 RESOLUTION TO TEMPORARILY WAIVE FLOODPLAIN REGULATION 
ADMINISTRATIVE FEES IN GILA BEND
Agenda Item:  
WHEREAS, the National Weather Service reports that strong to severe thunderstorms 
moved through central and southwest Arizona during the late evening hours of August 13, 2021 
and into the morning hours of August 14, 2021. An unusually humid airmass was in place, 
fueling the thunderstorms and allowing them to produce very heavy rainfall. Rain fell at the rate 
of 2-3” per hour with more intense, localized amounts of 6” per hour. This resulted in numerous 
instances of flash flooding; and
WHEREAS, as a result of these heavy rains, the Town of Gila Bend, Arizona 
experienced extreme flooding events that damaged numerous structures, private homes and 
commercial businesses; and
WHEREAS, on August 14, 2021, the Chairman of the Maricopa County Board of 
Supervisors declared that a local emergency exists; and
WHEREAS, pursuant to A.R.S. § 48-3602(B) the Maricopa County Board of 
Supervisors also serves as the Board of Directors for the Flood Control District of Maricopa 
County (the “District”); and
WHEREAS, all development of land, construction of residential, commercial or 
industrial structures within delineated floodplain areas are subject to the requirements of the 
Floodplain Regulations for Maricopa County, the latest version of which was adopted by the 
Board of Directors on January 17, 2018; and
WHEREAS, property owners and business operators in Gila Bend will be required to 
obtain appropriate permits and approvals from the District to repair, replace and reconstruct 
structures damaged and/or destroyed by the flood waters; and
WHEREAS, the Board of Directors is providing the resources of the District to, among 
other things, offer assistance to private property owners and business operators to aid with flood 
recovery efforts in Gila Bend;
WHEREAS, in accordance with the Floodplain Regulations administrative fees shall be 
charged for the processing of Floodplain Use Permits, Floodplain Variances, plan review and 
map changes; and

NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of the Flood Control 
District of Maricopa County does hereby authorize the Chief Engineer of the District, or those 
appropriately designated by the Chief Engineer, to waive all or any appropriate portion of the 
administrative fees for Floodplain Use Permits, Floodplain Variances, plan review and map 
changes for those private property owners and/or business operations located in and around Gila 
Bend, Arizona seeking such approvals to repair, replace and/or reconstruct structures damaged or 
destroyed as a result of the rains of August 13-14, 2021, for any application submitted prior to 
August 14, 2022, representing a period of one year from the date of the aforesaid declaration of 
local emergency.
