Chairman Sellers opened the meeting and asked Supervisor Chucri to introduce Denny 
Barney, former District 1 Supervisor who would offer the invocation. Due to technical 
difficulties, Mr. Barney was not able to connect to the meeting and Supervisor Chucri 
offered the invocation.

Monica Gery, Communications Officer with Animal Care and Control introduced Murr. 
A picture of this 26-pound black cat was shown on the screen and she said that Murr is 
full of love and looking for a forever home. He has had a wellness checkup, he is 
neutered, fully vaccinated, microchipped, and ready to go home today. Ms. Gery said 
for more information on Murr or other available pets, please visit Pets.Maricopa.gov or 
call (602) 506-PETS(7387).
Chairman Sellers asked the Clerk if there were any changes or corrections to the 
agenda. The Clerk said there were none.

Pursuant to A.R.S. §36-184(B)(5) and §11-251.05, convene the schedule public hearing to 
solicit comments and consider the adoption of proposed revisions to fee waiver text in the 
Maricopa County Environmental Health Code (EROP Case ES-2020-001/MCEHC Fee 
Waivers - Chapter I, Regulation 5).  This item will become effective immediately upon Board 
of Supervisors approval.
Hearing was originally set at the January 13, 2021, Board meeting, under C-88-20-014-X-00 
(incorrect fiscal year of 20).  C# has been modified in this agenda item to reflect the correct

Approve the appointment of Erik Hernandez to the Planning and Zoning Commission, 
representing Supervisorial District 4. The term of the appointment will be effective as of

Supervisor Hickman thanked Bruce Burrows for the many years of dedicated service to 
the Planning and Zoning Commission. He said with the growth in the West Valley, the 
Planning and Zoning Commission has been invaluable. Supervisor Hickman welcomed 
Erik Hernandez as the new Commissioner for District 4.

RECRUITMENT BANNER FOR MCSO HEADQUARTERS
Authorize an exception to the County’s Graphic Standards and approve the hanging of a 
temporary 9 x 30 polyester scrim mesh banner on the north face of the MCSO Headquarters 
building located at 550 W. Jackson Street in Phoenix as shown in the attachment to this 
agenda item.   The purpose of this banner is to enhance recruitment efforts.   MCSO will 
work with County Facilities Management regarding installation and will ensure that the sign 
is properly maintained for visual and safety reasons for the duration of its use.

Accept $38,356,926.60 in Coronavirus Relief Funds for Emergency Rental Assistance from 
the U.S. Department of Treasury.  Funds must be used for direct financial assistance, 
including rent, rental arrears, utilities and home energy costs, utilities and home energy costs 
arrears, and other expenses related to housing.  Remaining funds are available for housing 
stability services, including case management and other services intended to keep 
households stably housed, and administrative costs.  Funds generally expire on December

Accept the in-kind donations of 184 packages of various types of dog treats from Community 
Canine Project valued at $3,153.30; and in-kind donation of pork twist treats from Four Paws 
and Friends valued at $2,698.20.
Donation funds are not local revenues for the purpose of the constitutional expenditure 
limitations and therefore, expenditures of these revenues are not prohibited by the budget 
law. The approval of this action requested does not alter the budget constraining the 
expenditure of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105.

NEW HOPE AGREEMENT WITH VERDE VALLEY HUMANE SOCIETY
Approve an agreement between Verde Valley Humane Society and Maricopa County, 
administered by Maricopa County Animal Care and Control, to allow said rescue to transfer 
animals that have been deemed eligible for the New Hope program. Maricopa County will 
provide a rabies vaccination, dog license tag, and new owner transfer fee within the first year 
of transfer for each dog three months of age or older at no cost to the Contractor. The cost 
for these services is $52 for each animal transferred in FY 2021 and thereafter. Animal Care 
and Control estimates three hundred (300) New Hope transfers over the term of the 
agreement for a total of $15,600. The term of this agreement shall commence upon approval 
and execution by the Board and will expire on January 27, 2022. (C-79-21-050-X-00)

Approve an agreement between Heart2Heart Animal Rescue and Maricopa County, 
administered by Maricopa County Animal Care and Control, to allow said rescue to transfer 
animals that have been deemed eligible for the New Hope program. Maricopa County will 
provide a rabies vaccination, dog license tag, and new owner transfer fee within the first year 
of transfer for each dog three months of age or older at no cost to the Contractor. The cost 
for these services is $52 for each animal transferred in FY 2021 and thereafter. Animal Care 
and Control estimates twenty (20) New Hope transfers over the term of the agreement for a 
total of $1,040. The term of this agreement shall commence upon approval and execution

