This Extinguishment of Easement is made by Maricopa County, a political subdivision of the 
State of Arizona, and is effective as of the date recorded in the office of the Maricopa County 
Recorder. 
RECITALS 
WHEREAS, Maricopa County acquired a Drainage Easement containing 40,180 square feet, 
recorded on September 9, 2022, as Instrument Number 20220700626 in the official records 
of Maricopa County, Arizona (“Easement”) over a portion of land described and depicted on 
“Exhibit A”.  
WHEREAS, the Maricopa County Board of Supervisors did, on May 22, 2024, adopt a Resolution 
declaring that said Easement is no longer necessary for any public purpose. 
NOW, THEREFORE, Maricopa County, hereby releases, extinguishes, and disclaims any and 
all interest it has or may have in or to the Easement.

THE GRANTEE AGREES: 
A. To use the property described herein Exhibit "A" for the general welfare and benefit of the
public for the limited purposes of constructing, operating, and maintaining drainage basin
improvements for the adjacent Butler Drive lmlf street."
B. To pay the GRANTOR the sum of Ten No/100 DOLLARS ($10.00) as payment in full
for the pro1ierty described herein.
C. GRANTEE agrees to release and relinquish all tights granted herein to the above described
property in the event that the GRANTOR OR GRANTOR'S SUCCESSOR IN
INTEREST shall at any time in the future develop the parcel containing the easement,
provided that the development h1cludes drainage facilities approved to the satisfaction of
the GRANTEE'S County Engineer and/or the municipality or municipalities having
jurisdiction at this location at the time of development.
D. That, if in the opinion of the Transportation Director, it becomes necessary, fences and
private structures will be removed and replaced in kind, at no expense to the GRANTOR
except as may be herein otherwise agreed. Any ground cover disturbed from its original
state will also be replaced ill kind.
E. That no costs relating to constmction of Project No. TI0498 will be charged to the
GRANTOR.
F.
To indemnify GRANTOR for any and all daniages caused by or atising from the
proximate result of the activities of the GRANTEE, and/or its officers, employees, agents
and contractors, ill the exercise of GRANTEE's rights pursuant to the terms of this
Easement, except such injury or damage caused by or arising from the negligence or
willfulness of the GRANTOR, and/ol' its agents, invitees, or contractors. All clallllS shall
be submitted in accordance with the requirements of A.R.S. § 12-82 l, et seq.
To maintain the drahiage basin improvements and appurtenances in a state of good repair
and in a safe condition.
