The requested MCP will allow the Hope Community Services to 
continue offering equine therapy options. Luke AFB had determined 
the use to be compatible with the understanding that noise impact 
on outdoor facilities will not be reduced/mitigated. There are no 
outstanding concerns from reviewing agencies. There is no known 
opposition.

Recommendation: 
On 4/25/24, the Commission voted 6-0 to adopt a motion 
recommending the Board of Supervisors approve MCP2023011 
subject to conditions ‘a’ – ‘f’:  
 
a. 
 Development of the site shall be in substantial conformance with the site plan entitled 
“Hope Community Services Equine Therapy“, consisting of 1 full-size sheets, dated 
1/23/24, except as modified by the following conditions. 
 
b. 
Development of the site shall be in substantial conformance with the narrative report 
entitled “HOPE COMMUNITY SERVICES FARM LOCATION”, consisting of 6 pages, dated 
11/22/23, except as modified by the following conditions. 
 
c. 
The following Planning Engineering conditions shall apply:

1. Area of new disturbance must be provided with the grading & drainage plans 
submitted for building permit. If more than 1.0 acres is newly disturbed, a SWPPP 
will be required. 
 
2. Fence detail(s) must be provided with building permit submittal. 
 
3. Final design plans must show how all onsite runoff is routed to the retention basins. 
 
4. Engineering review of planning and/or zoning cases is for conceptual design only. All 
development and engineering design shall be in conformance with Section 1205 of 
the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for 
construction. 
 
5. Based on the conceptual design nature of the information submitted, changes to the 
site layout may be necessitated by the final engineering design of the drainage 
infrastructure. 
 
6. Detailed Grading and Drainage (Infrastructure) Plans must be submitted with the 
application for Building Permits.

All buildings will be subject to noise attenuation as per ARS § 28-8482(B) and Maricopa  
County requirements.  
 
e. 
Prior to issuance of a building permit, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been 
designed in accordance with their regulations and requirements, and that emergency fire 
protection service will be provided to the facility. Prior to issuance of the certificate of 
occupancy, local fire protection jurisdiction review and approval will be required. 
 
f. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, the property 
may be considered for reversion to the zoning that existed on the date of application per 
Maricopa County Zoning Ordinance procedures.  It is, therefore, stipulated and agreed that 
revocation does not reduce any rights that existed on the date of application to use, divide, 
sell or possess the property and that there would be no diminution in value of the property 
from the value it held on the date of application due to such revocation of the MCP. The 
MCP enhances the value of the property above its value as of the date the MCP is granted 
and reverting to the prior zoning results in the same value of the property as if the MCP 
had never been granted.

Project Summary:

The applicant is requesting to establish a Military Compatibility Permit (MCP) with a Plan of 
Development (POD) for equine therapy uses on a Rural-43 zoned parcel within the 70-decibel 
noise contour of Luke Air Force Base. The request is to change the use of the parcel from a single-
family residence into a therapy center that allows users to help maintain equine facilities and 
work with horses to achieve therapeutic results.

The approximately 1.1-acre site is located at 7324 N. 156th Ave adjacent to the west side of Luke 
Air Force Base. The site includes a 1,288 sq ft residential home which will be converted into facility 
offices with additional structures planned for horse corrals and living stalls. The facility will be 
open  Monday through Friday 7 am to 8 pm as well as Saturdays from 9 am to 3pm. There will be 
8-10 employees or volunteers on site throughout the workday.

The property is near the border of the City of Glendale and is part of the Glendale Municipal 
Planning Area.  The Glendale Municipal Plan designates the property as Luke Compatible, which 
is applied to lands surrounding LAFB that are delineated by the 1988 70 LDN noise contours. 
Projects located within this zoning district must first have a Use Compatibility and Consistency 
Determination (UCCD) prior to being able to apply for a Military Compatibility Permit (MCP).  Luke 
Air Force Base (LAFB) determined that this proposed outdoor equine therapy use is consistent 
and compatible with the high noise or accident potential zone of LAFB (UC2023009)

a Military Compatible land use.  The Military Compatible designation includes areas located within 
the state-statute defined High Noise or Accident Potential Zone of Luke Air Force Base and 
auxiliary airfields. The purpose of this designation is to assure development is consistent and 
compatible with the high noise and accident potential generated by military airport and ancillary 
military facility operations that have or may have an adverse effect on public health and safety.

