FOR SERVICES TO HOMELESS INDIVIDUALS
Approve Amendment No. 5 to the Competition Impracticable Contract (“Agreement”) 
between Circle the City (“Contractor”) and Maricopa County administered by its Human 
Services Department (“County”). 
The purpose of the Amendment is to address the following:
1. Revise Subsection 6.1 of Section 6.0 (Agreement Renewal) to read as follow:
6.1      The Agreement may be renewed by a written amendment six (6) times for a period of 
three months each, provided however that the Contractor is in full compliance with all terms 
and conditions of this Agreement.
2. Extend the Termination Date from July 1, 2021, through September 30, 2021.
A. Revise Section 10.0 (Funding, Invoicing, and Payment), Subsections 10.6, 10.7 and 10.8, 
to read as follows:
10.6     The funding for this Agreement is as follows:
1.         Agreement:  $955,584 County General Funds,
2.         Amendment 2:  $938,720 CARES Act,
3.         Amendment 3:  $1,000,000 CARES Act, and
4.         Amendment 4:  $1,000,000 CARES Act.
Amendment No. 5 shall provide the Contractor with an increase in funding in the amount of 
$300,000 under CARES Act. The funding availability period is July 1, 2021, through 
September 30, 2021. The Agreement amount shall now be increased to a total not-to-exceed 
amount of $4,194,304. 
10.7     The Subrecipient shall submit monthly invoices no later than the 15th calendar day 
of each month. 
10.8     The Contractor shall submit the June 2021 invoice no later than July 15, 2021. The 
September 2021 invoice shall be submitted no later than October 15.

AMENDMENT TO THE AGREEMENT WITH HUMAN SERVICES CAMPUS, INC. FOR 
SHELTER SERVICES
Approve financial Amendment No. 11 to the Agreement between Maricopa County 
(“County”), administered by its Human Services Department, and Human Services Campus, 
Inc., (“Subrecipient”). The County and the Subrecipient are referred to collectively as the 
“Parties.”
The Parties agree to enter into this Amendment No. 11 to amend the Agreement as follows: 
A. The activities described in section B. below shall begin on June 9, 2021 through 
September 30, 2021, Therefore, the Agreement termination date shall be revised from June 
30, 2021 through September 30, 2021.
B. Revise Paragraph 9.0 (Contractor Responsibilities) to add Subparagraphs 9.15 through 
9.18 that addresses the following:
1.
The Subrecipient shall be responsible for providing Weather Relief Relocation 
transportation services to homeless individuals. The Subrecipient shall provide 
transportation services from the Human Services Campus located at 204 South 12th 
Avenue, Phoenix 85007 to the St. Vincent de Paul site located at 420 West Watkins Avenue, 
Phoenix 85003. Homeless individuals will be relocated to an indoor location with air 
conditioning at which meals and water will be available. This will provide relief from extreme 
heat during the summer months. 
2. Transportation services will begin on June 9, 2021 through September 30, 2021.
C. The County shall provide the Subrecipient with $150,000 for the Weather Relief 
Relocation transportation services, listed above.
The foregoing paragraphs contain all the changes made by this Amendment No. 11. All other 
terms and conditions of the Agreement and Amendment Nos. 1, 2, 3, 4, 5, 6, 7, 8, 9 and 10 
shall remain the same and in full force and effect as approved and amended.

de Paul Watkins Hall of Banners, 420 West Watkins Avenue, Phoenix, Arizona 85003 
location.
The Agreement shall begin on June 9, 2021 and will terminate on September 30, 2021. The 
Agreement may be renewed by a written agreement six times for a period of three months 
each, provided however, that Contractor is in full compliance with all terms and conditions of

AGREEMENT WITH ARIZONA DEPARTMENT OF HOUSING FOR WEATHERIZATION 
ASSISTANCE PROGRAM
Approve revenue Agreement between Arizona Department of Housing (ADOH) and 
Maricopa County administered by its Human Services Department. The purpose of the 
Agreement is for ADOH to provide funding to the County to administer the Weatherization 
Assistance Program. 
ADOH will provide the County with Low Income Home Energy Assistance Program (LIHEAP) 
funds in the amount of $1,175,012 and Department of Energy (DOE) funds in the amount of 
$624,152 for a total Agreement amount of $1,799,164. The funding period of availability is 
July 1, 2021 to June 30, 2022. The funds will be utilized to provide weatherization measures 
in 217 dwellings occupied by low-income households in Maricopa County outside of the City 
of Phoenix and the City of Mesa.
ADOH contracts with the County on an annual reoccurring, non-competitive basis for service 
delivery of the Weatherization Assistance Program.
Acceptance of this Agreement will not impact the County General Fund.

Supervisors'/County Manager's summary of current events - Resumen de temas de 
actualidad de los Supervisores/Administrador del Condado
Joy Rich congratulated Ms. Garza on her appointment to Clerk of the Board.
Supervisor Bill Gates offered his thoughts and prayers to those dealing with the wildfires 
across Arizona.  He spoke of the use of fireworks and using them in a safe manner.  He 
spoke of a tour he recently took with the Downtown Phoenix Partnership Board of the 
newly renovated Phoenix Suns Arena noting the great use of an existing facility that will 
enhance the fan experience.  He congratulated the Phoenix Suns team on their 
progression through the playoffs and wished them luck in their upcoming games.
Supervisor Clint Hickman spoke of his recent attendance at a West Valley Mayors and 
Managers meeting.  He also commented on the topic of water conservation and his 
concerns for the valley.
Supervisor Steve Gallardo thanked all the health care providers and volunteers who 
continue to work through the pandemic and spoke of the vaccination events held 
throughout the valley. He also expressed the importance to continue to follow COVID-
19 protocols. He commented of how well the Phoenix Suns team is doing in the playoffs

as they continue to positively spotlight the community.  He spoke of the District 5 team 
they are coaching for the summer appropriately named the Gallardo D-Backs.
Supervisor Steve Chucri spoke of the recent passing of former Fountain Hills Mayor 
Jerry Miles and said a few kind words in honor of Mr. Miles.  He concurred with 
Supervisor Clint Hickman's comments on water conservation.
Chairman Jack Sellers briefly commented on the Library District summer reading 
program and his recent attendance with Supervisor Bill Gates at a Greater Phoenix 
Chamber meeting.  He spoke of the wildfires, ongoing drought, recent casualties and 
offered his prayers to the first responders who continue to fight the wildfires.

