Chairman Sellers opened the meeting and asked the Clerk to call the roll.

The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Formal Session at 
9:30 AM on Wednesday, January 10, 2024, in the Supervisors' Auditorium 205 W. Jefferson 
Phoenix, AZ 85003, with the following members present:  Jack Sellers, Chairman, District 1;  
Thomas Galvin, Vice Chairman, District 2;  Bill Gates, Supervisor, District 3 (remote);  Clint 
Hickman, Supervisor, District 4;  Steve Gallardo, Supervisor, District 5 (entered meeting late). 
Also present: Juanita Garza, Clerk; Kelly Gardiner, Minutes Coordinator; Jen Pokorski, County 
Manager; Andrea Cummings, Legal Counsel.

INVOCATION - INVOCACIÓN
Chairman Sellers introduced his guest, Mayor of Queen Creek, Julia Wheatley, who 
offered the invocation.

PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA
Ms. Wheatley led the Pledge of Allegiance to the flag.
Chairman Sellers took a few minutes to speak about the importance of the relationships 
that the County has with the municipalities in Maricopa County. He said Mayor 
Wheatley is an excellent leader in the fast-growing area of Queen Creek.
Supervisor Galvin echoed Chairman Sellers comments and said he appreciated her 
attending today’s meeting.

PET SHOWCASE BY MARICOPA COUNTY ANIMAL CARE AND CONTROL - 
PRESENTACIÓN DE ANIMALES DOMESTICOS POR EL DEPARTAMENTO DE
CONTROL Y CUIDADO DE ANIMALES
Kim Powell, with Maricopa County Animal Care and Control, introduced Blue, a three-
year-old female Husky mixed breed who came to the shelter as a stray. Blue is very 
friendly, has been spayed, and is ready to go to her new home.
Chairman Sellers asked the Clerk if there were any announcements or corrections to the 
agenda.
The Clerk said item 41, Precinct Committeemen, has an amended list of names that 
was provided overnight.

Chairman Sellers asked the Clerk to read the proclamation.
Mike Peterson, resident, spoke in favor of this Proclamation. He said he is concerned 
that teachers would misuse this message and there are no safeguards in place to keep 
it from being weaponized.
Supervisor Gallardo joined the meeting by phone and commented on this Proclamation.
He thanked Chairman Sellers for bringing this very important subject forward. He said 
he has been involved with this subject for many years and it is important to listen to the 
young people, particularly in today’s social climate. He said there are many challenges 
that young people face, and he would like to encourage people to assist the youth who 
might need help and direction.
Shelby Duplessis, representing Speak Up, Stand Up, Save a Life, was present to 
speak. She has been involved with this effort for the past seven years and is a former 
president of Leadership West. She invited the Board to attend the Annual Summit being 
held on January 30, 2024, at Grand Canyon University. She said this is an event that 
brings kids together to help them learn the importance of speaking up and helping youth 
connect with valuable resources. Ms. Duplessis thanked the Board for the 
proclamation.
Supervisor Hickman thanked Ms. Duplessis for attending the meeting and for all the 
attention that has been paid to this difficult subject. He said he knows the importance 
of speaking up and does not believe this would be used to weaponize or to bully other 
kids. Supervisor Hickman said he appreciates all the people who work to make this a 
successful program for the young people and families it impacts. 
Supervisor Galvin echoed the previous comments and thanked her for all the hard work.

MARICOPA COUNTY
Pursuant to A.R.S. § 9-471.03 convene the scheduled public hearing to determine if the 
public interest is served by de-annexing road right-of-way from City of Glendale jurisdiction 
to Maricopa County in accordance with City of Glendale Ordinance No. O23-45 and the 
analysis of the impact of the requested de-annexation.
Right-of-way location: Cotton Lane – Bethany Home Rd to Glendale Ave. Supervisory District
No. 4.
After reviewing the analysis and hearing those that may appear for or against the request, if
the Board determines that the public interest is served by this de-annex/annexation action, 
a vote of approval shall direct the following:
1. File an ordinance setting forth the legal description of the public right-of-way and declaring
the return of the right-of-way contingent on the fulfillment of the additional conditions of the 
statute in the Office of the Clerk of the Board.
2. Pursuant to ARS § 9-471.03(F), set a public hearing for February 7, 2024, to de-annex 
road subject right-of-way from City of Glendale jurisdiction to Maricopa County, in 
accordance with City of Glendale Ordinance No. O23-45 and the Ordinance approved by the
Board of Supervisors on this date.

Financial Status: Cost of the roadway development falls to the developer with no initial cost

cost and will be the responsibility of Maricopa County.  The cost of roadway maintenance 
provides a benefit to the traveling public.
The Board action will result to add 0.0053 square miles of right of way to County ownership

Sheriff Statutory Hearings

VIDEO RECORDING PROCESSING FEES BY LEGAL LIAISON SECTION
Pursuant to ARS 11-251-08, convene a hearing to consider the request for implementation 
of a one-time processing fee to be charged by the Legal Liaison Section (LLS) of the Sheriff’s
Office to the public for video recording requests. Initiation of this request to charge a 
processing fee for electronic video recordings is direct result of the new law ARS 39-129 
Local law enforcement; video recordings; fees, effective October 30, 2023.
LLS will charge $25/hour when processing requests for video recordings ($25 per hour X 
length of video). Multiple requests for the DVDs already processed (i.e., reviewed, redated, 
supervisor approved) of the same recording will have a flat fee of $15 per subsequent request
after the initial charge. If the already processed video is released electronically via secured 
file share, no fee will be charged to subsequent requesters. 
Also approve to continue current fee schedule implemented in 2009.  This fee schedule is
for when MCSO cannot produce records electronically. The fee schedule is as follows:
• Pages 1-10 $5.00
• 10+ pages $0.50 per page

