INVOCATION - INVOCACIÓN Bishop David Bailey of the Episcopal Church in Navajo Land was introduced by Vice Chairman Jack Sellers. Vice Chairman Sellers said Bishop Bailey has been a longtime friend and occasional golf buddy. He said when he feels challenged by the COVID pandemic, he reflects on Bishop Bailey and his region in northeastern Arizona, Navajo Nation, that has also been dealing with challenging times. Bishop Bailey offered the invocation. 2. PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA Bishop Bailey led the Pledge of Allegiance to the flag. 3. ELECTION OF THE 2021 BOARD OF SUPERVISORS' CHAIRMAN AND CHAIRMAN'S ADDRESS (C-06-21-365-X-00) Chairman Hickman said that due to the pandemic, all the reelected Supervisors have been sworn into office for their current term of service. He thanked newly elected Assessor, Eddie Cook for attending the meeting. He said the next item would be to nominate the new Chairman for calendar year 2021.Chairman Hickman stated it had been an honor to serve as Chairman. He said the challenges that were faced and decisions made were manageable because of the support of fellow Board members. Supervisor Gallardo requested a point of personal privilege and thanked Chairman Hickman for his leadership through the many challenges that the County faced in 2020. He said this has been a historic year with the pandemic and three elections. He talked about how the Board was able to adjust and restructure at the last minute to run a safe and successful election. Despite the historic challenges that the pandemic created for Maricopa County, Supervisor Gallardo stated Chairman Hickman managed it well, stayed the course, and earned Maricopa County “Best in Class”. He said the Board did their job serving the citizens of Maricopa County and will look back with pride. Supervisor Gates echoed the comments of Supervisor Gallardo. He said Chairman Hickman’s leadership during this past year and his dedication to the County helped save lives and save democracy. Supervisor Gates expressed gratitude for the perseverance Chairman Hickman showed during 2020. Chairman Hickman was very appreciative of the sentiments of his colleagues and called for the nomination for the election of the new Chairman of the Board of Supervisors Formal Meeting Minutes 01/06/2021 Page 3 of 19 Supervisor Gates made a motion to nominate Jack Sellers as the 2021 Chairman of the Board of Supervisors, seconded by Supervisor Gallardo Ayes: Clint Hickman, Jack Sellers, Steve Chucri, Bill Gates, Steve Gallardo Chairman Sellers thanked Supervisor Hickman for the great job he did and for the numerous hours spent handling complicated issues and challenges that were presented in 2020. He stated this was a true test of leadership skills. Chairman Sellers presented Supervisor Hickman with a plaque of recognition and photos were taken. Chairman Sellers came forward and began his speech by thanking his fellow Board members for placing their trust in him to lead Maricopa County during a difficult period. He thanked his late wife Marie and his children, Jack, Eric and Shannon, who encouraged him to continue to do the things he loves which is to serve the community. Chairman Seller stated that it’s great to serve on a Board with outstanding colleagues and acknowledged the immensely talented and dedicated staff at Maricopa County. Joy Rich, County Manager has built a team of highly knowledgeable professionals that have led Maricopa County through these unprecedented times. Chairman Sellers outlined priorities going forward. He stated that the COVID-19 pandemic continues to be a threat to public health and safety and has shaken our nation to its core; with lives lost, businesses closed and the financial impact on families. He said the County will use the tools available to bring the pandemic under control and it is incumbent on the elected officials to use those tools to help stop the suffering. Chairman Sellers stated that these efforts start with tracking and slowing the spread of the disease and noted that under the guidance of Marcy Flanagan, Director of Public Health and Dr. Rebecca Sunenshine, Medical Director of Disease Control Division, the County has provided up to date information and mitigation practices. The County has made informed decisions (CDC best practices) in an effort to protect citizens as well as healthcare resources. Chairman Sellers said that the next challenge regarding this pandemic is the vaccination process and his office will look to expand the efforts to educate on facts, especially on the safety and efficacy of the COVID-19 vaccine. He said the critics of the vaccine have been loud and Maricopa County will be louder. Maricopa County will continue to lead and educate with science-based data. The faster we as a County, State and a Nation can beat this virus the faster we can secure a brighter future for all Americans. He thanked Assistant County Manager Lee Ann Bohn and Human Services Director Bruce Liggett for their efforts in implementing targeted and successful assistance programs to the citizens of Maricopa County under the Board’s direction. Chairman Sellers reported that to date, five million dollars had been provided to non-profit organizations and seventy million dollars to