INVOCATION - INVOCACIÓN Chairman Sellers opened the meeting and asked Supervisor Chucri to introduce his guest, Jeff Fine, Clerk of the Court. Supervisor Chucri said Armed Forces Day was recognized last week and stated Mr. Fine is a 20-year Air Force veteran and thought it would be appropriate to ask Mr. Fine to lead the invocation and pledge. Mr. Fine said he was honored by the invitation and spoke about the importance of honoring those who serve and with Memorial Day approaching, the sacrifices that have been made for our freedoms. Mr. Fine offered the invocation. 2. PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA Mr. Fine led the Pledge of Allegiance to the flag. 3. PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL - PRESENTACIÓN DE ANIMALES DOMESTICOS POR EL DEPARTAMENTO DE CONTROL Y CUIDADO DE ANIMALES Monica Gery, Communications Officer for Animal Care and Control displayed a slide “Why Adopt at Animal Care and Control” and spoke about and the benefits of adoption from MCACC. She said when one pet is adopted, room is made for another one to be brought into the shelter. Ms. Gery said there are pets of all shapes and sizes and this coming weekend, a new best friend can be adopted for as little as $50 which includes the spay/neuter surgery, microchipping, vaccination, and license. Please visit Pets.maricopa.gov to see all the adoptable pets. Chairman Sellers asked the Clerk if there were any announcements or corrections to the agenda. The Clerk said there were two corrections: Agenda item #94, American Rescue Plan Act Budget needs to be amended to add to the list of items 1-13, #14 Broadband Infrastructure: $5 million. Agenda item #100 under letters H, I, and J the APN listed is incorrect, the correct APN should be 300-16-014J. TEMPE DANCE WEST LAVEEN Case #: Z2021016 Supervisor District: 5 Applicant / Owner: Benjamin Graff, Quarles & Brady LLP / Sandra Guerrero Request: Zone Change from Rural-43 to C-2 CUPD with a Plan of Development (POD) for a dance studio Site Location: Generally located approx. 1,080’ southeast of the SEC of 35th Ave. and Baseline Rd. in the Laveen area Commission Recommendation: On 4/22/21, the Commission voted 8-0 to recommend approval of Z2021016 subject to conditions ‘a’ – ‘g’: a. Development of the site shall be in substantial conformance with the Site Plan entitled “Tempe Dance West Laveen“, consisting of 3 full-size sheets, dated March 25, 2021, and stamped received March 25, 2021, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Tempe Dance West Laveen”, consisting of 9 pages, dated April 1, 2021, and stamped received April 1, 2021 except as modified by the following conditions. c. The following Planning Engineering conditions shall apply: 1. Retention basins must drain within 36 hours. 2. Engineering review of planning and/or zoning cases is for conceptual design only. All other permitted uses shall be subject to Chapter 11 requirements for commercial or public assembly uses. 2. Sight Visibility Triangles – Waiver of all required sight visibility triangles 3. Uses Permitted – All uses are prohibited except for the following uses: conservatories or studios (art, dancing or music and related performances); art galleries; day nurseries and nursery schools; photographer’s and artist’s studios, and; accessory buildings and uses customarily incidental to the above listed uses. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. f. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Zone Change, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Zone Change, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. RIO VERDE FOOTHILLS DOMESTIC WATER IMPROVEMENT DISTRICT ESTABLISHMENT HEARING Formal Meeting Minutes 05/19/2021 Page 5 of 49 Convene a public hearing to solicit comments and consider the petition to establish the Rio Verde Foothills Domestic Water Improvement District, pursuant to Arizona Revised Statutes Title 48, Chapter 6, Article 1. A petition was filed with the Superintendent of Streets on February 17, 2021 for the establishment of the Rio Verde Foothills Domestic Water Improvement District. The proposed improvement district, is non-contiguous and bounded by the McDowell Mountain Regional Park to the South; Tonto National Forest to the north; City of Scottsdale to the west; and Tonto National Forest north of Dixileta Drive, Dixileta Drive west to 172nd Street south to Rio Verde Drive, Rio Verde Drive east to 176th Street, 176th Street to the McDowell Mountain Regional Park comprise the east boundary. Supervisory