Approve the appointment of Bridget Harper to the Deferred Compensation Committee, 
representing Supervisorial District 2. The term of service will be effective as of Board
approval until replaced. Ms. Harper previously served on this Committee in the position of 
Ex Officio, Chief Financial Officer, Designee.
Approve the appointment of Alana Lewicki to the Deferred Compensation Committee, 
representing Supervisorial District 4. The term of service will be effective as of Board
approval until replaced.
Approve the appointment of Captain Matt Summers to the Deferred Compensation

APPOINTMENT TO THE INDUSTRIAL DEVELOPMENT AUTHORITY BOARD OF 
DIRECTORS
Approve the nomination of Leah Landrum Taylor to the Industrial Development Authority 
Board of Directors, nominated by the Nominating Committee, as an At-Large member. The 
term of service will be effective as of Board approval through December 17, 2029.

Lezley Shepherd, resident, spoke in opposition to the appointment. She stated she was 
concerned with the background of this candidate being selected.
Janis Schmidt, resident, spoke in opposition. She said the person being appointed is 
affiliated with Black Lives Matter (BLM) and she believes BLM is a Marxist organization 
and has no place in Arizona under our Constitution.
 
Jeff Caldwell, resident, spoke in opposition. He echoed previous comments about the 
background of the appointee and said he was concerned about the appointment and 
the negative influence she might have.

Supervisor Gallardo commented on the dedication of Leah Taylor to public service and 
her ability to contribute to the communities she serves. He thanked her for her

REAPPOINTMENT TO THE BOARD OF HEALTH
Approve the reappointment of Supervisor Bill Gates to the Board of Health, representing the
Maricopa County Board of Supervisors. The term of service will be effective as of January 
10, 2024 through December 31, 2024.

Jeff Caldwell, resident, spoke in opposition to the reappointment Supervisor Gates to 
the Board of Health. Mr. Caldwell said Supervisor Gates supported the mask mandates, 
the lockdowns, and the resulting bailouts that occurred. He does not support anyone 
who supports those positions.
Janis Schmidt, resident, spoke in opposition to the appointment and echoed Mr. 
Caldwell’s comments. She said the lockdown and mask mandates hurt the economy, 
our children, and education.

Janis Schmidt, resident, spoke in opposition of this appointment and the promotion of 
public transportation.  She believed the bike lanes take up too much space on the 
roadways, creating additional traffic backups, accidents, and emissions into the air.
Lezley Shepherd, resident, spoke in opposition. She said the Board needs to eliminate 
the Road Diet and increase the ADA access for public transit. 
Jeff Caldwell, resident, spoke in opposition. He asked Chairman Sellers to research 
this topic and he referenced an article from 10 years ago on Road Diets. Mr. Caldwell 
said implementing Road Diets creates more congestion and traffic accidents.

Lezley Shepherd, resident, talked about the effective dates of the appointments and 
stated the oaths should have been approved before today’s date. She expressed 
frustration that the Board members were able to attend and participate via Webinar and 
the public is not allowed to attend virtually and contribute.
Jeff Caldwell, resident, echoed Ms. Shepherd’s comments and the legality of oaths not 
being approved by the Board in a timely fashion. He asked if there was a policy for the 
timing of swearing in. 
Supervisor Sellers said these appointments come from other elected officials and the 
Board approval is a formality and the Board is not directly responsible for the other 
elected offices.
Ray Michaels, resident, and LD 8 Chairman stated the Board of Supervisors need to 
take a stand and require the other elected offices to comply with Arizona Revised 
Statute 38-291.9.

GRANT FUNDING FROM ARIZONA STOP VIOLENCE AGAINST WOMEN GRANT FOR 
SAFE DOMESTIC VIOLENCE INVESTIGATOR
Approve the application and acceptance of grant funds from the State of Arizona Governor’s
Office Youth, Faith, and Family for the Arizona STOP (Services, Training, Officers, and 
Prosecutors) Violence Against Women Grant for $149,926.86. These new grant funds will
provide funding for an Investigator position within MCAO’s Family Violence Bureaus. This 
grant agreement, GR-STOP-GOYFF-010124-11, will commence on January 1, 2024, and 
terminate on December 31, 2024.
The grant allows a 10% rate for administrative or indirect costs. The Maricopa County 
Attorney's Office FY 2024 composite indirect cost rate is 20.2%, or $30,285.23. The 
recoverable indirect cost is 0 due to budget constraints, and $30,285.23 is non-recoverable.
The non-recoverable indirect costs will be covered by the departmental general fund budget. 
MCAO has a cash equivalent match of $49,975.62 during the grant award period and has 
general fund resources to provide this match.  This grant is competitive and does not require
ongoing cash contributions after the grant period end date.
Authorize the Chairman of the Board of Supervisors, or designee, to sign all documents 
related to this award. Grant revenues are not "local revenues" for the purpose of the 
constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited 
by the budget law.
This award agreement is in the amount of $149,926.86 in Federal monies under the 
Assistance Listings Number 16.558 awarded to the State of Arizona by the U. S. Department
of Justice Office on Violence Against Women under 15JOVW-23-GG-00560-STOP. 
This grant is a one-time award with no expectation of continued funding. This is the first time
MCAO has received this grant funding. This grant will expire at the end of the award period 
unless prior written approval for an extension has been obtained from the State of Arizona 
Governor’s Office of Youth, Faith, and Family.