Approve an agreement between Arizona Boston Terrier Rescue, Inc. and Maricopa County, 
administered by Maricopa County Animal Care and Control, to allow said rescue to transfer 
animals that have been deemed eligible for the New Hope program. Maricopa County will 
provide a rabies vaccination, dog license tag, and new owner transfer fee within the first year 
of transfer for each dog three months of age or older at no cost to the Contractor. The cost 
for these services is $52 for each animal transferred in FY 2021 and thereafter. Animal Care 
and Control estimates two (2) New Hope transfers over the term of the agreement for a total 
of $104. The term of this agreement shall commence upon approval and execution by the

Control estimates one hundred and twenty-five (125) New Hope transfers over the term of 
the agreement for a total of $6,500. The term of this agreement shall commence upon

MEMORANDUM OF UNDERSTANDING WITH THE HUMANE SOCIETY OF UTAH
Approve the Memorandum of Understanding with the Humane Society of Utah for the out of 
state transfer of ownership and possession of animals with the intent of finding permanent 
placement for the animals. The MOU memorializes the transportation elements that the 
County through the Animal Care and Control Department will follow and that the Humane 
Society of Utah will accept all rights, ownership, control, and responsibility of the animals

ANNUAL ADJUSTMENT TO INMATE BOOKING AND HOUSING FEES
Approve the annual adjustment to the inmate booking and housing fees charged to other 
jurisdictions for the use of Maricopa County jails. The effective date of this adjustment will be 
July 1, 2021. The inmate booking fee will increase from $396.98 to $442.36 per inmate 
booked; the inmate housing fee will decrease from $102.55 to $95.44 per day.

(TSMC) request for Federal Trade Zone designation for a site located at Northwest corner

of Loop 303 and 43rd Avenue alignment, parcel 204-09-001, which is owned by TSMC and 
to be included in the City of Phoenix Foreign Trade Zone No.75, and reclassification of said

designation. Authorize the Chairman to sign said “non-objection” letter. The letter will be 
directed to the Foreign Trade-Zone Board, U.S. Department of Commerce.

Supervisor Gates said he was excited about this Foreign Trade Zone project which is 
in District 3 and impacts Maricopa County and the State of Arizona. He said this project 
represents a $38 billion economic impact over the next 20 years and he thanked all the 
partners who worked on this project.
Chairman Sellers echoed Vice Chairman Gates’ comments saying this type of project 
attracts more companies to the Valley to support what TSMC is doing.

EXCEPTIONS TO THE EMPLOYEE LEAVE POLICY (HR2415) TO ADDRESS THE 
COVID-19 VIRUS
Approve the following exceptions to the Maricopa County Employee Leave Policy (HR2415) 
from January 27, 2021 through December 31, 2021:
1. Allow employees who test positive for COVID to use up to 80 hours of Emergency Leave 
with Pay (prorated for part-time employees).
2. Allow employees to use up to 160 hours of their Sick Leave to care for a child (under the 
age of 18 or disabled adult child) whose school or place of care is unavailable or operating 
in a virtual environment due to COVID-19.
3. Allow eligible employees (see eligibility below) to borrow up to 40 hours of Sick Leave and 
40 hours of Vacation Time (prorated for part-time employees).
Leave under exception #2 and #3 is not a guarantee. Employees must follow standard 
department approval procedures when requesting to use this leave. Appointing Authorities 
can exclude their employees from exception #2 and #3 when it will create a hardship on the 
business needs and negatively impact their departments’ operations.
EMPLOYEE ELIGIBILITY TO BORROW LEAVE
Employees must meet the eligibility criteria set below and receive approval from their 
Appointing Authority.
1. Exhaust all Sick Leave, Vacation Time, and Floating Personal Day.
2. Cannot work or telework.

3. Subject to a federal, state, or local quarantine or isolation order related to COVID-19.
4. Advised by a healthcare provider to quarantine due to concerns related to COVID-19.
5. Experiencing symptoms of COVID-19 and seeking a medical diagnosis (also applies to 
symptoms experienced after receiving a COVID-19 vaccine).
6. Caring for an “Immediate Family Member” who is subject to a quarantine or isolation order 
related to COVID-19 or has been advised by a health care provider to quarantine due to 
concerns related to COVID-19.
     a. Immediate Family Member: Employee’s spouse, child, or parent as defined in the 
Employee Leave Policy (HR2415).
SEPARATION
Employees who voluntarily leave County employment with a negative Sick Leave or Vacation 
Time balance must reimburse the County for those negative balances. The amount eligible 
by law will be deducted from employees’ final paychecks. Employees should contact Human

In accordance with the County Policy A2508, accept the donation report from the Human 
services Department.
The Human Services Department, Workforce Development Division received a donation 
from Eyeglass World #8283, located at 3524 W. Peoria Ave #8283, Phoenix, Arizona 85029. 
Eyeglass World provided 12 vouchers for program participants to have eye exams, lenses, 
and frames. Each voucher is valued at $325 for a total cash value of $3,900.