District No. 2 This item was continued from the April 21, 2021 meeting. (C-64-21-188-X-01) Chairman Sellers asked the Clerk if there were any registered speakers or comments for agenda item #7. The Clerk replied there were no registered speakers however the following emails with comments were received: Four neutral from Travis & Jessica Smith, Tom Anderson, Phillip Tilford and Angela Sciarpelletti; Nine in opposition from David & Susan Shipley, Teresa Robison, Jean & Ferrell Anderson, Lori Ann Busse, George & Antonietta Potter, Pat Hughes, Alexandra M. Arboleda, Annie Hughes and Rocco Wachman; Four in favor from George Wijatyk, Sheri Novkov, Jan Bombardier and Linda Skrip. Supervisor Chucri made a brief comment and stated a Domestic Water Improvement District (DWID) in this area is not popular but is needed. The proponents of this DWID want to see a resolution to the water needs. Supervisor Chucri said he attended a three- hour meeting which included County representatives and 160 people who are passionate about this subject. Growth is coming and water is paramount for citizens, and he appreciates the patience of his constituents. He said this is a big deal, and he knows the importance of doing it right. He said this is not a typical DWID and the Board needs to be prepared for more DWIDs with similar circumstances and would like to continue this item to 8/18/2021. Supervisor Hickman thanked Supervisor Chucri for his leadership and courage during this very contentious process involving water and passionate residents. He agreed with Supervisor Chucri for the continuation of this item to consider a well-studied and thought-out approach. Supervisor Gates echoed Supervisor Hickman’s comments and thanked Supervisor Chucri for his leadership. He said sustainable solutions are needed because this is about economic growth and quality of life and nothing is more important than water going into the future. AUTHORIZE PAYMENT OF ATTORNEYS’ FEES AND RELATED NON-TAXABLE COSTS IN THE MATTER OF MELENDRES V. PENZONE, CV2007-02513 (D. ARIZ) Approve the Settlement in the amount of $375,606.63 between Maricopa County and Plaintiff(s), in Melendres v. Penzone, concerning District Court (Ariz.) No.CV2007-02513- GMS. Authorize the Chairman to sign any necessary documents upon review and approval as to form by assigned legal counsel. This item was discussed in Executive Session. Direct the Department of Finance to issue payment according to the settlement awarding and allocating attorney’s fees and related non-taxable costs in this matter. The total amount of the payment shall be allocated as specifically outlined in the settlement agreement. Additionally, pursuant to A.R.S. §42-17106(B), approve the transfer of expenditure authority in the FY 2021 budget as follows: a. Decrease the expenditure budget for Non Departmental (D470) General Fund (100) Non Recurring Non Project (NRNP) “Unreserved Contingency” (4711) line by the amount of $375,607. b. Increase the expenditure budget in the Non-Departmental (D470) General Fund (100) MCSO Judgment Order Non Recurring (MEL1) in the amount of by $375,607. These actions will have County-wide net impact of zero and they do not alter the budget constraining the expenditure of local revenue duly adopted by the Board pursuant to A.R.S. §42-17105. This item was heard at the April 5, 2021 Executive Session. ADDITIONS TO FLEET Approve nine (9) permanent additions to fleet of white, 2021 1/2 ton Chevy Silverado Crew Cab 4 x 4 SSVs. The total cost per vehicle including tax, warranty, radios and make ready charges is estimated to be $73,091 each for a total of $657,819 to be initially paid from the Sheriff's (D500) General Fund (100) appropriation. These vehicles are currently being sold on local vehicle lots and can be obtained this fiscal year. A County vehicle study was conducted in FY 2020 and the findings indicated a substantial vehicle shortfall for MCSO. MCSO requested 50 vehicles in its FY 2022 General Fund budget submission. ACCEPTANCE OF GRANT FUNDING FROM THE OFFICE OF NATIONAL DRUG CONTROL POLICY (ONDCP) FOR THE HIGH INTENSITY DRUG TRAFFICKING AREA (HIDTA) PROGRAM – INITIATIVE XXXI Formal Meeting Minutes 05/19/2021 Page 7 of 49 Approve Acceptance of up to $671,414 with the Office of National Drug Control Policy (ONDCP) Award Number G21SA0005A, for the High Intensity Drug Trafficking Area (HIDTA) Program. The term of this funding is January 1, 2021 to December 31, 2022. This amount represents the total FY 21/22 budget and spending ceiling for