ACCEPTANCE OF FFY 2023 STATE CRIMINAL ALIEN ASSISTANCE (SCAAP) 
FUNDING
Approve acceptance of $577,438 FY2023 reimbursement funding from the Bureau of Justice 
Assistance, State Criminal Alien Assistance Program (SCAAP). The corresponding 
application was approved by the Board of Supervisors (Agenda C-50-23-165-X-00), on April 
26, 2023.
This has been a reoccurring grant to the county for over 20 years and there is no cash or in-
kind matching requirement. Indirect costs are not applicable or recoverable since the 
reimbursement formula calculation only allows for staff whose primary responsibility is the 
care, custody, or supervision of persons detained (pre-trial detention) and incarcerated 
(convicted and sentenced) inmates. This funding is not competitive. There are no future or 
ongoing contributions required. This grant reimburses a portion of the costs for a mandated

requirement-incarcerating undocumented criminal aliens who are convicted of felony
offenses.
The Bureau of Justice Assistance allows these funds to be used for corrections purposes 
only. The specific planned use, as designated by the County Budget Office, will be 
Technology-Offender Management Software to be stated in the electronic request to 
drawdown funds.
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore expenditures of these revenues are not prohibited by the budget 
law.

communities up for 15 Minute Cities. She claimed pictures will be taken of cars and the 
tracking of people will be the focus.
Jeff Caldwell, resident, spoke in opposition. He said it is not about police officers 
keeping an eye on criminals, it is about violations of personal privacy and liberties. He 
stated it is the equivalent of facial recognition for cars, recording an automobile 
fingerprint. 
Janis Schmidt, resident, talked about the current organization and presentation of 
agenda items make it difficult to follow and respond to each item. She echoed the 
previous speakers comments and said this agenda item is a step toward New World 
Order and 15 Minute Cities and it will not help combat crime. 
Mike Peterson, resident, echoed previous speaker comments, “painted” a bleak picture 
for the future of the United States, and said the Board is responsible for the problems 
we face.

OF COMMUNITY ORIENTED POLICING SERVICES (COPS) FOR IMPLEMENTING 
CRISIS INTERVENTION TEAMS FFY24
Approve the acceptance of grant funds to the Sheriff’s Office from the Department of Justice 
(DOJ), Implementing Crisis Intervention Teams, Agreement Number 15JCOPS-23-GG-
01717-PPSE in the amount of $398,250 for the award period beginning October 1, 2023, 
and terminating on September 30, 2025. 
This is the first time this funding has been awarded to the Sheriff’s Office. The Sheriff’s Office
indirect cost rate for FY24 is 16.72%, applicable to the award amount of $398,250, for an 
indirect cost base of $398,250 and indirect costs of $66,587.40 which will be absorbed by
the General Fund. There is no match requirement. The grant award does not require ongoing 
cash contributions after the grant period end date. 
 
This is not a mandated function although it supports the MCSO public safety mandate by 
providing for the creation or expansion of crisis intervention teams and to embed mental and 
behavioral health services with law enforcement agencies so they can better respond to 
individuals in crisis in the community. This is a competitive award.  The application was open

to all local, state, tribal and territorial law enforcement agencies. This is reimbursement 
funding that will be used to pay for travel expenses, supplies and a sub-awardee. 
EMPACT – Suicide Prevention Center has been identified as the sub-awardee. EMPACT 
will provide key services through a full-time master’s Level Clinician, a full time Crisis 
Transition Navigator, a Director of Crisis & Trauma Healing Services who will provide
guidance and oversight, as well as other staff.

limitation, and therefore, expenditures of these revenues are not prohibited by the budget 
law.

from the Drug Enforcement Administration, Organized Crime Drug Enforcement Task Force 
(OCDETF) Investigative/Strategic Initiative # MN-23-0047/SWAZ P0972 in the amount of 
$416,000 for the award period beginning October 1, 2023, and terminating on September 
30, 2024.  This Agreement may be terminated by any of the parties by written notice to the 
other parties ten (10) business days prior to termination.
The funding award is recurring and has been awarded to the Sheriff’s Office the past twelve 
(12) years.  There is no match requirement. The Sheriff’s Office indirect cost rate for FY24 
is 16.72%, applicable to the award amount of $416,000 less capital expenses of $0.00 for 
an indirect cost base of $416,000.00 and indirect costs of $69,555.20 which will be absorbed
by the General Fund. There are no future or ongoing contributions required after the grant 
period ends; however, property (items) purchased with these funds must remain available to
the Strike Force/Strategic Initiative for the duration of its existence.   
This is not a mandated function although it supports the MCSO public safety mandate and 
provides a benefit to the citizens by disrupting the illicit drug trafficking organizations in 
Maricopa County and the State of Arizona resulting in a more safe and secure community. 
This is a non-competitive award.  The Maricopa County Sheriff’s Office is one of several local
law enforcement agencies in the Phoenix metro area that participate in this effort.  This is 
reimbursement funding that will be used to purchase capital and non-capital equipment; to 
lease and operate a vehicle; to secure subscription technical service; to pay monthly data 
charges relating to several types of equipment; and to secure contracted analyst service. 
These revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore, expenditures of these revenues are not prohibited by the budget