AGREEMENT WITH ARIZONA DEPARTMENT OF HOUSING FOR SWG 
WEATHERIZATION ASSISTANCE PROGRAM
Approve a Funding Agreement between the Arizona Department of Housing (ADOH) and 
Maricopa County administered by its Human Services Department. The purpose of the 
Agreement is for the County to administer the Southwest Gas (SWG) Weatherization 
Assistance Program. Through this Agreement, ADOH will provide the County with $86,219. 
The Agreement shall be effective beginning January 1, 2021 through December 31, 2021 
and upon signature by both Parties.

AMENDMENT TO THE AGREEMENT WITH COMMUNITY BRIDGES, INC. FOR THE 
PROVISION OF RAPID REHOUSING SERVICES
Approve Amendment No. 1 to a financial Agreement (“Agreement”) between Community 
Bridges, Inc. (“Subrecipient”) and Maricopa County the (“County”) administered by its Human 
Services Department. 
The Purpose of this Amendment is to address the following:

The County shall provide the Subrecipient $60,000 in ESG CARES Act Round 2

Approve and execute the First Amendment To License (“Amendment”) between Maricopa 
County (“Licensee”) and Salt River Project Agricultural Improvement and Power District 
(“Licensor”) (C-30-17-016-M-00) (“License Agreement”) for the Maricopa Trail (“MT”) and 
Sun Circle Trail (“SCT”) segments (collectively “MT/SCT”) as part of the Maricopa County 
trail system.
The purpose of this Amendment is to amend the License Agreement to: (1) consolidate 
multiple licenses between Licensor and Licensee for trail use and trail marker placement 
along various canals and lands managed and/or owned by the Licensee as part of a federal 
reclamation project; (2) amend and clarify the description of such licensed property and 
attached revised exhibits; (3) correct the term of the License Agreement; (4) clarify the 
license fee and maintenance responsibilities of the parties for such licensed property; and 
(5) define the responsibilities of the Licensee upon expiration or early termination of the 
License Agreement.
In accordance with the provisions of the Amendment, as of its effective date, two of the

District 2 - initiate establishment of the  Maricopa County Aggregate Mining Operations 
Zoning District #2 (a.k.a. Twin Knolls Aggregate Mining Operations Zoning District), to 
encompass an area bounded by the Boise St. alignment on the north, 85th Pl. on the east, 
Apache Trail on the south, and 81st St. on the west.  The Board will subsequently appoint 
an equal number up to seven each of mining industry representatives (from active operations 
within the district or from within any other district in the county) and private citizens not 
affiliated with the mining industry who reside within a three-mile radius of the district 
boundary – to the Maricopa County Aggregate Mining Operations Zoning District #2 
Recommendation Committee.  The committee will serve as a mediation body between 
members of the public and mining operators, recommend administrative regulations for 
adoption by the Board, and hear complaints filed with and make recommendations to the

coming into this community and potentially taking away a backdrop which has been

(Agreement) for Research between Children’s Hospital Corporation d/b/a Boston Children’s 
Hospital (BCH), a charitable corporation and Maricopa County by and through its Department 
of Public Health (MCDPH), Disease Control. This amendment will allow for continued access 
to anonymized data collected by Boston Children’s Hospital.  This amendment shall remain 
in effect from December 29, 2020 through December 28, 2022.  All other terms and

AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR 
COUNTY LABORATORY TESTING
Approve an additional $1,906.50 to IGA ADHS16-11634 increasing the not-to-exceed 
amount from $12,400 to $ 14,306.50 for CY2019, between Maricopa County, Department of 
Public Health and Arizona Department of Health Services for STD laboratory testing. The 
Contract term was January 1, 2016 through December 31, 2020.
The Lab Testing grant award is reoccurring and non-competitive and has been awarded to 
the Department for a number of years. There is no cash or in-kind match required and indirect 
cost is fully recoverable. Should this grant be discontinued, ongoing cash contributions may 
be required as this is a mandated function. At this time, there are no costs that will need to 
be absorbed by the department’s operating budget.
The Department of Public Health indirect rate for FY21 is 18.8%.  Indirect costs are estimated 
at         $302.00, all of which is fully recoverable.  Departmental indirect rates are reestablished 
at the beginning of each fiscal year and the future indirect rates will be collected at the 
corresponding rates.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This 
Amendment does not alter the budget constraining expenditures of local revenues duly 
adopted by the Board pursuant to A.R.S. §42-17105.  The overall grant budget will be 
adjusted as necessary to accommodate this grant through a future reconciliation.  Funding 
for this Agreement is provided by a Grant from ADHS and will not affect the County’s general

