Chair Brophy McGee opened the meeting, asked the Clerk to call the roll, and reminded 
audience members of the rules of decorum.

ROLL CALL - LISTA
The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Formal Session at 
9:30 AM on Wednesday, February 25, 2026, in the Supervisors' Auditorium 205 W. Jefferson 
Phoenix, AZ 85003, with the following members present:  Kate Brophy McGee, Chair, District 3; 
Debbie Lesko, Vice Chair, District 4; Mark Stewart, Supervisor, District 1; Thomas Galvin, 
Supervisor, District 2; Steve Gallardo, Supervisor, District 5 (remote). Also present: Juanita 
Garza, Clerk; Mia Vargas, Minutes Coordinator (remote); Jen Pokorski, County Manager; Brooke

Mr.  Lashua led the Pledge of Allegiance to the flag.
Vice Chair Lesko introduced her guest, Pastor Robby Lashua of Palmcroft Baptist 
Church, noting his role as a lead pastor at the church. She highlighted his background, 
education, and his passion for promoting classical Christianity.

PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL -

Kim Powell with Animal Care and Control, introduced Mint Chip, a one-year-old dog 
with lots of energy. She noted Mint Chip is looking for a home that will train her and 
take her on hikes. Mint Chip is available at the West Animal Shelter, and her adoption 
fee includes spay surgery, a microchip, and vaccinations.

Request: Military Compatibility Permit (MCP) amendment with a precise Plan of
Development (POD) to permit a billboard in addition to a shipping business in the Rural-43 
and MAAMF and AD-2 MAAMF zoning districts
Site Location: Generally located at the NEC of 143rd Ave & Butler Dr. in the west Glendale 
area
Commission Recommendation: On 1/22/26, the Commission voted 6-0 (motion by 
Commissioner Rochwalik D3, seconded by Commissioner Lindblom D1) to adopt a motion 
recommending the Board of Supervisors approve MCP250006 subject to conditions ‘a’ – ‘k’:
a. Development of the site shall be in substantial conformance with the Site Plan entitled 
“Butler Drive Billboard”, consisting of two full-size sheets, stamped received December 4, 
2025, except as modified by the following conditions. 
b. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Northen Parkway and 143rd Ave Billboard”, consisting of four pages, dated 
November 21, 2025, and stamped received December 4, 2025, except as modified by the 
following conditions.
c. The following Rural-43 & AD-2 Military Compatibility Permit standards shall apply 
(MCP2016003 and MCP250006):
1. Standard Parking Spaces: 0
2. ADA Parking Spaces: 0
3. Driveway/parking surface of compacted gravel
4. Maximum allowed height for billboard: 85 feet
d. The following Planning Engineering conditions shall apply:
1. Building permits shall be required for the required site grading. The permit application 
must include existing fencing erected without a permit.
2. The site is almost wholly contained within a Special Flood Hazard Area (SFHA) (Floodplain
– FEMA Zone A). As development plans progress for this site, provisions for compliance with
the Maricopa County Floodplain Use Regulations must be addressed. Any habitable 
structures on the site must comply with the Floodplain Use Regulations for Maricopa County
with respect to lower floor elevation (or in the case of a manufactured type building, the 
elevation of the lowest structural member).
3. Engineering review of planning and/or zoning cases is for conceptual design only. All 
development and engineering design shall be in conformance with Section 1205 of the
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for construction.
4. Based on the conceptual design nature of the information submitted, changes to the site 
layout may be necessitated by the final engineering design of the infrastructure.
e. The following Transportation conditions shall apply:
1. An approved MCDOT Right of Way Reservation Action Request to reduce the Future 
Right of Way 25-feet is required prior to the submittal of the Building Permit.