Number 21-AZDOHS-HSGP-210209-04 in the amount of $24,500.00 for the award period 
beginning January 1, 2024 and terminating on July 31, 2024 This Agreement may be 
terminated by any of the parties by written notice to the other parties thirty (30) business 
days prior to termination.
This is the second time the Sheriff’s Office has received this funding. There is no match 
requirement. The Sheriff’s Office indirect cost rate for FY24 is 16.72%, applicable to the 
award amount of $24,500 with $0.00 in capital expenses for an indirect cost base of $24,500
and indirect costs of $4,096.40. Indirect costs are unallowable by the terms of this agreement
unless applied for and approved in writing (page 7, Allowable Costs Section), and $4,096.40
in indirect costs will be absorbed by the General Fund. There are no future or ongoing 
contributions required after the grant period ends; however, property (items) purchased with 
these funds must remain available to the unit for the duration of its existence and/or the 
useful life of the item. 
This is not a mandated function although it supports the MCSO public safety mandate and 
provides a benefit to the citizens by updating crucial equipment to enhance the capabilities 
of the MCSO TLO’s to protect county infrastructure and mitigate incidents of terrorism

IGA WITH CITY OF PHOENIX FOR DETENTION SERVICES
Approve a(n) Intergovernmental Agreement between City of Phoenix and Maricopa County 
through the Sheriff's Office for booking and housing inmates in the not-to-exceed amount of
County established fees that are applicable during each year the agreement is in effect. This
Intergovernmental Agreement is retroactively effective from July 1, 2023 until June 30, 2028.
Pursuant to A.R.S.§ 31-121 it is the duty of the Maricopa County Sheriff to receive and 
provide for prisoners who have been committed to jail by competent authority. Pursuant to
A.R.S. § 31-121(D), Municipality is responsible for the costs of incarceration of the following
persons: (1) a person who is arrested by a peace officer employed by Municipality and who 
is charged in the municipal court and housed in the County Jail; and (2) a person who is 
convicted in the municipal court and sentenced to the County Jail (collectively, "Municipal 
Inmates"). This Agreement sets forth mutual performance of services and payment between
the County and the City of Phoenix.

ACCEPT FUNDING FROM THE ARIZONA CRIMINAL JUSTICE COMMISSION FOR 
THE REIMBURSEMENT OF FUNDS PURSUANT TO THE NICS ACT RECORDS 
IMPROVEMENT PROGRAM.
Approve the agreement with the Arizona Criminal Justice Commission for Reimbursements 
and acceptance of up to $65,567.25 in reimbursement funding for Maricopa County Justice 
Courts (MCJC) purchase of Live Scan Equipment that will allow the courts to capture 
fingerprints electronically. 
The FFY24 reimbursement funding eligibility began retroactively on December 6, 2023, and 
will terminate on September 30, 2025.
The agreement allows a reimbursement of funds up to a total of $65,587.25 to the Maricopa 
County Justice Courts (MCJC) for the purchase and deployment of seven (7) mobile 
Livescans. The Live scan equipment will upgrade the current MCJC procedures from an 
after-the-fact court summons process for fingerprinting, to an electronic fingerprint capture 
while the subject is still in the court. The enhanced process will enhance the biometric ten 
print fingerprint record, reduce case processing time, and facilitate enhance the accuracy of
court records.

PERMANENT ADDITIONS TO THE FLEET
Approve a permanent addition to the fleet of seven Chevy Malibu sedans to be used by the 
Juvenile Probation Department (JPD).  An increase in the standard probation population in 
FY2023, combined with contact standards adopted for high-risk youth adopted in 2021, 
necessitate the addition of the requested vehicles.  The Judicial Branch can self-fund the 
vehicle purchase in FY2024.
The estimated cost is $33,000 for each vehicle, for a total cost of $231,000 which includes
taxes and onboarding costs.  
As permanent additions to the County vehicle fleet, the Judicial Branch is requesting that
future replacements be addressed by County Equipment Services through established 
policies and procedures.
Because we have been made aware that these vehicles may not be received in FY2024, the
Branch will be submitting a FY2025 above baseline request for a non-recurring contingency
budget line item for $231,000 for the purchase of these vehicles.  That funding would only 
be utilized if the vehicles are not received prior to June 30, 2024.
Expenditure Impact By FY: FY2024 General Fund Operating Budget: $231,000.00 which 
includes taxes and onboarding costs.

Pursuant to the Administrative Bank Accounts Policy A2504, Animal Care and Control (ACC)
is requesting authorization to  establish an administrative bank account and request a budget
adjustment for an anticipated one-time donation. 
ACC received notification it is named as a beneficiary to a decedent’s Fidelity Investment 
account with a balance of approximately $76,000. To receive the funds, ACC needs to create
an administrative bank account to move the funds from the decedent’s account to ACC's 
account. Once the funds are released to ACC, the Fidelity account will be closed 
automatically.
In accordance with A. R. S 42-17106(B), approve the following adjustments to the FY 2024 
budget: Increase the revenue and expenditure authority for the Animal Care and Control 
(D790) Animal Care Donations Fund (575) Operating (OPER) by $76,000 due to an 
unanticipated one-time donation. Donation funds are not local revenues for the purpose of

NEW HOPE AGREEMENT WITH HEART OF INFINITY FOUNDATION
Approve an agreement between Heart of Infinity Foundation and Maricopa County, 
administered by Maricopa County Animal Care and Control, to allow said rescue to transfer 
animals that have been deemed eligible for the New Hope program. Maricopa County will 
provide a rabies vaccination, dog license tag, and new owner transfer fee within the first year 
of transfer for each dog three months of age or older at no cost to the Contractor. The cost 
for these services is $52 for each animal transferred in FY 2024 and thereafter. Animal Care
and Control estimates ten (10) New Hope transfers annually, for a total of $520.00 per year,
over the term of the agreement. The term of this agreement shall commence upon approval
and execution by the Board and will expire on January 10, 2027.