for each year of the subsequent years of the term will be negotiated based on the County’s 
need and the availability of funds. Year 1 funding consists of:
a. Up to $500,000 for the purchase of HIV medications through Arizona Department of Health 
Services, AIDS Drug Assistance Program, for Ryan White eligible clients.
b. Up to $75,000 for consultant costs related to the collaborative development and 
implementation of a shared Statewide Comprehensive Needs   Assessment.

IGA WITH CITY OF PHOENIX, HOUSING DEPARTMENT
Approve an amendment to extend the IGA between City of Phoenix, Housing Department 
and Maricopa County, Department of Public Health for the purpose of providing continued 
housing services to Ryan White eligible clients identified as unstably housed. This 
amendment extends the term from April 1. 2021 thru June 30, 2021. In addition, the final 
invoice is due to MCDPH by August 15, 2021.
This 3-month extension allows for the time needed to close Project HHHOME (Housing, HIV 
Health Outcomes & Employment), an HIV housing program.  Due to anticipated COVID-
related increases in core medical needs, it is projected there will not be adequate funding to 
support the current housing services model. The County is working closely with the City of 
Phoenix to identify alternate housing for the 14 clients that will be impacted.  The Ryan White 
Planning Council is collecting community information and will be making recommendations

Authorize and approve an extension to RFP Contract 14067 for Ryan White Part A program 
services between Maricopa County through its Department of Public Health and Chicanos 
Por La Causa.
The Department requires additional time to prepare for the upcoming RFP process due to 
updated requirements from Health Resources and Services Administration’s (HRSA) and 
HIV/AIDS Bureau (HAB) regarding Ryan White Part A funding. 
The contract term is extended for an additional three (3) months from March 1, 2021 through 
May 31, 2021. This is a 3-month extension beyond the original maximum 6-year term, 
making the total term 6 years, 3 months from March 1, 2015 thru May 31, 2021.

Approve a retro-active Purchase Order (PO) for the TB State IGA ADHS19-206652 between 
Arizona Department of Health Services (ADHS) and Maricopa County by and through its 
Department of Public Health (MCDPH) for the Tuberculosis Control Program. The not-to-
exceed amount of $281,650.00 is for the budget period July 1, 2020 through June 30, 2021. 
The IGA term is July 1, 2018 through June 30, 2023.  This is a Cost Reimbursement Contract.
This grant award is reoccurring and has been awarded to the department for many years. 
There is no cash or in-kind match requirement. TB services are mandated; should the grant 
cease, on-going contributions may be required. The grant award is not competitively bid.  
Maricopa County Department of Public Health’s indirect rate for FY21 is 18.8%. This grant 
allows for full indirect, therefore the estimated amount of $44,571 is fully recoverable. 
Departmental indirect rates are reestablished at the beginning of each fiscal year and the 
future indirect rates will be collected at the corresponding rates.

Approve Purchase Orders (PO) to cost reimbursement Intergovernmental Agreement (IGA) 
between ADHS and Maricopa County by and through its Department of Public Health 
(MCDPH), Office of Epidemiology (OE) to provide additional funding for the ‘Arizona Birth 
Defects Monitoring Program’ (AZBDMP). The purchase orders apply to first quarter funding 
of the budget period from January 1, 2021 through December 31, 2021. Approval is 
requested for the anticipated not-to-exceed amount of $269,250.00. All other terms of this 
agreement shall remain in their entirety.  This is the final year of the 5 year IGA contract term 
of January 1, 2017 through December 31, 2021.
This is the first 5 year term of this grant and it is uncertain whether it will reoccur. There is no 
cash or in-kind match required nor should ongoing cash contributions be necessary. The 
grant award is not a mandated function but provides a benefit to the citizens with its effort to 
collect, analyze and understand birth defect related data. The grant award was not 
competitive.