f. The following Maricopa County Department of Environmental Services Department 
(MCESD) condition shall apply:
1. Water and Wastewater services shall be provided upon installation of the modular office 
trailer with appropriate permits to be obtained.
g. All habitable buildings shall be subject to noise attenuation per ARS § 28-8482(B).
h. All outdoor lighting shall conform to the Maricopa County Zoning Ordinance.
i. Noncompliance with the regulations administered by the Maricopa County Environmental 
Services Department, Maricopa County Department of Transportation, Drainage Review 
Division, Planning and Development Department, or the Flood Control District of Maricopa 
County may be grounds for initiating a revocation of this Military Compatibility Permit as set 
forth in the Maricopa County Zoning Ordinance.
j. The property owner/s and their successors waive claim for diminution in value if the County
takes action to rescind approval due to noncompliance with conditions. 
k. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, the property shall revert 
to the zoning that existed on the date of application.  It is, therefore, stipulated and agreed 
that either revocation due to the failure to comply with any conditions, does not reduce any 
rights that existed on the date of application to use, divide, sell or possess the property and 
that there would be no diminution in value of the property from the value it held on the date 
of application due to such revocation of the Military Compatibility Permit.  The Military 
Compatibility Permit enhances the value of the property above its value as of the date the 
Military Compatibility Permit is granted and reverting to the prior zoning results in the same 
value of the property as if the Military Compatibility Permit had never been granted.

1. Without the submittal of a precise plan of development, no development approval is
inferred by this review, including, but not limited to number of proposed building lots/units, 
drainage design, access and roadway alignments. These items will be addressed as 
development plans progress and are submitted to the County for further review and/or 
entitlement. 
2. Payton Street is “public right-of-way” that is has not been accepted by the County; and is 
therefore not maintained by the County.
3. Apache Trail is maintained by ADOT. The applicant will be responsible for coordinating 
with the ADOT to review any traffic impact, right-of-way dedication, permitting or roadway

4. The above comments do not include identification of utilities or underground facilities 
within or adjacent to the required right-of-way that may have prior rights and/or require 
relocation. 
5. Engineering review of planning and/or zoning cases is for conceptual design only. All

service will be provided to the facility. Prior to issuance of the certificate of occupancy, local 
fire protection jurisdiction review and approval will be required.
f. Prior to issuance of a building permit, written confirmation will be required from water and 
septic providers.
g. Administrative approval of a Plan of Development will be required prior to approval and 
issuance of construction permits to develop and establish use of the site. Prior to issuance 
of a building permit, written confirmation will be required from the emergency fire protection 
jurisdiction having authority that the facility has been designed in accordance with their 
regulations and requirements, and that emergency fire protection service will be provided to
the subject site. Prior to issuance of the certificate of occupancy, local fire protection 
jurisdiction review and approval will be required.
h. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a 
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance.

Request: Zone Change with Overlay from Rural-190 to IND-2 IUPD 
Site Location: Generally located approximately 5,881 ft. southwest of the southwest corner 
of Elliott Rd. & 363rd Ave. in the Arlington area 
Commission Recommendation: Commission Action: On 1/22/26, the Commission voted 6-0
(motion by Commissioner Rochwalik, D3, seconded by Commissioner Lindblom, D1) to 
adopt a motion recommending the Board of Supervisors approve Z250031 subject to 
conditions ‘a’ -‘g’.
a. A Plan of Development is approved subject to site plan entitled “Sun Basin VII Solar 
Project Site Plan” consisting of 8 full-size sheets, dated November 12, 2025. The Plan of 
Development may be amended administratively under a separate application as long as the
amendment complies with the established IUPD development standards as approved by the
Board of Supervisors. Staff may determine slight refinements to remain in substantial 
conformance with the approved site plan.  Minor and major amendments to the site plan will 
be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance.
b. Development of the site shall be in substantial conformance with the Narrative Report 
entitled “Sun Basin VII Project”, consisting of 17 pages, dated November 2025, except as 
modified by the following conditions.
c. The following IND-2 IUPD standards shall apply: 
1. Minimum Front Yard – 100’
2. Minimum Side Yard -100’
3. Minimum Rear Yard – 100’
4. Minimum Parking: No Parking required
5. Minimum Screening: Minimum 6’ tall chain-link fences adjacent to rural/residential zoning 
boundaries, including attached barbed wire or concertina wire under 8’ in height, and allow 
all gates to have no attached screening. No screen wall, berm or hedges required along front
property lines. 
6. Minimum Paving: Alternative surfacing materials or methods approved by Maricopa 
County Air Quality to minimize dust pollution, such as but not limited to, native compacted 
soil or aggregate base course, may be used in driveways and parking areas.
7. Minimum Landscaping/Buffering: No landscaping or irrigation required. No screening 
required adjacent to rural and residential zoning districts.
8. Minimum Sight Visibility Triangles: Within sight visibility triangles at any intersection, on-
site chain-link fences without screening materials can exceed a height of 2’.