small business assistance. He also noted that more than 6000 households received assistance paying utility bills and more than 7200 households received help paying their rent. Chairman Sellers spoke on the importance to lead on the topic of homelessness. The 2020 point-in-time count showed more than 7400 people in our county experiencing homelessness and approximately half of those are unsheltered. There are many people who are relying on Social Services for the first time in their lives because of the pandemic. Without assistance, many of these individuals and families could end up homeless. Maricopa County works continually to be part of that solution. Chairman Sellers acknowledged Supervisor Gallardo for his strong voice and leadership on this front. Formal Meeting Minutes 01/06/2021 Page 4 of 19 Chairman Sellers stated that twelve million dollars of CARES Act funds were dedicated to getting people off the streets and into temporary shelters and medical care for the most vulnerable. He said this Board has committed dollars to continue to support homelessness in 2021 because of the need in our communities. Chairman Sellers looks forward to working with the Maricopa Association of Governments, cities and towns, and other agencies on more permanent solutions to homelessness. No single agency can solve this issue on their own. We will look for opportunities to work with our partners to expand services throughout the County. Chairman Sellers said there will come a time when the County will return to some normalcy. It is imperative that when that time comes, we are prepared. As the economy recovers, we will be competing with other regions across the country for people, jobs, and opportunities. Maricopa County continues to be the fastest growing county in the U.S. and will lead with its strengths: job growth, moderate temperatures, and leadership that understands the value of working together. He said working closely with innovative resources like Arizona State University and tech savvy businesses will allow local businesses to solve problems that once seemed insurmountable. The Smart City consortium championed by Supervisor Gates will potentially open the door for opportunities to partnerships that would benefit Maricopa County. Chairman Sellers said another priority is regional collaboration around transportation. He said having served on Maricopa Association of Governments (MAG) Transportation Policy Committee and the State Transportation Board, he is well versed on transportation issues. He said the leaders who crafted prop 400 in the early 2000’s laid the groundwork for the growth we see today and it is now time for current Maricopa County leaders to invest in infrastructure needs to get us through the next 20 years. Chairman Sellers said the Board has a significant role to play and he will continue to represent on the MAG Transportation Policy Committee and plans to work closely with Supervisor Hickman, who will continue to serve on the MAG Regional Council. He said he will maintain his current relationship with current members of the State Transportation Board. Maricopa County, along with cities/towns and MAG will put in the work and make the tough decisions necessary to ensure the next generation can enjoy the quality of life that's available to our citizens today. Chairman Sellers stated that during his tenure on the Board of Supervisors, there will be a regional transportation and infrastructure plan crafted that will go to the voters. Getting voter approval for this plan will be one of his top priorities, not only during his Chairmanship, but for as long as it takes to get it done right. Furthermore, it is possible that with the new presidential administration coming in there will be legislation directed at infrastructure development. It is important that the County is ready to act on any program that will benefit this region. In order to be prepared, Chairman Sellers has asked Jennifer Toth, Director of Maricopa County Department of Transportation, and Mike Fulton, Director of the Flood Control District, to work closely with the Government Relations team and be able to act quickly when the time is right. Chairman Sellers continued with his address and spoke on the topic of election integrity. He said he and his colleagues support a full forensic audit of the election tabulation equipment once the litigation related to the 2020 General Election is over. The Board of Supervisors supports good faith efforts to ensure our elections are as good as they can be. He said there is an urgent need to have faith restored in democracy. He said he agrees with Supervisor Chucri who said the Board is committed to “Best in Class” in elections and in all areas of the organization. The Board is committed to work with the new Recorder, the legislature and election experts regardless of political party to make sure people can vote when and how they want. He stressed the importance of citizens trusting that their ballot was counted as it was cast. Formal Meeting Minutes 01/06/2021 Page 5 of 19 He stated that audit hand counts to date have shown ballots cast in 2020 were tabulated accurately, starting with the presidential preference election in March, continuing into the August primary and concluding