Department of Correctional Health Services (CHS).   This agreement is for third party claims 
payment services provided by AHCCCS to CHS.  AHCCCS processes all outside provider
claims incurred due to the incarcerated patient population needing medical services from a 
health care provider outside of the jail system. 
The purpose of this amendment is to update SFY 2024 rates.

a twelve (12) month period. The Agreement shall be renewed for a term from January 30, 
2024, and ending January 29, 2025. 
In 2020, Correctional Health Services (CHS) and Arizona Complete Health entered into an
MOU to establish a collaborative protocol for effective communication, coordination, and 
continuity of care for individuals eligible for services provided by Arizona Complete Health

who are transitioning from incarceration to the community. Specifically, Arizona Complete
Health provides “reach-in” care coordination for members who have been incarcerated in the

allow Arizona Complete Health and CHS to work together to better address the needs of the 
community. All other terms remain unchanged.

Approve the following actions:
1. Receipt of funds from financial Agreements with Arizona Department of Economic 
Security, Child Care Administration (DES) for Child Care Provider designation at 11 
Maricopa County Head Start operated sites. As a designated Child Care provider, the County
will receive reimbursement for each eligible child enrolled in the DES Child Care Program.
The daily reimbursement rates are $46.15 for Toddlers (One (1) and Two (2) years-old) and 
$40.80 for Preschool (Three (3), Four (4), Five (5) years-old). Approve the receipt of an 
anticipated annual reimbursement amount of $878,656 for 96 DES eligible children. The
Agreements terms are November 27, 2023, or date of last signature and shall terminate on 
September 30, 2026. The anticipated amount for the Agreements for the full term is 
$2,372,090. The list of Head Start sites is attached.
2. Non-financial Amendment No. 1 to the Agreements that address changes in the Scope of
Work of the Agreement to address:
a. Program eligibility, reimbursement and record keeping
b. Central Registry Clearance for program staff
c. Changes to Exhibits and Attachments
3. Authorize the Human Services Department Director or designee to submit Amendments 
and required documents through the DES electronic portal.
The Maricopa County Human Services Department Head Start Program submitted Child 
Care Provider applications to DES in January 2023. The DES Child Care Provider 
designation is determined through a non-competitive process. Award of this designation and 
receipt of funds is a one-time occurrence. A cash or in-kind matching is not required and 
ongoing contributions are not required after Agreement term ends. 
The Human Services Department provisional indirect rate is 22.2% by the U.S. Department 
of Health and Human Services for FY2024 for salaries and employee related expenses. The 
anticipated reimbursement amount is $2,372,090 of which $1,941,154 is for salaries and 
ERE. The total estimated indirect costs are $430,936 and fully recoverable and shall be
effective upon execution of the Agreements. 
The services provided under the DES Child Care Program are not a mandated function but 
provide a benefit to the citizens by providing eligible children with high quality care and 
education. 
Grant revenues are not local revenues for the purpose of the constitutional expenditure 
limitation, and therefore expenditure of the revenues is not prohibited by the budget law. The 
grant funds do not alter the budget constraining expenditures of local revenues duly adopted
by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as 
necessary to accommodate this grant through a future reconciliation. The receipt of the funds

The purpose of Amendment No. 1 is to address the following:

establish the process for collaboration between the Parties to provide services to preschool 
children, including children with disabilities as defined in A.R.S. § 15-761, ages three years 
old to kindergarten-eligible five years old, in compliance with federal and state laws and
regulations, and in accordance with District policies and the Improving Head Start for School
Readiness Act of 2007 (42 U.S.C. §§ 9801, et seq.).

Arizona Fire and Medical Authority (“Subrecipient”) and Maricopa County (“County”) 
administered by its Human Services Department. The purpose of this Agreement is for
Subrecipient to install emergency equipment in case of power outages in the Tonopah and 
Wittmann areas. The County has provided the Subrecipient with $214,748 in U.S. 
Department of Housing and Urban Development (HUD) Community Development Block 
Grant (CDBG) funds. 
The purpose of the Amendment is to address the following items:
A. Increase the Agreement amount by $551,900 from $214,748 to $766,648 to complete the
scope of work at the Tonopah Arizona fire station. Funding for Amendment No. 4 is provided 
by U.S. Department of Housing and Urban Development (HUD) Community Development 
Block Grant CARES Act (CDBG-CV) funds
B. Change the funding source for all activities to be completed under this Agreement from

purpose of the Agreement is for the Contractor to administer a grant assistance program for
Food Banks serving Maricopa County residents. The County provided the Contractor with 
$3,000,000 in American Rescue Plan Act (ARPA) funds under ALN 21.027 for Agreement 
activities. The Agreement term is August 1, 2021, through June 30, 2024.
The Purpose of the Amendment is to address the following:
1. The County shall provide the Contractor with an increase in funding: $500,000 for the
remaining term through June 30, 2024. Funding is provided under ARPA ALN 21.207. 
2. Revise section 3.0 (Contractor Responsibilities) to clarify contract requirements.
All other terms and conditions of the Agreement and approved Amendments remain in full