TOWER ACCESS ROAD DRAINAGE IMPROVEMENT PROJECT
Approve Intergovernmental Agreement (IGA) FCD 2021A004 for the Shaw Butte Mountain 
Service Tower Access Road Drainage Improvement Project (Project) between the City of 
Phoenix (City) and the Flood Control District of Maricopa County (District). The estimated 
total Project cost is $80,000. The District’s estimated share of the Project cost is $60,000 
and is limited to $500,000; the City’s estimated share of the Project cost is $20,000. The City 
will operate and maintain the completed Project. This Agreement shall become effective as 
of the date it has been executed by all PROJECT PARTNERS and shall expire two years 
from that date, or upon Project completion, whichever occurs first. 
The City proposed the Project for the District’s evaluation under the District’s Small Project 
Assistance Program for Fiscal Year 2022. This IGA is proposed in accordance with the terms 
of the Small Project Assistance Program, adopted by the Board under Resolution FCD 
2009R003A (C-69-09-062-6-01).
The Project will reduce the flood hazard to existing homes along Wood Drive west of Central 
Avenue.

Approve Intergovernmental Agreement (IGA) FCD 2021A002 for the Solano Drive LWC and 
Channel Drainage Improvement Project (Project) between the Town of Paradise Valley 
(Town) and the Flood Control District of Maricopa County (District). The estimated total 
Project cost is $617,445. The District’s estimated share of the Project cost is $463,084 and 
is limited to $500,000; the Town’s estimated share of the Project cost is $154,361. The Town 
will operate and maintain the completed Project. This Agreement shall become effective as 
of the date it has been executed by all PROJECT PARTNERS and shall expire two years 
from that date, or upon Project completion, whichever occurs first. 
The Town proposed the Project for the District’s evaluation under the District’s Small Project 
Assistance Program for Fiscal Year 2022. This IGA is proposed in accordance with the terms 
of the Small Project Assistance Program, adopted by the Board under Resolution FCD

crossing, provide for a concrete ford crossing, curb improvements and downstream

of Paradise Valley (Town) and the Flood Control District of Maricopa County (District). The 
estimated total Project cost is $100,000. The District’s estimated share of the Project cost is 
$75,000 and is limited to $500,000; the Town’s estimated share of the Project cost is 
$25,000. The Town will operate and maintain the completed Project. This Agreement shall 
become effective as of the date it has been executed by all PROJECT PARTNERS and shall 
expire two years from that date, or upon Project completion, whichever occurs first. 
The Town proposed the Project for the District’s evaluation under the District’s Small Project 
Assistance Program for Fiscal Year 2022. This IGA is proposed in accordance with the terms 
of the Small Project Assistance Program, adopted by the Board under Resolution FCD

and downstream bank stabilization to prevent undermining of the roadway.

IGA WITH US ARMY CORPS OF ENGINEERS FOR REHABILITATION WORK AT NEW 
RIVER DAM
Approve IGA between the US Army Corps of Engineers (CORP) and the Flood Control 
District of Maricopa County (DISTRICT) for the rehabilitation of the New River Dam Outlet 
Channel (PROJECT).
The PROJECT will rehabilitate the dam’s outlet channel and construct an access ramp for 
ongoing maintenance by the District. The estimated cost of the PROJECT will be $2,455,228, 
the CORP’s portion will be $2,355,228. The DISTRICT’s portion will be $100,000 for adding 
the access ramp for maintenance, which is considered a betterment.

DRAINAGE CHANNEL MAINTENANCE ROADS AND ACCESS RAMPS
Approve Intergovernmental Agreement (IGA) FCD 2020A027 between the Flood Control 
District of Maricopa County (District) and the Arizona Department of Transportation (ADOT) 
for shared use of the Powerline Floodway and SR-24 drainage channel maintenance roads 
and access ramps.  
The purpose of this IGA is to define the relationship of the District and ADOT with reference 
to allowing joint use of maintenance roads and access ramps between the two agency 
facilities. The IGA also defines the maintenance responsibilities of both the District and 
ADOT for the drainage and freeway facilities in the area. This Agenda Item impacts

Approve a revenue and expenditure increase to the FY 2021 Flood Control District (690) 
Flood Control Grant Fund (989) Non-Recurring/Non-Project (NRNP) budget in the amount 
of $65,000 expenditure and $30,000 revenue.
The District approved and accepted a total of $303,100 in Federal Emergency Management 
Agency (FEMA) grant funding under FEMA’s Cooperating Technical Partners (CTP) 
Program – Region 9 to strengthen and increase the effectiveness of the National Flood 
Insurance Program (NFIP) (C-69-20-013-G-00). $101,352.97 in grant funding had been 
received through FY 2021; $201,747.03 remains to be received.  This Agenda Item impacts

correction being requested relates to the Intergovernmental Agreement's term end date. The 
SOLAR entry incorrectly stated the Agreement term was ending on May 1, 2026; however,