9. The IUPD overlay shall limit entitled uses to power generation and distribution, BESS 
facilities and ancillary uses.
10. Loading and Unloading: none required.
d. The following Planning Engineering conditions shall apply: 
1. Engineering review of planning and/or zoning cases is for conceptual design only. All 
development and engineering design shall be in conformance with Section 1205 of the
Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain 
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current 
engineering policies, standards and best practices at the time of application for construction.
2. Based on the conceptual design nature of the information submitted, changes to the site 
layout may be necessitated by the final engineering design of the drainage infrastructure.
3. Detailed Grading and Drainage (Infrastructure) Plans must be submitted with the 
application for Building Permits.
e. Prior to issuance of the initial building permit, all parcels shall be combined to create a 
single parcel matching the zone change area. 
f. Prior to issuance of a building permit, written confirmation will be required from the 
emergency fire protection jurisdiction having authority that the facility has been designed in 
accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, local 
fire protection jurisdiction review and approval will be required.
g. The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner.  The granting of this approval allows the property to enjoy 
uses in excess of those permitted by the zoning existing on the date of application, subject 
to conditions.  In the event of the failure to comply with any condition, the property may be 
considered by the Board after recommendation by the Commission at a public hearing for 
reversion to the zoning that existed on the date of application.  It is, therefore, stipulated and 
agreed that either revocation due to the failure to comply with any conditions, does not 
reduce any rights that existed on the date of application to use, divide, sell or possess the 
property and that there would be no diminution in value of the property from the value it held 
on the date of application due to such revocation of the Zone Change. The Zone Change 
enhances the value of the property above its value as of the date the Zone Change is granted
and reverting to the prior zoning results in the same value of the property as if the Zone 
Change had never been granted.

DEANNEXATION FROM CITY OF MESA TO MARICOPA COUNTY
(Supervisorial District 2)
Pursuant to A.R.S. § 9-471.03 convene the scheduled public hearing to determine if the 
public interest is served by de-annexing road right-of-way from City of Mesa jurisdiction to 
Maricopa County in accordance with the City of Mesa Ordinance No. 5999 and the analysis 
of the impact of the requested de-annexation.

Right-of-way location: SW corner Brown RD and Crismon RD.  Supervisory District No. 2.
After reviewing the analysis and hearing those that may appear for or against the request, if
the Board determines that the public interest is served by this de-annex/annexation action, 
a vote of approval shall direct the following:
1. File an ordinance setting forth the legal description of the public right-of-way and declaring
the return of the right-of-way contingent on the fulfillment of the additional conditions of the 
statute in the Office of the Clerk of the Board.
2. Pursuant to ARS § 9-471.03(F), set a public hearing for March 25, 2026 to de-annex road 
subject right-of-way from City of Mesa jurisdiction to Maricopa County, in accordance with
City of Mesa Ordinance No. 5999 and the Ordinance approved by the Board of Supervisors 
on this date.
3. Send notice of the date, time and place of the hearing on the requested action to each 
owner of real property subject to taxation adjacent to the subject public right-of-way at least 
twenty (20) days prior to the hearing.
Legal description of the roadway to be de-annexed, identified as Exhibit "A", is attached.
MCDOT Analysis: This roadway (Crismon Road) provides regional connectivity as a principal 
arterial roadway.  Development directly fronts this roadway and improvements by the 
developer to this roadway necessitate additional right of way to ensure public safety.
Financial Status: Cost of the roadway development falls to the developer with no initial cost 
to Maricopa County.  Cost of maintenance moving forward is typical of roadway maintenance
cost and will be the responsibility of Maricopa County. The cost of roadway maintenance 
provides a benefit to the traveling public.
The Board action will result to add .0002 square miles to County ownership and enable the 
County to assume responsibility for road maintenance.

highway system.  This action will serve as notice of the Board of Supervisors’ acceptance of 
all U.S. Patent easements, reservations, rights-of-way or properties along the alignments 
into the Maricopa County highway system and will also authorize the maintenance and 
acquisition of the necessary rights-of-way through donation, purchase, or condemnation.