this initiative. The Maricopa County Sheriff’s Office is the Fiduciary of these funds for the County and will receive $559,042. The Maricopa County Attorney’s Office will receive $112,372. The Sheriff’s Office funding award is designated for two separate initiatives: Intelligence Initiative (HIDTAISC): $71,941 and Interdiction Initiative (MCDST): $487, 101. The total indirect cost amount for these two initiatives is $81,620.14 ($10,503.39 and $71,116.75). The Sheriff Office indirect rate is 14.6% and MCSO will not recover $81,620.14. The County Attorney’s funding award is designated for the Investigation Initiative (MISTIC) and its indirect rate is 20.1%. The total indirect cost amount for this initiative is $22,586.77 and MCAO will not recover $22,586.77. This funding supports of the Sheriff’s public safety mandate through efforts to reduce illegal drug use with the interruption of drug trafficking. The funding is recurring and has been awarded to the Sheriff’s Office for over twelve years. There is no matching requirement and there are no future or ongoing contributions required after the grant period ends. This is a competitive award. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. ADMINISTRATIVE CORRECTION TO ADDITION TO FLEET-HORSE TRAILER Administrative correction to C-50-21-149-X-00 approved by the Board of Supervisor on April 7, 2021, change the estimated cost of the addition to fleet of a horse trailer from $8,895 plus tax to $11,595 plus tax and delivery. MOU WITH BOYS AND GIRLS CLUBS OF THE VALLEY/AZYOUTHFORCE Approve an MOU between Boys and Girls Clubs of the Valley/AZYouthForce and Maricopa County on behalf of MCSO to provide two (2) internship opportunities, career opportunities and career development for youth that are eighteen or nineteen years of age for the duration of 6 – 8 weeks. This is a non-financial agreement. Its term is May 1, 2021 and when signed by the parties and expires 12/31/2021. FY22 AOC FAMILY COUNSELING ALLOCATION Approve the application and acceptance of grant funds from the Administrative Office of the Courts (AOC) in the amount not-to-exceed $271,794 for the purpose of Family Counseling. The grant award will begin on July 1, 2021 and ends on June 30, 2022. The JPD department was awarded $271,631 in FY21. Also, approve the Board Resolution and authorize the Chairman to sign all documents related to these grant funds, as applicable. The Juvenile Probation Department indirect rate for FY21 is 21.5%. Total grant indirect costs are estimated to be $58,435.71 and are not recoverable. The grant does require a cash equivalent match of $67,948. The grant award is re-occurring and has been awarded to the department for over ten years. The department has an in-kind match requirement of $67,948 during the grant award period. The grant award is a mandated function and provides a benefit to the citizens by providing family counseling services to support juveniles with a focus on providing support to the entire and improve family functioning and relationships leading toward behavioral change. The award is administratively distributed to Counties through the AOC in accordance with state laws. If awarded, the department will absorb the costs of the grant award. Funding for this agreement is provided by the State and administered through the Administrative Office of the Courts (AOC). The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. MARICOPA COUNTY WORKFORCE DEVELOPMENT BOARD RECERTIFICATION Approve documents necessary for recertification of the Maricopa County Workforce Development Board (MCWDB). Documents will be submitted to the Arizona Department of Economic Security (DES) for the Program Years (PYs) 2020 – 2021 as required by the Workforce Innovation and Opportunity Act (WIOA). Also approve MCWDB Bylaws, Shared Governance Agreement, Training Services Limits Policy, Monitoring Oversight Policy, and Conflict of Interest Policy. Authorize Board of Supervisors Chair to sign recertification and certifications. The Board of Supervisors authorizes and approves the following: 1. MCWDB recertification submissions requirements for program years 2020 and 2021 2. MCWDB revised Bylaws 3. Revised Shared Governance Agreement 4. MCWDB Training Services Limits Policy, Work-based Training Services Policy, Monitoring Oversight Policy, and Conflict of Interest Policy. 