with the November general. Many experts believe these were some of the finest and most secure elections the County has conducted. He said he has spent a lot of time looking into the allegations that have been thrown around since November 3rd and the stakes are too high not to take this very seriously. Chairman Sellers said with current technology it is easy to spread misinformation and believes the greatest challenge we face as a country is the ability to work from a shared set of facts. The facts are that in 10 different cases there were complaints about election fraud, manipulation or tampering in Maricopa County elections and each case has been dismissed by the courts or withdrawn by the plaintiffs. He has asked questions and seen enough of the operation to feel comfortable looking anyone in the eye and giving them his word that the elections were run with integrity and the results canvassed by this Board were accurate. He will go above and beyond with the education efforts and communications to ensure the public is aware of the integrity in the election’s operations. Maricopa County has a fantastic workforce, great leadership, and the desire to serve. Chairman Sellers said transparency will be the cornerstone of his leadership and Maricopa County will be open to public feedback and will be inclusive to all who want to participate. This applies to elections as well as other matters of public interest. He said he expects staff to be open to new ideas and perspectives and welcoming of public inquiry so long as that inquiry is in good faith. He said there are still many tough decisions ahead as we are still in a public emergency. Maricopa County benefited from the CARES Act funding in 2020, and 2021 holds no such promise for federal support. The Board of Supervisors have a history of being fiscally prudent and the Board will continue to work together on the fiscal year 2022 budget that benefits all Maricopa County residents, Chairman Sellers said in the two years serving on the Board, there have been many unusual challenges, and nothing seemed shocking anymore. He said what gives him great hope is what he has seen from this dais. The meetings with his colleagues and the daily work of the County workforce confirms for him that whatever the challenge, Maricopa County deals with issues professionally and logically. The responses are based on facts. That approach will continue to serve Maricopa County in 2021. Chairman Sellers thanked his colleagues for allowing him the honor to serve as Chairman and he looks forward to a much brighter year ahead. Supervisor Gallardo thanked Chairman Sellers for stepping into the role as Chairman, he appreciated his Chairman’s Address and looks forward to working together in 2021. Supervisor Gates echoed Supervisor Gallardo’s comments and said the summary of the past year was well articulated as well as the vision for his Chairmanship. Supervisor Chucri said he has known Chairman Sellers for close to 20 years. He said Chairman Sellers has always been pragmatic and that quality is what is needed at this time. There is a need to prepare for the future even when the future is unclear. Supervisor Chucri stated his gratitude to Supervisor Hickman for the excellent job of navigating the challenges of 2020 as Chairman. ~ Following the Chairman’s Address, Chairman Sellers took the gavel and Chaired the rest of the meeting ~ Formal Meeting Minutes 01/06/2021 Page 6 of 19 PRESENTATIONS - PRESENTACIÓNES 5. APPOINT A JUSTICE OF THE PEACE FOR THE WHITE TANK JUSTICE COURT Pursuant to ARS §11-251(16) and the vacancy created by the resignation of David M. Osterfield, Justice of the Peace, White Tank Justice Court, consider nominations and make an appointment to the fill the vacancy for a Justice of the Peace for the White Tank Justice Precinct. Such appointment shall be effective January 6, 2021, through the end of the current term, December 31, 2022. (C-06-21-375-X-00) Supervisor Hickman said appointments are a big part of the Supervisors’ job and each one is important. This appointment for Justice of the Peace is one that encompasses District 4 and District 5 and Supervisor Hickman said there were many qualified applicants who submitted applications and were interviewed. He thanked all the people who took the time to apply. The position of Justice of the Peace is how justice serves the local community. Supervisor Hickman said he has known the selected applicant for many years. She has a law degree and currently works for the Attorney General’s office. Supervisor Hickman stated he is honored to recommend Heidi Owens as the next Justice of the Peace for White Tank Justice Court. Supervisor Gallardo said he appreciated Supervisor Hickman’s time and consideration for this appointment. He agreed on the importance of this position at the local level and to make a decision that is representative of this community. Motion was made by Supervisor Hickman to appoint Heidi Owens as the Justice of the Peace for the White Tank Justice Precinct, seconded by Supervisor Gallardo Ayes: Clint Hickman, Jack Sellers, Steve Chucri, Bill Gates, Steve Gallardo 6. PROCLAMATION: SPEAK UP, STAND UP, SAVE A LIFE Approve the Proclamation designating January 2021 as Speak Up, Stand Up, Save a Life