BUDGET REALIGNMENT FOR STUDENT NURSE WORKFORCE PRACTICE 
READINESS PROGRAM ACTIVITIES
Request approval to realign the funding allocations for the Nurse Readiness Program 
(Program) activities.
Maricopa County has endeavored to increase the practice readiness of New Graduate 
Nurses (NGNs) by creating and implementing a Maricopa County Student Nurse Workforce 
Practice Readiness Program for senior nursing students. The Program creates partnerships

between education and practice using nursing faculties and specially trained practice-based
nurse preceptors. The Program model provides for covering costs associated with employers
hiring preceptors, and nursing education faculties which will yield more confident and 
practice-prepared nurses who can transition to the workplace more efficiently. It is 
anticipated that up to 1,142 Student Nurses will participate in the Program. The Program 
began in November 2021 and will continue through December 31, 2026.
The County has entered into financial Agreements with Schools that provide Nursing 
Programs (Affiliation Agreements), and with Hospitals and Clinics (Work Experience 
Agreements) to provide hands-on training opportunities to Student Nurses. The County has 
allocated $2,910,300 in American Rescue Plan Act, provided to the County by the 
Department of Treasury, for Program activities. Changes requested below will not change 
the funding allocation for this Program and will remain at $2,910,300. 
Request approval to adjust funding expenditures as follows:
1. Increase the expenditures amounts for Affiliation Agreements and Student stipends by 
$827,925 from $519,900, to a total amount of $1,347,825. The adjustment is required in 
order to increase the number of Student Nurses and to increase stipends amounts to Student
Nurses from $250 to $500.
2. Decrease the expenditure amount for Work Experience Agreements by $827,925 from 
$2,390,400, to a total amount of $1,562,475. This decrease is necessary to so that funding 
is available for accommodating the recruitment of additional student nurses, which has been

RESCIND AND REPLACE IGA WITH CITY OF SURPRISE FOR SERVICES TO 
UNSHELTERED INDIVIDUALS
Request approval of the following actions:
1. Rescind action taken by the Board of Supervisors on December 6, 2023, to approve an 
Intergovernmental Agreement with the City of Surprise. The City requested changes be 
made to the Agreement that addressed the Termination and Compliance with Applicable 
Laws clauses of the Agreement.
2. Approve a revenue Intergovernmental Agreement (Agreement) between the City of 
Surprise (City) and Maricopa County (County), administered by its Human Services 
Department. The City and the County are collectively referred to herein as the “Parties”.
The purpose of this Agreement is to establish a collaboration between the Parties focused 
on a strategy to reduce homelessness in the west valley communities, including the Agua 
Fria Wash, through the County’s “Hand in Hand” program (the Program). Outreach will 
include a versatile combination of case management, coordination with municipal entities
and connection to services such as workforce programs, mental health care and substance 
use support. Through a sustained targeted effort, this partnership endeavors to reduce local 
street homelessness in the areas as measured by the Point in Time count.
The Agreement term is retroactive to November 1, 2023, through June 30, 2024, and may 
be extended upon acceptance and approval by the Parties.
The Parties shall share in the costs for the service delivery, the City shall provide the County
with $50,000 for service delivery for the Agreement term.
This is a non-reoccurring Agreement that is entered by the parties through a non-competitive
process. Cash, match, or in-kind are not required. The County does not have any obligations 
after the Agreement term.
The services provided under this Agreement are not mandated services but provide a benefit 
to the residents of Maricopa County to ensure outreach services are provided to assist 
unhoused individuals and families with services to transition into permanent housing.
The Human Services Department approved provisional indirect rate of 22.2% for FY2024, 
by the U.S. Department of Health and Human Services, is for salaries and employee related
expenses. The Agreement funding amount is $50,000 of which $0 is for salaries and 
employee related expenses, therefore, $0 indirect costs are recoverable. Unrecoverable 
costs will be absorbed by the Human Services Department budget.
Funds received from this Agreement do not alter the budget constraining expenditures of 
local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant 
budget will be adjusted as necessary to accommodate this Agreement through future grant 
reconciliation.

services for Veterans and their families who are homeless and at-risk in Maricopa County. 
The Subrecipient shall, directly or through an eligible subrecipient or developer, expand 
homeless veteran shelter availability by acquiring land and constructing non-congregate 
transitional housing, at approximately 6324 NW Grand Avenue, Glendale, AZ 85301. The 
City’s goal is to develop a minimum of 50 transitional housing units and provide wrap around 
services to Veterans experiencing homelessness or transitioning out of homelessness. 
The County shall provide Subrecipient with $3,000,000 in American Rescue Plan Act (ARPA)

The term of this Agreement is from January 1, 2024, through September 30, 2026.