rights, together with additional right-of-way and permanent and temporary 
easements to provide for construction, operation, and maintenance of the highway 
as designed and constructed by the City of Goodyear project: 42048 Sarival Ave: 
Yuma Rd to Elwood St; the centerline of the highway is described to-wit:   
BEGINNING at the West quarter corner of Section 19, Township 1 North, Range 1 
West, Gila and Salt River Meridian, Maricopa County, Arizona.
THENCE northerly along the section line common to Sections 18 and 19 Township
1 North, Range 1 West and Sections 13 and 24 Township 1 North, Range 2 West to 
a point being the intersection of Watkins St and Sarival Ave as depicted in Sarival 
Gardens recorded as Book 147 Page 19 in the Maricopa County Recorder’s Office 
and said point also being the point of ENDING.
The beginning, ending, general course and direction of the highway is depicted in 
the attached Exhibit, pursuant to A.R.S. § 28-6701(B); and
General Vicinity: Sarival Avenue from Dunlap Rd/Elwood St to Watkins Street, lying 
in Supervisory District No. 5.
In addition, direct the Clerk of the Board to record the Board of Supervisor’s

AGREEMENT WITH US DEPARTMENT OF JUSTICE, DRUG ENFORCEMENT 
ADMINISTRATION FOR THE DEA PHOENIX TASK FORCE FFY2026
Approve the Amendment to the agreement approved on 11/02/22 (C-50-23-066-X-00) and 
acceptance of up to $66,465.75 from the U.S. Department of Justice, Drug Enforcement 
Administration for MCSO participation in the DEA Phoenix Task Forces. The term of this 
agreement is October 1, 2025, through September 30, 2026.  
The grant award is recurring and has been awarded to the Sheriff's Office since 1998. A 
cash or in-kind match is not applicable. There is no future or ongoing contribution required 
following termination of the grant period. The Sheriff’s indirect cost rate for FY26 is 27.660%.
Indirect costs have been calculated as up to $18,384.43 and are unrecoverable per item 7 
of the Agreement. The $18,384.43 will be absorbed by the Sheriff’s Office General Fund 
(100) operating budget.  The grant award is not a mandated function but provides a benefit 
to the citizens by enhancing public safety through illegal drug interdiction. The grant award 
is not competitively bid.   
This agreement reimburses overtime costs for three deputies assigned to the Phoenix Task 
Force, up to $22,155.25 per deputy for a total of $66,465.75.  
These revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditures of these revenues are not prohibited by the budget 
law.

Approve and Accept grant funds from Arizona Department of Emergency and Military Affairs, 
Grant No. EMF-2025-EP-05007, CDFA# 97.042, in the amount of $1,145,936.40.  These 
grants are for emergency planning within Maricopa County. The grant award begins on July 
1, 2025 and ends June 30, 2026. Authorize the Chair to sign all documents related to these 
grant funds, as applicable. The Department will not be recovering the allowable 8.85% de
minumus rate based on the total direct charges, which totals $101,415.37. 
 
The grant award is reoccurring and has been awarded to the department for the past thirty 
(30) years. The department has a match requirement of $1,145,936.40. During the grant 
award period, the match for this grant comes from the General Fund (100-D150-1510 and 
100-D150-1520), Palo Verde (207-D150-1510), and the Intergovernmental Agreements 
(215-D150-1510-CTIGA). Maricopa County does not have to fund any additional costs for 
the program. The grant award is a mandated function for emergency preparedness through 
the Robert T. Stafford Act. This grant provides funds for recipients to build and maintain 
emergency management programs at the state and local level.  This grant award is non-
competitive and all counties in the State are eligible to apply for funds to support their 
Emergency Management Programs. 
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This
does not alter the budget constraining expenditures of local revenues duly adopted by the 
Board pursuant to A.R.S. §42‐17105.

Approve a non-financial Memorandum of Understanding (MOU) between TheSmileZone, 
Inc., (Provider) and Maricopa County (County) administered by its Human Services
Department. 
The purpose of the MOU is for Provider to provide Oral Health Services to Head Start 
Program participants by conducting onsite oral health services at Head Start program 
locations which may include exams/screenings, prophylaxis (cleaning), possible x-rays and 
restorative care, fluoride treatments, dental sealants as needed, along with providing dental 
outreach to students and their families to encourage preventative oral health activities.

