MARICOPA COUNTY STADIUM DISTRICT INTERNAL POLICY Policy Number: S0001 Current Adoption Date: 09-15-2021 Policy Title: PROHIBITIONS OF SMOKING AND TOBACCO USE ON DISTRICT PROPERTY Current Implementation Date: 09-15-2021 Board Agenda Number: C-619-353-6-01 Approved by: BOARD OF DIRECTORS Original Adoption Date: 03-27-2019 I. PURPOSE To comply with the 2006 Smoke-Free Arizona Act (A.R.S. §36-601.01) and to create a tobacco free environment on Maricopa County Stadium District premises. II. APPLICATION This policy applies to District employees, volunteers, contractors, clients, partners, tenants, and visitors while utilizing District-owned buildings and adjacent areas. The Board of Supervisors is authorized to jointly adopt policies applying to the Special Districts under the Intergovernmental Agreement, C-06-18- 393-6-00, approved on April 11, 2018. The lessee or tenant of District property is responsible for enforcing this policy. III. DEFINITIONS A. Adjacent Areas: District property surrounding District-owned buildings, such as breezeways, courtyards, parking garages, parking lots, and walkways. This may include areas further than 20 feet away from entrances, open windows, or ventilation systems. B. Appointing Authority: An elected official, the single administrative or executive head of the District, or the designated representative authorized to act in this capacity. C. Electronic Cigarette: Any device that simulates Smoking by vaporizing a substance that may or may not contain nicotine. D. Smoking: Carrying or possessing any lighted Tobacco Product or other plant based or synthetic substance. This includes cigars, cigarettes, pipes, and Electronic Cigarettes. E. Tobacco Product: Any product made or derived from tobacco that is intended for human consumption, including any component, part, or derivative of a tobacco product, including cigars, cigarettes, pipe tobacco, and smokeless tobacco. IV. POLICY A. The Maricopa County Stadium District prohibits Smoking and the use of Tobacco Products in buildings and Adjacent Areas owned or leased by the District. B. Under this Policy, the use of Electronic Cigarettes and vaping are treated the same as Smoking. The use of tobacco products is prohibited within a distance of at least 20 feet in all directions measured from each outer edge of an entrance, an open window or a ventilation system of a District building (A.R.S.§36-601.01, Arizona Department of Health Services R9-2-102(B)). D. “Tobacco Use Prohibited” signs shall be posted at general public and employee only entrances indicating that buildings are tobacco-free. E. Tobacco Product remnants (e.g. ashes, cigarette butts) shall be discarded in appropriate receptacles.