Month. (C-06-21-361-X-00) Juanita Garza, Clerk of the Board read the Proclamation. A copy of the proclamation is on file with the Clerk of the Board’s Office and retained in accordance with LAPR retention guidelines. Jeff Kirchler with the Maricopa County Public Defender’s Office was on the telephone to accept the Proclamation. He and colleague Gina Godbehere thanked the Board for their support for the past five years. He said during that time, many community partnerships have been created and the organization has grown every year. Maricopa County departments have contributed by volunteering and helping bring awareness to the subject. Mr. Kirchler said that this year’s conference will be virtual and will be held on January 19, 2021 and said for those who would like to register, go to SpeakStandSave.com. He stated a virtual event is not the ideal forum, but the organization is able to reach over 10,000 students, families, and other members of the community. He noted the theme for this year is resilience He stated the importance for our young people to know they are not alone, and resources are available. Mr. Kirchler expressed his appreciation for the continued support. Chairman Sellers thanked Mr. Kirchler for his dedication to the community on this very important subject. Supervisor Gallardo thanked the County Attorney’s Office, the Public Defender’s Office, and the school districts across the valley for their continued involvement in this very Formal Meeting Minutes 01/06/2021 Page 7 of 19 important subject. He said this has been going on for several years and is needed now more than ever. He stated this platform being provided is great for young people who need support and guidance from their schools, the community, as well as their peers. Supervisor Hickman echoed the previous comments and said this program was started due to a tragic incident at Independence High School. He expressed his gratitude to Gina Godbehere who was instrumental in getting this topic recognized. The pandemic has isolated our young people, and this is a valuable resource for schools, families and friends. The terms of the 3 reappointments will be effective February 1, 2021 through January 31, 2023. Pursuant to A.R.S. 49-582(A), accept the resignation of Tina Wesoloskie as Program Director and Assistant Chairman and approve the appointment of Kristen Weston-Smith as Program Director and Assistant Chairman to the Travel Reduction Program Regional Task Force. The term of the appointment will be effective as of Board approval with an indefinite expiration. The Program Director is not a voting member. MCSO will charge overtime pay rates and benefits for sworn employees that volunteer for this detail. This agreement is effective retroactive to December 14, 2020 and when signed by the parties. The term is through June 30, 2021 with an option to extend by amendment. RECERTIFICATION OF THE MARICOPA COUNTY WORKFORCE DEVELOPMENT BOARD Request the Board of Supervisors approve the submission of a Recertification of the Maricopa County Workforce Development Board (WDB) to Arizona Department of Economic Security (DES) for the Program Year (PYs) 2020-2022 as required by Workforce Innovation and Opportunity Act (WIOA). Through this approval, the Board of Supervisors authorizes the following: • Board of Supervisors’ Chairman, as Chief Elected Official (CEO) to sign the Recertification Request • Board of Supervisors’ Chairman and WDB Chairman to sign the recertification and certifies that address the following: o Appointment of members, as described in WIOA Section 107(a) - (c), performed successfully and sustained fiscal integrity during PYs 2020-22, and developed and implemented strategies to improve and continuously strengthen the ARIZONA@WORK system in accordance with WIOA; and o Compliance with the WDB Assurances contained with this request. • Submit Recertification packet to DES Also request authorization for the Chairman to sign all future documents related to recertification of the Maricopa County Workforce Development Board. All documents will receive legal review prior to processing for signatures and will be filed with the Clerk of the Board’s office. The Maricopa County Workforce Development Board Recertification request serves as formal notification to the Governor, Workforce Arizona Council, and DES of the County‘s request for Recertification for the PY 2020-2022 period. Supervisory District: All (C-22-21-075-X-00) Supervisor Gates thanked Lee Ann Bohn and her team for the work on the recertification of the Workforce Development Board. He also thanked former Chairman Hickman for his leadership on this. RESIGNATION OF MARICOPA COUNTY WORKFORCE DEVELOPMENT BOARD MEMBER Request approval for the following action regarding the Maricopa County Workforce Development Board (MCWDB) as set forth below: Accept the resignation of Neal Dauphin, Contracted Driver Services, Business Category. The MCWDB is established and receives its authority in accordance with the Workforce Innovation and Opportunity Act (WIOA), which was signed into law on July 22, 2014 as Public Law 113-128. The Maricopa County Board of Supervisors (BOS) shall have final authority. The Maricopa County Board of Supervisors approves the appointments and