TERMINATION OF LEASE AGREEMENT WITH THE PRESSROOM LLC
Due to a violation of applicable law, approve the official notice of an event of default and 
lease termination of Lease MC10192 (Lease) between Maricopa County, as Landlord by 
assignment, and The Pressroom, LLC, effective January 21, 2021, sent by the County’s Real 
Estate Department Director, for the Pressroom’s use of county-owned space located at 441 
W Madison Street, Phoenix, Arizona 85003.
The County purchased the property described above as part of the purchase of the city block 
located between West Madison and West Jackson Streets and South 4th and 5th Avenues 
in Phoenix, Arizona, which was approved by the Board of Supervisors on July 22, 2020 (C-
78-20-010-3-01). As part of the purchase, the Lease was assigned to County as landlord 
and either party had the right to terminate the Lease by providing a written ninety (90) day 
notice to the other party within forty-five (45) days of the transaction closing date of 10/15/20. 
On November 25, 2020, a notice was provided to the Pressroom (Tenant) that the County is 
electing to exercise its right to terminate the Lease.  Subsequent to the stated 
correspondence, the Tenant held an unpermitted event on January 16, 2021, in violation of 
applicable laws and as a result, on January 20, 2021, was closed for business by the Arizona 
Department of Health Services (ADHS).  In light of the unpermitted event, which constituted 
a default of the terms of the Lease, on January 21, 2021, the County Real Estate Department 
Director sent a Notice of Default and Lease Termination to the Tenant.  Said notice took 
effect immediately.

ENHANCEMENTS PROJECT
Approve the Intergovernmental Agreement (IGA) between Maricopa County and City of 
Peoria for the Bell Road Communication Enhancements Project. Under the IGA, the 
agencies will coordinate the improvements and share in the costs of the project. Funds are 
budgeted in FY2020 Transportation System Management Project, sub-project TT0667 Bell 
Road Communication Enhancements Project.
The estimated total cost for the project is $966,208. The County’s estimated cost share 
contribution is $51,451. The City of Peoria’s contribution is $29,924. There is $813,534 in 
federal funding and $71,299 from the City of Surprise.
 
The Project’s purpose is to improve the reliability of communications and expand 
communications bandwidth along Bell Road at existing MCDOT, City of Surprise, and City 
of Peoria traffic signals. The Project will also address existing damaged fiber and upgrade 
the fiber capacity and bandwidth to improve communications connectivity to City of Surprise 
and City of Peoria Traffic Management Centers (TMC’s). In addition, the Project will improve 
the reliability of this critical portion of the Regional Community Network (RNC) along Bell 
Road. The Maricopa County Department of Transportation (MCDOT) is the lead agency.

POWER DISTRIBUTION EASEMENT
Approve and execute a non-exclusive power distribution easement, without a public auction 
pursuant to A.R.S. 11-251 (9), to Salt River Project Agricultural Improvement and Power 
District (SRP), and its successors and assigns, in, upon, over, under, through and across 
the County’s property identified as APN 102-55-017A; and all other documents approved by 
legal counsel required to complete the transaction. This easement is needed to provide 
electric service to the new MCSO District No. 2 office, located at 695 North 105th Avenue, 
Avondale, Arizona.  This easement will grant SRP the right to construct, reconstruct, replace, 
repair, operate, and maintain electrical lines for the transmission and distribution of

AUDIT OF ELECTION EQUIPMENT AND SOFTWARE
Authorize the Maricopa County Elections Department to take the necessary steps to conduct 
an audit or audits of the Dominion Voting Systems equipment and software used in the 
November 3, 2020, general election, including retaining a U.S. Election Assistance 
Commission certified auditor or auditors, for the purpose of gathering information to prepare 
for future elections in Maricopa County. (C-19-21-073-X-00)
Chairman Sellers thanked Stephen Richer, County Recorder, for working closely with 
Scott Jarrett, Director of Election Day and Emergency Voting.
Mr. Richer addressed the Board noting the importance of this audit of the tabulation 
equipment and tabulation software to help the public understand how elections are 
conducted in Maricopa County. He encouraged the Board to exercise its statutory 
authority to conduct this audit on the equipment and the software and said that the 
Recorder’s office would do whatever was needed to cooperate and help inspire 
confidence in the election process. He stated that restoring confidence in the election 
process is not a one-day process but will be an ongoing effort.   Mr. Richer said he was 
thankful for the opportunity to partner with Chairman Sellers to make this mission 
regarding educating the public about the election process a concerted effort.  In 
conclusion, he stated that he fully supports this audit.
 
Scott Jarrett presented the forensic audit details. He began by stating that this process 
is an extension of previous efforts to build confidence and to ensure elections are 
accurate, secure, and done with integrity. He credited the Board of Supervisors, former 
Recorder, Adrian Fontes, his co-Elections Director, Rey Valenzuela and current 
Recorder Richer for working with the Elections Department to achieve these results.