Approve Resolution extending the Moratorium on increased regulatory burdens. Adopt a 
resolution that extends the moratorium on all new county government regulations. A 
resolution placing a Moratorium on all new county government regulations was adopted by 
the Board on May 22, 2013. The moratorium was effective until December 31, 2017. It was 
subject of subsequent extensions until December 31, 2019, December 31, 2021 and 
December 31, 2023. This amends the resolution to further extend the effective date of the 
moratorium to December 31, 2024.

in the dietetic internship program at Maricopa County Department of Public Health (MCDPH).
The agreement is non-financial, and the term remains the same, July 01, 2023 through June
30, 2028.
The amendment would allow students from NAU to continue to complete unpaid educational
rotations with Public Health while providing for intern stipends if MCDPH elects to do so. Any
stipends would be paid directly to interns and not to NAU.  As part of this Agreement, MCDPH
will continue to provide training experiences and make available the related facilities at

Approve Amendment 1 to the Competition Impracticable (CI) contract between the CDC 
Foundation and Maricopa County, by and through the Department of Public Health 
(MCDPH). This amendment shall extend the expiration date an additional year to June 30, 
2025, as well as increase the not to exceed (NTE) amount of the CI and related master 
agreement to $586,282.26 for the additional year. This extension and additional funding shall

U of A, Mel and Enid Zuckerman College of Public Health (MEZCOPH) for respiratory illness
services.  
Amendment 4 extends the term of the Agreement to May 31, 2024.  As such, the updated 
term will be February 08, 2021, through May 31, 2024.  The Amendment also adds Section

SERVICES, CENTERS FOR DISEASE CONTROL AND PREVENTION FOR PUBLIC 
HEALTH INFRASTRUCTURE DEVELOPMENT
Approve Notice of Award (NOA) 5 NE11OE000020-02-00, from the Department of Health 
and Human Services (DHHS), Centers for Disease Control and Prevention (CDC) and 
Maricopa County by and through its Department of Public Health (MCDPH) for the 
development of performance management infrastructure and enhancement of both internal 
departmental programs and broader community-wide collaborative efforts, with a not-to-
exceed amount of $42,776,025.00.  This is an increase of $3,015,037.00 from the previous 
award which had a not-to-exceed amount of $39,760,998.00.  The budget period began on 
December 01, 2023, and runs through November 30, 2024.  The non-competing continuation
award period began on December 01, 2022, and runs through November 30, 2027.  
This is a competitive grant award and at this time, it has not been determined if it will be 
recurring.  There is no cash or in-kind matching requirement.  Should the grant cease,
ongoing contributions would not be required.  
All future year funding is based on satisfactory programmatic performance and the 
availability of funds.  
This grant deviates from County Policy A2505 and does not allow for full indirect cost 
reimbursement, but a maximum of 10% indirect cost reimbursement as delegated in the 
grant agreement.  The MCDPH indirect rate for FY24 is 15.65%.  Full indirect costs are 
estimated at $428,957.54 of which $274,094.27 is recoverable and $154,863.26 is 
unrecoverable.  Program costs not covered by the grant will be subsidized by the MCDPH 
indirect cost pool.  Departmental indirect rates are re-established at the beginning of each 
fiscal year and the future indirect rates will be collected at the corresponding rates.  
This grant award is not a mandated function but provides a benefit to the citizens in Maricopa

Approve the Affiliation Agreement with Creighton Elementary School District #14 to provide
clinical nutrition training experience for graduate students in the dietetic internship program. 
The agreement is non-financial, and the term is to be retroactive from July 1, 2023, through 
June 30, 2033.
As a part of its established accredited dietetic internship program, the Department of Public 
Health seeks to provide its dietetic interns with a broad and diverse practicum experience. 
This agreement with Creighton Elementary School District (CED) will allow dietetic interns to
continue to receive approved practicum experience in clinical nutrition. Supervised by CED 
registered dietitians in Creighton Elementary School facilities, interns would continue to be

funding for HIV Care and Services.  
The purpose of this grant is to reduce new HIV Infections and to improve health outcomes 
and access to care.   The term of the Contract shall not exceed five (5) years. The not-to-
exceed amount is $500,000 per year for 5 years. The budget period is April 01,2023 to March
31,2024.  The contract term is April 01, 2022, through June 30, 2027.  
This grant has been awarded to MCDPH in the past and it is unknown if it will be awarded
again.  It is non-competitive and there is no cash or in-kind match required.  This grant is not 
a mandated function but provides a valuable service to the community. 
 This grant deviates from County Policy A2505 and does not allow for any indirect cost

in the School Surveillance and Medication Program (SSMP) administered by MCDPH. The 
retroactive not-to-exceed amount is $18,000 for the budget period October 01, 2023, through

the most used tobacco product amongst U.S. youth.  As such, UP will recommend evidence-
based curriculums, administer pre and post surveys to youth in schools, and provide
cessation referral resources for the Arizona Smoker’s Helpline (ASHLine).  
Either Party may terminate this MOU, in whole or in part at any time before the Term 
expiration by giving thirty (30) days written notice to the other party.  The MOU may also be 
cancelled pursuant to A.R.S. 38-511.

Authorize the Maricopa County Department of Transportation (MCDOT) to accept federal 
funding reimbursements as approved by the Maricopa Association of Governments (MAG) 
and expend the grant funds for the Department of Transportation: Transportation System 
Management Project, sub-project TE068 Next Generation REACT Services Pilot Project 
FY23 up to the total cost of the project.
Estimated construction cost of the project is $610,989.  MAG has authorized $566,732 in
federal reimbursement funds available in FY 2024. MCDOT’s local 5.7% match portion is 
$44,257 and will be absorbed by the department’s operating budget from HURF funds.
The grant awarded is a one-time award.  There are no future or ongoing contributions 
required after the grant period ends. The grant fulfills a mandated service that the department
is required to perform. The grant award is a competitively bid, and other eligible agencies

Chairman Sellers asked the Clerk if there was anything to report regarding Public 
Comment email responses. The Clerk said there was one email received to comment 
on several agenda items and that email was shared with all Board offices. 
The Clerk said she had in-room Public Comment slips and she handed them to the 
Chairman.
Lezley Shepherd, resident, spoke about the Constitution document that she provided 
to the Board. The comments focused on the elections and a hand count of ballots.
Jerome Davis was called on but was not present.
Roger Pickerall, resident, spoke about a writ that was presented to the courts. He read 
from that document and made reference to Maxims of Law.
Cerresse, resident, continued to read from the same Writ document as previous 
speaker.