5. Submission of the Recertification packet to DES. All documents received legal review prior to processing for signatures and will be filed with the Clerk of the Board’s office. The Maricopa County Workforce Development Board Recertification request serves as formal notification to the Governor, Workforce Arizona Council, and DES of the County‘s request for Recertification for the PY 2020-2022 period. APPOINTMENT OF MARICOPA COUNTY WORKFORCE DEVELOPMENT BOARD MEMBER(S) Request approval of the following actions regarding the Maricopa County Workforce Development Board (MCWDB) as set forth below: 1. Appoint Matthew Clark, State and Local Government Affairs Manager, Verizon to the Business Category effective upon approval through June 30, 2021 and July 1, 2021 through June 30, 2024. The MCWDB is established and receives its authority in accordance with the Workforce Innovation and Opportunity Act (WIOA), which was signed into law on July 22, 2014 as Public Law 113-128. The Maricopa County Board of Supervisors (BOS) shall have final authority. The Maricopa County Board of Supervisors approves the appointments and accepts the resignations of MCWDB members. Supervisory District: All Districts (C-95-21-030-X-00) Supervisor Gates thanked Lee Ann Bohn, Assistant County Manager, for her work dedicated to Maricopa County Workforce Development Board (MCWDB) recertification. He said he also appreciated the leadership of the Supervisors with a focus on the importance of getting people back to work. Supervisor Gallardo echoed Supervisor Gates’ comments on the importance of MCWDB and job development and kudos to Lee Ann Bohn and her team. Supervisor Hickman echoed his colleague’s comments and thanked the members who have contributed to the MCWDB at such a critical time for our County. He also thanked Joy Rich for her contributions to the MCWDB. Supervisor Chucri thanked Lee Ann Bohn and her team for their diligence in being a good fiduciary of the taxpayer money. The steadfast management of the monies is appreciated by the Board. Chairman Sellers said he appreciated all the efforts and echoed the previous comments. AGREEMENT WITH U.S. DEPARTMENT OF HOMELAND SECURITY FOR BIOWATCH PROGRAM Approve an Agreement between the United States Department of Homeland Security (DHS) and Maricopa County through the Air Quality Department, in the not-to-exceed amount of $677,877. This Agreement is funded by a grant from the DHS (Award Number 06OHBIO00003-16-00) with the purpose of continuing funding for the sixteenth year of the BioWatch program. The BioWatch program includes an ambient air monitoring network to sample air pollution in a variety of settings, assess health and welfare effects, assist in determining sources of air pollution; and to carry out the provisions of the US EPA, the Federal Clean Air Act and Amendments, Arizona Revised Statutes, and County Air Pollution Control Regulations that are intended to correct, remove, minimize or prevent air pollution within Maricopa County. The Agreement is effective from September 1, 2006 until April 30, 2025 while the budget program period is effective from May 1, 2021 until April 30, 2022. The FY2021 Air Quality composite indirect rate of 21.11% will be applied to the direct charges of $565,298 The recoverable indirect cost of administering this grant is $112,579; the non-recoverable indirect cost is $0. The award includes equipment expenses of $32,000 which are excluded from the indirect cost recovery. The grant award is reoccurring and has been awarded to the department in previous years. The cash or in-kind match is not applicable, indirect cost is fully recoverable, ongoing cash contributions not applicable. The grant award is not mandated, and the activities are 100% financially supported by the grant from Department of Homeland Security (DHS). Approve the submittal of a Grant application for continued funding. The application for funding is for the period of September 1, 2021 through August 31, 2022. a. The purpose of the Grant is for the County to provide Early Head Start program services to 96 infants and toddlers. The program goals include: i. Increasing access to quality care and education; ii. Removing barriers to employment for parents of children enrolled in Early Head Start; and iii. Incorporating Early Head Start performance measures into daily activities to ensure children are school ready b. The funding application amount is $1,934,864 ($1,891,750 Program Operations and $43,114 Training and Technical Assistance); c. The Grant requires a 20% Non-Federal Share (NFS) match of the total approved project costs. The total NFS match is estimated to be $483,716 for the budget period of September 1, 2021 through