He added that many of the previous efforts have already transpired.  They were 
established in the current law by the State of Arizona, the Legislature, the Governor, the 
Secretary of State, and the Attorney General and in a robust Elections Procedures 
Manual with steps in place to ensure results are reliable, accurate, and secure. Mr. 
Jarrett noted that all these processes had been previously reviewed with the Board at 
an open meeting before the canvass of the election. He presented a few details on the 
items outlined on the slide; testing and audits performed, the purchase of the equipment 
and ensuring it was certified by the United States Elections Assistance Commission, the 
oversight process, and the many security measures taken at every step of the process. 
Mr. Jarrett highlighted the 100% hand count of the Madison School District election 
where the results were a 100% match between the hand count and the machine results. 
Three subsequent hand counts also resulted in 100% matches.  
Mr. Jarrett noted that the staff worked directly with representatives from the political 
parties and the major campaign representatives throughout the tabulation and audit 
processes.  He also highlighted a number of security protocols including background 
checks of those entering the tabulation center and the placement of 24/7 security 
cameras to track the security of the ballots.

Mr. Jarrett reviewed The Forensic Audit slide, explaining that a forensic audit is a 
process that is designed to review the equipment to ensure that it is reliable and 
accurate.  The slide lists the scope and components of this type of audit  
Mr. Jarrett moved forward to the slide highlighting a few of the many questions being 
asked. He stated that this audit is intended to build confidence in the elections process 
and to help dispel the misinformation and disinformation. He stressed the importance of 
being able to trust the equipment in the future. Mr. Jarrett reiterated that this would be a 
continuation of the audits and reviews already performed.  He said it is important to note 
this assessment is going to be conducted by an outside certified audit firm and an 
outside accounting firm, not the Elections Department. The proposal for this audit 
includes that there will be at least one US Elections Certified firm, a firm accredited by 
the U.S. Election Administration Commission and National Institute of Technology.  
Potentially, there will be two firms conducting the audit.

Rumors continue to circulate about possible ways that the equipment may have been 
altered or hacked in some way.  This audit will be another opportunity to show that the 
equipment has been thoroughly examined by this outside certified audit firm and that 
the system is reliable.  With the March jurisdictional election in Goodyear coming up, the 
audit will be done before that election because the tabulation machines will be used in 
that election and security measures will be in place. Mr. Jarrett concluded his 
presentation and asked Chairman Sellers if he or the other Supervisors had any 
questions.
Supervisor Chucri recommended that this item move forward and if there were 
comments or questions, those could follow. 
Supervisor Hickman agreed with Supervisor Chucri but said there is a historical 
perspective he wanted to note. He spoke about his Chairman’s address in January 2020 
and said he emphasized that there would be key learning steps with the goal being three 
good elections. At that time, COVID-19 was not known. Supervisor Hickman said that in 
the days following the General Election, people asked questions that had been 
answered many times during presentations at Board meetings, the Election Canvass 
meeting or the Senate Hearings. He noted that many times the current questions being 
asked were covered at those meetings.  The information gathered during these meetings 
was applied and this process had been ongoing since the start of the year. 
He asked Mr. Jarrett how many times he addressed the Board regarding the election 
and the machines in 2020. Mr. Jarrett said there were at least two planning presentations 
to the Board before each election, to review the plans. He noted that this was the first 
time the Elections Department worked collaboratively with the Recorder’s Office to 
prepare and present voting plans before each election. The planning documents were 
often more than 60 pages to show the detail of the plan. In addition, following each 
election there was a debriefing presentation called “lessons learned.” All of the “lessons 
learned” were carried forward to the planning for the next election.  The Board then 
approved each emergency voting and election day plan.  Mr. Jarrett added that these 
robust planning meetings were intended to inform the public about what was going on 
regarding the elections.

