RE: Maricopa HOME Consortium—County Attorney Opinion Letter

Dear Sir or Madam:

As a duly appointed Deputy County Attorney of Maricopa County, Arizona, I have reviewed the
Maricopa County HOME Consortium Agreement (the "Agreement") that was drafted according
to the National Affordable Housing Act.

Pursuant to the Agreement, the geographically contiguous units of general local government
consisting of the municipalities of Avondale, Chandler, Gilbert, Glendale, Goodyear, Peoria,
Scottsdale, Surprise, and the County of Maricopa, have formed a consortium for the purpose of
receiving an allocation to participate in the HOME Investment Partnership Program.

The Agreement contains an auto-renew clause that all consortium members have agreed to for the
renewal period of July 1, 2026, through June 30, 2029, for program years 2027-2029. The
Agreement designates Maricopa County to act in a representative capacity for all member units of
general local government, and to assume responsibility for ensuring that the Consortium's HOME
Program is carried out in compliance with HUD rules, regulations, and requirements of the HOME
Program, including requirements concerning a comprehensive housing affordability strategy.

I have determined that the Agreement’s terms and provisions are fully authorized under state and
local laws, and that the Agreement provides full legal authority for the Consortium to undertake
or assist in undertaking housing assistance activities for the HOME Investment Partnership
Program. See Arizona Revised Statutes § 11-952.
