FACTS

On May 26, 2020 petitioners listed in Exhibit B hereto (“Petitioners”) initiated a
Petition for Exclusion of Lands from McMicken Irrigation District (“McMicken”). A legal description
of these lands (“Subject Lands”) is attached hereto as Exhibit A and incorporated herein by reference.
Petitioners requested exclusion of the Subject Lands from McMicken because the lands are not
susceptible of irrigation from the irrigation works of McMicken, and there is a unique and limited
opportunity for the Subject Lands to be included in Maricopa County Municipal Water Conservation
District Number One (“MWD”) and receive agricultural irrigation water service from MWD.
Allowing the Subject Lands to be excluded from the District and be included in MWD furthers the
District’s primary purpose of providing water for irrigation purposes,

McMicken has received a title report dated January 22, 2020, from Petitioners confirming that
Petitioners own the Subject Lands.

On_June 26, 2020 | after due notice was made pursuant to A.R.S, § 48-2946, this matter
was heard by the McMicken Board of Directors. No written objections were filed. The McMicken

Board of Directors determined that the Subject Lands are not susceptible of irrigation from the

irrigation works of McMicken and that it would be in the best interest of McMicken to exclude the
Subject Lands from within the exterior boundaries of McMicken.
ORDER

IT IS HEREBY ORDERED, based on the foregoing facts, that the Petition of the Petitioners be
granted excluding from within the exterior boundaries of McMicken the Subject Lands described in
Exhibit A hereto, and that any and all rights and privileges pertaining to the inclusion of the Subject
Lands within the boundaries of McMicken be extinguished, and the Subject Lands be relieved of
responsibility for existing or hereafter incurred financial obligations and indebtedness of McMicken.

IT IS FURTHER ORDERED that the Secretary of McMicken record a certified copy of this
Order with the office of the Maricopa County Recorder and file said recorded certified copy with the
Board of Supervisors of Maricopa County, Arizona.