August 31, 2022, which is obtained through in-kind donations of services and parent’s volunteering; d. The County is a current recipient of Grant No. 09HP000105 and has the opportunity to submit the anon-competitive application for funding continuation (reoccurring grant); and e. The Human Services Department will utilize the provisional indirect rate of 22.2% approved by the U.S. Department of Health and Human Services for FY22 for salaries and Formal Meeting Minutes 05/19/2021 Page 22 of 49 employee related expenses. The estimated grant funds are $1,934,864 of which $501,025 is for salaries and benefits. The total estimated indirect costs are $111,227 and fully recoverable. 2. Approve the submittal of an application for a Non-Federal Share (NFS) Waiver. The application is for a reduction to the Maricopa County Head Start Program’s Grant’s required NFS (match). a. The current Grant required NFS is $ 460,962, Maricopa County Head Start program has successfully collected $117,067 (25%) of the required NFS. The application proposes to reduce NSF by $298,894, a reduction of (64%). If approved, the new NFS shall be reduced to $162,068 for the Grant period of August 1, 2020 to September 30, 2021. The Grant funding award will not be impacted and will remain at the current amount of $2,804,899 for the period of September 1, 2020 through August 31, 2021. b. The Head Start program identifies NFS through the valuation of donated goods, and facilities and services provided by parents and community volunteers. Factors that impacted the NFS collection include: i. The Head Start agency located in a community adversely affected by a major disaster, specifically spikes of positive COVID-19 cases creating barriers towards meeting full enrollment, as outlined in the Head Start Act Section 640(b). ii. The implementation of virtual services resulted in decreased in family engagement and in- kind and volunteer hours, a major component of NSF generation. 3. Also request authorization for the Chairman to sign the Application for Federal Assistance SF-424s for the actions listed above and any documents related to this funding application. The Office of Head Start requires the Maricopa County Board of Supervisors Chairman to sign all grant applications, applications for additional funds, as well as amendments and budget revisions to the Grant. Amendments are required if the program needs to transfer funds between budget line items in an aggregate amount of $250,000 or more. The Application for Federal Assistance SF-424s are due on June 1, 2021. The purpose of this MOU is to describe the collaborative relationship and shared commitment between PCA AZ and the County under the Governor’s Office of Youth, Faith and Family (GOYFF) State Opioid Response (SOR) FY21 Positive Parenting Program© (Triple P) training opportunity. PCA AZ shall provide training to County staff on the Triple P training curriculum which will be integrated in the Head Start program. While recognizing the shared commitment, this collaborative relationship does not involve an exchange of funds and either party may withdraw at any time at its discretion and, for such reasons, it is not meant to be treated as a formal, binding agreement. The duration of this collaborative relationship begins April 5, 2021 and continues through the term of the current GOYFF SOR Triple P funding, which ends September 30, 2021. Through this Agreement, School Interns shall be provided with supervised practice educational experiences with the Head Start program. Interns are provided with training opportunities that may include assessments and observations in the following areas: • Observe the unique ages and stages of children birth to five • Observe case management strategies, including time management and caseload priority • Provide direct support of children’s social emotional development • Observe and co-facilitate family needs assessment • Observe and co-facilitate child assessment including Teaching Strategies Gold (TSG), Devereux Early Childhood Assessment (DECA), Family Maps (FMAPS) • Assist with identifying required system changes and assist with developing processes for improved outcome measures The term of this Agreement shall be for a period of five (5) years from the effective date. The funds were provided to the County because the City of Scottsdale did not request direct funding. The funds must be used for direct financial assistance, including rent, rental arrears, utilities and home energy costs, utilities and home energy costs