Supervisor Gallardo noted that the above-mentioned meetings were at full Board of 
Supervisor meetings.  In addition there were many informal meetings out in the 
communities that were designed to inform and educate citizens. He mentioned the 
meetings that were also conducted in Spanish including a meeting conducted in 
collaboration with Spanish television.  Supervisor Gallardo also noted meetings 
conducted by ZOOM to inform citizens about how the elections were going to be 
conducted including security, safety, the polling sites, and all elements of the voting 
process.
Supervisor Hickman also commented about the Dominion Voting machines which 
featured electronic adjudication which would offer greater speed and accuracy. The 
Board went to the Legislature to ensure that questions were answered regarding this 
new aspect of electronic adjudication and ensure any concerns were addressed. A tour 
of the Elections facility was offered to all legislators to look at the machines and answer 
any questions. Supervisor Hickman asked Mr. Jarrett who was the main sponsor of the 
piece of legislation, SB1135, signed into law last year. This law, Mr. Jarrett replied, was 
sponsored by Senator Farnsworth, the former Senate Judiciary Committee Chairman. 
Supervisor Hickman asked if Mr. Farnsworth had attended any of the tours.  Mr. Jarrett 
replied he had not. However, he had asked enough questions to frame the legislation 
that subsequently was signed into law. Additionally, Supervisor Hickman and Mr. Jarrett 
went before the legislative committees to answer questions regarding the Dominion 
machines and the electronic adjudication aspect. Supervisor Hickman also mentioned 
that he and Supervisor Gallardo went before the House Committee to answer questions. 
House Member Townsend was the Chairman of that committee and was present for that 
question and answer period.
Supervisor Hickman asked Mr. Jarrett about the status of the tabulators. Mr. Jarrett said 
the tabulation machines continue to be monitored 24/7 with video equipment and the 
feed is streamed live on the Election’s website. This has been continuous since they 
were set up in January. All the tabulators used in the general election are still in the 
same state since the election. He explained that each machine has 2 memory cards.  
One was removed to be used for vote tabulation counts.  The other memory card is still 
in the machine.  The second memory card is still in the machine sealed with a tamper-
evident seal.  He stated that the equipment is ready for this audit, and the machines 
have not been tampered with.
Supervisor Chucri made the following motion with a comment. “I move forward for 
approval to do a scope of work on item 69 as presented by Mr. Jarrett.”  He thanked Mr. 
Jarrett for all his work. Supervisor Chucri also stated that it was his understanding “that 
this audit is the beginning of our efforts to communicate with our constituents, that we 
will take the necessary steps to continue to educate and make sure that our residents 
have confidence in our voting process.”
Supervisor Gates seconded the motion.
Supervisor Gates thanked Supervisor Hickman for his questions and comments and 
said that many people were not paying attention to the information being shared 
throughout the year along with the work done by the Elections Department and the 
Recorder’s Office including Scott Jarrett and Rey Valenzuela. Supervisor Gates said he 
fully supports this audit, but that support in no way undermines the efforts of the 
Elections team for all the work done in the past year.  He also stated that he has no 
regrets about the Board taking a more active role in the elections process.  He said that 
he realizes that there are still questions in the community related to the machines – that 
is why he is supportive of this audit of the machines to audit the hardware and the

software.  Supervisor Gates thanked Recorder Richer for his partnership and 
collaboration and thanked Chairman Sellers for his leadership in this process.
Supervisor Hickman also thanked Chairman Sellers for his leadership as Chairman of 
the Board including his interactions with legislative members. He once again thanked 
the Elections and the Recorder’s Offices for all their hard work. He added that the Board 
follows the practice: trust but verify.  That is what this audit is doing.  He emphasized 
that the audit would be done by certified teams who bring their “best practices” to the 
task.  
Supervisor Hickman noted that the city of Goodyear has already sent out ballots to the 
military for their upcoming election.  He said that the fact that the surrounding cities 
(except Phoenix) contract with Maricopa County to run their elections is additional 
incentive to restore confidence in the process.
Supervisor Gallardo stated that he has always been very transparent about his beliefs.  
He commented, “If what I am saying is wrong then prove me wrong.”
He stated the County has performed three historic elections during a pandemic with 
record turnouts. All three were safe, secure, and accurate. He thanked the Elections 
team for their work and the countless hours spent running three successful elections 
making sure that everyone had their right to cast a ballot.  There were no questions 
about accuracy or access to the ballot box. He said that any time there are accusations, 
rumors or even lies about the accuracy of the process it is like a slap in the face to the 
entire Elections team.  Supervisor Gallardo said that he agreed with Supervisor 
Hickman’s review of the number of hours in meetings and other efforts to inform the 
community about the entire elections process.  There were no questions or complaints 
after the Presidential Preference Election; nor were there questions or complaints after 
the Primary Election.  However, after the General Elections there began to be a number 
of complaints or concerns raised.  He felt that many who did not like the results began 
to circulate questions, concerns and even lies about the process and/or the machines.
Supervisor Gallardo commented that the County had done a number of logic and 
accuracy tests as well as several hand audits. Each process showed that the elections 
were safe, secure and accurate.  Therefore, he asked himself, “Why do another audit?”  
He said that he realizes that there will always be persons who will not accept the 
outcome of the election and may continue to question the process.  However, he said 
he will support this audit to inform the public knowing that there is a group of people who 
will never be satisfied with the results.  People talk about election integrity and fair 
elections and yet he said he was particularly bothered to know that the legislature is 
actively working to introduce bills to suppress voter turnout. He said that the legislature 
would be using the County’s election process and audit to justify the bills they are 
introducing.  He felt that the underlying reason for many of the proposed bills was that 
some did not like the people who were voting.  Supervisor Gallardo commented that 
during his time at the legislature he had introduced many bills dealing with elections, but 
not one time did he require that there be an audit in order to justify the bill he was 
introducing.  
Supervisor Gallardo stated his support for this audit and noted that this audit would be 
looking at internet connectivity which has not been audited to this point.  He felt it would 
be important to look at that aspect.  He stated that he felt the second aspect of this audit 
could be called, proof of performance.  He expressed the importance of continuing to 
educate the public and reaffirming to them that the elections are safe, secure and 
accurate and to remind everyone the importance of voting.

