REZONE APPROXIMATELY 156 ACRES LOCATED ON THE SOUTHEAST CORNER OF WEST YUMA ROAD AND
SOUTH ESTRELLA PARKWAY, KNOWN AS FULTON HOMES AT BALLPARK VILLAGE, FROM PLANNED AREA
DEVELOPMENT  TO PLANNED AREA DEVELOPMENT AMENDMENT
 
 
Chairman Clymer opened the public hearing at 6:03 p.m.
Senior Planner Justin Gabrielson presented the request for a rezoning of approximately 156 acres generally located
at the Southeast Corner of West Yuma Road and South Estrella Parkway from Fulton Homes at Ballpark Village 1st
Amended Planned Area Development to Fulton Homes at Ballpark Village 2nd Amended Planned Area
Development. The applicant request proposes additional amendments to the approved PAD. Specifically, the
applicant proposes to eliminate the R35 alley-loaded product. The request proposes replacing the R-52 district with
the R-60 district, thereby increasing minimum lot dimensions from 52 feet by 100 feet to 60 feet by 125 feet. This
change does not introduce a new product type but instead establishes larger minimum lot sizes and results in
reduced residential density. Additionally, the proposal includes increasing minimum lot depths within the R-45 land
use district to accommodate a wider variety of home products. Finally, the amendment revises the amenity framework
by replacing three large amenity areas with six distributed amenity areas of varying sizes, increasing the variety and
accessibility of recreational opportunities for residents. 
Chris Webb with Rose Law Group, representing the applicant, was available for questions and briefly reviewed the
changes requested through this rezoning.
Chairman Clymer closed the public hearing at 6:09 p.m.

ZONING ORDINANCE COMPREHENSIVE UPDATE
 
 
Planning Manager Christian Williams reviewed the Zoning Ordinance Update progress, noting past Work Session
dates and public outreach performed, with the final adoption of the Zoning Ordinance set for July 2026. Mr. Williams
summarized changes made throughout the update, addressing Battery Energy Storage Systems (BESS), data
centers, noticing requirements, and additional modernizations. For BESS, proposed regulations include defined
separation distances from residential, commercial, and industrial districts, allowances for reduced setbacks with a
plume study, and coordination with the Fire Marshal on life-safety standards, emergency response, and
decommissioning. Data center standards include permitting in I-1 and I-2 with conditions, a 300-foot residential
separation, and considerations for utility demand and noise. Notification areas would increase to 600 feet for Use
Permit, Special Use Permit, and standard Rezone applications, and to 1,200 feet for Planned Area Developments.
Additional updates include allowances for manufactured homes in AG and AU districts, attached housing in select

residential zones, extended temporary signage durations, parking reductions in specific contexts supported by
studies, updated medical office parking ratios, added regulations to address drive-through circulation, increased
industrial height limits to 70 feet, and optional height increases for multi-family developments in MF-28 and MF-24
with design and buffering requirements.
There were two speakers for this item: Cepand Alizadeh from the Arizona Technology Council spoke regarding the
proposed height standards for BESS, recommending allowing BESS within agricultural settings, as well as removing
the will serve letter requirement for Data Centers. Autumn Johnson from the Arizona Solar Energy Industries
Association spoke about BESS facilities, recommending a Special Use Permit process for BESS facilities to locate in
other areas besides industrial, as well as a reduction in the setback and screening requirements.
 
INFORMATION ITEMS
 
 
 
 
Development Services Director Katie Wilken introduced the new City Manager Bryan Langley. Ms. Wilken reviewed
the items previously seen before the Commission. Ms. Wilken also spoke on the recently adopted city budget,
summer construction hours mandated by state law, and political signs within the city.

The next Planning and Zoning Commission meeting will be held on July 1, 2026 at 6 p.m. in the Goodyear City Hall
Council Chambers.