accepts the resignations of MCWDB members. ASPCA COVID GRANT AMENDMENT AND BUDGET ADJUSTMENT Approve the amendment of grant funds from the American Society for the Prevention of Cruelty to Animals (ASPCA) in the amount of $25,000, for a total funding amount of $55,000. The amendment extends the termination date of the grant from Dec. 1, 2020 to March 31, 2021. Authorize the Chairman to sign the First Amendment. In accordance with A.R.S. §42-17106(B), authorize the increase of revenue and expenditure authority in Animal Care and Control (D790) Animal Care and Control Grant Fund (573) Non- Recurring Non-Project (NRNP) appropriation group by $25,000. The Animal Care and Control indirect rate for FY2021 is 19.18%. Total grant indirect costs are estimated to be $10,549.00 and are not recoverable. Costs will be absorbed in the Department operating budget. The grant award is a one-time, non-recurring. The grant award does not require a cash contribution, nor an in-kind contribution, and there are no future or ongoing contributions required following the grant period. The grant award does provide funding for a mandated service, which is to provide adequate care of animals that are sheltered with the Animal Care and Control Department. This grant was competitively bid. AMENDMENT TO CONRAD 30 PHYSICIAN EMPLOYMENT AGREEMENT Approve amendment no. 1 to the Conrad 30 Physician Employment Agreement C-29-21- 002-X-00. This document is a contract required by the State of Arizona in order to apply for a Conrad 30 J1 Visa waiver, and the amendment is requested by the State. If granted, this waiver means the employee, a Medical Examiner, does not have to return to his home Formal Meeting Minutes 01/06/2021 Page 12 of 19 country for two years (a condition of the J1 visa he was granted as a student). Given the nationwide shortage of Medical Examiners, OME is pursuing this waiver in order to retain a presently employed Medical Examiner who currently has a H1B visa. The Clerk replied there were 10 comments related to COVID; 838 comments regarding elections; 2 comments regarding Homelessness; 5 comments regarding the mask mandate. The Clerk also reported that all the emails have been forwarded to the Board of Supervisors Offices. SUMMARY OF CURRENT EVENTS - EL RESUMEN DE TEMAS DE ACTUALIDAD 26. Supervisors'/County Manager's summary of current events - Resumen de temas de actualidad de los Supervisores/Administrador del Condado Joy Rich, County Manager, acknowledged former Chairman Hickman and his staff for being generous with their time during his Chairmanship. Ms. Rich said he did not lead from “an ivory tower” but was shoulder to shoulder with leadership. She said no other Formal Meeting Minutes 01/06/2021 Page 17 of 19 Chairman has ever been asked to do what former Chairman Hickman did and she was truly grateful for his leadership and friendship. Supervisor Gates said he had the opportunity to participate in a panel on Smart Region events recently. He said this gave him the opportunity to speak with other leaders including House Representative Weninger and Arizona Commerce Authority, Sandra Watson about the Smart Region development. Supervisor Gates said this activity was in keeping with Chairman Sellers’ address talking about supporting Smart Region development in the coming year. Supervisor Gallardo said he took a tour of the COVID-19 vaccine site at the Veterans Memorial Coliseum with Dr. Sunenshine. He said it was well laid out and seems to run smooth with a lot of different partnerships working together. Supervisor Gallardo said as part of the County Supervisors Association, he would participate in the start of the 2021 Legislative Session Orientation. As the Counties come together to learn the legislative process, this will be an interesting year and there are a lot of issues on the table this session. He also thanked former Chairman Hickman and his Chief of Staff, Scott Isham for all the great work in 2020. Supervisor Hickman thanked his staff, Scott Isham and Michelle Montijo, for the support to all the Board and respective staff. Supervisor Hickman thanked Joy Rich and the team she built who have done a great job during the pandemic. He welcomed the newly electees: Assessor, Eddie Cook, Treasurer, John Allen and Recorder, Stephen Richer. He stated he is looking forward to working with Chairman Sellers and his staff with an emphasis on Public Service not Political Service. He said his time working as a Supervisor has been very satisfying because of the many talented people he has had the pleasure of working with. Chairman Sellers thanked his Chief of Staff, Rick Bohan and Bridgette Hernandez for their hard work and dedication. He spoke about the challenges we have faced and the importance of staying focused on the aspects that make Maricopa County an attractive place for people to live, sustaining the quality of life the citizens have come to expect. He said he will stay focused on what it takes to ensure a brighter future. Having attended the Smart Region Summit last night, he is encouraged that Maricopa County is going in the right direction and he is thankful that Supervisor Gates will continue to represent Maricopa County in the progress. He said he appreciates the confidence the Board has in him.