Ray Michaels, resident, and LD8 Chairman. Mr. Michaels said he is praying for the 
Board and all leaders. He spoke about the structure of our current government and the 
dissatisfaction that is felt by “We the People”.
Michelle Stapley, resident, read a quote from Samuel Adams. She spoke about the 
Declaration of Military Accountability and the organizers who pledge to hold 
accountable those who are in violation of the law.
Kristen Vail, resident, was called on but was not present.
Tom Arnold, resident, said this was his first time attending a Board meeting. He said it 
was difficult to follow the agenda. Mr. Arnold stated it was difficult to tell if the Board 
members were interested in the comments made by the audience and the votes 
followed without hesitation. He hoped there was consideration for each of the agenda 
items.
Michelle Altherr, resident, Chairman of LD23, and Senate candidate for LD23. Ms. 
Altherr said all five supervisorial district seats are up for reelection this year. She said 
the County needs principled leaders to step up and take charge and she encourages 
the public to do their research and learn what the candidates stand for.
  
Elwood Koentzler (Butch), resident and Chairman of the Estrella Conservative Republic 
Club, and Vice Chairman of LD23. He said he was fearful he would lose his republic 
and talked about some underhanded dealings to infiltrate the Maricopa County 
Republican Committee.
 
Kathleen Harrell, resident, said she was a poll worker before elections were run by 
machines and she expressed frustration at the state of our elections. She spoke about 
disenfranchised voters and if there was one, that was one too many. 
Barbara Ratti, resident, talked about a video called State of Denial. She said this video 
revealed a variety of problems that occurred during the previous election. Ms. Ratti 
spoke about all of the perceived problems that occurred.
Jeff Caldwell, resident, said the following comments were a direct criticism of the 
scheme created by Maricopa County and who is the official officer over the elections 
process. Mr. Caldwell said the hierarchy is not clear and he is critical of that ambiguity. 
He asked Chairman Sellers to declare who is the official election official. 
 
Supervisor Hickman commented on the support that the Board members offer the 
Chairman and one another when one member has more experience in a particular area 
of interest.
Mike Peterson, resident, spoke about the elections coming up and the candidates that 
will be running in 2024. He talked about the problems in Maricopa County caused by 
the Board of Supervisors.
Luke Portell, resident, talked about elections and definitions of law.
Florence Smith, resident, said after the 2020 election, she wrote a book, Testimony of 
Fraud, the 2020 Michigan Election.  She wanted to share a chapter that focused on 
machines and she gave several examples of the reasons machines are a problem.

Supervisors'/County Manager's summary of current events - Resumen de temas de 
actualidad de los Supervisores/Administrador del Condado
Supervisor Galvin thanked Supervisor Sellers for Chairing the first meeting of the year. 
Supervisor Galvin talked briefly about a variety of events he attended this past week, 
including a Lion’s Club speaking engagement, Governor’s State of the State address, 
the Chambers Legislative forecast luncheon where there were good ideas exchanged 
regarding the upcoming session.
Supervisor Gallardo echoed Supervisor Galvin comments regarding the Chairman’s 
first meeting. Supervisor Gallardo thanked the Chairman for the Stand-Up Proclamation 
and commended the breadth of the programs, both on and off campus, and helping 
families year around. He mentioned the Martin Luther King luncheon that was 
scheduled for January 11, 2024. He wished everyone a safe holiday weekend.
Supervisor Sellers said he has been very involved in the communities and when he 
attends the events, he does so to listen and learn. He named a variety of events and 
said at each one, there is something to be learned. Chairman Sellers said there is a lot 
going on in the Valley and there is no silver-bullet answer for all the issues.

RESOLUTION FOR ELLIOT ROAD DRAINAGE IMPROVEMENTS FROM EAST 
MARICOPA FLOODWAY TO ELLSWORTH ROAD
Adopt Resolution FCD 2023R004 for Elliot Road from the East Maricopa Floodway (EMF) to
Ellsworth Road  (PROJECT), authorizing the Chief Engineer and General Manager of the 
Flood Control District of Maricopa County (DISTRICT) to include funds for the drainage
features of the PROJECT in the DISTRICT’s current and future Five-Year Capital 
Improvement Program; to negotiate and prepare Intergovernmental Agreements for cost 
sharing, rights-of-way acquisition, design, construction, construction management and future 
operation and maintenance of the Project; to advertise, select, negotiate, and award 
contracts for engineering and construction services as appropriate. 
The PROJECT is located in a developed urban area within the City of Mesa (CITY) along 
Elliot Road. The PROJECT is intended to mitigate excess stormwater runoff that impacts 
existing residences and businesses by using new storm drains and other drainage features 
to convey stormwater to the EMF. The proposed improvements were studied as part of the 
East Mesa Area Drainage Master Plan Update (EMADMPU) prepared in November 2013. 
The EMADMPU provided solutions to mitigate the flood hazards in the area including the 
drainage improvements along Elliot Road from the EMF to Ellsworth Road. The estimated 
cost for the PROJECT’s drainage features is $7,500,000 and these costs will be shared 
between the DISTRICT and the CITY.    This Agenda Item impacts Supervisorial District 1.
