THE FLOOD CONTROL DISTRICT OF MARICOPA COUNTY, a political subdivision of
the State of Arizona, GRANTOR, does hereby grant and convey to MARICOPA COUNTY, a political
subdivision of the State of Arizona, GRANTEE, for the sum of Sixteen Thousand dollars and no cents
($16,000.00), and other valuable consideration, receipt and sufficiency of which are hereby acknowledged,
paid by GRANTEE, all that certain real property (Property) situated in the County of Maricopa, State of
Arizona, described as follows:

See Attached Exhibit “A” attached hereto and incorporated herein

GRANTOR makes no representations concerning its right, title or interest in the Property, which
is being conveyed without any warranty of any nature whatsoever.

SUBJECT TO: (1) easements and/or agreements for public road and highways, public utilities,
railroads and pipelines; (2) assessments and codes, covenants, and restrictions; (3) any other reservations,
easements, rights of way, and deed restrictions as may appear of record; and (4) any item readily
discoverable by a visual inspection or survey of the Property.

RESERVING HOWEVER TO GRANTOR, and its successors and assigns, a Permanent
Channel Easement and Right of Way on, over, under, and across the Property. for the following purposes,
namely: The right of ingress and egress, and the right to construct, reconstruct, operate, inspect, and
maintain a flood control project, including all incidental purposes consistent therewith, and together with
the right to authorize, permit, and license the use thereof only for utilities or other public purposes not
inconsistent with its use as a flood control project as solely determined by GRANTEE.

County Records, lying within the Northeast Quarter of Section Thirty One, Township Three North,

Commencing at the Northeast corner of said Section 31, being a brass cap in handhole, from which