 TheSmileZone, Inc. will provide onsite dental equipment and oral health services to Head
Start Program (Participants) at various Head Start Program locations.  The County and 
Provider will collaborate to offer Oral Health Services to Participants ages 0-5.  Oral Health 
Services will be provided to ALL participants free of charge, regardless of economic status 
and only with the permission of the participant’s parent or guardian in accordance with Head
Start Performance Standards in 45 CFR 1302.42.
The MOU term is retroactive, beginning January 1, 2026, through June 30, 2027.
This non-financial Agreement will not impact the County General Fund.

between the Maricopa County Community College District doing business as Maricopa 
Corporate College (MCCCD or Contractor) and Maricopa County (County), administered by
its Human Services Department. The County and the Contractor are collectively referred to 
herein as the “Parties” and individually as the “Party.” 
The purpose of the Agreement is for the Contractor to provide training programs for Maricopa
County youth and adult job seekers in rural communities of Gila Bend, Wickenburg, Queen 
Creek, and surrounding areas for the County’s Workforce 2 You Program (“Program”) 
utilizing funding provided to the County by the State of Arizona, Governor’s Office of Youth, 
Faith and Family (GOYFF), Workforce Innovation Opportunity Act (“WIOA”) Grant Program. 
The term of the Agreement is from September 30, 2025, to September 30, 2026.
The County shall provide the Contractor with this, it’s third year of funding, in the amount of 
$500,000, provided to the County by the State of Arizona, Governor’s Office of Youth, Faith 
and Family (GOYFF), Workforce Innovation Opportunity Act (“WIOA”) Grant Program - Grant 
No. GR-WIOA-GOYFF-100123-08. The Program is intended to improve access to training
programs that provide participants industry recognized credentials upon completion. 
Program components include in-person training, supported testing if required for 
credentialing, and direct coordination with County staff for career placement post completion 
of the Program.
The purpose of this Amendment No. 2 is to address the following:
A. Revise and replace Paragraph 7.0 (FUNDING) with the following:
The Maricopa County Human Services Department Workforce Development Division (WDD) 
Workforce 2 You Program is administering this Program with funds provided by the State of

Education’s Teacher Registered Apprenticeship Program (TRAP). The Teacher Registered 
Apprenticeship Program is designed to provide aspiring educators with a structured pathway 
to the teaching profession. Apprentices gain practical classroom experience under the 
guidance of experienced teachers while completing their academic coursework. In July 2025 
the County provided the Subrecipient with $1,500,000 in American Rescue Plan Act (ARPA) 
State and Local Fiscal Recovery funds (SLFRF) UNDER Assistance Listing Number (ALN) 
21.027 to administer the Apprenticeship Program. 
The purpose of this Amendment No. 1 is the following:
A. Reduce total Agreement funding amount by $700,000, from $1,500,000 to $800,000.
B. Extend Agreement expiration date from June 30, 2026, to August 31, 2026.
C. Revise and replace Paragraph 7.0 (FUNDING) with the following:
The County shall provide the Subrecipient with an amount not to exceed $800,000 in ARPA
Funds under Assistance Listing Number (ALN) 21.027 provided to the County through the 
U.S. Department of Treasury. ARPA funds must be fully expended by August 31, 2026.
D. Revise and replace Paragraph 10.0 (COMPENSATION), with updated final Installment
and closeout language

AMENDMENT TO MARICOPA COUNTY HOME CONSORTIUM 3 YEAR-
INTERGOVERNMENTAL AGREEMENT

Approve an amendment to the Maricopa County HOME Consortium 3-Year 
Intergovernmental Agreement (“Agreement”) with geographically contiguous municipalities
consisting of the cities and town of: Avondale, Chandler, Gilbert, Glendale, Peoria, 
Scottsdale, Surprise, Tempe, and County of Maricopa (collectively, the “Consortium” or the 
“Maricopa HOME Consortium” or the “Parties”; and individually, “Consortium Member” or 
“Party”) for the U.S. Department of Housing and Urban Development (HUD) HOME 
Investment Partnerships Programs (“HOME”).
The purpose of the Amendment is to seek approval to add the City of Goodyear as a member 
of the Consortium with all rights, responsibilities and obligations as set forth in the 3-Year 
Agreement and as applicable in US Department of Housing and Urban Development (“HUD”) 
regulations.
The Agreement, which was renewed and approved by the Board of Supervisors on June 14, 
2023, designates Maricopa County as the lead agency for the Consortium, and to assume 
responsibility for ensuring that the Consortium’s HOME Program is carried out in compliance
with HUD rules, regulations, and requirements, including requirements concerning a