arears, and other expenses related to housing. Remaining funds are available for housing stability services, including case management costs. The funds were due to be expended by December 31, 2021. The total $46,208,820.70 will be assigned to the Human Services Department to assist eligible renter households impacted by the COVID-19 Pandemic, with direct financial assistance including rent, rental arrears, utilities and home energy costs, utilities and home energy costs arears, and other expenses related to housing. On March 26, 2021, the U.S. Department of the Treasury provided an amendment to the funding expenditure period from December 31, 2021 to September 30, 2022. As a result, the EPA disapproved MCAQD’s negative declaration for aerospace coating and required the MCAQD to evaluate Rule 348 to determine if it represents RACT for the 2008 8-hour Ozone NAAQS. The MCAQD evaluated Rule 348 and determined that it is consistent with the Aerospace CTG and is generally consistent with several other aerospace coating rules recently approved as RACT and, therefore, meets RACT for the 2008 Ozone NAAQS and no changes to the current version of Rule 348 are required. The Clerk said there were three emails regarding COVID; 27 emails regarding elections and a few miscellaneous emails. All comments were shared with all the Board offices. SUMMARY OF CURRENT EVENTS - EL RESUMEN DE TEMAS DE ACTUALIDAD 103. Supervisors'/County Manager's summary of current events - Resumen de temas de actualidad de los Supervisores/Administrador del Condado Supervisor Gallardo made a few comments regarding COVID and the continued efforts with healthcare partners for vaccinations in the pop-up site events. A recent event in South Phoenix had a good turnout and included 12 to 17-year-olds with 700 or so people showing up. He said these are primarily walk-up sites with no appointment necessary and the County wants to make sure the public is aware and make it as easy as possible. Supervisor Gallardo spoke about the Election Audit and said he was happy with the ongoing response from the Board. He said he has gotten bipartisan support and feedback from other counties through the County Supervisors Association. He said the Board will continue to work in unity and continue to spread the truth. Supervisor Hickman was glad to be on CNN last night to speak publicly in support of Maricopa County Elections Department and the great work they have accomplished. He said he appreciated the elected officials being available to support the process at last Monday’s meeting. He said the unity of the County Leaders in one room gave him a feeling of calm. Supervisor Hickman said he looks forward to the day when the Board can focus solely on the ministerial duties that continue to drive the County forward. Supervisor Gates thanked the Chairman for his leadership particularly in this past week in dealing with the letters from the Senate and said he is proud to be a member of the Board. Supervisor Gates noted that yesterday, the outside contractors that were brought in to conduct the audit admitted the letter of accusations that was sent to the Board were false. He said in the interest of transparency, he looks forward to the retraction of the accusations. Chairman Sellers said he is proud to be a member of the Board and Maricopa County as a whole. The meeting on Monday, May 17, 2021 addressed the annual budget and a property tax reduction for the property owners of Maricopa County. He said this was a demonstration of teamwork. This Agreement shall become effective as of the date it has been executed by all PROJECT PARTNERS and shall remain in full force and effect until all stipulations previously indicated have been satisfied. The Laveen watershed is bounded by the Salt River on north, South Mountain on the south, on approximately the 7th Avenue alignment to the east, and Gila River Indian Community to the west. The PROJECT is bounded on the west by 51st Avenue, on the south by Estrella Drive, on the east by 41st Avenue, and on the north by Carver Road. The PROJECT includes two regional basins, storm drains and inlets, lateral pipes and outfall pipes. This Agenda Item impacts Supervisorial District 5. Final plans for Phase 1 have changed slightly requiring another review by SRP to assess the proposed construction on SRP’s easement. The Project was identified as one of the significant flood hazards in the Laveen Area Drainage Master Study Plan Update (ADMS/PU) study area due to potential for flood flows from South Mountain.