The applicant completed all neighborhood notification requirements for site posting and 
notification within 300’ of the proposed parcel. The applicant additionally held a local 
neighborhood meeting with residents on December 4th 2023, in which two neighbors attended 
and expressed no opposition to the proposal. This application includes approval for a POD, the 
site has been designed accordingly and meets all zoning and site planning requirements.

Staff supports the use as presented as it allows a military compatible use in an area primarily 
built with existing single-family residences. New residential uses are prohibited within the 
delineated high noise and accident potential zones. The proposed equine therapy use removes 
an existing residence from the noise impact area and ensures future uses will be compatible to 
the military overlay area. The use is unique in nature that it additionally will not add an adverse 
impact to the outrounding roadways or the remaining local residents in the area.  
 
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors

HCS Animal Assisted Therapy Program is designed to assist children and adolescents who have experienced 
traumaƟc events through partnering with animals to help clients meet personalized treatment goals. HCS 
animal assisted therapists enlist the help of animals into a variety of tradiƟonal therapeuƟc modaliƟes based on 
individual treatment goals such as healthy communicaƟon, emoƟonal regulaƟon, and healthy boundaries. 
Depending on each member’s needs and comfort level, we can invite different animals into the sessions 
including bunnies, goats, bearded dragons, turtles, cats, or a dog to contribute to the individual therapeuƟc 
process.

Equine Assisted Therapy 
HCS’s Equine Assisted Therapy Program is designed to assist children and adolescents who have experienced 
traumatic events through partnering with horses to help clients meet personalized treatment goals. Through 
groundwork based, unmounted activities and relationship building with horses, clients can experientially 
identify and adapt maladaptive coping skills and behaviors in order to integrate past trauma, build healthy 
relationship skills, develop assertive communication skills, and increase esteem while building insights. HCS 
equine assisted therapists work with clients to meet individualized treatment goals within the context of a 
personal relationship with a horse or horses while integrating a variety of traditional therapy models into the 
farm milieu.  
 
Therapeutic Gardening 
HCS’s Therapeutic Gardening Program is designed to assist children and adolescents who have experienced 
traumatic events through outdoor activities in nature. Therapeutic Gardening provides a mindful and engaging 
therapeutic experience that can complement traditional therapeutic interventions and enhance overall quality 
of life for participants. HCS therapeutic gardening clinicians bring a variety of modalities into the garden, 
grounding growth in the exploration and appreciation of the natural world. 
 
Animals and plants bring unique elements to the therapy process. Studies show that Animal, Equine and 
Therapeutic Gardening therapy services significantly reduce PTSD symptoms and behavioral issues resulting 
from long-term exposure to trauma. It can also prepare children who have particularly severe mental health 
and/or behavioral challenges for HCS' more traditional trauma therapy.

Monday – Friday 7 am – 8 pm, Saturday 9 am – 3 pm

Description of Buildings and site improvements: The existing building will remain in place.  HCS will only be 
adding horse stalls and storage units to the property. 
 
Phasing of Improvements: HCS will first complete grading/draining of the lot, then proceed with parking, 
sidewalk, and block fencing. Once those items are completed, horse stalls and additional storage will be added.  
 
Relationship to Surrounding Properties:  The property is zoned RU-43, and is surrounded by other residences 
with the same zoning.  This project will offer needed services to children in Maricopa County.   
 
Location and Accessibility:  The property is located near Myrtle and Reems Avenue and provides established 
accessibility to and from the site.  
 
Circulation Systems: Applicant will be reconfiguring the front yard to provide for adequate parking and ingress 
and egress.

Development Schedule: Applicant intends to start construction as soon as permits are issued and expects 
construction to be completed within 1 year of commencement.

Other considerations:  The property is located within Luke Air Force Base’s LDN 70 area.  The County has 
historically encouraged non-residential uses in this area.  
 
Neighbor Discussion: The CEO has spoken to two direct neighbors and one down the street. All voiced support 
for the program.

Site Plan: 
 
This property is an existing residential parcel, zoned RU-43 at 1.09 gross acres. APN 501-49-046H. Parcels on all 
four sides of this property are zoned RU-43. Front and rear yards are 40’ with side yards at 30’. There are two 
separate public utility easements along the western edge of the property, one measuring 10’ and the other 16’. 
The proposed project adds horse stables and storage sheds to the property, with a grand total of 6,116 SF of 
building area, which includes the existing residence. All proposed structures are under the maximum allowable 
height of 30’. Lot coverage is 12.9%, well below the maximum coverage of 25%. Per discussion with Maricopa 
County Transportation, our parking requirement is thirteen (13) parking spaces, with one being van-accessible. 
We are proposing thirteen (13) parking spaces with one van-accessible space. The parking lot paving will be a 
minimum of asphalt millings in a binder. We are proposing a one-way entry and exit drive on the property.