Chairman Sellers said the Board has always been anxious to partner with the Legislature 
recognizing their authority over elections and the Board has worked diligently with them 
and kept them informed of the County’s processes. A final concern that Chairman 
Sellers talked about was the doubt in many people’s minds about the elections process.  
He said he wants to reassure the public that the elections are fair despite all the rumors.  
It is important to continue to educate our citizens about the facts.  Chairman Sellers also 
thanked the new Recorder, Mr. Richer, for his efforts in the short time he has been in 
office to cooperate with these verification efforts.  He also expressed appreciation to Mr. 
Jarrett and Mr. Valenzuela for all of their work throughout the entire election process 
and these audits.  He said, “The Board’s goal of assuring trust in our elections does not 
end with an audit, it is part, and maybe an important part, but we shall continue to 
educate our residents with facts.  We have an excellent elections team and I am proud 
to tell their story to anyone.” 
Supervisor Chucri stated that the Board had often talked about the evolution of elections 
in Maricopa County over the past several decades.  “We have commented on the 
Maricopa County of the 1960’s versus the Maricopa County of today.”  He commented 
on the roles of the Recorder and the Board and the evolution and importance of always 
working toward a better process. The recent restructuring of the Elections and 
Recorder’s Departments has been a positive development leading to the hiring of Mr. 
Jarrett and of creating a nimbler process. Supervisor Chucri stated that “one’s right to 
vote is sacrosanct…and that voting is the bedrock of our democracy, and we should do 
all that we can to protect that." 
Supervisor Chucri said in thinking about this current concern about the equipment, the 
often-heard phrase “the customer is always right” can be applied. He said what this really 
means is that you “listen” to the customer, and also, that even if you disagree, you try to 
understand where the customer is coming from and to bridge the gap.  He said that in 
this case the customers are “our residents, our constituents and the voters.”  He added 
that it is not an issue of being to the far left or the far right.  He noted that even his mother 
and his contractor, average Arizonians, questioned the equipment.  
Commenting on Supervisor Hickman’s statements about transparency, Supervisor 
Chucri noted that he had campaigned on the issue of transparency, and that he has 
been in favor of this audit for some time for the reasons he had stated, not to prove 
someone was wrong.  He said it must be done, and done right, not just as “window 
dressing.”  He is advocating for the audit to make sure there is confidence in the 
elections processes.  He felt it was paramount that people maintain an open mind.  He 
agreed with the Chairman that it is necessary to have a spirit of cooperation with the 
legislature.  He also noted that he agreed with Supervisor Gallardo that the results 
should be “communicated and communicated well.”  He thanked all who had 
communicated with him about the process.
Chairman Sellers thanked Supervisor Chucri for all of his work on this issue.  He noted 
that Supervisor Chucri was the one who brought this issue to this point.  At this point, 
the Chairman called for the vote.

JOINT USE AGREEMENT FOR THE PASSIVE RECREATIONAL USE AT NEW RIVER 
DAM
Approve Joint Use Agreement (JUA) FCD 2020A023 for the Passive Recreational Use at 
New River Dam between the City of Peoria (City) and the Flood Control District of Maricopa 
County (District).  The JUA details the necessary coordination and responsibilities of each 
party for the use of a portion of the New River Dam project area defined as the “Passive 
Recreation Area” by the City for passive recreational purposes such as multi-use trails for 
equestrian, pedestrian, and non-motorized uses (“the PROJECT”). All costs for 
development, maintenance, and operation of recreational features at New River Dam under 
this agreement shall be borne by the City.  There is no cost to the District. The term of this

The City has formally requested the District to use a portion of the New River Dam project 
area for passive recreational activities. The City recently completed Phase 1 of Paloma 
Community Park at New River Dam; the PROJECT will provide multi-use trails for passive 
recreation at New River Dam adjacent to Paloma Community Park and connectivity to other 
City parks and trails.  The District intends to provide a non-exclusive use agreement for 
passive recreation to the City at no cost.  This Agenda Item impacts Supervisorial District 4.