comprehensive housing affordability strategy. Each of the above listed municipalities 
approved the automatic renewal of the Agreement. Renewal of the Agreement provides full 
legal authority for the Consortium to continue to undertake or assist in undertaking housing 
assistance activities for the HOME Program. The Agreement term is July 1, 2023, through 
June 30, 2026, for Federal Fiscal Years 2024-2026. HSD will be seeking to renew the 3-year
Agreement again in June 2026 and will submit this action for approval before the Board of 
Supervisors
Maricopa County Human Services Department, as a Participating Jurisdiction, oversees the
HUD HOME Investment Partnership Program and must provide HUD with information that 
the Agreement’s Amendment has full approval of all the Parties in compliance with the 
National Affordable Housing Act and HUD rules, regulations, and requirements of the HOME
Program, implementing the 3-Year Consortium Agreement.
The Agreement is non-financial and will not impact the County General Funds.

SHARING

Approve non-financial Memorandum of Understanding (MOU) between Arizona Department
of Economic Security (ADES) and Maricopa County, administered by its Human Services 
Department (County), Early Education Division. ADES and the County are collectively 
referred to herein as the “Parties” and individually as “Party.”
The purpose of this non-financial Memorandum of Understanding (MOU) is to set forth and 
formalize an agreement between the Parties to clarify the roles and responsibilities for data 
sharing and collaboration between ADES’ Division of Benefits and Medical Eligibility 
(“DBME”) and the Human Services Department’s Early Education Division (Department), 
which processes are identified in the Data Sharing Agreement No. D1775189 previously 
approved by the Board of Supervisors (C-22-26-025-X-00) at December 10, 2025 formal 
meeting.
The MOU shall formalize authorization of ADES’ Division of Benefits and Medical Eligibility
(“DBME) to share information with the Department to conduct eligibility determination for 
individuals/families for programs administered by HSD. The Department’s Early Education
Division reviews DBME information regarding SNAP and TANF enrollment, verifies income 
of household members, reviews Employment, Unemployment, Compensation, Wages and 
Child Support information or other State sponsored benefits and health informatics to ensure 
Head Start Program health requirements are also met. 
The term of this MOU is effective when fully executed through May 20,2030 and runs 
concurrent with the fully executed Data Sharing Agreement D1775189. This Agreement may
be extended through a written amendment by mutual agreement of the Parties.

White Part A Program.  This grant provides continued lifesaving medical and support 
services to people living with HIV/AIDS (PLWHA) through the Ryan White Part A HIV 
Emergency Relief Grant Program. The Not-to-Exceed amount is $3,270,266 for the budget

period March 1, 2026, through February 28, 2027. The term of the grant is March 1, 2025, 
through February 29, 2028.
The grant award is recurring and has been awarded to the department for many years. This 
is a non-competing continuation and there is no cash or in-kind match required.  This is not 
a mandated service but provides a benefit to our citizens with the provision of health related
and support services for up to 4,500 people Living with HIV/AIDS. Should the grant cease, 
on-going contributions should not be required.
The grant allows for the full indirect rate of 16.69% for FY26. Indirect cost is estimated to be 
$467,741.36, all of which is recoverable.  All program costs are allocated to the grant so 
there will be no additional burden on the department’s operating budget.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditure of the funds is not prohibited by the budget law.
Approval of this action does not alter the budget constraining the expenditure of local 
revenues duly adopted by the Board pursuant to A.R.S. §42-17105.

FOR SEXUALLY TRANSMITTED INFECTION CONTROL SERVICES
Approve a retroactive Purchase Order (PO) PO0000846601 for Intergovernmental 
Agreement (IGA) CTR067014 between Arizona Department of Health Services (ADHS) and 
Maricopa County by and through its Department of Public Health (MCDPH) for sexually 
transmitted infection (STI) services.  The PO was issued by ADHS on February 5, 2026.  The
not-to-exceed amount of the PO is $332,038.67 for the budget period February 1, 2025, 
through February 28, 2026. The IGA term is January 01, 2023, through December 31, 2028.
The STI Control Services grant award is reoccurring, non-competitive, and has been 
awarded to the Department for several years.  This grant funds an IGA that supports 
infrastructure to provide surveillance, prevention, policy development, and communication to 
expand and identify new infection control interventions.  There is no cash or in-kind match 
required, and indirect costs are fully recoverable.  Should this grant be discontinued, ongoing
cash contributions will not be required as this is not a mandated function.  As such, there will
be no cost that will need to be absorbed by the Department’s operating budget.  
MCDPH's indirect rate for FY26 is 16.69%. The indirect costs are estimated at $47,491.01, 
all of which are recoverable. Departmental indirect rates are established at the beginning of 
each fiscal year, and the future indirect rates will be collected at the corresponding rate.   
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditure of the revenues is not prohibited by the budget law. 
This Amendment does not alter the budget constraining expenditures of local revenues duly

