(Easement Extinguishment)

A RESOLUTION OF THE BOARD OF SUPERVISORS OF MARICOPA COUNTY, ARIZONA, 
DECLARING ROADWAY EASEMENTS TO BE UNNECESSARY FOR PUBLIC PURPOSES AND 
EXTINGUISHING THE EASEMENTS.
RESOLUTION OF THE MARICOPA COUNTY BOARD OF SUPERVISORS EXTINGUISHING RIGHT-
OF-WAY HELD BY EASEMENT PURSUANT TO A.R.S. § 28-7214.
WHEREAS, A.R.S. § 28-7214 authorizes a county board of supervisors to extinguish right-of-
way, provided the county does not hold such right-of-way by fee title; and 
WHEREAS, Maricopa County holds right-of-way by easement pursuant to a Roadway Easement 
from Marcia and Leo Biglaiser, dated April 28, 1995 and recorded in the Office of the Maricopa County 
Recorder in instrument 19950238469 (“Horan Segment”); and
WHEREAS, Maricopa County holds right-of-way by easement pursuant to a Roadway Easement 
from Alfred A. and Emily Gianni, dated May 15, 1995 and recorded in the Office of the Maricopa County 
Recorder in instrument 19950273518 (“Gianni Segment”); and
WHEREAS, Maricopa County holds right-of-way by easement pursuant to a Roadway Easement 
from Paul L. Scott, dated May 25, 1995 and recorded in the Office of the Maricopa County Recorder in 
instrument 19950297854 (“Romero Segment”); and
WHEREAS, the easement area to be extinguished is described to wit:

Portions of the Northeast Quarter of Section Thirty-five (35), Township Six (6) North, Range Two (2) East 
of the Gila and Salt River Base and Meridian, Maricopa County, Arizona.  Said portions of land being 
more particularly described as follows:
Horan Segment (Instrument 19950238469)
The North Forty (40) and the South Forty (40) feet of the East one-half (E 1/2) of the West one-half (W 
1/2) of the Southeast one-quarter (SE 1/4) of the Northeast one-quarter (NE 1/4) of Section Thirty-five 
(35), Township Six (6) North, Range Two (2) East.
Gianni Segment (Instrument 19950273518)
The South Forty (40) feet of the West one-half (W 1/2) of the South one-half (S 1/2) of the Southeast one-
quarter (SE 1/4) of the Southeast one-quarter (SE 1/4) of the Northeast one-quarter (NE 1/4) of Section 
Thirty-five (35), Township Six (6) North, Range Two (2) East.
Romero Segment (Instrument 19950297854)
The South Forty (40) feet of the East one-half (E 1/2) of the South one-half (S 1/2) of the Southeast one-
quarter (SE 1/4) of the Southeast one-quarter (SE 1/4) of the Northeast one-quarter (NE 1/4) of Section 
Thirty-five (35), Township Six (6) North, Range Two (2) East, EXCEPT the East Forty (40) feet thereof.
General Vicinity: 27th Avenue and Cloud Road. Supervisorial District 3.

A map or plat of the roadway to be extinguished is attached; and
WHEREAS, the Director of the Maricopa County Department of Transportation has advised that 
said right-of-way is not necessary to provide a public highway and is, therefore, no longer needed by the 
County; and
WHEREAS, the Maricopa County Board of Supervisors has determined that the Easements are 
not necessary to provide a public highway, are no longer needed by the County and may be extinguished.
WHEREAS, this Resolution shall become effective and is expressly conditioned upon the 
recordation of an ingress and egress easement with the Maricopa County Recorder’s Office for the 
easement area being extinguished pursuant to this Resolution;
NOW, THEREFORE, be it Resolved by the Maricopa County Board of Supervisors that its Chair 
execute this Resolution evidencing the determination by the Board that the Easements are not necessary 
to provide a public highway and is, therefore, no longer needed by the County, and that the Easements 
referenced herein are hereby extinguished pursuant to A.R.S. § 28-7214; and it is
FURTHER RESOLVED that the Clerk of the Board record this Resolution in the Office of the 
Maricopa County Recorder to provide public notice of the extinguishment of the Easements pursuant to 
A.R.S. § 28-7214.