The Maricopa County Environmental Services Department (MCESD) has completed review 
for the  SUP - Hope Community Service Equine Therapy  planning case(s). Please note the 
following MCESD requirements for site development: 
Onsite Wastewater –  
A Minor Plan Review application must be submitted for any existing system(s) if being 
utilized and if the applicant believes the existing system(s) are adequate in size to support 
the new use; otherwise, a new septic permit/install may be required.

Pool –  
Operating permits are required for public and semi-public pools, wading pools or special use 
pools, spas and artificial bathing lakes. Operating permits are not required for private 
residential pools and spas. Where required, submit an application to MCESD Aquatic Health 
and Safety Program for a public swimming pool.  
 
Additional information for public swimming pools can be found on the MCESD Aquatic 
Health and Safety webpage. 
Additional Notes –  
Environmental Services does not require these items for condition of approval of  Z2023125, however 
these items must be addressed with the development of the site. Environmental Services does not 
require additional review of this case. 
 
*It should be noted that this document does not approve the referenced project. Comments are provided 
for the benefit of the applicant for MCESD permit requirements and as an advisory to Maricopa County 
Planning and Development Department. Other Maricopa County agencies may have additional 
requirements. Final review and approval will be made through Planning and Development Department 
procedures. Applicant may need to submit separate applications to the Maricopa County Environmental 
Services Department for approval of proposed facilities regulated by the Department. Review of any such 
application will be based on current regulations at the time of application.

Thank you for the opportunity to provide comments on the Use Compatibility and Consistency 
Determination Application for the Hope Community Services Equine Therapy Program.  The site is 
located on approximately 1.1 acres and is located at 324 N 156th Ave in unincorporated Maricopa 
County, AZ.  The applicant, which is a non-profit organization, is proposing to use this property to 
provide equine therapy services to children and families in the behavioral health and child welfare 
systems.  No residential dwellings or building construction will be a part of this special use permit.  The 
parcel is located within the Luke AFB 1988 JLUS 70 DNL and is within the “territory in the vicinity of a 
military airport” defined by A.R.S. § 28-8461.    
 
 
Luke AFB follows A.R.S. § 28-8481 when evaluating compatible land use within the “territory in 
the vicinity of a military airport.  Luke AFB considers the proposed use of this property to be compatible 
and consistent with the high noise or accident potential of a military airport.   
 
Since the site will be located within the “territory in the vicinity of a military airport,” it will be 
subjected to approximately 165 over flights per day.  We recommend you review the sound attenuation 
requirements found in A.R.S. §28-8482.  We also encourage an aggressive notification program on the 
part of the county to inform potential occupants about Luke AFB operations.

Thank you for the opportunity to comment on the Military Compatible Use Permit 
application for the proposed Hope Community Equine Therapy facility.  The request is to 
provide outdoor therapy to children recovering from trauma along with the addition of horse 
stalls.  The site sits on approximately 1.09-acres and is located at 7324 N. 156th Avenue in 
unincorporated Maricopa County, AZ.  The site is located inside the Luke AFB 1988 70 Ldn, 
“high noise or accident potential zone,” as identified by A.R.S. § 28-8461, and is within the 
“territory in the vicinity of a military airport,” also defined by A.R.S. § 28-8461. 
 
Luke AFB follows A.R.S. § 28-8481 when evaluating compatible land use within the 
“territory in the vicinity of a military airport” and considers this request for “medical and other 
health services” to be compatible with the high noise or accident potential of a military airport or 
ancillary military facility.  However, A.R.S. § 28-8481 includes additional information for this 
type of development within the 70 Ldn: 
 
Measures to achieve an outdoor to indoor noise reduction level of thirty decibels 
pursuant to an ordinance adopted under section 28-8482 must be incorporated into the design 
and construction of all buildings and the political subdivision must make an express finding, as 
part of approval, that the use of noise reduction level criteria will not alleviate outdoor noise.   
 
Since the event space will be located within the “territory in the vicinity of a military 
airport,” it will be subjected to approximately 170 over flights a day.  If approved, a strong 
notification program on the part of the applicant is essential to inform therapy patients about 
Luke AFB operations.