Approve settlement of Floodplain Regulations and Zoning Code violations and entry of a
Consent Judgment in Flood Control District of Maricopa County v. Larkin et al., No. CV2025-
063624. Pursuant to the terms of the Consent Judgment, the property owner must remedy 
the violations within 15 days of the entry of the Consent Judgment in exchange for a 
reduction of civil penalties owed. This matter was heard in Executive Session on February 
23, 2026.

MARICOPA COUNTY RECORDER’S OFFICE APPROPRIATION ADJUSTMENT
In accordance with A.R.S. §42-17106 (B), approve the following amendments to the FY 2026 
budget:
1. Increase the expenditure authority for Recorder (D360) General Fund (100) Non Recurring
(NRNP) budget by $550,000.
2. Decrease the expenditure authority for Non Departmental (D470) General Fund (100) Non
Recurring (NRNP) in the line “Recorder Contingency” (4711) budget by $550,000.
These actions will have a County-wide net impact of $0 and they do not alter the budget 
constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S.
42-17105.

mail sorting machine, including questions regarding its funding source.
Ms. Pokorski clarified that the funding is for a new signature verification station 
requested by the Recorder, not the Agilis machine. She added that an attached memo 
explains how the Recorder plans to use funds allocated in last year’s legislative budget.

AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF TRANSPORTATION FOR 
USE OF THE POWERLINE FLOODWAY AND SR-24 DRAINAGE CHANNEL 
MAINTENANCE ROADS AND ACCESS RAMPS
(Supervisorial District 1 and 2)
Approve Amendment No. 1 to the Intergovernmental Agreement (IGA) FCD 2020A027 
between the Flood Control District of Maricopa County (District) and the Arizona Department 
of Transportation (ADOT) for shared use of the Powerline Floodway and SR-24 drainage 
channel maintenance roads and access ramps.  The purpose of this Amendment to the 
existing IGA is to allow for joint use of new future maintenance roads within the defined 
Exhibit area.
The purpose of the original IGA was to define the relationship between the District and ADOT
with referencing to allowing joint use of the maintenance roads and access ramps between 
the two agency facilities.  The IGA also defined the maintenance responsibilities of both the 
District and ADOT for the drainage and freeway facilities in the area.

Approve and execute the First Amendment to the Intergovernmental Agreement (IGA) 
among the Maricopa County Board of Supervisors and the Maricopa County Stadium District,
Flood Control District of Maricopa County, and Maricopa County Library District for the joint 
adoption of Board of Supervisor Policies (C-06-18-393-6-00) to remove the Maricopa County
Stadium District from this agreement and all related existing policies governed by this 
agreement.  
This IGA only applies to Board of Supervisors policies with an effective date on or after April 
11, 2018.

PURCHASE AGREEMENT AND CONVEYANCE DOCUMENTS FOR SALE OF REAL 
PROPERTY FCD FP-029-1EX, FP-029-2EX AND FP-029-3EX
(Supervisorial District 3)
Pursuant to A.R.S. §48-3603(I), the Flood Control District (District) requests the Board of 
Directors approve the sale of FCD Parcels FP-029-1EX, FP-029-2EX and FP-029-3EX
(APN 202-11-011B, 202-11-024 and 202-11-025C) and authorize the Chair to execute a 
deed by and between Flood Control District of Maricopa County as Seller, and J Wesley 
Smith, as Buyer, and authorize the Chair to sign all other documents approved by legal 
counsel required to dispose of/transfer the property without further Board action. 
This District property was purchased as part of the Flood Control District of Maricopa 
County’s Floodprone Properties Acquisition Program and was declared excess to the needs
of the District by the Board of Directors on April 26, 2017 (C-69-17-024-8-00). On October 
15, 2025, District parcels FP-029-1EX, FP-029-2EX and FP-029-3EX were appraised at a 
value of $38,000.00.
On January 22, 2026, the Maricopa County Real Estate Department held a public auction 
for District parcels FP-029-1EX, FP-029-2EX and FP-029-3EX that resulted in a winning bid
of $38,000.00.
