A RESOLUTION RESCINDING A BOARD ACTION TO DECLARE ROAD FILE NO. A669, 129TH
AVE FROM NORTHERN AVE TO BUTLER DR AND BUTLER DR FROM DYSART RD TO 127TH
AVE, A COUNTY HIGHWAY.
WHEREAS, A.R.S. § 28-6701(A) authorizes a county board of supervisors to establish, alter or
abandon a highway in the county and other legal subdivisions; and
WHEREAS, on the 11th day of March 2020, the Board adopted a Resolution, designated Road
File Number A669 (C-64-20-123-M-01), recorded in instrument No. 2020-0219669, declaring 129th Ave
from Northern Ave to Butler Dr and Butler Dr from Dysart Rd to 127th Ave a public highway in the
County Highway system; and
WHEREAS, a Map depicting the adopted resolution was recorded in instrument No. 2020-
0219669; and
WHEREAS, said roads were declared to acquire the necessary rights of way in City of El
Mirage jurisdiction for the construction of the TT0498 Northern Parkway – El Mirage Alternative Access
project; and
WHEREAS, the rights of way were never acquired by the County but were obtained by the City
of El Mirage, and
WHEREAS, the City of El Mirage has requested that the County rescind and terminate County
Road File A669; and
WHEREAS, the portions of said roads to be removed from the designation “county highway”
are described as follows;

Two roadway alignments having a width of 80 feet, together with all appurtenant rights lying
within Section 35, Township 3 North, Range 1 West of the Gila and Salt River Base and
Meridian, Maricopa County, Arizona, and being centered on the following lines to-wit:
Butler Drive from the West quarter corner of said Section 35 to the center of said section.
And 129th Avenue (alignment) from Northern Avenue to Butler Drive.
A map or plat showing the beginning, ending, general course and direction of the
highway is depicted in the attached Exhibit “A”, pursuant to A.R.S. § 28-6701(B); and
General Vicinity: Northern Avenue and Dysart Road in Supervisor District 4 and in the City of
El Mirage.
WHEREAS, the Board finds that the acquisition as provided for in the Resolution has not
occurred and will not occur as all property rights were acquired by the City of El Mirage; and

WHEREAS, the Board finds that rescinding said action is in the best interests of Maricopa
County and takes this action to remove said highway i from the County highway system; and
NOW, THEREFORE, BE IT RESOLVED that the action declaring Road File No. A669 a public
highway is hereby rescinded, as more fully set forth herein above and, that the County Engineer is
hereby directed to make a map or plat of the road and cause the same to be recorded in the Office of
the County Recorder, evidencing that the road has been removed from the County highway system.
